I am VP / General Counsel at a mid-size entertainment & technology company in the Los Angeles area. As the only attorney at my company, I must periodically seek advice from experts in intellectual property at local law firms. Ms. Tobi is my go to counsel and has been for the past 5 years with regard to copyrights, trade marks and trade secrets. Her detailed, prompt and direct advice has enabled my company to gauge its potential litigation position with accuracy many times over. Ms. Tobi's expert knowledge, sound business advice and humble approach has been the key to many of our successful license agreements and settlements, helping bring certainty to sometimes apparant catastrophic liabilities. A major plus for Ms. Tobi is her willingness to enter into alternative fee arrangements specific to certain recurring business. I strongly recommend Ms. Tobi.

I found Attorney Shen online and inquired about my case. This case isn't his field and I am remote from him too, but he spent a lot of time to speak to me, just like a friend. He answered my phone any time and even did research etc. He didn't take my case and but a friend chatting me. I can't believe anyone who would have spent time to help a stranger and he is an attorney. So I believe he is trustworthy attorney if he does take your case!

Mr. Shen helped me with a patent application. He is one the best patent lawyers I have worked with. He quickly understood the idea I was trying to patent although he had no previous background in my field. He designed the best strategy to file the patent application and explained to me in details to make sure we were on the same page. He was highly professional and always get back to me quickly whenever I had any question. It was a great pleasure to work with him and I would highly recommend him.

As a startup medical device company on a budget but ambitious plans, we turned to David to advance our intellectual property from several early and disjointed applications filed by well established and reputable large firms, into a valuable portfolio suitable used to raise multi-million dollars in capital. David explained the best manner to structure our activities, claims, clarified the purpose of each application, and established milestones and timelines. He provided us valuable ongoing counsel on the most efficient way to allocate our resources, the manner in which to protect equity with new concepts and advances, and the applicability of prior art. David also structured our applications in a staged manner in order to best protect our ideas while fitting our schedule and budget. In addition to impressive personal knowledge in the medical device space, David is meticulous and methodical, creating clearly written and well structured patent applications and portfolios. He routinely questions the need for unnecessary (but billable) patent activities, and systematically follows up during the prosecution process. Because of the quality and consistency of his work, we, including our CEO and President, have come to trust David to handle all of our IP matters.

David was my lawyer on a case that lasted almost four years. He did everything possible to keep the costs down and not waste time and money. As my case started he insisted that every time I made a statement that he was going to use in the trial, I had to have the documentation to back it up. He was extremely diligent with his approach, knowledge and understanding of the facts that he was presenting. He made sure that I took an active part in the proceedings of the trial, by explaining what was going on, what happened and what was his future approach he was going to take. I trusted him completely, he was aggressive when he had to be, communicated well, and his approach to changing situations was amazing. I would highly recommend him to be your attorney. He will give you his best at all times. You can trust him whether he is defending you or you are the plaintiff. You cannot good wrong if you are looking for an honest, forthcoming, aggressive and upright attorney. He is the best.

John was super helpful when I reached out to him for a few questions. He advised me over the phone with a free consultation regarding sons bankruptcy questions I had. I called because my co-parent is looking to file bankruptcy but he also has ownership in a family cabin my parents and I own. John was able to advise on all our options plus he gave his professional opinion as to what would he best for us. His advice had a major impact on our decision and we will absolutely work with him in the future. I highly recommend him for any bankruptcy and tax related questions. He’s incredibly knowledgeable and friendly. 10 out of 10 I recommend!

We contacted Faucher Law for a second opinion after having a bad experience with a tax attorney. I was immediately taken aback by how friendly and pleasant our interactions were over the phone/zoom with John and his secretary. John helped us confidently address complicated tax issues we didn’t know how to manage. We are relieved to have someone so friendly and knowledgeable to call on for advice. If you need help, call their office. He is quick to respond and get you the help you need. Friendly, efficient, professional.

