I had interviewed several attorney's that were referred to me, and I selected Chris for his candor and thoughtfulness. Chris and his staff were always responsive to my inquiries and their resourcefulness led to a very positive outcome for estate settlement issue I was dealing with. Chris is an outstanding attorney and successfully defended my rights against a strongly adversarial counterparty.

Ryan Casson recently drafted a trust and will for my family. He was friendly, very knowledgeable, and he explained things in a way that was easily understandable. He is very detail-oriented and left no task undone. This was our first time having a will/trust drafted and he made the process easy. I’m an attorney myself so I know what to look for when hiring a lawyer. Ryan is the real deal.

We are very happy with our estate plan created by Ryan Casson! Ryan helped us navigate the issues we knew about, but more importantly helped us identify and address several problematic scenarios we hadn't even thought of. We appreciated his knowledge of both tax and elder law as both became important for our planning. Ryan was easy to discuss issues with, and took the time to really understand our needs. We never felt rushed or embarrassed to ask him questions, and he was great at listening to our concerns. We feel confident that our plan is right for us as his attention to detail and obvious care to make sure we understood all issues removed any doubt. We can highly recommend Ryan to anyone who wants a comprehensive estate plan that covers all the bases.

Divorcing a narcissist is extremely hard, especially in a high conflict divorce and when attorneys smell assets and money. Prior to retaining Ms. Niedens, I had worked with 4 attorneys. Unfortunately, I did not feel like I had proper guidance and/or tangible representation with any of them. I felt as I was just a milking cow for all attorneys. I also felt oppressed and that there is no fairness for men in California. My first attorney was horrible and not trustworthy. The second was unable to handle my ex’s attorney who is aggressive and used unethical tactics. The third wanted me to, simply, bend over and give up on everything, and the fourth was too busy with many other cases - nothing was done other than billing me for communicating my ex’s demands. My divorce was lengthy, toxic, and very expensive. Backward 9 years ago, when I initiated my divorce, I contacted numerous law offices including Ms. Niedens office. Even though my intuition and gut instincts were telling me to retain Ms. Niedens, I went with the shiny attorneys who have glowing reviews and prestigious offices thinking they would provide the best legal representation for me. THAT WAS THE BIGGEST MISTAKE I MADE WHICH I WILL ALWAYS REGRET. After years of being milked by the attorneys and my ex with no results, I decided to go with my initial gut feeling…I went back to Ms. Niedens begging her to take my case. After accepting my case, Ms. Niedens developed a legal strategy and explained it to me in a simple way. Shortly thereafter, I started hearing the hits on the big drum. I started seeing results. For the first time in years, I felt that justice and fairness can be accomplished in California. I felt that my best interests and legal rights are being supported and protected. I now realize that justice comes with evidence and the ability of the attorney to know the law and provide zealous representation. During my journey with Ms. Niedens, she acted like a navigator who drove while reading the map. She knew exactly when it was better to take the bus instead of the bike. Now that my case is into closure, I can confidently attest to her skills, knowledge, and expertise. Ms. Niedens is a highly competent attorney, and most importantly, extremely knowledgeable, and very professional. She is sincere, confidant, sharp, truly genuine, fair, and tough. She knows the system very well and is highly respected by the court. I am very impressed with her attention to details, deep knowledge of every detail of my very long case, and her ability to think outside the box. I will always be deeply grateful to her and her team (Mallory and Justine) for the outstanding support they provided and still providing to me. I highly recommend Ms. Niedens and her team. They are the BEST. A five plus stars review is not enough compares to the outstanding results and support they provided to me.

After that seemed to go almost nowhere, we consulted with Marsha Niedens and she explained to us all things wrong thus far with our case. We started from scratch utilizing her services and after a lengthy battle, we gained peace in our household. Highly recommended family law attorney.

I filed for divorce by myself and for years attempted to navigate the court system myself through the divorce and subsequent custody battle with the help of the self-help services at the courthouse. Finally after being beyond frustrated with my ex's continued delay and manipulation I hired Marsha to represent me. She not only secured a great custody plan, but came back again this year to keep it in place. She is prompt in her response, always available via phone or email, and so caring. She's wonderful to talk to, she really gets it and her attention to detail is amazing. I truly don't know how I ever tried to deal with all of this on my own. I feel so much better knowing that I have someone that not only knows the language but is also a human who understands the impact of all of this on my children. I won't step in to the courtroom without her again. Don't waste your time thinking that you can handle your case on your own. I lost weeks and months of my life trying to learn the court language and defend myself without the proper representation. I would recommend her to anyone needing help with divorce, custody or child support.

