Matt is incredibly smart. But beyond being knowledgeable about the law, Matt is generous with his time and really cares. He's helped me through several real estate and landlord issues, and with complex trust structuring with my family. In all cases, Matt took the time to understand what I was thinking and what caused me concern. He was respectful of my feelings and opinions, but also guided me and helped me make solid choices for my family. I can't say enough to recommend Matt. He is the best attorney I know.

A written Will, of 21 pages. A Financial Power of Attorney of 18 pages. A Health Care Power of Attorney of 12 pages. A few pages of Transfer Documents concerning real property. Advice on how to give my body to medical research and how to have my children have immediate access to my checking and savings accounts without waiting for a Death Certificate. We had two meetings with Elaine who had been referred highly to us by a financial advisor and she was an excellent listener, probed to cover all the basis, and is a delightful and down to earth person.

When I was running into a legal situation with my ex business partner on both co-owned real state property and the business partnership, I was so frustrated because two prior lawyers got me nowhere at the time. Fortunately, I found Peter Fredman from the internet search. The case eventually went to the court for a trial. Peter did an remarkable job and helped me win the case. Thank you so much for the help! You are the best!

I first worked with Cara Jobson when she helped me successfully obtain asylum, and I’m back now to update my review with more good news: I just received my green card, asylum-based, in the mail! Throughout the entire process, I never felt alone, and she provided me with unwavering support. If you’re reading this and searching for an immigration lawyer, Cara Jobson is absolutely the one you want by your side. Thank you Cara, for everything!

Imagine opening a mail from the IRS stating that you owe several thousand dollars in taxes because you did not properly report your cryptocurrency. My partner and my heart's jumped into a panic! We knew Prerna also does tax law in addition to being an excellent immigration attorney, so we reached out to them. Prerna got back to us ASAP, and helped us file an amended tax return while running up against a tight deadline from the IRS. Prerna so skillfully and patiently walked me through how to properly document my cryptocurrency, with the appropriate cost bases! About a month after filing our amended return through Prerna, we actually got a nice return on our taxes instead of owing the nightmarish several thousand dollars to the IRS. Prerna also gave us tips of what to do better for our next years tax return so we do not make the same mistakes again. I highly recommend Prerna for taxes and immigration. Their knowledge, service, attention to detail and care is unmatched!

My very elderly parents and I had a long meeting with Linda about updating their living trust, which went well (aside from her double booking the time and having to turn someone away). Then they waited months and months with no communication, only to finally hear that she was just too busy to get to it. Unacceptable and unprofessional.

I was recommend to call Linda by a good family friend who is an expert attorney in another field of law regarding a troublesome estate issue. Although she couldn't take my case directly, she went the extra mile and helped me to sort through some of the red tape around California law by explaining how inheritance law works. In addition, she was able to find some background information on my very complex family estate issue. I plan to have her complete my own personal trust and I highly recommend Linda for estate planning!

After an unfortunate incident which caused me to require legal representation, I had the good fortune of having Scott Herndon recommended to me by a mutual friend. He was forthright, reliable and diligent in all of his communications with me, and proved to be a very effective advocate on my behalf. We reached a resolution that I am very pleased with, and Scott’s advice and counsel were instrumental in making that happen. As well as being a complete professional, Scott is also a nice guy who is sensitive to his clients’ needs, and I would wholeheartedly recommend him to anyone seeking legal counsel.

Scott represented me in an auto accident where I was injured and achieved a favorable outcome on my behalf, more than I was expecting. He was very professional and kept me in the loop on my case. He always responded promptly to my questions or concerns. I am grateful he handled my case and I was very pleased throughout. He also represented me in another matter previously and I would definitely recommend him if you’re looking for a great attorney.

Zachary Epstein handled a case for me with the IRS a few years ago. He quickly put me at ease by calling them and getting them to route all communications through his office since he would be handling my case. It was a difficult process to maneuver me through the lengthy hoops and we made a game plan. He surrounds his practice with other specialists that got me to the finish line. Everyday that goes by, I thank him for getting me out of my jam. Highly appreciate and recommend The Law Office of Zachary Epstein. Give him a call.

I highly recommend George McNitt for legal services. He's responsive, reliable, and knowledgeable in matters related to wills and related issues. I'm especially appreciative that he accepts ARAG and responds to inquiries from those who have this legal insurance via benefits packages such as those offered in the University of California system; no one else on the list of ARAG lawyers in the East Bay area responded to me. Highly professional and a pleasure to work with his office.

