I want others to know how pleased I am with the collections effort made by James Colborn on my behalf. He was persistent, tenacious, even-tempered and just kept doing his job until he collected on an unpaid debt. I wholeheartedly recommend Mr. Colborn to others who find themselves in a bind with a collection debt. Thank you James for a job very well done!!

James resolved an odd case for me in which the address on my title was switched with my neighbor over 15 years ago, and despite the neighbors property being sold twice since then it was never caught. I live remotely and had never met James, I was fortunate to find him on the internet and am very glad I ended up working with him. I tried to resolve this myself and got nowhere so I reached out to James. First he gave me advice on how to resolve it myself and offered to help if I wasn't successful. After failing to resolve it I went back to James and he agreed to help. He was able to find the original title company even though I had lost the documentation and pursued a solution through them. Simultaneously he pursued an alternative solution with the owner of the other property. Timing was important because the property next door was set for foreclosure with my physical property listed as the legal address on the title. James kept me up to speed on all aspects of his efforts. He was courteous and professional in resolving the issue, and ultimately when the situation demanded it, aggressive enough to gain cooperation to resolve the problem. James resolved the problem, clearing my property from complications with the foreclosure, correcting the information with the county and solving the problem. He did all of this remotely as I no longer live in the area and never met face to face. I found James to be professional, competent, and fair. I was very glad he was representing me and was very satisfied with his work and the outcome. While it is never inexpensive when you need legal advice, I felt his fees were fair and that I got a very good deal for the work and results. I would rely on James for future real estate work without hesitation and would recommend him to friends and colleagues. Working with James was a very positive experience.

My adult daughter was arrested. I panicked. I hired Mr. Carlos Rodriguez to represent her in answer to some serious charges. My daughter and i both found Mr. Rodriguez to be: - knowledgeable in law (and if did not know, had the resources and determination to find out) - dependable. Showed up for phone calls or visits as schedulled, or in rare cases reschedulled - refreshingly honest. He did not sugar coat any situation or potential consequence - available. If not immediately available, he or support staff would respond in timely matter - didn't totally discard us once court "all said and done". We were welcomed to call with any further questions or concerns. He assured my daughter he was still there for her, which seems "above and beyond" the standard. I would note that my daughter is one who takes responsibility for her errors. She and I treated "Mr. Carlos" with the respect and gratitude he rightly deserves. We are forever grateful for the service provided by Mr. Rodriguez and his staff and would highly recommend him as a defense attorney. Shellan stewart

I had an absolutely wonderful experience having a consult with this law firm. The gentleman I spoke with was highly knowledgeable, with a keen legal mind and great emotional intelligence. He helped me to better generally understand how Idaho law governs the process I am interested in, gave great practical advice about the ins and out of what retaining Taylor law would be like, and was a genuinely compassionate and kindhearted person. I can tell from this call that Taylor law is one of the best forms in the Treasure Valley. Retaining them will place great resources and knowledge at one’s fingertips. I believe anyone would receive an organized service from sharp legal minds at this firm.

