Mr. Petersen is extremely knowledgable in consumer debt collection and consumer collection cases. Hired this attorney for an aggressive debt collector that had incorrectly reported to credit report and was calling continually, violating several laws. He was able to quickly resolve the issue and represent me in the court case. He thoroughly understands and defends consumer rights against these companies that will try to bully you while they knowingly violate laws, and I had utmost confidence in his handling he case. He is on your side as a consumer, and fee structure was very fair. I have hired numerous attorneys over the years for different needs, and for consumer collection and litigation he is the best I've hired, can't recommend enough.

Larry was referred to me by another Orlando Lawyer who told me Larry had soundly beat him in a collections case. I have found Larry to be an excellent litigator with a sound understanding of the law and good writing skills. Larry is very personable and will tell you up front if he is the right lawyer for your particular problem. I call Larry often for his opinion and advice on all kinds of matters. Over the years I have referred my friends to Larry because I know he is honest and will do a good job. Most recently, I told Larry about a problem I had with a lender on a commercial property. Larry suggested a chapter 11 bankruptcy (reorganization) for the property in order to force the lender to negotiate the loan and stop a foreclosure. He jumped right on it, stopped the foreclosure, negotiated down the lenders legal fees (from $10,000 to $3,000) and got my plan approved. Today I still own the building, the loan is reinstated and I have equity in the property.

Mark Longwell is truly one of the best attorneys I've ever had the privilege of working with. His track record speaks for itself—100 out of 100! Wins! Every case feels like he's fighting for his own family, but instead, he's fighting for mine. Longwell Lawyers consistently delivers exceptional service, and I will continue to rely on Mark and his outstanding team whenever I need legal representation. Their reasonable pricing, prompt communication, and deep understanding of the law make them unbeatable. I highly recommend Longwell Lawyers to anyone seeking top-tier legal expertise without having to search through endless reviews—this is the firm you can trust to get the job done right.

Update* first and foremost, I have not had time sharing with my son since I asked Mouse to file contempt. That was 26 days ago. This was the action that Longwell advised against. Then the moment he filed for withdraw, the opposing side figured they don’t have to follow any time sharing. They know he has my $, and they know I can’t hire another lawyer without that $. Second, abusive? How does being disrespectful magically upgrade to abusive? Oh I wrote a review, so you lied. Get over it. Let’s define abuse. Improper use of something. You quit, you’re holding onto TWELVE THOUSAND DOLLARS, with zero legal ability to charge against it, and you refuse to return it to your former client so he can hire a new lawyer. That’s abusing funds. My pool boy returns the money within a week if he doesn’t provide the service. Third, you did not call me Mr Longwell, which means you could not have left a message. If you did, prove it cause I can prove you didn’t. Why would you lie about something so trivial. I’ve updated to include the most recent billing after they quit. It is an indisputable fact that they have now paid themselves more in one month to quit, than any of the other previous months they claimed they did diligent work. I hired Longwell lawyers early 2021 for a paternity trial. It is August 2024, no parenting plan agreement. No Trial, Carson Mouser is withdrawing claiming I am rude and disrespectful. I never hired him, I had hired a different attorney in their firm and my case was eventually “assessed to benefit” from being appointed Mouser. I had no choice in the matter. He had agreed to go to trial, I paid him $2000 to “prepare” and then Mouser requested $10,000 for trial. Eventually the opposition hired a lawyer and requested an update within 30 days or I was going to default. I sent an email to Mouser asking what I needed at the beginning of the work week. He never responded, at all. I sent him two more emails after the mother refused to exchange at the end of the work week, he didn’t respond. I had to call Mousers office, once he got on the phone I had asked him why he didn’t answer me and he said that I sent my email directly to him. My exact words were, “that’s a problem?” And Mouser said he’s done, he’s withdrawing. So I asked for a return of my money, he said to call the office. I call the office and they tell me they will ONLY RETURN MY MONEY AFTER I SIGN CONSENT and then they have 90 days to return it after the motion is granted. I ask for my file and they said they only turn it over after withdrawing. Let’s be super clear. They were paid since 2021 to go to trial. They have 12k specifically for trial. They have made their intentions clear they will NOT go to trial. But will NOT return money they do not intend to use. They are aware I have to respond to the courts within 24 days or I default. Can you imagine your former lawyer holding onto the only $ you had for trial after they filed for a trial date, $ which they don’t even intend to use? I don’t make a lot of money. They know that though. I have been the sole provider for daycare for the entire year, and barely can pay that. I see Mark Longwell has responded to a previous poor review about Carson Mouser. His argument will be I was rude and disrespectful. Even if your lawyers assumed I was disrespectful, their response is to blow the case for their precious client? Hold onto money I’ve paid for trial after filing for a trial? If anything I said here is untrue, you should sue me. Cause I’ve been left with the choice to either pay for a new lawyer, or pay for VPK. $12,000 being held. 40kish more already wasted. I should have never hired them and fired them the moment they stuck Mr Mouse on the job without my consent. I should have just bought oceanfront property in Colorado. The same exact result would be happening right now. No parenting plan, no trial, money for trial stuck with in a useless spot.

