During difficult situations in life support and love from friends and family is crucial to growing forward positively. It is even more crucial to have someone outside of the situation who has the knowledge and compassion to give it to you straight! I was fortunate to find an exceptional attorney with a wide knowledge base, resources to uncover the unknown, empathy and tenacity to deliver eminent legal representation.

This attorney was empathetic to my situation and had my best interests at heart. Even though she could have earned much more by playing on my desire to prove I have been wronged- she instead helped me weigh the risks and benefits so I cold make an informed choice. I would recommend Attorney Stroud to anyone seeking authentic council.

We had been receiving threatening letters from the IRS for several years. The notices were frightening enough, but the threats to confiscate property and bank accounts kept us awake at nights. We were 3 years behind on both our private business and our personal taxes. We desperately needed somebody to help us sort it all out. The amount of money we owed seemed overwhelming and we didn't know where or who to turn to for help. The idea of picking up the phone and calling the IRS was terrifying. We located Kevin Sayed from a google search and from the very first point of contact, he took the ball and ran with it. Along with offering us reassurances, he was able to wade through our pile of documents and get the taxes filed for all of the missing years - for both personal and business. He immediately contacted the IRS for us - at both the Federal and State levels. Because we had made a major move within the last few years, our returns involved filing within several states. Kevin and his staff handled it all with ease. Best of all, Kevin negotiated with the Federal and State tax officials and developed a reasonable monthly payment plan for us. During the process, Kevin was very quick to respond to all of our inquiries and kept us informed every step of the way. We plan on using Kevin whenever we need our taxes handled. He is professional, efficient, reassuring and takes control quickly of difficult situations. On top of that, he has a sense of humor (difficult to find with a lawyer, ha!). If you're in tax trouble with the IRS and don't know who to go to - we highly recommend Kevin Sayed. We are finally back to getting a good nights sleep and can live with the agreements Kevin worked out for us. Thank you so much, Kevin!!

My husband & I contacted Kevin's firm after a surprise levy from the state DOR left our bank acct with a $0 balance. From the moment Kevin got on the phone I felt instantly at peace. He was calm, understanding, downright funny at times (helped to break the tension!), and really knew his stuff. I was frantic when I made the call and by the time I was done talking with Kevin I felt like all was right with the world! Meeting with him was just the same. He had answers to all my questions, was a complete straight-shooter (no beating around the bush or placating from this guy!), and managed to help us out with a back tax problem that has haunted us for 6 years! By the time Kevin got done playing phone tag with the state DOR, we had a feasible payment plan in place, the levy lifted from our bank account, and a promise that they would leave us alone as long as we held up our end of the bargain! YES! He did such a great job with my husband's state back tax problem that we've even retained him to work on my husband's IRS back tax problem now! He's THAT good! On top of being a great lawyer, he's incredibly caring- even following up and asking if my husband was feeling better (he had the flu). He's also really quick on turnaround time. I've never called that he wasn't available and he is so quick on email it's ridiculous! I appreciated that he was so honest with me, like letting me know that stuff I was attempting to do myself (i.e. bargaining with the IRS) would have completely not worked because I didn't have all the pieces in place to do so effectively. Once he showed me the parts I was missing, I realized I wouldn't have been effective at all- thank goodness he's there to pick up my slack! Kevin truly is a miracle worker and I would recommend him to the highest degree. I felt like we were never going to be able to get out from under the spectre of these taxing authorities and with his help I finally see the light at the end of the tunnel. If you need help with taxation issues, he's your man!

I sought legal guidance from Cathy Thompson regarding my rights and responsibilities as related to marital separation. I found her to be very knowledgable of the pertinent state laws, and helpful in providing guidance for potential options available for my consideration. She demonstrated an ability to listen carefully, and to respond with clarifying comments and questions. This enabled me to have needed objectivity and focus, while feeling respected.

As others have said, be wary of doing business with this law firm if you're selling your home. They insisted that we come to the office and sit down to sign documents that easily could've been electronically signed, which was fine.. but then they told us AFTER signing that they will no longer electronically wire funds due to "wire fraud".. um, sure. They gave us the option of having the check mailed to us, which would arrive 4-5 days after closing, or paying $30 to have it overnighted. Since $30 is outrageous for an envelope, we requested it be mailed to our new address and verified that they had it correctly listed. After two weeks passed and we did not receive the check, we reached out to the firm. When we finally connected with the office, the woman we spoke with was rude and said that if we needed the money so bad, we should've spent the $30 to overnight it. WOW. Eventually she said she would speak with the attorney. When she called us back later that day, she said the check had been returned to their office because she'd put the wrong zip code. She said they would overnight it, and we FINALLY got it... for a completely different amount then stated on our paperwork. When we called back, we were told the amount was different because of yet another error they made on their end. To make a long story short, legal fees are not cheap and you shouldn't waste your time with one that is a) not going to treat you with respect and b) not capable of being thorough and complete with sensitive financial documents. I understand that we are all human and make mistakes, but being proactive and kind can go a long way.

If you are considering seeking legal representation from attorney Mr. Dupree, please be extremely cautious. He has a history of inappropriate physical contact and sending sexually explicit messages to female clients. I personally experienced this behavior on four separate occasions while in his office. During my final visit, I felt compelled to bring my adult son for protection, as Mr. Dupree had previously touched me inappropriately as I was leaving his office. Mr. Dupree took advantage of my vulnerability and desperate need for legal assistance. He knew I had limited options and used that to his advantage. After the fourth incident, I terminated his services. No amount of compensation could justify the continued abuse I was subjected to. He finally returned my fees after I publicly exposed his behavior on my Facebook page, "End Corruption in Harnett County." I have sent Mr. Dupree a demand before filing a civil suit. I refuse to allow him to victimize other women. If you have also been a victim of Mr. Dupree's misconduct, please reach out to me. You are not alone, one other has come forward, we must hold him accountable. The NC Bar has failed to take action, so I am taking matters into my own hands so he will think about his egregious behavior before he decides to inappropriately touch another client for his disturbing pleasure.

I would recommend hiring anyone other than David Silver to handle an estate/probate. Apparently, this is his specialty, but we found him to be non-responsive, insulting and incompetent. After many frustrating months of dealing with him (two weeks while he was on vacation), we have had to extend probable for another 3 months because of his lack of follow-up for the notice of death in the newspaper. The important items that we actually needed him to take care of were never done and the things that he did do were grossly overcharged. Now, at the time when we actually needed him to work and close out the estate, he has "fired" us and left us without an attorney. During this difficult time, we were hoping for someone we could rely on and handle things for us, and instead we have been left frustrated, angry and disappointed and in a worse position than we were in nearly 5 month ago.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
