My recent experience with Manikas PLC for estate planning exceeded my expectations. Before delving into the process of estate planning, I am not sure my husband and I fully understood what not planning would mean for us and our family. One of the most valuable parts of the experience was the planning meeting where Kyle walked us through the specifics of what would happen to our home in probate and my children if there were no legal precautions taken. It was a stark reality check that every parent should experience. As we worked through the planning, what impressed us the most was the genuine sense of commitment that Kyle had. There was an ongoing collaboration to make sure that all the details, like the deed and other aspects of the trust funding, were taken care of so that the plan would work when we needed it. Kyle was available to address our questions and concerns as my husband and I worked through the process, which was very reassuring. There was a strong emphasis on education and communication from start to finish and this allowed us to make well-informed decisions. I wholeheartedly recommend Kyle.

I was represented in the court by Mr. Manikas . From the first meeting with him, I had a complete confidence that he is in control of all aspects of my case. He provided the best recommendations for every step I had to take and because I followed exactly what I was told to do before the court, the result was outstanding. I greatly appreciate the hard work, time and dedication of Mr. Manikas . I highly recommend him as a attorney you can completely rely on. His professionalism and level of expertise is the highest that you can expect. Thank you very much!

When we needed to learn how to manage our sister's anticipated inheritance, it didn't take long to settle on the Farr Law Firm for advice. Their reputation as the experts in elder law and estate planning preceded them. After a thorough review of our situation, they revised my mother's revocable living trust and prepared a Special Needs Trust for my sister. There was some urgency as my mother was nearing 100 years of age. Thanks to their knowledge and depth of experience they were able to complete the work in a matter of days. Trusts are complicated and in the course of administering them, I've had numerous questions for Mr. Farr or a member of his staff. Without fail, responses are clear, comprehensive and delivered without delay. Working with Farr, I know I can count on things being done correctly and to our best advantage - and that adds up to great peace of mind.

Originally we chose Evan Farr and his law firm based on his clients' reviews. Our initial appointment with Evan only confirmed all the excellent reviews we have read. Three specific qualities set Evan apart from other attorneys practicing Elder Law: his vast knowledge, excellent listening skills and offering of continuous education for his many clients. We much appreciated Evan's help in navigating the complex and stressful process of setting up our legal documents. We also appreciate Sara Entis' efforts to finalize this colossal task and to make the important signing appointment totally flawless. In addition, we want to mention Sierra Kolasa's willingness to help every time we needed assistance. Our entire experience only proved that choosing Evan and his firm was the right decision. We highly recommend Evan and his firm to everyone.

In 2017, I was seeking legal expertise in the area of Elder Care. My journey led me to Jean Galloway Ball. Since then, she has been instrumental in guiding me through/about Elder Care as well as Estate Planning/Trusts. She was able to assess my situations immediately, provide the challenges ahead for me, options for resolutions, thorough in ensuring I understood all documentation, and, above all else, understood me. I am thankful for her knowledge, frankness, concern, and patience. As a result of her professional demeanor, and just who she is, I felt at ease during and after each session even though, many times, the situation that I was dealing with didn’t warrant it. I highly recommend Jean Galloway Ball. She will never give up on her client.

Jean Galloway Ball is a superb attorney in every way. We hired her to represent us in a difficult estate litigation matter. I am an attorney myself and I had very high standards. She met and even exceeded them throughout the litigation. She has great judgment, is very responsive, produces excellent work product and works really hard to represent your interests. I am very happy we hired Jean to represent us.

My husband left behind a very muddled and complicated estate with no will, loans that were owed him, real estate owned in several states, a construction project that was barely started, unpaid taxes, money in a foreign account that was frozen, a safe deposit box owned by him alone and a jealous girl friend who sued me. Jean and her associates have helped me through the process of becoming the administrator of his estate, reactivate my late husbands LLC so I can continue the construction project and has countered the suit effectively. Jean has begun the process of forcing the repayments of the loans by placing liens against the debtors property which he has for sale thereby preventing sale without repayment of his loan. There is still much to be done, but I have confidence in Jean's ability to advise me and help me find the specialized help I need to complete this task..

