While my son was visiting the Smokies, he received 2 speeding tickets (1 in Swain County and 1 in Cherokee County) a couple of days apart. Rather than just paying the fines and accepting the points on his license, I researched and hired an lawyer. My research pointed me to to the firm of Brown, Ward & Haynes. Mr. John Ammons and his assistant Roger Taylor provided excellent advice and service in getting the tickets reduced to improper equipment infractions. They kept me informed of their progress and were easy to contact. His fee was also reasonable. I would highly recommed him.

After being hurt in a car accident that was not my fault, it became clear quickly that I would need an attorney to make sure my interests would be taken of. Through referrals my daughter got while I was in the hospital, we decided to contact Melrose Law. Throughout the whole process, the Melrose's, Brandy and their staff have been professional, respectful and kind. I believe the results were the best outcome possible and really appreciate their efforts!

Amy and Stephanie were with me and had my back the whole journey. There were NO surprises! Please do not attempt to represent yourself. They gave me a detailed plan and told me exactly what to do and what to expect and were in constant communication through the many steps and hurdles required. I received the best outcome possible! Even though I was very nervous, a great relief came over me when Amy appeared in court. I am so very grateful, thank you for your extremely professional and friendly advice and representing me in my case!!!!! I would give more stars if possible.

I had hoped when I initially hired Ms. Vanhook that because she had been a former family court judge that she would know all of the ins, outs, loopholes, and best ways to sway judgements for her clients. She doesn't. I thought because she was a mom, that she would be sympathetic for my particular situations and predicaments, she wasn't. I thought because of time constraints and my location she would work hard to fast track my case, nope. I actually felt like she was partnering with my ex's attorney to keep continuing the case so I could not get custody of my son, and told her so. Firing her did not make it clear I was done with her lack of professionalism and assistance. She took money from me to do a job that wasn't done. I stopped paying her and told her that there would not be another dime until she got me to court. I feel she should refund my money, as I did her job myself. The most she did was file a motion for me, that I paid for, and appear in court for the weekly sorting of cases and agree with counsel to continue continuing the case. I don't think that was worth what I paid, as that may have equaled less than 30 minutes of time dealing with my case alone. She never, in her tenure on my case, let me know my son needed to be subpoenaed to appear, he's 12. She never truly gave me the information I asked for and rarely took it upon herself to contact me. Firing her twice didn't make a dent for her to withdraw, until I took matters in my own hands with a judge. Don't use this attorney for child custody/divorce. Ms. Vanhook does not put the needs of her clients first. If you want updates or questions answered, you have to contact and contact and contact Ms. Vanhook before you get an answer, which is probably a half-truth answer at best. I got myself on the docket for my custody trial. I may not be an attorney, or handled myself perfectly in court, or was told I had to subpoena my son, so he did not get to include his voice and let the court know how he felt, but I got the job done and I am now waiting on my court order from the judge. I am glad this is over and no matter what happens, I know it's more than I could have expected from Ms. Vanhook based on Ms. Vanhook's previous work and care on my case. I had to give her at least one star, but in my opinion, deserves none.

I hired Danya to help get custody of my three children, and she fought hard for me. The divorce process is tough, and not only is it emotionally difficult and physically draining. The actual legal process itself is simply unchartered territory for for me. My divorce was one of the most painful and grueling experience of my life, and Danya help me successfully navigate this nightmare! I felt as though Danya genuinely cared about me, and the fate of my children. She listen to my perspective, and my opinions, and incorporated that into her thinking for the case, if it was appropriate. Danya didn't sugar coat anything, and she got me through making tough choices that would be best for me and my children. My case was complicated or that I made it complicated because, I was in playing shocked by my my ex-husband's ridiculous unjustified financial demands! Danya has the experience and is knowledgeable of the law. She worked my child custody case in the most cost-effective possible. Danya does not implify the attorney stereotype of those seeking only to make a profit. She is a good person and someone, I also consider to be a friend!

We hired Danya to represent our son with a difficult case involving many charges. The entire process was long through the court system, Danya stayed by our side through the whole thing. She represented us well and all charges were dropped. I could not be happier with her service and dedication to our son. Would recommend 100%. Thank you Danya

I would HIGHLY recommend Mr.Taylor to anyone who needs assistance getting disability benefits. He has worked for over 3 years with multiple appeals to get my brother-in-law Dennis his benefits. He kept fighting even after Dennis had given up and never asked for anything extra. He knew Dennis could no longer work due to multiple reasons and kept pushing until he proved that fact. Thank you so much for never giving up hope! We are so grateful for your service.

