We are so impressed with the Jones Elder Law team and highly recommend them for anyone planning for their future. Steve Jones took the time to really get to know us and our vision, and then fully explained all trust, will, and health declaration options for us to choose from for our situation. They are a very knowledgeable team with a real passion for helping seniors protect their legacy.

My husband and I are extremely happy with our experience with Jones Elder Law. Stephen and his team walked us through every step of the setting up of our trusts and was always available and happy to answer any of our questions. We now have such a piece of mind knowing that everything is in place to protecting our assets. We also really like the pricing model that Jones Elder Law uses. All in all, a great experience! We highly recommend Jones Elder Law!!

I had to hire a family law attorney for a nasty custody battle I was in. Justin Winn at Grant, Miller & Smith LLC was fantastic. He was always quick to respond to me and Justin was always good about giving me feedback and helping to guide me in the right direction. This was the toughest thing I have ever had to go through but my attorney was always there help keep me calm about my situation, he stood up for me and got a good outcome. Justin worked hard to keep this case from going to trial. Justin and the law firm are very respectful and professional! Some of the best attorneys and staff I have dealt with!

I live out of state and needed an attorney to help settle a relative's estate who had lived and passed away in St. Louis. I had called several attorneys asking rates, availability, and how to get some important information I needed. While the other attorneys simple quoted rates and told me to call back - when I asked Mr. Moore if he could find out some information - I could hear him immediately typing into his computer. I was astounded at how quickly and how thoroughly he researched. He gave me more information in a half an hour - than I had found in over two weeks calling different entities. Mr. Moore thoroughly understands estate law - plus, he's very sharp. The best part though, is that I felt that he had my back. He was diligent, enthusiastic and quick with the answers I needed. It was so refreshing to work with an attorney who was truly working on my behalf. I actually looked forward to talking to him because of his helpfulness. If I lived in Missouri I would absolutely hire him to do all my estate planning. I wholeheartedly recommend Mr. Moore.

Mr. Charles Moore was exactly what a probate lawyer should be, and I’m grateful for him and his services. He spoke to me as a human being, not just a voice over the phone. I was already nervous to speak about things, things I really didn’t know about, and he explained everything to me with easy and concern. I trust Charles Moore, especially during a difficult time. I feel like I’m in good hands, so grateful. Thank you for being professional, and honest.

Mr. Moore made my estate planning a very simple process. I had put it off for a very long time thinking it would be complicated and quite frankly "not a fun thing to do". I appreciate his knowledge and individual assessment of my personal wants and needs for my families future. I encourage you to give him a call.

I recently contacted the firm about a custody modification and was pleasantly surprised by Erika's personality. She was knowledgeable about legal matters, but she didn't talk to me like I was an idiot when I asked questions (and I had plenty of them lol). I met with a different lawyer (not at this firm) prior to speaking with Erika, and I originally planned to work with him. A friend convinced me to call Flesner Wentzel instead because she felt like the first lawyer would not truly fight for my kids in the courtroom. I'm glad I listened to her. The prices for custody matters are very reasonable, and you can do a monthly payment plan. I'm a single parent, so knowing I can afford court without falling behind on other bills gives me peace of mind. I plan to hire this firm to represent me in the near future.

I had the extreme good fortune to have Erika Wentzel as my lawyer. I was going up against a New York stock exchange company that owns Plaza Mercedes West and knew it would be a tough fight against the big dog. Erika is very knowledgeable, prepared, and just overall excellent that I knew (and told her often) that no matter how it turned out she did the best job she could for me. I can not say enough great things about Erika. You are in great hands with Erika and her law firm. I strongly recommend Erika Wentzel and the Flesner Wentzel law firm of St. Charles, MO!!!!

My ex and I worked out an agreement for an uncontested divorce and we both wanted to make sure our divorce was finalized as soon as possible. Erika was able to get our divorce filed quickly and had the judgment signed on the 31st day after filing (the soonest it could legally be finalized). She has also drafted and reviewed several business contracts for me. She always makes helpful suggestions for amendments or additions. I am very happy with the services I have received.

