I am a 26 year old male that went for and won full custody of my daughter. Not an easy thing to do, especially here in Georgia. I had been fighting for five years and went through four other attorneys to represent my case before hiring Megan. I lost a lot of money and went full circle with no positive results. For my daughters safety giving up was not an option. I saw an add of facebook that read "fathers have rights too." I called Megan's firm and sat down for a consultation the next day. I hired her on the spot. I could tell she genuinely cared about my case and for my daughter whom she had never met. Ill never forget when she looked me in the eyes and said "we are going to get your daughter out of there." It wasnt but a couple weeks later we had an emergency hearing and won. My daughter was finally safe. We stayed in consant contact preparing for the final hearing and won again with ease. This was over a year ago. To this day Megan and I still communicate on a weekly basis regarding my case and future posibilities of my wife adopting my daughter. Without Megan I would still be living in constant fear for my daughters life and well being. She is very knowledgable, responsive, and caring. I could not reccomened anyone else on a higher level than Megan McClinton.

I was drawn to Samantha after hearing from a close friend (who was also going through a divorce) about how amazing her attorney was. So I asked for her info and I don't think that I could have made a better choice! It had been an uphill battle with my ex on everything and when I brought Samantha into the mix, I have to say, she showed up ready to work! Extremely detail oriented, aggressive (but not overly so) and an extremely smart attorney. I explained my situation to her and like that I had a powerhouse in my corner! She was crazy quick with getting back to me with all of my concerns (no matter how neurotic I got) and was constantly there for me. I have to say, while in mediation with my ex-husband (4 hours in) I was getting tired. But Samantha was there by my side making sure nothing slipped by. She was realistic and aggressive in the court room, and when my ex was on the stand she didn't pull any punches, nothing cheap, just professionally showed the court what I had been dealing with for too long. I left my experience with Samantha getting the child support that I felt my children and I deserved as well with an outstanding alimony to get me back on my feet after HE bamboozled me off them. DO YOURSELF A FAVOR if you're in unfortunate circumstances and GET SAMANTHA in your corner as soon as possible!

Bill was kind and understanding of my limitations, and worked within my limitations to get things done. He does not put on airs or arrogance. He is an ex-Veteran (Army)...and down to earth. He was gracious to my family especially my daughter as he believed he was fighting for her. His is a small firm and you are not paying for a lot of the extra frivolties of large firms. Because of this, he was able to arrange a payment plan when I had little to nothing to give at the beginning. He is just a no nonsense man who knows the law backwards and forewards. He is not a typical suit and tie shark lawyer only wanting money. He works for the money you pay him and he works with you on payment. His fees and payment arrangements were reasonable and fair and flexible. He made sure I understood the law as well as he did. He explained things thoroughly so I was never wasting my time with misunderstandings and confusions. He negotiated intelligently for me with the other lawyer throughout a complex divorce involving financial and emotional abuse, mental problems, trauma, a personality disorder, disability, and molestation. He was honest, and put his foot down when I was not following through on my side...making sure I was not wasting money or opportunities...But he did so with tact. He mediated me a good financial lump sum from my divorce. My daughter and I are in a good financial situation due to him. He plans to help me to negotiate down some of my debt with creditors. He has told me his favorite cases are injury cases...I know he can handle any case with any complexities seeing what he was able to do with my case. I had to drive an hour and a half each way to see him each time we met....and I have to say that. "Bill Fields is worth it!!!!!"

Bill kept me informed throughout my entire case. When I couldn't meet during the day he stayed late, when I couldn't take a call during the day he'd set up time to call me on the weekend. I never once got the feeling he was counting the minutes while we spoke in order to bill me later. In fact I'm pretty sure he didn't charge me for all the work he put into my case. Great guy, knowledgeable and the outcome of the case was everything I hoped for and more.

Attorney Roney is a very capable attorney. She assisted me with a divorce situation and had it not been for her I would have lost a great deal of money and property. She knows the law and uses her knowledge to your benefit. I am thankful that I found her and she will always represent me in all future legal matters. - A DeKalb County Resident

I contacted Attorney Roney after obtaining her name from the Georgia Bar Association. I was concerned about foreclosure and needed legal representation. Atty. Roney invited me to her office and gave me sufficient information, so I could make an informed decision regarding my legal rights and obligations. We met over a course of weeks and she provided me with information that clarified the process leading to foreclosure. I appreciated her willingness to answer all my questions, as well as offer me sound alternatives above and beyond bankruptcy. Her legal coaching gave me the confidence to attempt further arrangements with my mortgagor, which led to a successful mortgage modification. I would not hesitate to call upon Atty. Roney should I need legal counsel in the future.

RUN. Several of the reviews are from Pendergrass Employees and they aren't true. This firm is trash!!!! My interaction with this firm began with a case in 2021. The person had no insurance and the firm did no work due to this. In 2022, I was in a 2nd accident, both accidents were not at fault. This time, the person had insurance. Pendergrass has a subpar level of communication. They send you for treatment, they do not check in on treatment, and ultimately leave you alienated for the entirety of the case. They fully expect for patrons to know case law, how to know the difference between Chiropractors and Ortho offices, and they expect for you to essentially manage the entire care process on your own. I received doctors recommendations from the Chiropractor to have pain injections or surgery to fix my back. Pendergrass advised since it was not in the case notes, it is not considered a Dr. recommendation. How are clients to know the law of car accident? How are they to know what happens when Dr.'s do not write what they say in case notes? How are clients to be educated on where to get care and where not to for their best interest of care and compensation? How can a case be successful if the law firm does not communicate with the client or with the provider and the providers do not communicate with the attorney? I have several instances in an email where they said they would do something and didn't do it. The level of accountability here and quality assurance is in the toilet. Ultimately THEY WILL NOT GO TO TRIAL even when client's are being offered settlements that don't even pay all the medical bills. The Employees Aurora - Smart, tries her best, but has an overwhelming work load and she can't communicate with her clients often due to it. Addonay - Immature, you'll feel like you're talking to a child to get business done. Handles business ineffectively and does not call, text, or email when he says he will. Phil Pendergrass - I talked to him once in two years. Immediately makes you feel comfortable with placing your business with them because he owns the place and is confident in his abilities but backs out of trail and any conversations during your tenure as a client. Carol - Steps in as the competent communicator and senior paralegal (yes she wrote a review for the firm below as a customer...imagine that). She tries, but even after she tried to remedy my scenario, she too went weeks without communicating with me until I reach out and she acts as if she didn't agree to do things via phone or email. Hayden Melson - Chief Operating Officer LOL! Dodges phone calls, gives you Lawyer-like answers to direct questions, ensures he says as little as possible via phone and email. A word class example of jock toxicity with a mix of silver spoon syndrome. Hire absolutely anyone else.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
