Gregg is one of the most genuine people you will ever meet, and I owe a lot to him for taking his time to work with my wife, and I. From the beginning he believed us, and fought for truth, and justice, doing everything by the book. Always being available for a phone call, or text (when he's not in court). Not only for legal advice, but even a mentor in many regards. I could go on, and on. Bottom line is he's the fairest lawer I know, he's the best at what he does, and not only will he be my lawer again (hopefully wont need a lawer in the future) but I consider him a great friend now. Praise God, and thank you Gregg Grafagnino. God is truly with you when you bring the heat in court.

I was 19 years old and made a mistake that could wreck the rest of my life. Other family in the past has gone through Gregg and was amazed at what he could get done. When I met him he took time for me to get on an emotional level with him and then gave full attention to my case! I then made his job even more difficult by not complying to certain things and he was still patient and determined to make the best alternative for me! I've so far recommended him to 3 friends and they are all beyond happy with the results. Call him!

Neil went to bat for me and my family in a pretty ugly situation and helped us to get our lives back on track. What I most appreciated was his willingness to drive an hour and a half to another parish to file papers on my behalf; AND his punctuality in returning all calls was very helpful to me. I can't imagine a better lawyer out there. It seemed he sincerely cared about me and my kids and was willing to go the extra mile for us. This didn't go unnoticed and I appreciated it very much since our situation got a bit dire. Under the worst pressure, he not only didn't buckle he fought harder for us and succeeded. Thank you very much. Neil Montgomery=A great attorney.

Neil is my attorney and has been for a while. He will continue to act for me through this divorce and any other legal matters. Neil has wisdom that you can not easily find amongst regular lawyers. Neil can fight in the trenches with even the nastiest of attorney's. He will worry about your case all night long so you can try to sleep soundly. Neil's his true temperament tells me one day he will become a well respected judge because his fairness defines him. I wish to comment about another review about Neil which wasn't favorable. This open forum allows for anyone to write whatever they want. It is so unfair if there is a personal vendetta which it seems there is from what seems to be the losing side who went up against Neil Montgomery. You chose but to me - negative comments from the losing side seems like sour grapes rather than legitimate review. I know that I am glad his my attorney and although I hope for fairness, if the other side wishes to blame their failure on the other attorney, Neil is professional enough to let the mud slinging fall right off his back. He works very hard for HIS client so you probably want him as your attorney.

There is NO place in the institution of Justice for this man. If you want an attorney that DOESN'T have your children's best interest at heart, please do hire him. If you're looking for an attorney that wants to work with his client & all parties involved the Neil is NOT THE MAN FOR YOU. He hasn't learned anything in the short 9 years of his career because his EGO supersedes him and interferers with his application of the law. He advises his client to get children involved in the cases using unscrupulous tactics. I'm glad I'm done with this man and so is my attorney. His refusal to respond to emails, faxes and phone calls cost me more in the end. My advice to him would be to take a few ethical classes.

Do not waste your money! Sara filled my head with things we would ask for in court and her ideas on how things would go- then when the hearing happened- Sara sat in the zoom court hearing and did pretty much NOTHING to the point where I texted her during the hearing asking if she was helping me at all! None of what we discussed or put in court papers was mentioned. She did NOTHING. Then just recently the apposing party filed court papers. Sara didn’t notify me AT ALL. I had to go online and pay to view the court documents that had been filed the month before prior. I asked if the document had been received and was lied to! She stated that she had not received them and service was slow. The document was EMAILED. Then the day of the court hearing, Sara was NO WHERE to be found. I was forced to handle the court hearing myself, got lucky and was given a continuance after explaining my attorneys short comings. (It’s pretty sad when a full court room gasps when hearing how she just disregarded her own client) After court I texted her letting her know that court had taken place and all I could get was that they were sorry for the inconvenience and “miscommunication” and that they received some documentation last week then they tried to inform me of the ew court date that I WAS THE ONE THAT SET IT with the judge. I questioned why I wasn’t informed and was told by her “legal assistant” that Sara was ill. Now after wasting my money on Sara, I have to get another attorney. Save yourself the headache and seek other counsel! This lady will take your money and leave you out to fend for yourself when the court date comes up.