I am very displeased with John Crone. I hired him in 2022 to take on a probate case and have been disappointed with the lack of communication. I have been trying to run him down only to get brushed off every time. I have emails stating that due to the amount of assets my father has this would be a couple month long case. I have been so stressed out due to lack of communication and being in the dark about everything that I have started seeking therapy. I go through the reviews and notice that those that are very pleased with his work have the opposite ethnicity of me. I want to put into perspective that he was paid up front exactly what he asked for and has been dragging my case for almost 2 years. He says my case is unique and promises to get back with information and never does. This has added unbelievable stress to me. I would not recommend him to any African American people. This already bad situation has gotten worse. I pray he finally gets back to me because it does not take months and months to answer questions or acknowledge my concerns.

My experience was just short of negligence. Communication is desperately lacking, my requests to review motions before submitted on my behalf and communications from opposing attorneys were completely ignored, and the outcome due to their ignorance was less than acceptable. Worst family law firm in Orlando. I wouldn’t recommend them to my worst enemy! Lack of focus, terrible communication, ignorance, and outright lies is exactly what you should expect from Paulette Hamilton and her staff. When you look for representation as you go to battle, please find another law firm, one that is aggressive, pays attention to you, and is detail oriented. This Clown show does not care about their clients, they care about money. I honestly don’t know how they are not embarrassed with how they handled my case and I will spread word far and wide so that nobody I know is taken advantage of like I was. PLEASE find a firm that is truly looking out for you - Divorce and child custody is hard enough without having a lackluster attorney representing you.

This firm enjoys harassing local businesses. Mr. Adam Miller has been trying to enforce and invalid subpoena for the past 5 months. TRYING is the important word. It would take pages to list all the faux pas and issues my wife and I have with this very personable but lazy uncaring, poor excuse for an Attorney. Wasted years of our life, now we have to get a real Attorney in this space. Go name brand is the lesson here. His staff even laughs at you, you have to collect all the evidence yourself a year after you've been lied to and told you we'll get it handled. Lied to so many times about what was done or allegedly in progress. Once we finally got to him writing a demand letter...we waited a month to read it ( unfiled, thank GOD). Then we got a copy and it left out 90 percent of the points a second grader would have known to include in it. Then it sat another month on HIS desk...when we called, to ask if they had heard from State Farm ( he laughs and says...hold on let me look ...oops...I got so busy it's still on my deks. ) Love NASCAR apparently more than serving clients. He did get us a second opinion, but he didn't even remember later who the doctor was that HE had sent us to. Referred to our doctors by the wrong names, titles. fields of expertise. If you have an injury that will leave you with a lifelong issue..DON'T EVEN THINK ABOUT THIS POOR EXCUSE OF AN ATTORNEY. Can you imagine a personal injury Attorney not wanting to go for more than a 100 K...and content to settle for 7500.00 knowing that it would leave you with thousands and thousands of dollars of unpaid medical bills, and nothing towards a life of needing a pain killer and a glass of wine to get to sleep from the pain?. Charles Parker forced her to say...she was 100 percent cured before he would even file the Demand Letter. Can you imagine that.....Would have had done that if her legs had been cut off from the car accident. Well we can't file until you can walk. He actually thinks we are thinking over for the last couple weeks...settling for 7500.00. If he wants a dime from the new attorney we will let the B.A.R. know the fullness of his negligence. We want justice, is that too much to ask for from one's Attorney. Several attorney friends we should have gone to could not believe the LONG list of truly unconscionable oversights, negligence would be an understatement.

