I've worked with the team at Legacy Elder Law Center for about a year now and they've been simply amazing partners. It's abundantly clear that they care about each and every person that calls. Their reputation is built on helping, caring, and being a true advocate for families throughout the planning process. I highly recommend that anyone give them a call and see if they would be a good fit. If not, they'll help you find someone who is.

It has been my pleasure to know and work with Attorney Rory Clark and the staff of The Legacy Elder Law Center for the past six years. They have assisted me with the complexity of helping my parents create their irrevocable trust. With Rory's expertise and guidance, the entire family feels that our parents' financial future is secure. My thanks to all for making this experience so easy and allaying our fears.

This team has done nothing but work to help me. They have been confidantes, therapists, and obviously legal experts. They have taken a potentially disastrous situation and turned it around in a flash and explained all of my options at each stage of the process. I could not be happier with their work. We're not done yet and there are still some hurdles to jump but without them I really would be up the creek without a paddle. Thank you Leann, Rachael, Eliz, Rory and the rest for your patience, expertise, and kindness. Worth every penny.

When I was going through my divorce this past year, Tawyna was the right person to represent me. She was all business and fought for me like no lawyer I have ever had. If you need a strong lawyer, that has your back, and always thinking about you and your needs, she is the lawyer you for you.She saves me lots of money and was always very professional and matter of fact. The billing retainer was very reasonable in which my ex spouse spent three times more than my case. I didn’t have to be pay my ex spouse attorney fees, which saved me tons of money. Tawyna is the lawyer you need and would be foolish to go with someone else. Will go to battle with her again in the future. Her legal team is amazing and the model of professionalism. If you need a lawyer, better call Tawyna!

I was referred to Tawnya by The Alexandria Bar Association (ACBA) Lawyer Referral Service, for my uncontested divorce. I arrived at the office for my consultation appointment. The receptionist (a gentleman, didn't catch his name) didn't tell Tawnya that I arrived. 10 minutes later, she came out, and was surprised to see me. Unfortunate, but fine. Now we can begin. We get to her office, and the conversation went thus: What's your situation? I'm getting a divorce How long were you married? 6 years I sent you paperwork, you didn't complete it. Yes I did, I emailed it back to you. Do you have a signed settlement agreement? No, she won't sign. Did you send that to me? Yes, in the same email. Oh! There it is. I was beyond frustrated. I booked a 30 minute appointment, and the majority of it was eaten answering questions that I had already provided answers and documentation for when she requested it 4 days prior. I was very thorough, to avoid this exact scenario. I wanted this meeting to be productive. It wasn't. She talked me through the process, answered a few specific questions I had brought with me, but ultimately, nothing I couldn't have found online. Very disappointing experience.

This law office I visited was exceptional. The lawyers were highly knowledgeable and professional. They provided clear and concise advice, and their attention to detail was impressive. The office itself was well-organized and had a welcoming atmosphere. I was thoroughly impressed with their expertise and the level of service they provided. Overall, it was a great experience and I would highly recommend this law office.

Highly recommend for estate planning needs. Josh and his team made us feel really comfortable throughout the process and never felt pressured. They answered all of our questions and gave us the time we needed to think over these important decisions before signing. Looking forward to partnering with this firm for our future estate planning reviews and modifications as things change.

Like a lot of people, we delayed doing our wills and trust partly bc we were looking for the right person to guide us through the process. Well, we found him. I can’t recommend Josh Hummer’s Winchester estate and elder law firm more highly. Unlike most estate lawyers, he recognizes the important relational dynamics that surround the death of loved ones…connections that go far beyond the nuts and bolts of medical and financial planning. His staff exudes compassion and competence. They are dedicated and kind professionals who walk you gently through each part of the process using a detailed and well-executed format. We now have a lovely binder of essential documents and are using their suggestions to compose important final thoughts and wishes that will mean so much to the people we love. The first consultation is free. Definitely worth your consideration if estate planning is still on your to-do list. (And lovely gift mugs to boot!) We loved working with this group. Our estate is small…but we felt valued throughout the entire process!

David Reed is a fantastic attorney. He has been my and my family's attorney for a long time and he has been a tremendous mountain of strength for us during some very stressful matters. David is very professional, is exceptionally knowledgeable, especially in the area of real estate, and he is courteous and kind. Mr. Reed explains everything from the beginning to the end and has goes above and beyond what any other attorney would. David has handled our real estate needs, my son's traffic offenses, and my husband's DWI case which was a particularly stressful time for us. He has handled just about anything that has come up for us. If you are looking for the best real estate attorney, traffic or criminal representation, or just some guidance on a matter, David Reed is your man. We are forever grateful to David for his professionalism in getting things done and getting them done in a highly efficient manner. I very much recommend David to anyone who is in need of legal representation. He is the best!