I found Joe to be very condescending and dismissive. I was very clear on the simple things I wanted from the divorce which he completely ignored and did not represent for me at all. My estranged was in contempt of court on at least 2 occasions & although I paid to have that followed up there was nothing that ended up happening as Joe said the judge will just take care of it at my divorce hearing. That was today and everything has been put off till March. I was warned this would happen-drags everything out and exhausts people and their finances. Joe does not communicate enough beforehand, does not establish expectations, does not explain things in a simple matter, and you have to know what to ask in order to even get dialogue started and he still dodges some questions or even goes silent. I found him to be completely frustrating, even though I tried to maintain composure in the beginning and do as he instructed. I wish I had had the time and finances to hire someone else. When I asked why he doesn’t seem to advocate or follow up very well for me he said, “I have paying clients“ this did not make sense because I had paid everything he asked up to that point. Then he started saying in order to do some of the follow up that was required from what we had already initiated and I had paid I found Joe to be very condescending and dismissive. Jack was recommended by a family member for our custody case. Warm and compassionate on our first meeting but that will never make up for how the case progressed and the fallout of his behavior. Jack would promise a draft or response and then go radio silent for weeks when we needed to act swiftly. Many times over he would send a draft and we would reply with edits only for him to completely ignore the edits, over and over again. He showed up to court disheveled, profusely sweating, unkempt. He lied directly to our faces about what was said in chambers with the judge. He submitted a petition to the court with all of the wrong edits and affixed our signature to it. He lied over and over about submitting said petition, allowing the opposing party to file for custody first. We submitted a formal complaint to the state against him and he was found to have violated the rules of professional conduct. I could not be less satisfied in his professional capacity.

Highly disappointed. Had worked successfully with Jack on a case the end of 2018, beginning of 2019. Tried to work with him again in 2020 and it's been an utterly disappointing nightmare. I'm out a lot of precious time and money and have nothing to show for it. He never filed the paperwork with the court that we met several different times to fill out, but he still hasn't filed it over a year later, and certainly not for lack of trying and following up on my part. He finally just stopped taking my calls and responding to messages. Words cannot convey my disappointment.

The legal assistant, Holly, for John Fuchs is incredibly rude. I called to inquire a case I had submitted, she told me it’s “impossible we call every client…” I stated that is exactly why I was calling, to follow up and save her precious time. She also proceeded to sigh heavily on the phone while I was talking. I was polite, never angry. Maybe coach Holly on how to be nice to clients and proper phone etiquette.

Mr. Weeks was supposed to be the expert in estate planning and elder care, which is why we went to him for the will, trust and other elder issues. He was not at first helpful; he ran through everything and didn't seem to want to spend the time to explain anything. We finally told him we found him less than helpful, and then he was a little better. He never gave advice about medicare and nursing home issues, and he promised to look into the veteran benefits, but never did. We truly felt he wasn't interested in us. We felt we got a decent product, but that it was not necessarily taylored to our concerns. We recommend him only because he is the only one in the St. Charles area that is supposed to be certified in elder care issues.

The state provided my parent with an attorney, and although we met with this attorney and Weeks to discuss the issues, the scheduled meeting with ALL parties never occurred. When we pressed Mr. Weeks about rescheduling the conference, he said that we could meet, but it would cost us thousands of more dollars to continue. We were left helpless when we needed it most, and the abuse continues.

I first called Terry Kaufman after receiving an advertisement for him, as an attorney in mail. I called for free consultation with Terry Kaufman. He told me pro, cons & basicly anything he thought I would want. I was convinced to hire him & paid half money upfront. After 2 week Terry Kaufman sends a letter in mail, before my 1st court date, stating what proscutor agreed on & stating if I don't accept he wasn't able go further with case. The plea agreement would be ridiculous for me to accept so I didn't accept. Terry Kaufman took all money I paid upfront for what I feel he didn't deserve as we hadn't even went to court. I feel if your a good lawyer or attorney than you fight for your client. Terry Kaufman refused to send me any detail receipt for what my money was used on. Please don't hire him.

I found Terry in a Google search. We met for a free consultation (he'll also answer questions for free also) and was impressed. The reasonable retainer fees allowed us to take our cases to court and have both convictions reduced. You'll pay higher retainer fees with other local attorneys and probably be disappointed. He'll make recommendations at no cost if it is outside of his scope of expertise. I highly recommend Terry.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