Me Gilligan and I went to court and when he came to me he came to me and used the words a singular charge of reckless driving. All paper work I signed regarding this plea only had a singular charge on it, yet later I found out I was also charged and convicted of dwlr non impaired. He will not return my phone calls and this has been years now the DA tells me he’s the only one that can fix this clerical error. No one else. This is in Jackson county. I am still not able to obtain a license due to me gilligan not returning my calls to resolve this matter. Years. I’ll remove this if he finally reaches out. 980.349.9404 thank you in advance Mr. Gilligan

I hired Gilligan for my case, and he ensured me that he would appear for me on my court date. That day came around and he DID NOT show up and a bond was out in my name. I never even heard from him that day. I only knew this because the other person involved in my case (who hired a different lawyer) was there and told me that no one was there to represent me. After calling his firm numerous times, I couldn’t get a hold of him. Finall I heard from him and he was on his honeymoon!?!?! Why did you lie and say you would appear in court for me on that day? Why didn’t you tell me you were getting married that week? I guess he tried to do some sort of absence form that somehow didn’t make it to the court. He blamed his paralegal of course (which by the way, he went through 3 different paralegals during the time I had him retained. That speaks volumes of how he runs his business.) after that gets worked out, I complete my community service, turn in the forms to him, and I NEVER HEAR BACK FROM HIM AGAIN. After numerous follow ups, I had to contact the NC STATE BAR and tell them he abandoned my case and wouldn’t talk to me. They told me to write him a letter and see if he responds. He of course, did not. The State Bar calls him and of course he gets back to me right away with no apology that he was ignoring me for weeks. This man is rude, dishonest, uncommunicative, and unreliable. I beg you not to give him a minute of your time or cent of your money. There are much better lawyers in the area. PLEASE DONT HIRE HIM.

While I cannot attest to the entire WNC law firm staff (they might be good lawyers). I can say that Brian and his paralegal Mica gave a below average effort (I have had the pleasure of dealing with other competent lawyers in the past). I hired him for a civil family law case, not criminal law. I think he either had trouble understanding my situation or he didn't care. Several times he stated something like, "If you had more money things would be different" I cannot remember his exact words. That statement confused me because I gave him 5 thousand dollars and he did nothing for me, but appear in court, and file a motion. All discussions between him and my opposition was done in secret in the back room. Other things that irritated me, the simple act of getting a phone call returned was a joke. All legal feedback was given in hindsight and all planning was done 5 minutes before court started. He allowed the opposing attorney set the terms and control the case, which I verbally detested to Brian. To further aggravate me, half the time, I was unable to reach voice mail at the WNC Law Firm. I was later told that it was, "Being worked on". I was not impressed by their (Brain and Mica) performance, it was sub-par at best. Don't be fooled, Brain is good at selling himself as competent. Brian is good at telling you what you want to hear. However, you're not looking for a life coach, you're looking for zealous legal representation. In reality, Brian has no industry recognition (clout). He guaranteed me that something (a legal outcome) was not going to happen. Guess what happened? The exact thing he said he would prevent from occurring. He blamed the Judge for the outcome! Not his poor lawyer skills, his lack of effort, or his inability to understand my case. My understanding is that there is a cardinal rule among attorneys that you never speak to a client in absolutes. Giving a client a 100% guaranteed outcome is frowned upon. Obviously, that rule doesn't apply to Brian or he missed that day back in law school. In my opinion, you can do much better than Brian K Law and his assistant Mica. I spent over 5 thousand dollars and Brian did nothing for me that I couldn't do alone. Heed my warnings, go elsewhere and demand a flat rate contract. Unless you like throwing money in the garbage. That's my 2 cents.

What a Criminal Defense Lawyer Can Do for You

A criminal defense lawyer provides legal representation to individuals or organizations accused of criminal conduct. If you're facing criminal charges, a defense lawyer will work to protect your rights, build a defense strategy, and ensure you receive a fair trial. Their primary goal is to reduce or dismiss charges, secure an acquittal, or negotiate a favorable plea deal.

Criminal defense lawyers have extensive knowledge of criminal law and court procedures. They investigate your case, identify weaknesses in the prosecution's evidence, and represent you in court, ensuring that you have the best possible defense.

When Should I Hire a Criminal Defense Lawyer?

It’s crucial to hire a criminal defense lawyer as soon as possible if you are facing any criminal charges. Some situations in which you should seek legal representation include:

  • Arrest or police questioning: If you've been arrested or are under investigation, hiring a lawyer early on can prevent self-incrimination and protect your rights during police questioning.
  • Felony charges: Crimes such as murder, assault, drug trafficking, or robbery carry severe penalties, including long prison sentences. A defense lawyer is essential in these cases.
  • Misdemeanor charges: Even for less serious offenses like DUI, theft, or simple assault, a lawyer can help reduce penalties, negotiate alternatives to jail, or get charges dismissed.
  • Plea negotiations: If you’re considering a plea bargain, a lawyer can evaluate the deal, advise you on its consequences, and negotiate for more favorable terms.
  • Probation or parole violations: If you’ve been accused of violating probation or parole, a lawyer can defend you against additional penalties or revocation.
  • Juvenile offenses: For minors charged with criminal acts, a criminal defense lawyer can protect their future by minimizing legal repercussions or keeping the case in juvenile court.

What Does a Criminal Defense Lawyer Do?

