I'm not even sure where to start. There aren't many people that are experts in probate/estate law. Nathan Krogh is however one of those people. I watched Nathan single-handedly tackled a complicated case for me and he did an amazing job. Which in the end meant a victory for me. From my perspective Nathan is a quintessential professional. He did everything right in my book. Not just law knowledge which seemed endless but his amazing ability to disassemble all the complicated pieces and explain it in simple terms that I could easily understand. He also has extensive experience in his field. Nathan did everything on time or before the deadline we agreed on. He picked up the phone when I called or called me right back if he wasn't in the office when I left a message. He answered all my emails in a timely manner PLUS he's a hockey player and a hockey dad. If ever I need professional probate/estate law assistance Nathan is the only place I'll go and I will recommend him to anyone that asks me. Vinny Heinz

Nathan Krogh, of Krogh Law Firm, P.A., is a great attorney! He is competent and attentive. He worked with us on setting up an LLC and purchase a commercial building. It was a complicated situation, but he made everything easy for us. His response time to our questions was incredible, and his fees are reasonable! Moving forward, we will be using Nathan for our real estate, probate, and estate planning. He has earned our trust!

We inherited real estate and had been told by a real estate agent, 2 different lawyers and an employee of a title company, that Probate Court would be necessary to transfer the property title. Frankly I was nervous! One of Nathan's expertise is in the area of real estate law, and with his knowledge of the law he is amazing. Nathan is a great listener, and he quickly assured us that probate would NOT be necessary. He then proceeded with examples (in lay terms) the next steps necessary for title and sale. Only a small percent of lawyers in Minnesota are Board Certified Real Property Law Specialists; we hired him, and he made our lives much easier. Without hesitation, we would definitely recommend Krogh Law Firm in Roseville, Minnesota.

John was very professional. He explained the process thoroughly and responded to my inquiries in a timely fashion. He has a great sense of humor which helped ease the process. His costs are not outrageous like some lawyers are as well! I’m very happy with my results and more happy that I’m divorced.

My case was a little different being that myself and my soon to be X had most items in our settlement already negotiated (we were planning on filing ourselves). Mr Guzik made sure that the spirit of this agreement was protected. If I had not had him represent me I would have left myself open to future problems beyond what I have agreed to today. Mr. Guzik's staff is very personable and professional and Brian (sorry Brian I did not catch your last name - my apologies) was sure to make sure any questions or contact that I needed with Mr. Guzik was handled appropriately and in a very timely fashion. This is a top notch operation.

My husband and I have been seeking for the right advice on our complicated and very disturbing case for the parenting time and the child support matter for my 11 year old son. The final order that we've received recently has quiet a few errors and an unexpected order from the judge for my summer parenting time with my son, that we both were extremely dismayed due to the time and enormous financial pressure imposed on us after a long and seemingly very biased procedures with the court. After talking to dozens of laywers including superlaywers in Minnesota, out of desperation, I looked at AVVO site one more time, and Mr. Whelpley caught my eyes with his 40 years of experiences in various fields of expertise. I called him hoping that he would be different from all the other laywers who gave me the same brief advice. Mr. Whelpley, not only gave us the entirely different approach from all other lawyers, but also was more than willling to listen to me and talk to me way longer than I usually expect from lawyers in general for an initial consulation. He did not push me timewise nor was reluctant to give me the poignant reality check on the judge(s) in a very calming way and on how I should proceed when facing a difficult situations with a judge. His advise was very wise, calming, and also very 'strategic'. His military background also helped us a lot due to the unique situation that we are in as a military family, which was completely ignored by the court. Mr. Whelpley was the only lawyer who was more than willing to listen to you and give you the new perspective on your case WITHOUT hurrying you to "finish-the-phone-call-and-hire-the-lawyer(me)-immediately-if-you-want-to-talk-more" kind of way. Especially if you are being pushed in time, feeling discriminated or going through any bias, Mr. Whepley is the one that you want to talk to and work with. HE IS DIFFERENT, WISE, and STRATEGIC.

Jim Whelpley is a very good Bankruptcy Attorney. It is definitely his calling! During the process of my filing Chapter 13 Bankruptcy, there was a point where I was feeling very sad and over-whelmed and I started to cry. Jim gave me a book to read that listed the names of people throughout history and their lives who had filed bankruptcy (many of these people were people we admire even today!). That book made me feel a lot better! I also appreciated Jim's sense of humor. He has kind of a dry sense of humor (sort of like Johnny Carson) which is very funny and very often helped to lighten the mood. Jim has definitely found his "niche" as a Bankruptcy Attorney, and I am grateful for his expertise in helping me find a peaceful life!

I was referred to Mr Dan Kufus for estate planning. Mr Kufus prepared the necessary documents exceptionally and in timely matter. Later, I felt the need of legal assistance due to my recently changed family matters in the summer of 2016. I consulted him about my recent needs in making modification to my child support payments and parental rights. Mr Kufus worked with me patiently while he was getting to know my hard headed personality. Mr. Kufus guided me through the legal system with positive results. I can confidently say, I wish I had met him earlier, especially during my divorce. That was the time I felt all alone when I was trying to save what was left from my marriage, My beloved children. When the odds were all against me and all that mattered to others was just money and materialistic values, I wish Mr. Kufus was beside me legally protecting and defending what was left from my family. He has been fair and just. I appreciate everything he has done for me. Contact him when you feel all alone in your legal battle in saving and defending what is left from your family. I know he will be there for you strong, fair and just.

Jane handled all of our estate documents including will, living will, healthcare directives, etc. This was in preparation for the guardianship of our son. We have also used her for some business advice. Everything was done professionally and she made sure to take time with us to ensure that we understood the information she was providing. If Jane doesn't have the exact information you need, she works very hard to get that information and explain it in terms that everyone can understand.

I would like to thank the Orchard Law Firm, PLLC for helping us settle our mother’s estate. I found them professional and easy to work with during the process. They were patient and professional with an heir that had unreasonable expectations, was uncooperative, consistently missed deadlines and would deviate from the will’s instructions. They had the heart of a teacher guiding this heir, explaining the laws relative to the will. Lastly, they did an excellent job cooperating with a law firm in South Dakota to manage a complex real estate transaction.

We can’t thank John Spiten enough for helping us through being T-boned by another driver. He responded to our call with a quick response and told us exactly what was going to occur. He answered all of our questions and put us at ease, no matter how trivial those questions were. We were able to focus on healing, knowing he was taking care of every detail. He worked hard and got us the settlement he thought we deserved. Thank you again John.

My uncle was being abused in a nursing home. Josh was honestly a gift. I can't imagine an attorney more skilled, effective or reasonable. He was always available. When I couldn't pay, he kept helping. He helped us in court. He helped fight him being dumped out by an assisted living. He won our medical assistance appeal. Josh was amazing to work with! If you need help, he is the only lawyer I'd call.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
