Alyson has helped me, and our family, with several (diverse) estate, will, and elder-care matters and she's been wonderful in every respect. Alyson is knowledgeable, responsive, thorough, caring, principled, and wholly dedicated to her client's best outcomes. You could not possibly find a better advocate for your needs, or the needs of a loved-one.

Due to the untimely death of one relative, I was thrust into a dual position of Estate Administrator and Conservator of an elderly second relative. Since this situation was all new to me I had to rely extensively on legal guidance. Attorney Alyson Marcuccio was exemplary in this regard. The situation with my relatives was somewhat complicated due to property title issues, asset identification, and interaction with the State over prior services provided by them to my deceased relative. Atty Marcuccio's knowledge of these issues was extensive and made what appeared to be a daunting task more than manageable. Furthermore, she was always available to be contacted either by phone or email and promptly and courteously returned messages. All required paperwork was promptly prepared and filed. Therefore, I wholeheartedly recommend the legal services of Attorney Alyson Marcuccio for any issue regarding Estate Planning or Probate.

Alyson is the best thing that could have happen to us in dealing with my minor son's estate. She has gone above and beyond my expectations. She has stood up for not just for my son's rights but also for mine as the natural guardian (mother). She has dealt with all aspects of this mess with the highest respect and regard. She is not in this for the money for she truly cares for the standings of a minor child. She has been on our case for almost three years and will continue to be to the end. My 13 year old son has been involved with what has been going on and one day after I got off the phone with Alyson my son said to me that he could not believe that someone like Alyson would really care about him. That really is something coming from the mouth of a babe as the saying goes. My son and I have been truly blessed with having Alyson as our lawyer.

I am an attorney that has been on the opposite side of a litigation matter with Attorney Kelleher. I was very impressed with his knowledge, and the respectful and professional way he worked with me to resolve the matter. I have found myself as executor in a probate estate. It is not my area of expertise, but Attorney Kelleher has great knowledge and experience with probate matters. I did not hesitate to retain him as my attorney and it is the best decision I have made for the family and heirs of the deceased. I highly recommend Attorney Ed Kelleher.

I have been fortunate to have had legal advice and services from Jay for almost a decade now. Lawyers who build great, long relationships with their clients can be hard to find. Top that off with high responsiveness and professionalism, and we got ourselves a winning team. I call them for almost any legal issue I have! He has helped me with real estate, healthcare, dealing with police, and contracts. He has all my trust and you should as well.

Kathy is an excellent attorney with great discernment. She handled a very tough family case for us. She was able to interview the many parties involved family and non family members, as well as other professionals involved. She had clarity on each individual in a short amount of time and was 100% accurate in her assessment of all. Kathy is kind, responsible, insightful, compassionate and has integrity; is always willing to lend an ear and invaluable advice. She will always do what is right, of that I have no doubt. I highly recommend Kathy.

Fred Baker was amazing. I wanted to dispute the appointment of the executor of my father's estate. Since I've half a country away, I used AVVO to find a lawyer in CT. Before the hearing, Mr. Baker listened to my story, talked to my siblings and collected all the history and then sat down with me to explain all the legal details involved. He was candid that deputing a will is an uphill battle and having the executor removed was almost impossible. But he gave me options and proposed practice compromises. Then he explained court details that I could never have known which gave me the confidence to face the judge and other attorneys. During the hearing he negotiated with the other attorneys using tactics that I never have would have imagined. I wasn't asking to change the the dispersal of the will, but the nominated executor and estate lawyer were being ruthless and unflinching. Fred Baker used reason, suggesting a simple compromise, and when that didn't work he utilized every other option available. He scared the life out of my opponent, threatening them with long delays and huge expenses until I got the result I needed. Despite everyone warning me it would be outrageously expensive, Mr. Baker he did it for a very reasonable fee. We only me once, since I had to travel across the country for the hearing, but I was very impressed with his performance and him as a person.

Attorney Fay has been helping me navigate the family court system for over 6 years now. I have stayed with Attorney Fay for this long because she is honest, ethical and direct. My custody dispute has been very challenging but Attorney Fay has never missed a court hearing/appearance/status conference, etc and there have been many in 6 years. Her command of the details of my case is truly impressive. She is also honest about what she is capable of helping with and what to expect at court. I have never felt mislead or disappointed by her guidance. And I appreciate how fair she is with her billing; it has allowed me to continue to fight for my child's best interest without going bankrupt in the process. I cannot say enough about what a true professional Attorney Fay is. If you are in need of an attorney who will be committed to your case not matter how difficult or challenging the other party is, I highly recommend Attorney Fay.

Brian is terrific. Highly recommend. Only those with unreasonable expectations believe that simply getting a "paid" lawyer is the end all be all of judicial magic and that everything will come up roses. Sometimes you have to lay in the bed you've made, but I guarantee it will be a bit fluffier if you use Brian for your defense. If he can get you kicked loose he will. I appreciate all he helped me with.

Brian Romano helped me with a situation I had little to no knowledge on. I reached out to many lawyers on the subject and he was recommended to me by a Friends father. I was hesitant with other lawyers and once I spoke to Brian. I felt instantly ready to move forward. Everything he told me happened and anything that he was unsure on Brian found out same hour. He truly helped me in moment I wasn’t confident taking on. He saved me money throughout the process and overall I came out on top. I cannot thank Brian and his team enough. Always there for me if anything pops up in the mail as well. Pick Brian for your needs!

I have never met more incompetent people in my life. This office continually changed pricing on us through the closing process. Then we get a call a month and a half later stating that we owe extra money for taxes. Clearly they were just too lazy to check on what the taxes would actually be, and based it off of old numbers. So we sent them the check they asked for, and then i get a letter a week later stating I have to send the money to the town of New Milford now. The people Joe has working for him are absolutely incompetent, and its a JOKE. With so many real estate attorneys around I would use ANYONE else, and I fully plan to use someone else next time!

I was referred to Joseph Saffi when I purchased a home in Connecticut. I was advised he is the go-to guy for real estate in this area. We were involved in several deals which, for one reason or another did not go through. Joe was very helpful in tracking down information necessary to pursue all deals. He even asked some informative questions about a property we had put a bid in on which later had me realize I was getting into a bad deal. When we finally closed on our house, Joe was timely and professional, and very reasonably priced for all the work he did. Highly recommended.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