I feel very fortunate to have chosen John Goodell from the Racine Olson Law Firm to represent me in an estate matter involving the death of my cousin. John was of extraordinary help. This was not a typical or routine case for anyone with roadblocks at many a turn to completion. John Goodell was extremely diligent and perseverant through every twist and turn. Angels office and Justin Walters are a JOKE, Walters doesn't understand HIPAA law or even ADA Law under the courts perview. We have drug addicts, and they are wasting the tax payers money, on an ADA dog violation. That should have NEVER happened as Angell is the City Atty, of Rigby, and should have instructed the Mayor and the Police Chief the definition of neighborhood nuience, Tasha and Brenda Lane, I an ADA can not take my ADA dog out in a back yard I perched, because there's agressive dogs that attack the fence, pushing the fence boards into my yard, and those dogs already jumped the fence and attacked another neighbors dogs. So, I took my dog out front and Tasha and Brenda Lane, along with Matthew Polk have been playing games since the day I moved in Angell himself has been named in a Tort, and reported to the BAR so this is just good ole boy retaliation. So, your tax dollars are going to prosecute an ADA person because Angell, didn't council the Mayor, City Council, or the Chief of Police and it's officers of ordinances to get the neighbors under control, of course they didn't, they want to prosecute a dog off a leash for pissing. That's how money grubbing these Zealots are. Wasting YOUR tax dollars to fill thier pockets over perry incident of neighbors that appear to be above the law themselves in Chief Fullmor's eyes I think it's called selective prosecutions, when the law is only applies to specific parties, Oh actually the police manuals already address this, how do I know? I read them ALL. I also went to the PD Academy about 30 years ago and have my 911 dispatcher certs. I have been studying law 23 years. This is nothing but good ole boy retaliation for naming Angell in a Tort, and reporting him to the BAR. Happy he's playing retaliation for a 156.00 fine? This will probably expose the underground of the criminal complex of back scratching of we will let our friends violate the laws but go after those that we want to make an example of. Tax Payers I'm here to tell you, Angells Firm has already billed the city more than 156.50 on your dime, to prosecute a dog needing a place to take a piss. As a tax payer you should be pissed that Angell, our little Mayor and self proclaimed "oversight" with ZERO experience in either law or policing knows what the heck Chief Fullmor's doing. Oh, but I sure know what's going on. Because I have combined 30 years of both knowledge of both law and PD knowledge. Unlike our Mayor or even Angell himself. Justin Walters is a rude little miscreant that does not understand HIPAA or ADA Laws. This law firm is preditory and seeks to abuse it's power within the community off the community's tax dollars. To bad the Police Chief and gang didn't focus on getting drugs off the street, instead they are worried about an ADA dog needing to piss. Oh side note Allen Fillmor and gang of cops don't seem to be able to find former City Atty Dunn with Fentanyl cuz they are to busy trying to nail ADA people and thier dogs needing to go to the bathroom. This is how our tax dollars are spent people. It's only going to get worse. As I investigate, I found out Angell is rolling in our tax dollars. I public record requested his city contract and just this contract brings in 6k PLUS 3500.00 per misdimeanor. I've found three illegal revenue streams involving citations and fees, he and Justin Walters know what they are doing to the people of Rigby, this goes all the way to the top and through our current government and I have the hard copy proof now. I'm going to the Public Corruption Unit of the FBI where I have turned in a dirty cop now doing 40 years in Club Fed. Angell is so glib he thought no one would catch on. PRR public records, Walters is in charge for fees and fines. I caught Walters and Judge picking who and how to punish people. Citations are supposed to go up per citation. They didn't fine to ordaninces. Chief of the PD involved. Corruption. FOIA Dave Swager, City Hall 4 insurance/ bonds. Police Misconduct/ Dishonest Employees 500k each egregious action.

I really wish that I could give this a good review but unfortunately I cannot . I can say that the women who work in the office are magnificent they are wonderful ladies they work hard and they are kind and thoughtful . With that being said I still would definitely not come here and if you do stay away from Adam Olson. This was the biggest waste of money I have ever spent. He was not knowledgeable. He had me do all the footwork. Every other lawyer I have ever had was able to receive documentation on their own. But Adam he makes you do it all. I had to call all the hospitals and tried to get the information which they said they would not release unless I was a lawyer and when I told him that he did nothing. He waits till the last minute to get a hold of you regarding important decisions gives you these 24 and 48 hour timelines. I'm sure there are many more vetted more experienced attorneys out there. I would not waste my money on him. I could go on and on about everything but I really don't have the energy. I will be contacting the Bar Association and informing them of his poor work.

Mark was initially rude. He made me feel as though he was annoyed by me and my questions. He was snarky and short with me. I was put in contact with him through the bar referral service. I told him how he was making me feel and he softened. By the end we were joking, sharing stories and he apologized for his first impression on me. I got some valuable information from him that I appreciate but I would not recommend him. I am going to seek a second opinion from a more empathetic attorney.