Jerri Smitko recently handled a case for me and I can’t say enough good things about her law firm. Her staff is wonderful and know what their doing. They really don’t go to court until all the ducks are in a row. They had some big shot attorney from Lafayette and she ran circles around him. Five witnesses were called against me, she used their own words against them and tore their story apart. (That’s not all she tore) If your case means a lot to you, I would give them a call

Jerri and Jodi have been my saving grace over the last 2.5 years. Jerri is a beast in the court room and knows what she is taking about. She does not sugar coat or mislead you. Jerri is honest and will not milk you for what you do or don't have. Jerri's rate is what is because she does her best. Also as far as staff goes, Jodi has done a great jump listening to me, guiding me and supporting me. She is an angel. This lawfirm has good people, real people and you get what you pay for. Thank you from the bottom of my heart Jerri Smitko!!

She provided poor advice with regard to property settlement details. She advised it would be ok to agree to give my ex spouse half of my retirement because I could get an equal amount from his social security when I retired. This is NOT the case....I am unable to claim ANY of his social security benefits. This is causing significant financial hardship for me.

I filed for divorce on grounds of abuse. When I hired Joan, she advised me not to seek our local women's shelter, the Haven, for assistance and further stated I had better resources with current life coach and my children's counselor. She on multiple levels did not properly represent me and my children as her client and for an expensive amount @ $10,000. She has in result endangered myself and my children. As without the proper guidance from professionals in domestic violence she advised not to seek, I have been exposed to two more abusive relationships after my divorce, one with a current protective order. My children have been exposed to extreme child alienation from my ex spouse I highly do not recommend Joan as she clearly cannot be trusted to properly represent on her client's behalf.

Joan Malbrough was my attorney for my divorce and custody. I told her what I wanted and we discussed my options. When it went to court, she grilled my ex over his lies and lack of involvement in our child's life. I could not have asked for a better attorney and plan to hire her again when I take my ex back to court!!!

What a Criminal Defense Lawyer Can Do for You

A criminal defense lawyer provides legal representation to individuals or organizations accused of criminal conduct. If you're facing criminal charges, a defense lawyer will work to protect your rights, build a defense strategy, and ensure you receive a fair trial. Their primary goal is to reduce or dismiss charges, secure an acquittal, or negotiate a favorable plea deal.

Criminal defense lawyers have extensive knowledge of criminal law and court procedures. They investigate your case, identify weaknesses in the prosecution's evidence, and represent you in court, ensuring that you have the best possible defense.

When Should I Hire a Criminal Defense Lawyer?

It’s crucial to hire a criminal defense lawyer as soon as possible if you are facing any criminal charges. Some situations in which you should seek legal representation include:

  • Arrest or police questioning: If you've been arrested or are under investigation, hiring a lawyer early on can prevent self-incrimination and protect your rights during police questioning.
  • Felony charges: Crimes such as murder, assault, drug trafficking, or robbery carry severe penalties, including long prison sentences. A defense lawyer is essential in these cases.
  • Misdemeanor charges: Even for less serious offenses like DUI, theft, or simple assault, a lawyer can help reduce penalties, negotiate alternatives to jail, or get charges dismissed.
  • Plea negotiations: If you’re considering a plea bargain, a lawyer can evaluate the deal, advise you on its consequences, and negotiate for more favorable terms.
  • Probation or parole violations: If you’ve been accused of violating probation or parole, a lawyer can defend you against additional penalties or revocation.
  • Juvenile offenses: For minors charged with criminal acts, a criminal defense lawyer can protect their future by minimizing legal repercussions or keeping the case in juvenile court.

What Does a Criminal Defense Lawyer Do?

Criminal defense lawyers provide comprehensive legal services to protect their clients’ rights throughout the criminal justice process. Their duties include:

  • Case evaluation and investigation: Reviewing the evidence, interviewing witnesses, and investigating the facts to develop a strong defense strategy.
  • Legal advice: Advising you on your rights, the charges you’re facing, and potential defense strategies, including whether to take a plea deal or go to trial.
  • Negotiating plea bargains: Working with prosecutors to negotiate a plea deal that could reduce charges or minimize penalties.
  • Court representation: Representing you in all court hearings, including bail hearings, pretrial motions, trials, and sentencing hearings.
  • Filing motions: Filing motions to dismiss charges, suppress evidence, or reduce bail, depending on the specifics of your case.
  • Trial preparation and defense: Preparing a defense strategy and presenting arguments, evidence, and witnesses during trial to contest the prosecution's case.
  • Appeals: If you are convicted, a defense lawyer can appeal the conviction or sentence, arguing errors in the trial process or legal rulings.