Criminal defense lawyers provide comprehensive legal services to protect their clients’ rights throughout the criminal justice process. Their duties include:

  • Case evaluation and investigation: Reviewing the evidence, interviewing witnesses, and investigating the facts to develop a strong defense strategy.
  • Legal advice: Advising you on your rights, the charges you’re facing, and potential defense strategies, including whether to take a plea deal or go to trial.
  • Negotiating plea bargains: Working with prosecutors to negotiate a plea deal that could reduce charges or minimize penalties.
  • Court representation: Representing you in all court hearings, including bail hearings, pretrial motions, trials, and sentencing hearings.
  • Filing motions: Filing motions to dismiss charges, suppress evidence, or reduce bail, depending on the specifics of your case.
  • Trial preparation and defense: Preparing a defense strategy and presenting arguments, evidence, and witnesses during trial to contest the prosecution's case.
  • Appeals: If you are convicted, a defense lawyer can appeal the conviction or sentence, arguing errors in the trial process or legal rulings.

How Are Criminal Defense Lawyers Paid?

Criminal defense lawyers generally charge clients in one of three ways, depending on the complexity of the case and the lawyer’s experience. Payment structures include:

  • Flat fee: For straightforward cases (e.g., minor misdemeanors), some lawyers charge a one-time flat fee that covers all aspects of the defense.
  • Hourly rate: For more complex or ongoing cases, lawyers may charge by the hour, with rates varying based on the lawyer’s experience and geographic location.
  • Retainer fee: In cases where extensive work is expected, the client may pay a retainer fee upfront. The lawyer then bills against that retainer for their work on the case.

The cost of criminal defense services can vary greatly, so it’s important to discuss fees during your initial consultation.

How Much Does a Criminal Defense Lawyer Cost?

The cost of hiring a criminal defense lawyer depends on several factors, including the severity of the charges, the complexity of the case, and the lawyer’s experience. General cost guidelines are:

  • Misdemeanor cases: For relatively minor offenses, such as a DUI or petty theft, a flat fee may range from $1,500 to $5,000.
  • Felony cases: More serious charges, such as assault or drug trafficking, can range from $10,000 to $100,000 or more, depending on the complexity and duration of the case.
  • Hourly rates: For cases billed by the hour, lawyers may charge anywhere from $150 to $500 or more per hour, depending on their expertise and the case's location.
  • Additional expenses: You may also be responsible for other costs, such as filing fees, expert witness fees, or the cost of private investigators.

Be sure to clarify the lawyer’s fee structure and any potential additional costs during your consultation.

Top Questions to Ask a Criminal Defense Lawyer

Before hiring a criminal defense lawyer, you’ll want to ensure that they’re a good fit for your case. Here are key questions to ask:

  1. What is your experience with cases like mine?
Make sure the lawyer has a strong track record with the specific type of criminal charges you’re facing, whether it’s DUI, drug offenses, or violent crimes.
  2. What is your fee structure?
Ask how the lawyer charges for their services and whether you’ll be responsible for any additional costs.
  3. What are the potential outcomes of my case?
A good lawyer should provide an honest assessment of your case and the likelihood of dismissal, a plea bargain, or conviction.
  4. How many cases have you taken to trial?
While many criminal cases settle with a plea deal, it’s important to hire a lawyer with courtroom experience in case your case goes to trial.
  5. Who will handle my case?
Ask if the lawyer will be personally involved or if other attorneys in the firm will handle most of the work.
  6. How do you communicate with your clients?
Be clear on how often and through what channels you can expect updates on your case.

How to Check the Credibility of a Criminal Defense Lawyer

To verify the credibility of a criminal defense lawyer, take the following steps:

  • Check their standing with the state bar: Confirm that the lawyer is licensed and in good standing with your state’s bar association. Look for any past disciplinary actions or complaints.
  • Read online reviews and testimonials: Platforms like Avvo, Martindale-Hubbell, or Google can provide insights from previous clients about the lawyer’s communication, professionalism, and case outcomes.
  • Ask for references: A reputable lawyer should have past clients or other professionals who can speak to their competence and work ethic.
  • Review their case history: Look at the lawyer’s website or professional profile to see their experience with criminal cases, including high-profile or complex cases.
  • Look for trial experience: If your case might go to trial, make sure the lawyer has a strong history of courtroom advocacy and success.

What Should I Prepare for My First Consultation?

To make the most of your first consultation with a criminal defense lawyer, bring the following:

  • Details of your case: Be prepared to provide a detailed account of the charges against you, including any documents related to your arrest, police reports, and court dates.
  • Criminal history: If you have any prior criminal convictions, inform your lawyer so they can understand how that may affect your current case.
  • List of witnesses or evidence: If there are any potential witnesses or evidence that may support your defense, share this information during the consultation.
  • Questions for the lawyer: Prepare questions about their experience, legal strategy, and fees to ensure you understand how they will handle your case.
  • Bail or release documents: If you’ve been released on bail, bring any paperwork related to your release conditions or restrictions.

By being well-prepared, you can help your lawyer quickly assess your situation and begin building an effective defense strategy.