Frugal Legal Services should be the staple for how all parents are represented in custody cases. Ms. Burroughs worked hard and diligently on my case and set realistic expectations. My case had a ton of unrelated issues to custody and Ms. Burroughs was completely understanding and worked through our nearly 9 month case. Ms. Burroughs is a magical and enlightening person who gets results. I went from having no contact with my children to now everything is 50/50 and I get to see my sons every other week and have the assurance that no one should be able to change that. The only shame here is that I can only give Ms. Burroughs and Frugal Legal Services 5 stars because it doesn’t let you show off the absolute brilliance of the firm or Ms. Burroughs. Ms. Burroughs and Frugal Legal Services are the prime and top option of any family matters should anyone require those services. I will recommend them for my entire life because of the amazing work that was done.

I'm an attorney, but not licensed to practice in Virginia. My father had recently passed and left some IRA certificates at a Federal Credit Union (FCU) in Virginia Beach without a designated beneficiary. This FCU refused to transfer ownership of the IRAs to his surviving spouse, i.e., my 90+ year old mother. Attorney L. Ashley Brooks explained to us and argued to the FCU that Virginia law supported my mother's ownership. With Counsel Brooks' excellent legal counsel and the helpful assistance of the paralegals and support staff at the Law Office of Angela N. Manz, my family was able to reach a successful outcome in our dispute with the FCU.

When we needed to learn how to manage our sister's anticipated inheritance, it didn't take long to settle on the Farr Law Firm for advice. Their reputation as the experts in elder law and estate planning preceded them. After a thorough review of our situation, they revised my mother's revocable living trust and prepared a Special Needs Trust for my sister. There was some urgency as my mother was nearing 100 years of age. Thanks to their knowledge and depth of experience they were able to complete the work in a matter of days. Trusts are complicated and in the course of administering them, I've had numerous questions for Mr. Farr or a member of his staff. Without fail, responses are clear, comprehensive and delivered without delay. Working with Farr, I know I can count on things being done correctly and to our best advantage - and that adds up to great peace of mind.

Originally we chose Evan Farr and his law firm based on his clients' reviews. Our initial appointment with Evan only confirmed all the excellent reviews we have read. Three specific qualities set Evan apart from other attorneys practicing Elder Law: his vast knowledge, excellent listening skills and offering of continuous education for his many clients. We much appreciated Evan's help in navigating the complex and stressful process of setting up our legal documents. We also appreciate Sara Entis' efforts to finalize this colossal task and to make the important signing appointment totally flawless. In addition, we want to mention Sierra Kolasa's willingness to help every time we needed assistance. Our entire experience only proved that choosing Evan and his firm was the right decision. We highly recommend Evan and his firm to everyone.

I recommend Donna Wilson to anyone who is looking for an estate planning or elder law attorney in the Williamsburg area. Although I am an elder law attorney in Tampa, how I met Donna told me everything I needed to know about her and her law firm. We spent several days at a professional “bootcamp” with the sole focus on becoming the best advocates we can be for the people that trust us with their lives as well as their post-mortem affairs. Donna stood out as an extremely capable attorney ready, able and willing to provide clients – not only the highest level of skill and expertise – but all the aspects of respect, empathy and attention lost today in our profession. If you are in need of genuine people who can meet your estate planning or elder law needs, do not look any further than Donna Wilson, and Wilson Law PLC.

We had our estate planning done by another attorney several years ago and needed to update documents. Donna Wilson found several errors and inconsistencies in our old documents that would not only have cost us more money, but could have left us and our child unprotected at the time of our death or disability. We now have piece of mind knowing we have had a thorough and professional review of our situation and that we now have a plan that is tailored to our needs. As we were deciding what plans to make for our family several alternate scenarios were created to give us examples of what could happen depending on our choices and it was clear that Ms. Wilson clearly knows her field. The process was smooth, yet complete, and the office staff was quite responsive to questions and concerns. Communication has been wonderful and the documents we received were carefully explained and extremely well organized. We are relieved and confident that we made the best decision in choosing Wilson Law.

As a couple quickly approaching the age for retirement, we turned to Donna Wilson and her team for help in protecting our wealth. The process was painless and easy to understand. With children and grandchildren in the mix, we wanted to make sure our assets would be available to them upon our departure from this life. We were able to create an exceptional plan, legacy trust, and other components to make certain our wishes would be carried out. We were so impressed with the final outcome of this effort that we shared our experience (not all the details) with other family members. Three other family members have since turned to Donna and her team and completed very similar processes. It sure is a good feeling to know that our family will benefit from the fruits of our life-long hard work and not a bunch of bureaucrats.