What a Debt Collection Lawyer Can Do for You

A debt collection lawyer helps individuals and businesses navigate legal matters related to debt collection. Whether you’re a creditor seeking to recover unpaid debts or a debtor facing aggressive collection actions, a debt collection lawyer can provide valuable assistance. These lawyers help creditors pursue legal action to collect overdue debts and ensure compliance with debt collection laws. On the debtor’s side, they help defend against unlawful collection practices, negotiate repayment plans, or file for bankruptcy if necessary.

If you’re dealing with a debt collection issue, a lawyer can ensure your rights are protected and work toward a resolution that aligns with your financial or business needs.

When Should I Hire a Debt Collection Lawyer?

You should consider hiring a debt collection lawyer if you are facing any of the following situations:

  • For Creditors:
    • Unpaid debts: If you’re a creditor (such as a business or individual) with unpaid invoices, loans, or accounts receivable, a lawyer can help you pursue legal action to recover the debt.
    • Debtor refuses to pay: When a debtor is unwilling or unable to make payments, a lawyer can assist with filing lawsuits, securing judgments, and enforcing those judgments to collect the debt.
    • Negotiating repayment plans: If you’re willing to work with a debtor to arrange a payment plan, a lawyer can negotiate and draft a legally enforceable agreement.
    • Legal representation in court: If a debtor disputes the debt or countersues, a lawyer can represent you in court and ensure your legal interests are protected.
    • Securing liens or garnishments: A lawyer can help you secure liens on a debtor’s property or garnishments on their wages to recover the owed debt.
  • For Debtors:
    • Facing debt collection lawsuits: If you’ve been sued by a creditor or collection agency, a lawyer can represent you in court and help you defend against the claim or negotiate a settlement.
    • Debt collection harassment: If creditors or debt collection agencies are harassing you or violating your rights under the Fair Debt Collection Practices Act (FDCPA), a lawyer can help stop the harassment and potentially sue for damages.
    • Negotiating debt settlements: If you owe a significant amount of money but want to avoid bankruptcy, a lawyer can negotiate with creditors to reduce the total amount owed or set up a payment plan.
    • Disputing a debt: If you believe a debt is incorrect or have been wrongfully targeted by debt collectors, a lawyer can help you dispute the claim and provide evidence to resolve the matter.
    • Bankruptcy options: If your debts are overwhelming and you’re unable to repay them, a debt collection lawyer can help you explore bankruptcy as an option for debt relief.

Hiring a lawyer early in the process can help you protect your financial interests and avoid escalating legal issues.

What Does a Debt Collection Lawyer Do?

A debt collection lawyer provides a variety of services depending on whether they are representing the creditor or the debtor. Their responsibilities often include:

