In my forty years in business, I have yet to come across someone as knowledgeable and helpful as Mr. War. From our first phone meeting to when my trademark and patent were issued, he went above and beyond to ensure the process succeeded. I can't think of a single way he could have improved his excellent service. Thank you isn’t enough! Steve, you helped me do what seemed impossible! Mercy Poteet / Flame Stacker Fire Pit 9/26/2004

I highly recommend Sean Farrelly and Kingbird Legal to anyone looking for a car accident lawyer or personal injury lawyer in the West Chester, PA area. Having co-counseled with him and referred clients to him on several occasions, I can attest that he cares deeply about each client, and he works strategically and aggressively to secure the best possible outcome. Simply put, if you are looking for a great lawyer in the West Chester area who will be caring, accessible, and put your interests first, I strongly recommend reaching out to Sean.

Sean was absolutely amazing. I suffered a personal injury from a slip & fall accident and hired Sean to represent me. From the hospital bed to settlement mediation, Sean was informative & constantly communicated updates throughout the process. His knowledge and experience in personal injury litigation resulted in beyond satisfactory compensation for my injury. I highly recommend you hire him to represent you if you fall victim to an unfortunate accident.

OT dissected my contract's legal jargon and got to the heart of the matter to ensure that I was protected. She made me aware of trends and scenarios in the publishing industry that I didn't know existed. If you want someone to protect your interests, hire this attorney. Money well spent. If not, you either pay a little now or pay a lot more later. Thank you OT!

I reached out to Bryn to discuss my start-up and my concerns regarding copyright and intellectual property rights. Bryn was extremely professional and easy to talk to as he reviewed and answeredmy questions. He was patient and helped me consider the legal aspects of my start-up while leveraging his expertise to forge a path forward. He was so helpful that I also followed up with him regarding an estate settlement issue I was having and he did not hesitate to be supportive and offered to loop in one of his colleagues that specializes in estate law. Overall, great experience interacting with Bryn.

I had an EEO case and felt very lost. I reached out to a previous law firm before Pitre and Associates, I did not have much faith in them. I continued researching and came across Pitre & Associates. My case was lengthy but it was handled and walked away with what was necessary. My dignity, and being able to apply for the gov with a new, clean SF-50. Overrides all they (the opponents)attended to do to my career. Was also compensated for damages. Pros: you will come out with something good amd benefitial with Pitre & Associates. Cons: It can get costly. Stand up for what you believe in, but be ready to spend some coins. The great thing is Mr. Pitre fights for you to get that money back. Thank you God!! I would certainly hire the firm again. I recommend the firm to anyone feeling lost and dealing with an EEO, Harrassment, hostile work environment, discrimination. I pray, I never get in a position like that again. It was emotionally draining. Michelle was my fave attorney, although I did not have her for too long. It is not just a job to her, she cares for people. I sensed that. Mr. Pitre is extremely knowledgeable and extremely responsive; he became my other fave at the end. My wish is: I had found them sooner for some advice before I had even attempted to deal with this. I was high risk pregnant in a very unhealthy situation. Some professional guidance would have helped. They are on my emergency call list if I come across something like this again.....God willing.

My lawyer, Andrellos Mitchell, is an outstanding litigation attorney. He represented me in a real estate case involving my condominium where the Condo Association and its Management Company breached their contractual obligations after a fire damaged my unit. The defendants hired very large law firms. They tried to get the case dismissed, but were unsuccessful. Mr. Mitchell is ethical, knowledgeable, and aggressive in the litigation process. He fights hard for his clients, but he isn't cheap. In the legal profession, you get what you pay for. While Mr. Mitchell does not make any guarantees of success, he does promise to give you his best efforts and seek a positive outcome for you. All he asks in return is that you cooperate with him, assist him with your case, and pay your bill.

Mary A. Mr. Mitchell is an excellent employment lawyer. Ignore the fake negative reviews. Mr. Mitchell was hired for my employment case in state government. He responded quickly. We met for a business lunch. He is very articulate and thorough in his interview and review of your documents. He quickly contacted my employer in writing and is handling the matter. I have not had any more harassment at my job to date. In fact, my employer has tried to offer me a promotion. For Your Information (FYI): The negative reviews are from fake clients. 1. Real clients don’t make “inquiries” when they contact a lawyer. That’s not how the legal business works. 2. Real clients pay money for a consultation fee to meet with the lawyer. 3. Real clients sign a retainer agreement and pay a retainer fee for representation. 4. Fake/Broke clients don’t want to pay for legal services. 5. Google and some other sites allow anyone to make reviews without proof that the person actually hired the lawyer. So the sites can’t be trusted. 6. Fake reviewers are trying to blackmail my lawyer for money. Not going to happen. 7. Don’t believe the fake reviews, Mr. Mitchell is a great lawyer!

James stands out as the finest attorney I've encountered, excelling not only in legal expertise but also in being a friendly and helpful individual. During our hour-long consultation regarding potential copyright and trademark issues for our startup, James exhibited highest professionalism. Unlike many attorneys who simply address questions, James actively assisted in evaluating various scenarios, empathetically putting himself in my shoes and presenting diverse solutions. As we develop our business and refine our plans, we look forward to working with him on our cases in the future. I highly recommend James based on this positive experience.

