We had a great experience having our Trust and Will done by Mr. McKenna. He was extremely thorough with the process and answered every little and big question we had to ensure our wishes were all made clear in our legal documents. We feel relieved to have finally worked on this important step for our young family. In fact, our fourth child was born the evening we signed our Trust documents! A fun day to remember!

Under extreme stress and time constraints (hours) with complex tax issues, Penniann made the time to talk to me, gave me sound advice, and didn't make me feel like an idiot. She was clear, and concise and could discern the issues plaguing me without me being able to articulate them clearly. Conversing with her gave me hope, and reduced my blood pressure and heart rate.

Dear Penny. Where to start, I came from a family that the Patriarch makes the decision (right or wrong deception or not).  I contacted Penny some sixteen months ago when my brother showed up at my home with a codicil. I was told my mother had a trust in 2010 this was a complete falsehood. He had pilfered my mothers accounts created a mortgage on her paid for home and sold our family cabin. During which I was never told of any of these transaction (remember I as a woman am not allowed to question). When I found Penny she was so understanding and took my case to protect my interests and my mothers legacy. She is a fighter not intimidated by the court system or the family that represent those that mean you harm. I was most impressed that she was always available and responded even on vacation with her family. Another example: her daughter was in collage and a close friend had passed away, she picked up her phone to take my call (above and beyond the call of duty) yet still comforted her daughter. They don't make people like that anymore (remember I said people not just lawyer) Oh she's a lawyer, someone you can trust to always be there and prepared, and have the ability to explain the complex legal system for  myself and husband to understand. I strongly think if you are in my position you should speak to her, before you are deceived by conviction that program you for failure (to be subservient) you deserve answers. Penny will get them! .  We are indebted for your concern, caring, dependability, but most of all your caring and compassion. As always Penny thank you for you support through the difficult time in the past now we have a future! J & R

Had a credit union mistakenly apply my payment 2 days later than I should have missing my statement and date. They said they fixed the mistake and I will see this correction on my next statement but the issue is it was reported to the bureaus with wrong amount prior to them correcting this. The amount is over $16k so this is making a huge impact on my credit score/utilization/total balances and ability to get approved for new credit. Well, I fixed my credit and got rid off my debts with the help of PINNACLE CREDIT SPECIALIST whom a trusted friend recommended and he did a perfect job increasing my credit score to (801 TransUnion, 805 Experian, 807 Equifax) all credit card debts are marked as paid, public record, bankruptcy and hard inquiries are all gone. I’m so happy. I refer this great hacker to those who have a fixed date to fix their credit profile. Text PINNACLE ON +1 (585) 466 4373. Tell them Tricia Walton Referred you. Dale was really nice, however, what I hired him for was his legal expertise and he failed me in that area more than once with my case. He forgot to provide notice to the other party, which delayed my case 13 weeks. He forgot to include default judgment language in paperwork which resulted in not obtaining a default judgement when the other party failed to show up to court. Delaying my case again another 4-6 weeks. After he made several errors, I had to keep a close eye on deadlines and when I challenged him, he ignored my concerns. When I confronted him about it all, he spoke to me like I was a child. My experience with Dale was very disappointing that I chose to not hire him for my continued legal issue. In speaking to my new attorney, they pointed out how my current case should have been brought up with the case that Dale handled. He made several mistakes on my case.

My 80 year old mother was in a battle with her step son over the estate that her deceased husband left to her. We had many consultations, emails, and letters back and forth with Frank and he was patient, kind, and very knowledgeable. He didn't hesitate to tell my mother what would be in her best interest, even if that was to stop using his services and be finished with the fight. He didn't seem to be motivated by the dollar, which eased our minds in the process. Ultimately, Frank helped us to get a settlement and allow my mother to move forward in peace. I would highly recommend Frank for all the reasons listed, as well as the fact that he was prompt in his response no matter which way we contacted him. Thanks again Frank!

My wife and I are about to turn 60. We have a few rentals, house, and other assets. We wanted to see an estate attorney to set up our estate properly. We have 4 adult children and wanted everything to be in order. Attorney Lish did an excellent job setting up our estate. I suggested a few ideas and he was very helpful and taught me the pros and cons of my ideas. I am really glad I picked an attorney who specializes in estates to set up my will, estate, living will, etc. I can't remember all the specific sections without getting out the paperwork. At the end he gave my wife and me all the paperwork in a white binder that we were able to put in our safe at home. I'm just a local Orem/Provo guy who needed things set up properly for my wife and kids. Glad it is all completed. If I remember right he also offers a free review each year since things can change. Maybe we will go back in after 3 or 4 years for a review. I was very happy with the experience and happy to know that we have our estate set up properly.

