Attorney Khawaja represented me in my recent bankruptcy case. The entire process was very fast because Mr. Khawaja was very knowledgeable about the bankruptcy laws. He explained the process, the forms that needed to be completed and provided a detail description of all the supporting documentation I would need to complete the process. He always responded to my questions quickly and with great patience. I have worked with attorneys in the past and Mr. Khawaja is one of the very best I have dealt with.

Bankruptcy Attorney, Mr. Rehan Khawaja and his Legal Assistant, Mr. John Walker are professionals who I highly recommend in helping with your legal concerns. Mr. Khawaja from day one of my initial consultation was so very understanding, professional and brilliant at knowing how to help me. He really put me at ease with my situation since I was unsure how most of the process worked. Anytime I needed to speak with Mr. Khawaja, he was immediately available and always willing to explain in detail what I did not understand. What I realized about working with this attorney is that he is extremely proficient in every part of what he does. He did not waste time on any matter and is completely brilliant in his field understanding how the law works. For my 341 meeting, I was completely confident knowing he was there to help represent me. When I noticed other people in the meeting with different lawyers I knew immediately I had chosen the right person as Mr. Khawaja is always highly professional in both appearance and attitude. He is a highly qualified lawyer and I am so THANKFUL he has been able to help me lift the burden of debt from my shoulders so I can breathe. Thank you so very much for all of your help and time!!! I couldn’t believe when I received a letter in the mail stating my bankruptcy was discharged. I had been contemplating bankruptcy for most of my adult life and was always told by others how hard it was to do and how it would not work or be good. I was so nervous and concerned going into this, but Mr. Khawaja made it seem so easy and simple. I am truly amazed by how excellent a lawyer he is. In addition, his legal assistant, Mr. Walker is so knowledgeable, helpful, kind and together these two are the experience you need in order to get through a bankruptcy.

Rehan was a real person helping me to navigate a very difficult legal case, due to another lawyer's shoddy work. He took my case in the most difficult time. He saved my life from going to jail because of misunderstanding that occurred in the initial BK process. He helped to restructure my debt with a Ch. 13 100% repayment plan. He recently helped me an my husband to gain permission from the trustee to purchase our first home. I am so grateful for Mr. Khawaja's ability to turn my life around with his hard work. He provides honesty and demonstrates a great proficiency for his work. Anyone in the Florida area should work with Rehan, he is the absolute best bankruptcy lawyer out there. He will treat you like a real person!

When Atty. Matthew Collett was referred to me to handle my case, the first thing I did was reviewed his profiles against the other attorney profiles that I had in my list. I was impressed with all that he had successfully accomplished and I said to myself "hmmm...this guy would fit in the case". He was actually the one that hit the bell and made my decision to retain him. He put in his full efforts and worked hard on my case for a reasonable and affordable charge. He listened closely and carefully to and understood my situations and/or opinions and provided with legal advice, he was really easy to work with, he advised me that my case could be referred to other attorney if it were outside of his expertise, and most importantly the untiring patience that he had shown throughout the entire case process. He was able to resolve my case in a short period of time with positive outcomes. Now, the biggest thing to me is that I am able to retain my employment because of his expertise. He is second to none with his undoubted dedication, knowledge, skills and abilities. I would definitely recommend Attorney Matthew Collett for consultation and eventually for retention to handle your case all the way through the end.

Matt Collett was a pleasure to deal with, he got my driving with a suspended license changed to a civil case of not having a valid drivers license. He also got my speeding ticket completely dropped. He also did not charge me a ridiculous price, I was very happy with the deal he gave me. I also thought he was a very nice and reliable guy to have, he was very responsive and kept me up to date with everything that was going on.

Matt is also very well connected, there have been a few things that Matt was honest with me and let me know that isnt his expertise, but he was able to set me up with someone. Regardless of what you need a laywer for I would recomed giving Matt a call.

I've used Omar for a couple of things and been very happy with his service. He's great about communicating, which not all lawyers are. His fees are reasonable, given the cost of legal issues these days. He gives things to you straight, but lets you make your own decision after laying out all the facts. I like his common sense approach. His ego doesn't get in the way. I like his ethics. I like his honesty. I've recommended him to my friends. He's got a grasp of what ordinary people are up against, instead of being insulated from the real world.