I was referred to Gold Law, a Professional Law Corporation in 2013 when I was made a Co-Trustee of a friend's trust. My friends Children lived in South America so it was necessary to have someone in California as part of the trust. In my first meeting at The Gold Law Office I was introduced to Marissa Garcia who would be the trust attorney. Marissa collected all the information for the trust and I was immediately at ease with how she handled everything. She knew exactly what to do in the correct sequence even though she was dealing with me here in California and my friend's son in South America; where laws differ and that was no problem for her. Within less than one year that trust was closed. In 2015 my sister passed away and I was the Successor Trustee for her trust. I knew immediately that I would go to Marissa to be the trust attorney. This trust is much more complex than the first trust she was involved in. Again Marissa knew everything that needed to be done and in what order. Marissa has been very patient with me through all of this and has kept me informed of everything. None of my questions are a problem for her to answer and to explain. Marissa is a very professional attorney and also a very caring person. She has always been there for me and is never too busy to listen to me on my bad days as I find myself with no immediate family left. I know that we will remain friends even after this trust has come to a close.

Guy Bayley is an excellent attorney who gave me solid advice during a consultation that worked out in my favor. He was available to me by text or call to answer any questions I had and help guide me along the way as I worked towards a resolution with my previous landlord. Guy was very honest & upfront & gave me a blueprint on how to resolve my issue on my own & then if it didn’t work, he would step in on my behalf. He is sincere & not just out for the money as I only got a consultation. I ended up following his advice & it all worked out in my favor without having to go to court, retain an attorney, plus the resolution that I ended up agreeing to was almost triple what I initially requested for the troubles the management company caused. I highly recommend Guy Bayley.

My family and I hired Terry to administer my dad & mom's A/B trust after his death. She also helped to dissolve a Family Limited Partnership he had created. All of this was followed up with a new will and trust for my mom. Later, things needed changing as my mom's capacity declined. Terry supported us through that, legally and as a trusted friend and advisor. Everything was done as fast as we needed and was appropriate to our needs. Terry has handled sensitive issues with aplomb, where circumstances could have caused a very volatile situation or a rift in the family. I have complete trust that Terry will solve our problems in her usual no-nonsense manner, but with extreme diplomacy. Terry is very easy to reach either by phone or email, which she replies to quickly. Even if I have an issue that is non E&T, she can generally advise me or point me in the right direction. I would consider her our family attorney now, since 2008. She remembers me and details about me and my family, including the dynamics. Terry looks to me like she's about in her 50s, and if you saw her in the grocery store you wouldn't think, "There's an attorney..." It's likely she'll greet you wearing slacks and a camp-shirt with a pull-over sweater and loafers. Frankly, I appreciate that all her fees aren't going into Ralph Lauren suits and Gucci pumps :-) Her demeanor is very practical and she will talk loud enough that your grandma can hear her. She has had the same admin / paralegal for quite some time. I mention this because retention indicates that she's easy to work with and non-drama. BTW, her admin is more than a gate keeper. She will remember you and will be familiar with your matter. You couldn't pick a more caring and conscientious attorney. BTW, I have worked with several attorneys in the past and can say, Terry does not nickel and dime you, and her rates are lower than average for the area. I've had attorneys burn through a retainer with 10 minutes here and there to "read and evaluate" an email or answer the phone. In other words, you get value for what you pay with Terry's law office.

My family recently required legal assistance and sought guidance from Ms. McConville. We found her to be extremely responsive, accessible, and also passionate about resolving our legal issue. I found the passion extremely refreshing as I have used legal services in the past, and have never previously experienced that behavior in a lawyer. Ms. McConville expressed genuine concern for our issue and took immediate steps that one wouldn’t ordinarily expect. She was extremely engaged in resolving our problem, and in just a few days had us on the right path. This is not your normal attorney; she delivers gold plated service, receives a five star rating, and gets two thumbs up!!

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