I cannot recommend Matt highly enough! He provided exceptional legal representation and went above and beyond for me every step of the way. From the beginning, Matt was extremely responsive and easy to communicate with. He kept me informed about the status of my case and made sure I understood every step of the process. Not only was Matt an excellent legal advocate, but he also provided invaluable guidance and advice throughout the entire process. He took the time to thoroughly explain my options, assess the strengths and weaknesses of my case, and develop a strategic plan of action. Matt's depth of knowledge and experience in employment law was evident from our very first meeting. He was able to quickly identify the key issues and provide clear recommendations on the best path forward. When it came time to negotiate, Matt was an aggressive and skilled advocate who fought tirelessly to get me the best possible outcome. He truly had my best interests at heart and made sure I was treated fairly. One of the things that impressed me most about working with Matt was his genuine care and concern for my wellbeing. He understood that this was a stressful and emotional situation, and he went out of his way to provide moral support and ensure I was doing okay, not just focusing on the legal aspects. Matt's team was also incredibly helpful and supportive throughout the entire ordeal. I am so grateful to Matt for his hard work and dedication. He made a very stressful situation much more manageable, and I'm thrilled with the final result. If you are facing any kind of employment dispute or issue, I cannot recommend Matt highly enough. He is a true professional who will fight tirelessly on your behalf, while also providing the personal touch and support you need during a difficult time. I am forever grateful for his exceptional service.

Be warned, extremely shady and questionable billing methods. Seems like once they have your money, they’ll just ignore you. She used to be good in the past but maybe it’s the lack of business and/or greed that she prioritizes money over great customer service. Would stay far away from this deceptive, manipulative and money hungry lawyer!

I have known Tamara for almost 20 years, and at one time professionally worked with her. I held her in the highest regards. Tamara set up an Irrevocable Trust for our family 15-16 years ago. Prior to the trust expiring, we contacted her to set up an appointment to meet, and go over our options. We received a random bill, prior to our appointment for $600.00 with a description of "RESEARCH." Keep in mind that she represented herself as one of the leading expert in CA in Trust Law at the initial meeting, even stating she taught Trust Law at a local law school. When we called for an explanation, we were informed that she had to research our options, as what to do at the end of the trust. It was at this point, that we informed her that her services were no longer needed! We contacted another attorney, who knew exactly what to do, and had the necessary paperwork completed, and electronically submitted to the county in 3 days for $289.00. It took only 1 telephone call, and 2 emails, with no Federal or State tax consequences. We continue to receive bills as of this review, with accrued interest, violting Rule 2-107 of the Rules of Professional Conduct of the CA State Bar Association. Neither Tamara, or her staff will return telephone calls, or emails, just continued random billing. We never signed a retainer agreement with her concerning this matter. Just a call to set up an appointment to meet with her, which never took place. Unfortunately this has resulted in a complaint with the California Bar Association, with supporting documentation. We will update this website on their findings. Again I am so disappointed! It appears that Tamara has now expanded her field of practice, and no longer cares about her clients, as evident by their lack of communication. The office screens calls, and refuses to return repeated telephone messages, and emails. I sent an email directly to Tamara, explaining my position, whereas I informed her if I did not hear from her within 30 days, I would consider the account zeroed out, and closed. Did not hear anything for over 2 months, and all we received was an additional bill with interest. I would highly recommend to anyone looking for legal services with Tamara, not only to do your due diligence, but also compare the fast response of other attorneys, and fee schedules. It just appears to me that they are out for money, and really no longer cares about the clients, once they have collected their legal fees! Lincoln once said "the lawyer has a superior opportunity of being a good man." or woman! ⭐

We had a positive experience with Tamara over a decade ago when we first set up our trust. When the trust was nearing its term, we reached out to see if we can set up an appointment with her to discuss what our options would be when the trust expires. After making an appointment for a few weeks out, we get a random invoice for $600.00 when we haven’t even had a chance to sit down with her yet. When we called the office to find out what this bill was for, she stated it was for “research.” First off, this is your specialty & field yet you had to go out and do research on the trust that YOU set up?? Second, shouldn’t you at least advise or get permission from your client before taking the initiative to do something like this then turn around and blindly send us a bill without any explanation or heads up? After a few back and forth with their office, we were under the impression that they understood we no longer wanted their service and they would adjust the bill. Nope! After six months, they had the audacity to send us a new bill with occurred interest on top of the original bill!!! AFTER SIX MONTHS OF NO CONTACT!!! We tried numerous times to get a hold of someone in their office for weeks. But they screen their calls and emails so once they have your money, they tend to not call you back or follow up. And when you call them out on it, they blame their phone system being down or some other BS they can think of. Needless to say, I’ll be filing a bar complaint and highly advise people to stay away from this money hungry firm!

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