Cathy, Leslie, and her team were awesome from 2020 through 2021. I couldn't ask for a better team. My mom went to the hospital in April 2020 end up in a medical coma for months. My mom didn't update her estate planning to allow for me to assist her in daily life. Mind you this is the first time I ever had to deal with something like this, I am a young 34 year woman. They educated me on different options on what to do, assist me with everything I had to do for my mom. I end up having to go to court to get guardianship/conservatorship for my mom. Leslie was awesome in assisting me with what I needed to do for court paperwork, accounting, etc. When my mom recover and she was able to get her rights back, Cathy took the time to speak with my mom to get her estate planning done as well get her rights back. My mom was impressed by the service they provide to her. Unfortunately, my mom passed away in April of this year, and again I went back to Cathy and her team for more guidance on what is best to do to avoid any issues. When it came to family disagreement on the Last Will, I ask for Leslie to help out to speak with my family. She was able to get them to come to an agreement to move things smoothly. I couldn't get through this mess in the last past two years without them. I would give them 10 stars if I could. They were very reasonable on price with me. Thank you so much for everything you have done!

Sarah Knapp and the Shounbach team were truly pivotal in guiding me through my divorce. Sarah is not only a highly skilled attorney but also incredibly kind, patient, and calm—qualities that make all the difference during such a difficult time. I always felt supported and knew she was advocating for my best interests every step of the way. Divorce is messy, emotional, and overwhelming, but having an attorney like Sarah in your corner brings a sense of clarity and peace. I can't recommend her enough.

Jeremy has provided legal services for my wife and me on several occasions. In every instance he has been professional, prompt, and knowledgeable. He has helped us in estate planning by providing wills, power of attorneys, and advanced medical directives. With his expert knowledge of the relevant legals requirements, he has given us wise counsel, but always in way that respects our own wishes and is tailored to our unique needs. Jeremy has also done work for us related to the constitution of an LLC. He walked us through the necessary steps and handled all of the legal requirements. His work was done quickly so no time was lost. His office is well-organized and the work to be done is clearly communicated ahead of time. Questions that arise along the way are answered patiently and with a depth of insight. It can be hard to find a lawyer who is at once professional and personable, but Jeremy is that rare attorney.

We as a family have been so pleased with the care, compassion, and overall service we received from Obenshain Law Group. Yes, Mark is a “bulldog” at what he does, but also was so compassionate towards me and what I was going through.

Powell has been our personal attorney for at least 25 years. I am a financial planner and understand the need to keep legal plans up to date. When I need to reach him, I get a response from him or his legal assistant in a timely fashion. As our children grew and our situation became more complex, he kept our Wills, Trusts, Powers of Attorney and Medical Directives up to date. He has also done work for my adult children at my behest when they lived in North Carolina or Virginia. They have liked him and his work very much. Some of my clients have chosen to use his services and they have learned that Powell works well with their other advisors. He cares deeply about his clients and you cannot buy that attribute.

Tim gave me a great deal of comfort going into our case. Spent a fair amount of time upfront and followed through with good outreach to the prosecutor. Got lucky with the judge's dismissal, but if that hadn't happened, we had a good plea deal ready to go. Without him, we would have had no palatable follow up plan.

I'm trying to think of what to say that would not sound generic, and all I can really think to say is to thank him for what he did on my behalf. My situation I'm sure was way more than 10 bar for but he stood by me the whole time to the point where there was clearly nothing in it for him. I think Tim is what we all would hope for in an attorney. He definitely went above and beyond for me and my particular situation. We recently worked with Kyle to draft our will and living trust, and we couldn’t be more pleased with the experience. Kyle’s pricing is fixed, and his services are completely transparent. He was upfront in advising us against certain options because they required more of our own effort, making it unnecessary to pay for his additional services—a level of honesty we truly appreciated. Kyle provided valuable tax advice, including clarifying the impact of sunsetting provisions on asset transfers, which helped us make more informed decisions. His expertise and clear explanations made the process feel manageable, even when addressing complex legal and financial topics. The office, located in Fairfax and easily accessible off I-66, is shared with other legal practices. The front desk staff was helpful, and the main conference room—offering a beautiful view of Fairfax County—provided a professional and welcoming environment. Scheduling was straightforward, though the process took slightly longer for us due to the need for our child (away at college) to sign certain documents. Kyle went above and beyond, meeting with us on the day before Thanksgiving to ensure everything was completed. He even arranged for witnesses since the regular staff was unavailable during the holiday. Kyle’s professionalism, flexibility, and attention to detail made what could have been a stressful process remarkably smooth. We highly recommend him to anyone seeking thoughtful and reliable estate planning services.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