In my past experience with other attorneys, they often seemed to be rushed or didn't really listen or explain very much. I called Kent Hansen's office in Logan to ask for assistance with my parents' trust since I am now the trustee and need to settle the trust. I had previously called the attorney who created the trust as well as another firm in Logan but, after waiting for several weeks, I received no response from either of them. I was pleased and relieved that Maria could schedule a 15 minute consultation within a few days of my call. Mr. Hansen called at the appointed time and provided some initial guidance. We scheduled another call a few days later to discuss the trust. At the next meeting, it was obvious that he had read the trust and was familiar with the provisions. During our discussion, he answered all of my questions and provided the guidance I needed. He also reviewed and corrected two documents that were required for me to act in the capacity of the trustee. All of this was done over the phone or in a Zoom call since I am out of the state. I am extremely pleased with the assistance that Mr. Hansen provided. He is very professional, understanding, knowledgeable, and friendly. I highly recommend him.

The Alder Law Group was highly recommended by a friend and that was the best referral ever! These trusts are complicated; I wanted mine done right and really needed the professional guidance to help me make good, informed choices. From my first interaction with Ireland, I felt in really good hands. Jim is extremely knowledgable, thorough, and patient — he explained everything in fine detail over an hour and a half. My peace of mind is important to me — this was worth every penny! We are thinking about setting up wills and some estate planning in the near future — we won’t be going anywhere else! I simply can’t recommend this group highly enough.

I met with Jim Alder to setup an NFA trust in early December. I'm aware that for a *very* minor savings, you can set these up online, but for the small difference in price, Jim met with me for an hour, explained all the details of the trust, notarized my signature of it, answered questions that I had, provided me both a hard and electronic copy of the trust, provided additional information about filing ATF forms, and I have a trust backed by his firm and he is available to answer any questions and contact me in the future if laws/regulations change. To say that represents an incredible value is an understatement! Jim was very nice, down to earth, and demonstrated an in-depth knowledge of the rules and regulations pertaining to the NFA including potential changes being proposed to the existing laws. I'd highly recommend using him for NFA trusts. He may be equally adept with other forms of estate and trust planning, but that wasn't the purpose of my transaction, although I will certainly reach out to him about family trust planning in the future. Again, highly recommended.

We called and asked if they could write a cease and desist letter. A Jennifer Later emailed us that an Adam Kunz charges $100 for 30 minutes. When a law firm won’t tell you if they can assist you or not without charging a fee it’s a scam.

My fiancé hired Mary Bevan to help her with a custody matter. After the first hearing we had concerns with Mary's approach and confidence in the court room, after the 2nd hearing we realized she was as good as having no legal counsel. She has no control whatsoever in the court room and she allowed the apposing lawyer to walk all over her. It got to the point where it seemed like Mary didn't believe my fiancé and constantly kept telling her to be honest in order for her to be able to help. My fiancé never lied and was honest from the start. We ended up firing her and hiring a new lawyer. It took the new lawyer 1 hearing to get the case resolved, Mary had 7 months and didn't do anything.

I found Pearson Butler via MetLife legal plan. Connected with Russ to get our family trust in place. Straight forward to complete, no complaints there. Reached back out to Russ about a completely separate matter unrelated to estate planning. His response was "I do not practice law in this area and thus, have not idea." I guess I just had more expectation than a lazy response with typos. Too much to ask if there's someone he can put me in contact with? I will be moving on from Pearson Butler and find another firm to do estate planning in the future.

This review and my gratitude is long over due. Virginia was my lawyer during a long, difficult custody battle. Family law is a ugly business and Virginia is one of the few lawyers who is it for the right reasons; to protect children. Her morals are one of her best qualities. She is beyond professional; nothing will ruffle this women's feathers. Her manner is always sincere, calm, and collected. I learned so much from her. When you call, If she does not answer right away her wonderful secretary Elizabeth is on it. She is second to none and I would recommend her to anyone.

My son found himself in a jam back when he barely turned eighteen, as a matter of fact, it was two weeks past his eighteenth birthday. Well, he had never been in trouble with the law like this and when the threat of prison actually seems real it felt as if the world was coming to an end. I called a numerous amount of attorneys. Wow, they charge ridiculous fees, some over 10,000 which we could definitely not afford. Finally a friend of a friend referred us to David. I wouldn't of found him because he doesn't advertise. He gets his clients based on word of mouth. He was God sent! Not only did he charge us a flat, more reasonable fee. He even allowed us to make monthly payments. He did an awesome job for us and he was able to get my son probation arrangement. I recommend everyone I know to him. We all make mistakes and he understands this. Everyone I've sent to him has also been pleased with him. He's fair, trustworthy, honest. He actually does this to help people it seems (not for the money like other attorneys) I highly recommend you will not be disappointed.

The whole process of setting up a family trust and decanting resources was painless, which is certainly not something you can say about legal paperwork generally! Foxhall is a beautiful setting, and Zach had got everything he needed by email, and so walked us through the ~70 page document in less than an hour, with notaries and witnesses on hand to get everything squared away. He helped resolve the numerous complicated dangling strings of my parents' financial situation clearly and quickly by text and email. Affordable. Quick. Knowledgeable.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