I hired this firm to take on a security negligence case. We’re I suffered a severe TBI back in December 2021 .. About a year later I questioned whether or not this attorney and this firm was capable of handling this type of case because I had doubts. I let Mr. Studer convince me to keep him as my attorney , so I did. When I finally had enough and I reached out to him to fire him, Seth Studer told me you don’t have to fire me because I’m stepping down from practicing Law. I said that might be best. Mr. Studer never called me one time over the 2+ years he had my case and asked me how I was doing , I’m not exaggerating. I have phone records to prove it phone records to prove how many times he ignored. My calls ignored my text messages and how many times he did call me the phone Records don’t lie. This wasn’t a simple car accident. This is a traumatic brain injury case , I’m not the same person I used to be. I feel like this attorney should have checked on me periodically return those text messages and those calls. I notified this attorney six or seven times throughout the course of two years telling him that I was feeling suicidal.. And that I wanted to know why I was having these thoughts that started every since I endured this horrific night and downtown Orlando it’s not that I want to kill myself, but I can’t control the thoughts. Good thing I didn’t kill myself. I wouldn’t be able to create this post right now. Thank God .. This firm should have gotten me some psychological treatment he should have sent me to a psychiatrist , he should have done a lot of things, but he didn’t. I will be filling out the Florida Bar Complaint and it’s going to start there. I can’t post all the screenshots of all the text messages that he didn’t reply to, but I can provide them to the Flordia Bar and I plan on it. I’ve retained two other law firms to take over the case, and they immediately put me in treatment for depression psychiatric reasons to find out why I’m having suicidal thoughts Tbi Treatment centers. I’m now getting the help and seeing the doctors that I should’ve been seen since Mr. Studer took my case, but he wasn’t sending me to any doctors and I trusted him is sad to say the different brain doctor that I’m seeing today have All told me why are you starting treatment three years after the injury you should’ve been receiving treatment when it happened so hopefully at that point in time I had a better chance at potential recovery but because I waited so long the doctors don’t think seeking treatment now is going to do any good and this is sad very emotional. I wouldn’t recommend this Law Firm to anybody out there all these Law Firm say they have the clients best interest the interest they have is the money going in their pocket And this is a prime example it said to say again this was the worst day of my life. It changed my life forever and I wish that I never hired this Seth stutter or firm in general because it wasn’t just Seth Studer. It was the Firm and that’s exactly what Studer told me . Make sure when hiring a lawyer, just because there websites say “ auto accident, slip n fall, security neglect “ doesn’t mean they have actually tried one of those types of cases before, just means there Liscence to take on that particular type of case. So please I give y’all some advice, attorneys are quick to send out electronic signatures needed for the victim to sign, So you don’t call around anywhere else. When We all should do are homework and find out more about the attorney of your choice before signing that email.

Robert was awesome to work with. My case took years to resolve and i never felt out of the loop. I could always get ahold of him through text, calls, or emails. He took what we needed into account and always made sure we were able to get the treatment we needed for our injuries. In the long run we were able to settle right as the trial started and we are happy to have our future treatment and more secure. Such a weight is off our shoulders and we have Robert and everyone else at his firm that helped to thank for it. I would highly recommend having this firm fight for you because I've seen how they fought for me and my brother. Thank you guys again!

A debt collection lawyer helps individuals and businesses navigate legal matters related to debt collection. Whether you’re a creditor seeking to recover unpaid debts or a debtor facing aggressive collection actions, a debt collection lawyer can provide valuable assistance. These lawyers help creditors pursue legal action to collect overdue debts and ensure compliance with debt collection laws. On the debtor’s side, they help defend against unlawful collection practices, negotiate repayment plans, or file for bankruptcy if necessary.

If you’re dealing with a debt collection issue, a lawyer can ensure your rights are protected and work toward a resolution that aligns with your financial or business needs.

When Should I Hire a Debt Collection Lawyer?

You should consider hiring a debt collection lawyer if you are facing any of the following situations:

  • For Creditors:
    • Unpaid debts: If you’re a creditor (such as a business or individual) with unpaid invoices, loans, or accounts receivable, a lawyer can help you pursue legal action to recover the debt.
    • Debtor refuses to pay: When a debtor is unwilling or unable to make payments, a lawyer can assist with filing lawsuits, securing judgments, and enforcing those judgments to collect the debt.
    • Negotiating repayment plans: If you’re willing to work with a debtor to arrange a payment plan, a lawyer can negotiate and draft a legally enforceable agreement.
    • Legal representation in court: If a debtor disputes the debt or countersues, a lawyer can represent you in court and ensure your legal interests are protected.
    • Securing liens or garnishments: A lawyer can help you secure liens on a debtor’s property or garnishments on their wages to recover the owed debt.
  • For Debtors:
    • Facing debt collection lawsuits: If you’ve been sued by a creditor or collection agency, a lawyer can represent you in court and help you defend against the claim or negotiate a settlement.
    • Debt collection harassment: If creditors or debt collection agencies are harassing you or violating your rights under the Fair Debt Collection Practices Act (FDCPA), a lawyer can help stop the harassment and potentially sue for damages.
    • Negotiating debt settlements: If you owe a significant amount of money but want to avoid bankruptcy, a lawyer can negotiate with creditors to reduce the total amount owed or set up a payment plan.
    • Disputing a debt: If you believe a debt is incorrect or have been wrongfully targeted by debt collectors, a lawyer can help you dispute the claim and provide evidence to resolve the matter.
    • Bankruptcy options: If your debts are overwhelming and you’re unable to repay them, a debt collection lawyer can help you explore bankruptcy as an option for debt relief.

Hiring a lawyer early in the process can help you protect your financial interests and avoid escalating legal issues.

What Does a Debt Collection Lawyer Do?

