Kristin has been our attorney through one of the nastiest custody battles, which had been ongoing for about 3 years. She is incredibly perceptive and thorough in her representation. She answers our questions thoroughly and goes to battle for her clients. Many people look for a "bulldog" attorney and Kristin is a nothing short of that. I consistently recommend her to anyone looking for a family attorney in the Twin Cities area.

Kate up dated our wills, power of attorneys and health care directives. She was very easy to communicate with and we were comfortable to ask her anything! It was a seamless process and her fee was very fair. I would recommend her to anybody. You will not be disappointed!

Kate worked with my mother in the last years of my parents’ lives to set up a living trust for her, assist her with the heavy paperwork burden that was involved in moving my father into the Minnesota Veterans home, comforted me in my grief for them when they passed, and was extremely knowledgeable and efficient in selling my parents’ house and administering their estate. I am now working with her to get my own affairs in order, and I highly recommend her.

We came to work with Kate after a less than satisfactory encounter with another lawyer at her previous firm. That first meeting with Kate made us feel completely comfortable and we quickly forgot about the previous concerns. She was quick to satisfy our needs with nothing but grace and a smiling face. Our working together became a collaboration and we got our needs met in every way. I have since been able to get answers via email or a fast call for anything I have needed. We are so satisfied with Kate that we are following her to her own private practice and excited to continue our family legal needs for years to come.

I worked with Naften for 10 years- he was a mentor that I would go to and ask questions when I didn't know the answer - he always knew the answer. He's top rate, the type of intelligent, hardworking, detail oriented attorney you want working on your transactions.

Family Law - Child Custody - DV Advocate Dedication, accuracy, knowledge and support. As a strong advocate myself for my children in an extremely in-depth and difficult situation, Ms. Jessica Kim took on a lot and walked me through it all with ease. I've had so many questions, and she was always there. The turnaround time was impeccable. I was in absolute shock with this type of dedication and accurate information provided which made our situation less stressful. Jessica isn't doing this as a "job" rather, a career of making sure her clients and their children are well represented to ensure their safety and well-being, as well as everything in between. Ms. Kim shows a great amount of knowledge and integrity as she works with her clients' personal situation and I can not thank her enough for representing my children and myself. Jessica - Your firm has been a turning point in our lives in every single way while taking into consideration the financial burden one could possibly encounter during these difficult situations. I would (and will continue to) recommend your firm to anyone walking in my shoes. Your heart and soul is in your career, and you're doing this for us that need and rely on someone like you for guidance and support. Again, I appreciate your assistance in everything you do. It does not go unnoticed. Thank you again.

Ms. Oney is a consummate professional and excellent attorney and advocate. I have had a lot of experience with family law attorneys and can say without hesitation, that Julie is the best I have ever dealt with. She is thorough. She knows the law. She can give case law. Further, she genuinely seems to care, without being overly emotional – which is how it should be. I was, and continue to be, very pleased with the outcome of my case. There was never an incident wherein I wasn’t impressed with her responses, strategy, or knowledge. She handled a Stipulation and Order for me – which came after an unfortunate Judgment and Decree. My only regret is not finding her earlier to handle my initial Custody proceedings. If you are looking for an advocate and attorney that will do an amazing job…look no further – Julie Oney is the one you need! UPDATE/ADDITION: Had to use Julie again for a Child Support matter and cannot say enough positive about her and her masterful handling of my matter - she stayed the course and made sure things were done in a way that was far beyond what I could have asked or imagined!

Tells clients to do illegal things in divorce. His knowledge on divorce is very limited. He is extremely cunning and manipulative, as if you don't do what he tells you he will drop you as a client. He trespasses on the other clients property and thinks it's fine as he is learning info about the other subject. He had lied in his affidavit months judge about the divorce. Stay far away from this unexpirenced lawyer. He will only bring trouble to you. Also, he rips you out of all your money, somethings were even charged twice on the bill.