What a Debt Collection Lawyer Can Do for You

A debt collection lawyer helps individuals and businesses navigate legal matters related to debt collection. Whether you’re a creditor seeking to recover unpaid debts or a debtor facing aggressive collection actions, a debt collection lawyer can provide valuable assistance. These lawyers help creditors pursue legal action to collect overdue debts and ensure compliance with debt collection laws. On the debtor’s side, they help defend against unlawful collection practices, negotiate repayment plans, or file for bankruptcy if necessary.

If you’re dealing with a debt collection issue, a lawyer can ensure your rights are protected and work toward a resolution that aligns with your financial or business needs.

When Should I Hire a Debt Collection Lawyer?

You should consider hiring a debt collection lawyer if you are facing any of the following situations:

  • For Creditors:
    • Unpaid debts: If you’re a creditor (such as a business or individual) with unpaid invoices, loans, or accounts receivable, a lawyer can help you pursue legal action to recover the debt.
    • Debtor refuses to pay: When a debtor is unwilling or unable to make payments, a lawyer can assist with filing lawsuits, securing judgments, and enforcing those judgments to collect the debt.
    • Negotiating repayment plans: If you’re willing to work with a debtor to arrange a payment plan, a lawyer can negotiate and draft a legally enforceable agreement.
    • Legal representation in court: If a debtor disputes the debt or countersues, a lawyer can represent you in court and ensure your legal interests are protected.
    • Securing liens or garnishments: A lawyer can help you secure liens on a debtor’s property or garnishments on their wages to recover the owed debt.
  • For Debtors:
    • Facing debt collection lawsuits: If you’ve been sued by a creditor or collection agency, a lawyer can represent you in court and help you defend against the claim or negotiate a settlement.
    • Debt collection harassment: If creditors or debt collection agencies are harassing you or violating your rights under the Fair Debt Collection Practices Act (FDCPA), a lawyer can help stop the harassment and potentially sue for damages.
    • Negotiating debt settlements: If you owe a significant amount of money but want to avoid bankruptcy, a lawyer can negotiate with creditors to reduce the total amount owed or set up a payment plan.
    • Disputing a debt: If you believe a debt is incorrect or have been wrongfully targeted by debt collectors, a lawyer can help you dispute the claim and provide evidence to resolve the matter.
    • Bankruptcy options: If your debts are overwhelming and you’re unable to repay them, a debt collection lawyer can help you explore bankruptcy as an option for debt relief.

Hiring a lawyer early in the process can help you protect your financial interests and avoid escalating legal issues.

What Does a Debt Collection Lawyer Do?

A debt collection lawyer provides a variety of services depending on whether they are representing the creditor or the debtor. Their responsibilities often include:

  • For Creditors:
    • Filing lawsuits: A lawyer can file a lawsuit against a debtor who has failed to pay what they owe. This includes preparing and submitting legal documents, representing you in court, and pursuing judgments.
    • Negotiating settlements: If the debtor is willing to settle, the lawyer can negotiate a payment arrangement or reduced settlement that ensures you recover some or all of the debt.
    • Securing judgments and enforcement: After obtaining a court judgment, a lawyer can help enforce it through methods like wage garnishment, bank levies, or property liens.
    • Reviewing contracts and agreements: A lawyer can review your contracts and lending agreements to ensure that they comply with the law and are enforceable if a debtor defaults.
  • For Debtors:
    • Defending against debt collection lawsuits: If you’re being sued by a creditor, a lawyer can challenge the lawsuit, dispute the debt’s validity, or negotiate a more favorable settlement.
    • Stopping harassment: If debt collectors are using unlawful practices to collect a debt (such as threatening you or contacting you excessively), a lawyer can intervene and protect your rights.
    • Negotiating debt relief: A lawyer can negotiate with creditors to reduce the total amount of debt you owe or develop a manageable payment plan that suits your financial situation.
    • Disputing inaccurate debts: If a debt is not valid, a lawyer can help you gather evidence to dispute the claim and prevent further collection actions.
    • Filing for bankruptcy: If your debts are overwhelming, a lawyer can advise you on whether filing for bankruptcy is the best option and help you through the process.