How Are Criminal Defense Lawyers Paid?

Criminal defense lawyers generally charge clients in one of three ways, depending on the complexity of the case and the lawyer’s experience. Payment structures include:

  • Flat fee: For straightforward cases (e.g., minor misdemeanors), some lawyers charge a one-time flat fee that covers all aspects of the defense.
  • Hourly rate: For more complex or ongoing cases, lawyers may charge by the hour, with rates varying based on the lawyer’s experience and geographic location.
  • Retainer fee: In cases where extensive work is expected, the client may pay a retainer fee upfront. The lawyer then bills against that retainer for their work on the case.

The cost of criminal defense services can vary greatly, so it’s important to discuss fees during your initial consultation.

How Much Does a Criminal Defense Lawyer Cost?

The cost of hiring a criminal defense lawyer depends on several factors, including the severity of the charges, the complexity of the case, and the lawyer’s experience. General cost guidelines are:

  • Misdemeanor cases: For relatively minor offenses, such as a DUI or petty theft, a flat fee may range from $1,500 to $5,000.
  • Felony cases: More serious charges, such as assault or drug trafficking, can range from $10,000 to $100,000 or more, depending on the complexity and duration of the case.
  • Hourly rates: For cases billed by the hour, lawyers may charge anywhere from $150 to $500 or more per hour, depending on their expertise and the case's location.
  • Additional expenses: You may also be responsible for other costs, such as filing fees, expert witness fees, or the cost of private investigators.

Be sure to clarify the lawyer’s fee structure and any potential additional costs during your consultation.

Top Questions to Ask a Criminal Defense Lawyer

Before hiring a criminal defense lawyer, you’ll want to ensure that they’re a good fit for your case. Here are key questions to ask:

  1. What is your experience with cases like mine?
Make sure the lawyer has a strong track record with the specific type of criminal charges you’re facing, whether it’s DUI, drug offenses, or violent crimes.
  2. What is your fee structure?
Ask how the lawyer charges for their services and whether you’ll be responsible for any additional costs.
  3. What are the potential outcomes of my case?
A good lawyer should provide an honest assessment of your case and the likelihood of dismissal, a plea bargain, or conviction.
  4. How many cases have you taken to trial?
While many criminal cases settle with a plea deal, it’s important to hire a lawyer with courtroom experience in case your case goes to trial.
  5. Who will handle my case?
Ask if the lawyer will be personally involved or if other attorneys in the firm will handle most of the work.
  6. How do you communicate with your clients?
Be clear on how often and through what channels you can expect updates on your case.

How to Check the Credibility of a Criminal Defense Lawyer

To verify the credibility of a criminal defense lawyer, take the following steps:

  • Check their standing with the state bar: Confirm that the lawyer is licensed and in good standing with your state’s bar association. Look for any past disciplinary actions or complaints.
  • Read online reviews and testimonials: Platforms like Avvo, Martindale-Hubbell, or Google can provide insights from previous clients about the lawyer’s communication, professionalism, and case outcomes.
  • Ask for references: A reputable lawyer should have past clients or other professionals who can speak to their competence and work ethic.
  • Review their case history: Look at the lawyer’s website or professional profile to see their experience with criminal cases, including high-profile or complex cases.
  • Look for trial experience: If your case might go to trial, make sure the lawyer has a strong history of courtroom advocacy and success.

What Should I Prepare for My First Consultation?

To make the most of your first consultation with a criminal defense lawyer, bring the following:

  • Details of your case: Be prepared to provide a detailed account of the charges against you, including any documents related to your arrest, police reports, and court dates.
  • Criminal history: If you have any prior criminal convictions, inform your lawyer so they can understand how that may affect your current case.
  • List of witnesses or evidence: If there are any potential witnesses or evidence that may support your defense, share this information during the consultation.
  • Questions for the lawyer: Prepare questions about their experience, legal strategy, and fees to ensure you understand how they will handle your case.
  • Bail or release documents: If you’ve been released on bail, bring any paperwork related to your release conditions or restrictions.

By being well-prepared, you can help your lawyer quickly assess your situation and begin building an effective defense strategy.