I was interested to find the firm is all young female lawyers. I gave them a chance and was pleased with the result. I was assigned Jesci Norrington, which was excellent for the job. Jesci wrote an new will for me and found that my home deed needed updating of dual ownership and added survivor clauses to protect either my wife or me. This was all done quickly and looked great, at a reasonable fee. I am well pleased and am spreading the word. Thanks.

My elderly mother's legal affairs were a mess - Mr. Sim was very thorough, and quickly determined there were many issues of concern regarding her estate. As busy as I know he is, he always took the time to answer many, many questions we continually had doing the whole "clean-up" process, and he delivered an estate package that even my hard to please mother said she wished she had received from other attorneys in past years. When we went into sign the documents, he took the time to explain every detail to her before she signed everything. Four years ago Mr. Sim prepared my own estate package, and when I was looking for an estate attorney for my mother, he was the only one I would consider.

From the moment I had my initial consultation with Ms. Jamel Rowe, I knew I had found the right attorney. I was incredibly nervous and felt ashamed about having to go through this process, but Jamel put me at ease immediately. She created a safe, non-judgmental space where I felt comfortable opening up. Jamel’s reputation as a "bulldog" in the courtroom was exactly what I needed. She is the epitome of professionalism, expertise, and skill, and I truly can't praise her enough. Her paralegal, Ms. Julia Brice, was consistently on top of everything, ensuring that things got done efficiently and effectively. I also had the pleasure of working closely with Mr. Carl Chandler, who was nothing short of outstanding. He is an exceptional attorney and a pleasure to collaborate with. Both Jamel and Carl fought tirelessly on my behalf, securing exactly what I was hoping for. I will always be grateful to them. I must also mention Ms. Kathy at the front desk, who brightened my day each time I called or came into the office. I wholeheartedly recommend Livesay & Myers, PC – they are an incredible team!

After a preliminary meeting with Ms. Griffith, I hired her to prepare and submit a Virginia Medicaid application on behalf of my sister who is under skilled nursing care in a retirement community. I could not have made a better choice of attorney, nor could I have submitted an acceptable application without her. Ms. Griffith is highly skilled, experienced, knowledgeable, and professional. She is also a pleasure to work with. I have a profound hearing loss, which she accommodated patiently. She always responded to telephone messages and emails quickly, and completed all her work-product on the dates promised. I learned that preparing and submitting the Medicaid application required Ms. Griffith to work with four principals: me who hired her, my sister the client, the nursing home where my sister resides, and the Virginia Department of Family Services. In a very impressive display, Ms. Griffith seamlessly brought all four parties together in a timely fashion to get the application approved. A complicating factor is that I live in another state, making communication and contact more difficult. I am convinced that Ms. Griffith's interpersonal skills were a very important part of the successful application process. I highly recommend Ms. Griffith and I plan to hire her again in the future should the need arise. Thank you Ms. Griffith, I appreciate your help and leadership!

We used the services of Ms. Cucinelli for a number of problems that arose with my aged mother, for whom I was guardian. She was always easy to reach, clear and concise in her answers to questions. She displayed both a broad and deep expertise in Virginia elder law. I cannot imagine an attorney who would be better able to handle even the most complex legal issues in this field. She was so extremely good at what she does that I took my next-door neighbor to her for work with his estate and other advance planning.

Outstanding attention to the full history, context and details of the matter by Samantha in the firm. Very patient with me explaining the best options to resolve a contentious estate situation that had gone on for 3 years previously where another very strong firm was on the other side using "low-ball, then delay then obfuscate, then avoid" tactics with my prior counsel. Once formally engaged on the case, Samantha resolved the entire matter w/in approx 4 months for a reasonable fee as well considering the amount of time invested in the process (Expect it to be a process of back and forth and attrition BTW!). I couldn't be more pleased with the firm, Samantha and Kara's professionalism, teamwork or the positive results for my family's future!

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