A debt collection lawyer provides a variety of services depending on whether they are representing the creditor or the debtor. Their responsibilities often include:

  • For Creditors:
    • Filing lawsuits: A lawyer can file a lawsuit against a debtor who has failed to pay what they owe. This includes preparing and submitting legal documents, representing you in court, and pursuing judgments.
    • Negotiating settlements: If the debtor is willing to settle, the lawyer can negotiate a payment arrangement or reduced settlement that ensures you recover some or all of the debt.
    • Securing judgments and enforcement: After obtaining a court judgment, a lawyer can help enforce it through methods like wage garnishment, bank levies, or property liens.
    • Reviewing contracts and agreements: A lawyer can review your contracts and lending agreements to ensure that they comply with the law and are enforceable if a debtor defaults.
  • For Debtors:
    • Defending against debt collection lawsuits: If you’re being sued by a creditor, a lawyer can challenge the lawsuit, dispute the debt’s validity, or negotiate a more favorable settlement.
    • Stopping harassment: If debt collectors are using unlawful practices to collect a debt (such as threatening you or contacting you excessively), a lawyer can intervene and protect your rights.
    • Negotiating debt relief: A lawyer can negotiate with creditors to reduce the total amount of debt you owe or develop a manageable payment plan that suits your financial situation.
    • Disputing inaccurate debts: If a debt is not valid, a lawyer can help you gather evidence to dispute the claim and prevent further collection actions.
    • Filing for bankruptcy: If your debts are overwhelming, a lawyer can advise you on whether filing for bankruptcy is the best option and help you through the process.

How Are Debt Collection Lawyers Paid?

Debt collection lawyers typically charge for their services in different ways depending on the complexity of the case and whether they represent a creditor or debtor. Common payment structures include:

  • Hourly rate: Many debt collection lawyers charge by the hour, with rates typically ranging from $150 to $500 or more, depending on the lawyer’s experience and the case’s complexity. Hourly fees are common when the lawyer is representing either party in litigation or negotiation.
  • Contingency fee: For creditors, some lawyers work on a contingency fee basis, meaning they only get paid if they successfully recover the debt. Their fee is typically a percentage of the recovered amount, usually ranging from 20% to 40%.
  • Flat fee: For specific services, such as reviewing a contract, drafting a demand letter, or defending a straightforward debt collection lawsuit, a lawyer may charge a flat fee.
  • Retainer: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

It’s important to discuss fees with your lawyer during the initial consultation and understand the total cost of their services before proceeding with your case.

How Much Does a Debt Collection Lawyer Cost?

The cost of hiring a debt collection lawyer depends on whether you are a creditor or debtor, the complexity of the case, and the lawyer’s experience. General cost estimates include:

  • Hourly rates: Most debt collection lawyers charge between $150 and $500 per hour. Complex cases involving litigation or large amounts of money may result in higher legal fees.
  • Contingency fees: If the lawyer works on a contingency basis, they typically charge between 20% and 40% of the recovered amount. For example, if you recover $10,000 and the contingency fee is 30%, the lawyer would take $3,000.
  • Flat fees: For simpler services like drafting a demand letter or responding to a debt collection lawsuit, flat fees may range from $500 to $2,500, depending on the work required.
  • Retainers: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

Always ask for a detailed cost estimate during your consultation to avoid surprises and ensure that the services fit your budget.

Top Questions to Ask a Debt Collection Lawyer

Before hiring a debt collection lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case. Key questions to ask include:

  1. What experience do you have with debt collection cases?
Make sure the lawyer has experience handling cases similar to yours, whether you’re a creditor or debtor.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, on a contingency fee basis, or a flat fee, and ask for a detailed estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential outcomes.
  4. How long will the process take?
Debt collection cases can take time, so ask the lawyer how long they expect the process to last, from filing the claim to recovering the debt or resolving the dispute.
  5. What are my legal rights?
Ask the lawyer to explain your rights as a creditor or debtor, including protections under laws like the Fair Debt Collection Practices Act (FDCPA).
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be managing your case.

How to Check the Credibility of a Debt Collection Lawyer

To ensure you are hiring a reputable debt collection lawyer, take the following steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for debt collection experience: Review the lawyer’s website or professional profile to ensure they specialize in debt collection law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle debt collection cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on debt collection matters.
  • Check for certifications or memberships: Look for certifications or memberships in organizations like the National Creditors Bar Association (NCBA) or other relevant associations that focus on debt collection law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a debt collection lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • For Creditors:
    • List of outstanding debts: Bring a detailed list of the debts owed to you or your business, including invoices, contracts, or other supporting documentation.
    • Previous communication with the debtor: Provide copies of any emails, letters, or phone call logs showing attempts to collect the debt.
    • Contracts or agreements: Bring any contracts or agreements related to the debt, as they may be critical in proving your case.
    • Judgment information (if applicable): If you’ve already obtained a court judgment against the debtor, bring the judgment documents and any enforcement attempts.
  • For Debtors:
    • Debt collection letters or notices: Bring any correspondence from creditors or collection agencies, including demand letters and collection notices.
    • Payment records: Provide proof of any payments made toward the debt, including receipts, canceled checks, or bank statements.