How Are Debt Collection Lawyers Paid?

Debt collection lawyers typically charge for their services in different ways depending on the complexity of the case and whether they represent a creditor or debtor. Common payment structures include:

  • Hourly rate: Many debt collection lawyers charge by the hour, with rates typically ranging from $150 to $500 or more, depending on the lawyer’s experience and the case’s complexity. Hourly fees are common when the lawyer is representing either party in litigation or negotiation.
  • Contingency fee: For creditors, some lawyers work on a contingency fee basis, meaning they only get paid if they successfully recover the debt. Their fee is typically a percentage of the recovered amount, usually ranging from 20% to 40%.
  • Flat fee: For specific services, such as reviewing a contract, drafting a demand letter, or defending a straightforward debt collection lawsuit, a lawyer may charge a flat fee.
  • Retainer: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

It’s important to discuss fees with your lawyer during the initial consultation and understand the total cost of their services before proceeding with your case.

How Much Does a Debt Collection Lawyer Cost?

The cost of hiring a debt collection lawyer depends on whether you are a creditor or debtor, the complexity of the case, and the lawyer’s experience. General cost estimates include:

  • Hourly rates: Most debt collection lawyers charge between $150 and $500 per hour. Complex cases involving litigation or large amounts of money may result in higher legal fees.
  • Contingency fees: If the lawyer works on a contingency basis, they typically charge between 20% and 40% of the recovered amount. For example, if you recover $10,000 and the contingency fee is 30%, the lawyer would take $3,000.
  • Flat fees: For simpler services like drafting a demand letter or responding to a debt collection lawsuit, flat fees may range from $500 to $2,500, depending on the work required.
  • Retainers: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

Always ask for a detailed cost estimate during your consultation to avoid surprises and ensure that the services fit your budget.

Top Questions to Ask a Debt Collection Lawyer

Before hiring a debt collection lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case. Key questions to ask include:

  1. What experience do you have with debt collection cases?
Make sure the lawyer has experience handling cases similar to yours, whether you’re a creditor or debtor.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, on a contingency fee basis, or a flat fee, and ask for a detailed estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential outcomes.
  4. How long will the process take?
Debt collection cases can take time, so ask the lawyer how long they expect the process to last, from filing the claim to recovering the debt or resolving the dispute.
  5. What are my legal rights?
Ask the lawyer to explain your rights as a creditor or debtor, including protections under laws like the Fair Debt Collection Practices Act (FDCPA).
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be managing your case.

How to Check the Credibility of a Debt Collection Lawyer

To ensure you are hiring a reputable debt collection lawyer, take the following steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for debt collection experience: Review the lawyer’s website or professional profile to ensure they specialize in debt collection law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle debt collection cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on debt collection matters.
  • Check for certifications or memberships: Look for certifications or memberships in organizations like the National Creditors Bar Association (NCBA) or other relevant associations that focus on debt collection law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a debt collection lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • For Creditors:
    • List of outstanding debts: Bring a detailed list of the debts owed to you or your business, including invoices, contracts, or other supporting documentation.
    • Previous communication with the debtor: Provide copies of any emails, letters, or phone call logs showing attempts to collect the debt.
    • Contracts or agreements: Bring any contracts or agreements related to the debt, as they may be critical in proving your case.
    • Judgment information (if applicable): If you’ve already obtained a court judgment against the debtor, bring the judgment documents and any enforcement attempts.
  • For Debtors:
    • Debt collection letters or notices: Bring any correspondence from creditors or collection agencies, including demand letters and collection notices.
    • Payment records: Provide proof of any payments made toward the debt, including receipts, canceled checks, or bank statements.
    • Debt validation or dispute documentation: If you’ve disputed the debt or requested validation, bring copies of the dispute letters and the creditor’s response.
    • Legal summons or lawsuit documentation: If you’re facing a lawsuit, bring the court summons, complaint, and any legal documents related to the case.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and provide the best legal advice tailored to your needs.