We had the pleasure of working with Joseph Flanders. My husband recently has been diagnosed with PTSD. He had not worked in almost a year. We were trying to get me on my husbands IRA account so I could get money out of his IRA He was not able to answer simple security questions to take money out to pay off some bills. His Financial Institution said we needed to make me his guardian. Which he did not need. I reached out to Joe to see if he could help us. He agreed and we are so glad he did. He was very compassionate about our situation and bothered that they were not allowing this. He said a Judge would not sign off on a Conservertorship because my husband did not need one. He suggested making me his POA. That didnt work. He kept at them. He kept telling us I am not giving up! His hard work and determination paid off. Thanks to Joe we will not lose our house and are able to pay off bills that accumulated during this time. He actually cares about his clients. Thanks Joe!

I have legal insurance through work and this lawyer was on my list to call. I called about a case that is very intense and I have no idea how to navigate it. I was upset at the other paryties' actions and was trying to explain what happened. I was trying to learn what to do and if he could help. He told me these cases can get messy and implied he didn't want to deal with it. Then he told me like others above, " I don't think I want to work with you". I WAS SHOCKED!!! Why? What did I do! Was I intense, YES. Was it directed at him, NO. We are talking about my son, of course I was worked up, anyone would be!!! I don't think I would ever want to work with a lawyer like that, or recommend anyone waste their time even calling Joe. No I never used him or was never a client of his. Thank goodness, I'd be worried about my case with a lawyer that can't even handle listening to the details of the case. How would he deal with court and the judge or other attorney coming at him?

Joe helped me with my estate plan, and also some title work. He was very responsive to my initial inquiry and was very helpful when I met with him. In addition he was very knowledgable about the law and provided information about estate planning that I didn't know, which was really helpful. I feel very confident in my plan and feel better knowing there will be no questions about my estate if I were to pass away. I would recommend Joe to anyone looking for a great attorney.

The tender years doctrine is a legal principle in family law since the late 19th century. In common law, it presumes that during a child's "tender" years (generally regarded as the age of four and under), the mother should have custody of the child. The doctrine often arises in divorce proceedings.

I was so thankful for all of Jim's guidance while I was going through my divorce and he helped me get what was best for my two young daughters. He played so many roles for me besides being "just" an excellent attorney. He was a friend, a counselor, a father figure, a therapist and always a gentlemen to all parties involved. Jim was somehow able to keep my stress level under control through this extremely difficult time in my life. A great attorney, a great man.

Sadly, I've had to deal with my ex for the past 10yrs for various issues having to do with our child, but THANK GOODNESS Jim has been my attorney the whole time! It has been extremely stressful throughout the years and continues to be (YEP he is STILL representing me), but when it comes to knowledge, kindness, understanding and heart he has it all and has been there for me every step of the way. Anytime I doubted his advice or what an outcome may be in court (due to my "worry wart" personality) - I've ALWAYS been proven wrong! He has always been spot on with what he has told me, whether in my favor or not. I have complete faith in him. I've referred 3 people to him (2 of them family members). I was referred 10+ years ago by a co-worker who said he was the BEST! I haven't looked back since. I can only speak on the family matters he has assisted me with (child parenting time, child support, etc.... ) but I most definitely would recommend him to anyone & everyone!

As sad and stressful as divorces are, you expect to hire an attorney who is trustworthy and will do whatever it takes to defend you rightfully. James Lofstrom, however, did not fulfill this for me. He messed up paperwork several times, costing me more money and delaying the inevitable, my divorce. After he finally got the paperwork corrected with the courts (three times total), my divorce was finally overwith. He did not follow through with things I requested him to do, which left me with nothing that I had "won" in the divorce. I lost all of my childhood memorabilia because he did not file papers demanding the items be returned. The only thing Mr. Loftstrom was good at was sending an overpriced bill.

I hired Andrew Moran through a friend who had had a good experience with him. The good points: He is very good at responding to questions, e-mails, voicemails, and knows the law. The bad points: My case was difficult, and instead of trying to find a way to represent me fairly, he came out and said that the opposing counsel was going to win and while he didn't outright say it, he made statements that made it appear like he was biased and agreeing with the opposing counsel's side, and that I was wrong for wanting to defend myself in what was an uphill battle. I felt "sold out" and things got worse before they got better. I hired a different attorney who turned things around.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