Eric Singer has changed my life in ways that words cannot begin to describe. He took my case and to say it was an uphill battle from the begging is an understatement. Eric also sets realistic expectations, he describes the complexity of the case, his approach and different path going forward depending on the outcome. His prices are amongst the fairest in the field, his ability to work with Clients with financial constraints compares to none. I paid the deposit, set up monthly payments and believe it or not, he started on my case the very next morning. My case went through so many Immigration Court in Virginia, USCIS matters in Baltimore and Florida, he was there every step of the way. The scope of the work we covered is rather sweeping: litigating and succeeding in vacating the absentia order of removal, understanding and undoing the damage done by two prior attorneys, getting removal proceeding dismissed, getting the I-130 approved and interview prepping. I am now a legal permanent resident of the United States ( feels so good to say that) and none of it would have been possible without Eric Singer

After speaking with two other law firms, we decided to hire Eric Menhart, Esq. to represent us when dealing with a copyright infringement lawsuit. We hired him because he was by far the most experienced attorney we talked to in dealing with this type of legal issue, and found him very easy to relate to. He was very professional and responded promptly to all our questions either via email or by phone. He dealt with all the issues involved in our case, and clearly explained our options at each new development during the negotiation process, which took about 2 months to resolve. We are very satisfied with his representation and the outcome of the case.

Five stars are simply not enough for Jim, my attorney Casey, and my paralegal Yuliana at Hacking Immigration Law. After having a less-than-ideal experience with a previous immigration lawyer, I received an RFE (Request for Evidence) from USCIS, which left me feeling uncertain and stressed about my case. That's when I decided to switch to Hacking Immigration Law, and it was the best decision I could have made. The team immediately jumped into action. Their professionalism, dedication, and attention to detail were incredible. In less than 72 hours after submitting my RFE response, both my I-130 and I-485 were approved, and I am now a lawful permanent resident of the United States. I can't recommend them highly enough. If you want a team that truly cares about your case and delivers results, look no further than Hacking Immigration Law. Thank you again, Jim, Casey, and Yuliana, for helping me achieve this dream!

What's interesting is, I was using an IP attorney that was recommended later to find out that they were more about making money than providing a sound service. However, I was trying to find out some information regarding trademark abandonment. Through my search, I stumbled onto an article that explained abandonment thoroughly which after reading I then wanted to find out who wrote it. Once I found the source I then googled Michael to find out that he also wrote some other interesting articles in regards to Trademarking/Branding. After I read more of his articles showed me that he was very knowledgeable about IP law and that he didn't mind sharing information. I realized that he could be a great candidate for representing my business for trademarking. I had some other attorneys lined up to converse with about Trademarking, however once I called Michael and we spoke I knew that I had found the right attorney. On top of being patient and a good listener, he had very good communication skills. Michael and his team are hardworking and very responsive and must say that I'm happy that I found him to represent me. I also highly recommend him to others seeking an IP attorney.

My business partner failed to do his work well and our company was bankrupt. Instead of helping resolve the problem, he used a clause in our agreement to take control of the company. That's when I hired Theodore Allison. It took several months of careful negotiations, tons of emails, lots of arguments, working through false promises and much anguish, but Theo finally led me to a resolution that solved the problem. The road ahead was unclear, but Theo remained patient, calm and focused until the solution was at hand. I am grateful for his skill and perseverance.

Theodore Allison has been our firm's lawyer for 15 years (since we started our practice), and he has been wonderful to work with. I trust him completely, and can't recommend him more highly. Theodore is literally one of the most intelligent people I know, and his thoughtful, creative, and thorough work has helped us more times than I can count. We truly couldn't run our practice without his help and advice. Theodore is the top of the top in Washington.

Dan and his firm were introduced to me through another local business owner and that was important to me. Dan is an approachable attorney who made himself available when I needed him. He and his staff turned around a contract issue I had with my business quickly and I felt like they took the time to explain things to me in a way that helped me to decide how to structure my contract from a solid legal perspective.

Dan was referred to us, and once we got him involved in our case, we knew he was the piece we needed. He was tenacious, responsive and he managed our expectations perfectly. If he thought something was a bad idea, he'd say so...and vice versa. He didn't just do what was good for Dan, he followed a path that was good for us, his client. Can't ask for more in a lawyer!

I've been working with Ward and Ward for the last 15 years and find both Tom and Dan good lawyers to work with. They bring a realistic business-centric attitude to the case, present the options, the costs and the odds of success for various strategies. I always have felt they had my best interests at heart and are not afraid of tough litigation if that's what's needed.

Walt has been my business / corporate attorney for many years and in my former company (prior to being acquired) Walt was instrumental in releasing more than $200,000 being held unfairly by a large merchant account company. He has also represented us in smaller matters, but always demonstrated an above average ability to see through the problem quickly, come up with a creative (within the law) solution that most attorney's would not have. Highly recommend.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