I wanted to share my honest opinion about my interaction with James Chanin. I called in with a Police Misconduct case and immediately while speaking I kept getting interrupted and was unable to clearly explain what happened. Mr Chanin repeatedly talked over me and then placed me on hold. Once he came back to the phone I tried to continue on with my story but it was very hard knowing that this attorney is basically telling your story for you by interrupting every sentence I made which made it very hard and confusing. The case I have is with a former Stockton police officer who robbed me off some cash. This same officer has already been found guilty and also admitted guilt in another case just last year. I was unable to relay all the facts because I was being talked over and put on hold. Mr Chanin eventually stated that he can not represent me because it’s going to take $5,000 to 10,000 to take on my case. With that said I believe that number is a bunch of bull crap because for one this case is already in the hands of the District Attorney as well as Internal Affairs. All the evidence and paperwork leading to this officers wrongdoings are available. I have been tirelessly searching for an attorney that will represent me. I had high hopes for James Chanin since I looked up his information and seen that he does handles police misconduct cases and also his mission statement says that he became an attorney to help people. He also stated that he is not satisfied until he knows that he has done everything possible to help people. He also stated that he strives to do an exemplary and professional job with minimal costs to clients and that he is not afraid to try a case. All of this I found to be not true he was definitely afraid to take on my case and he didn’t do anything to help me when he has years of experience in police misconduct cases. I am very disappointed because it seems like attorneys are looking for the dollar sign and media coverage in order to take on a case. The mission definitely is not to help people the mission is to see who has the most money in a case. Knowing that these attorneys spend years in school and working hard just to end up not helping and being the voice for the people who don’t have the help is very disheartening and disappointing.

BEWARE WORST ATTORNEY EVER!!!!! If you’re interested in an attorney that “ghosts” you this is the guy! Four months into a very sensitive case involving a dementia elder parent and this attorney disappears. This is after disclosing personal information, many documents being completed I have been unable to reach this attorney by email, phone messages and texts. I will say this attorney has no empathy no compassion and clearly does not care about his clients. The lack of communication throughout this entire case has been completely unacceptable. AND if you want to work with an attorney has no regard for safeguarding confidential information and doesn’t accept encrypted emails he again is your guy!! This attorney has no integrity and I hope no one goes through what I’ve gone through. It’s already been a tough situation and now to have to start all over is just devastating. If you’re shopping for an attorney KEEP SHOPPING you DO NOT want Darryl Yorkey!!!!!

I have been working with Darryl for 8 months now and he has been hyper responsive and AMAZING to work with. He is helping me with my immigration paperwork and his light hearted attitude and willingness to go above and beyond has made the painful experience of applying much more enjoyable. I highly recommend him as he knows how to get it done when other attorneys were not so helpful and had discouraging attitudes. He takes a "nothing is going to get in the way of getting this done" approach which you need when hiring legal counsel.

Mr Yorkey just stood me up for a document signing meeting. I drove an hour to Berkeley and waiting an hour for him. He never showed up and never phoned nor emailed. Took my deposit of many thousands of dollars and spent it all very quickly on unnecessary research . Once those fund were consumed continued to charge in the following ways. 1) I also needed counsel in another state and told Triano and partner I had a lawyer there already. Then to my amazement I was charged by them for finding a backup counsel in the other state. 2) More research without asking e.g on individuals on title in a certain property which in my opinion was completely irrelevant to the case and by the way information I could have provide if asked for or told why it was needed. 3) Advising me on issues via long emails that had already discussed then charging me a second time. When challenged he became defensive. 4) asking me to prepare a time-line to discuss with one of the assistants. The assistant read my time line, charged me, but never followed up to discuss it with me. The list goes on... . A very frustration and expensive ordeal. The last thing I needed when seeking professional expertise under duress.

Worst experience ever with a lawyer. Triano and Byrne are about milking the client. Confuse and delay is their working strategy. Worked with them for over a year. They confuse you and delay so they can send grunt lawyers to court hearings and bill you. DO NOT HIRE THIS LAWYER. They come across so nice and caring, then they rack up the fees.

Greg Wilcox was bizarre in the couple hours of consult I had with him for elder Medical planning. I saw this amazing CV and a recommendation for him from another non bay area lawyer. But then - he seemed very confused about every background piece of info I gave him. He couldn't answer any of my questions that were novel. He only repeated information that I already knew from online sources or the same talking points that I think he lectures on. But he was unable to retain information or comprehend my specific circumstance or questions. I found this strange. And he was also weird in his interaction- rudely interrupting my attempts to answer questions, barking at me to stop talking all the sudden. I felt this was odd and a sign of some cognitive problem he was having. I can be sympathetic to that...but he should not be charging $450 an hour in that state. I told him- that I can't seem to get my main questions asked and he told me to pay him more money.

When I first spoke with him over the phone I knew that he may not have been the right attorney and I should have listened to my instincts. In the end, he did not do in court what he said he was going to..say five minutes prior to the commencement as well as did not file motions he said that he had. In the end, I believe he is a great part of the reason for the outcome of my case and a formal complaint will be filed shortly against him. I'd advise anyone looking into him for representation to look elsewhere. There are many other excellent attorneys that will follow through with what is discussed in person. Good luck!

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