  • For Creditors:
    • Filing lawsuits: A lawyer can file a lawsuit against a debtor who has failed to pay what they owe. This includes preparing and submitting legal documents, representing you in court, and pursuing judgments.
    • Negotiating settlements: If the debtor is willing to settle, the lawyer can negotiate a payment arrangement or reduced settlement that ensures you recover some or all of the debt.
    • Securing judgments and enforcement: After obtaining a court judgment, a lawyer can help enforce it through methods like wage garnishment, bank levies, or property liens.
    • Reviewing contracts and agreements: A lawyer can review your contracts and lending agreements to ensure that they comply with the law and are enforceable if a debtor defaults.
  • For Debtors:
    • Defending against debt collection lawsuits: If you’re being sued by a creditor, a lawyer can challenge the lawsuit, dispute the debt’s validity, or negotiate a more favorable settlement.
    • Stopping harassment: If debt collectors are using unlawful practices to collect a debt (such as threatening you or contacting you excessively), a lawyer can intervene and protect your rights.
    • Negotiating debt relief: A lawyer can negotiate with creditors to reduce the total amount of debt you owe or develop a manageable payment plan that suits your financial situation.
    • Disputing inaccurate debts: If a debt is not valid, a lawyer can help you gather evidence to dispute the claim and prevent further collection actions.
    • Filing for bankruptcy: If your debts are overwhelming, a lawyer can advise you on whether filing for bankruptcy is the best option and help you through the process.

How Are Debt Collection Lawyers Paid?

Debt collection lawyers typically charge for their services in different ways depending on the complexity of the case and whether they represent a creditor or debtor. Common payment structures include:

  • Hourly rate: Many debt collection lawyers charge by the hour, with rates typically ranging from $150 to $500 or more, depending on the lawyer’s experience and the case’s complexity. Hourly fees are common when the lawyer is representing either party in litigation or negotiation.
  • Contingency fee: For creditors, some lawyers work on a contingency fee basis, meaning they only get paid if they successfully recover the debt. Their fee is typically a percentage of the recovered amount, usually ranging from 20% to 40%.
  • Flat fee: For specific services, such as reviewing a contract, drafting a demand letter, or defending a straightforward debt collection lawsuit, a lawyer may charge a flat fee.
  • Retainer: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

It’s important to discuss fees with your lawyer during the initial consultation and understand the total cost of their services before proceeding with your case.

How Much Does a Debt Collection Lawyer Cost?

The cost of hiring a debt collection lawyer depends on whether you are a creditor or debtor, the complexity of the case, and the lawyer’s experience. General cost estimates include:

  • Hourly rates: Most debt collection lawyers charge between $150 and $500 per hour. Complex cases involving litigation or large amounts of money may result in higher legal fees.
  • Contingency fees: If the lawyer works on a contingency basis, they typically charge between 20% and 40% of the recovered amount. For example, if you recover $10,000 and the contingency fee is 30%, the lawyer would take $3,000.
  • Flat fees: For simpler services like drafting a demand letter or responding to a debt collection lawsuit, flat fees may range from $500 to $2,500, depending on the work required.
  • Retainers: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

Always ask for a detailed cost estimate during your consultation to avoid surprises and ensure that the services fit your budget.

Top Questions to Ask a Debt Collection Lawyer

Before hiring a debt collection lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case. Key questions to ask include:

  1. What experience do you have with debt collection cases?
Make sure the lawyer has experience handling cases similar to yours, whether you’re a creditor or debtor.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, on a contingency fee basis, or a flat fee, and ask for a detailed estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential outcomes.
  4. How long will the process take?
Debt collection cases can take time, so ask the lawyer how long they expect the process to last, from filing the claim to recovering the debt or resolving the dispute.
  5. What are my legal rights?
Ask the lawyer to explain your rights as a creditor or debtor, including protections under laws like the Fair Debt Collection Practices Act (FDCPA).
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be managing your case.

How to Check the Credibility of a Debt Collection Lawyer

To ensure you are hiring a reputable debt collection lawyer, take the following steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for debt collection experience: Review the lawyer’s website or professional profile to ensure they specialize in debt collection law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle debt collection cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on debt collection matters.
  • Check for certifications or memberships: Look for certifications or memberships in organizations like the National Creditors Bar Association (NCBA) or other relevant associations that focus on debt collection law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a debt collection lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • For Creditors:
    • List of outstanding debts: Bring a detailed list of the debts owed to you or your business, including invoices, contracts, or other supporting documentation.
    • Previous communication with the debtor: Provide copies of any emails, letters, or phone call logs showing attempts to collect the debt.
    • Contracts or agreements: Bring any contracts or agreements related to the debt, as they may be critical in proving your case.
