I contacted Mr. Cox due to an estate I was an heir to had turned one sided. Mr. Cox did an excellent job guiding me in situations and being the “go between” person between the Estate lawyer, the Executor and me as they both told me not to contact them. Mr. Cox and his assistant (Sherri) are very understanding, did not rush me and would get back to me the same day with answers to my questions. The entire office made me feel comfortable. The estate has taken awhile to close but without Mr. Cox assistance, it most definitely would still be open.

I was referred to Mr. Cox by several of his peers, both in Iowa and Nebraska, for representation in a civil jury trial. I found him to be very knowledgeable, experienced and focused. He and his staff were very accessible, personable and professional, and Mr. Cox was very successful in my representation. I was impressed with his ability to pinpoint and focus on the real issues, to bring out important facts to the jury, and to communicate with me at every step, through the conclusion of my representation. Definitely the guy you want to have on your side, and I would recommend Mr. Cox without reservation.

We have been in business for almost 20 years. We have been sued a couple different times- some more serious than others. In all cases John represented our company better than I could have expected. Some of the many ways John impressed us are: he always kept us informed, he was respectful of our thoughts and ideas, he always had his game face on, he did his homework and most importantly...he has been able to show/represent our case to prove that we were not negligent ! John is extremely professional and I would recommend him to anyone that is looking for a top notch lawyer.

In the all the years our company has existed, we have been sued for negligence twice. Both times, our insurance company chose John McHale to represent us, and both times we were found not guilty of any wrongdoing by two different juries in two different counties. I give John McHale EXCELLENT ratings on his research, his detail, his knowledge, his courtroom presentation, his strategy, and his preparation, as well as his professional treatment of us, the judges, juries, witnesses and yes even the plaintiffs side. Additionally his communications to us before, during and after both trials was superb. Being rather new at this "being sued" thing, I was reassured when about half way through the first trial, the Clerk of Court, during a recess, said to me "I've been doing this for a lot of years and you never know how these trials will turn out, but I can tell you that your lawyer is good.......really good. I wish he lived here." Beyond a doubt, If ever we find ourselves in a similar situation, I want John to represent us!

Hiring Randy was LIFE CHANGING for my family and I. He was so great throughout the entire process. He was very professional and empathetic of our unfortunate situation. He worked diligently and often I would get messages from him very early in the morning or very late at night, which I very much appreciated and made me feel like my case was his TOP priority! If you are ever in an unfortunate situation where you need to hire a personal injury attorney Randy Shanks is the only way to go! I couldn’t recommend him enough!

I was on a car accident. I had no idea who to turn to and my family turned to Mr Randy Shanks. Thank goodness. Randy and Rhonda his assistant were so amazing. They kept me updated on bills. I didn’t have to worry about anything. I could just work on healing. Bless this office for being my advocate. Highly recommend this office if you are in any accident.

Joe is hands-down Council Bluffs number one attorney in my opinion. Joe went above and beyond any expectations I had of my case, even though I was very anxious I just sat tight and let him do his job and he definitely came through for me and my children would Definitely recommend him for a federal attorney.

Such great reviews yet when I call I get the run around and then never get a call back. Might want to change that up guys. People need good legal service so if your what your reviews say you are. Might want to start taking calls EDIT: LOL they get a email about a bad review then call and before he wanted to talk about my case Waytt tried to get upset about my honest review. Kinda that a missed call or something of that nature doesn't get a call but a bad review does. This companies ego is way to big to help people that need timely answers.

I retained Mike twice over the last 20 some years To represent me in two divorces. I actually settled the first divorce in my deposition with my ex-wife. Which was impressed by, But in retrospect, I never got to see him work a divorce. 17 years go by. My third wife decided that she liked girls better…. But it was ugly. And when it got ugly, I begin to feel like Micheal and interrogating me more than representing me. After nearly 2 years of retainer (Which I will say was minuscule), But I was forced to hire a new council. And then I found out from my new law firm that it only took 10 minutes on the telephone to get my soon to be ex-wife Attorney to agree that the prenup we signed was valid!!! I love Mike. But he’s in his 70s and he likes playing poker and talking… If you need something done, I’m Not sure that he would be the guy to aggressively defend you. Forgive me, Mike. I just felt like I needed to tell the story. I wish you all luck and whatever legal battle you have… But honestly, If I could go back, I would’ve heard my ex-wife Attorney!! Amie Galner Literally came at me so hard she almost got a judicial review!!! I told Mike if I ever needed to hire somebody to tear someone’s you know what’s off…. I would hire her hands down!! She’s aggressive and vicious. And as her former opponent, I have to applaud her!!! Even though she did trash my reputation as much as she could… But I’ve been my ex-wife. I would love to watch that as well.

I want to Mr. Wenters for an incident at Mercy hospital. I called him every single month twice a month, asking them how everything was going. He said that he's doing what it can and I guess we have to sue them he said and that was in February. Anyways, to make a long story short. 2 weeks ago I called him and said. How's everything going? He said we waited too long over 2 years. There's nothing he can do. Avoid this law firm at all cost.

I can’t speak on everyone at this law firm, but I cannot in good conscience recommend Keith Buzzard as a lawyer to anyone. My experience with him has been an absolute nightmare. Keith has greatly neglected my case. He always says he will do xyz in ___ amount of time, (without even being prompted to give a timeframe) then he never does. Instead he will take weeks or even months longer than he says he will. This led to me having to call frequently to see when he was finally going to do what he’d say he would, which I’m sure was by design since they charge you $225 per phone call and he won’t answer emails… Yet, he wouldn’t call back when I’d leave voicemails either, so I learned his schedule real quick because I refuse to be ignored. He didn’t advocate for me at all when it came to getting alimony (even though I was a stay at home mom at the time of divorce), getting assets in my name (so I lost 2/3 vehicles we had and the one I have isn’t even in my name so I can’t sell it), nor for better child support (please tell me how $240 a month is enough for 3 children in this economy when our incomes are so different)… Pretty sure he didn’t believe me when I told him I was leaving an abusive situation and was terrified… I ended up homeless and in a hotel for awhile and faced constant fear of living on the streets for a year and a half… I asked for him to help me get full custody of my youngest until she was done breastfeeding since she was only 8 months old. He didn’t even bring up the topic in court. So I had to give up breastfeeding and listen to my daughter scream cry for me when I’d give her to her dad. I filed some motions on my own but they’d get denied because it wasn’t from my lawyer… So I’d fill them out then make him file, and once he “filed incorrectly” then waited until after the weekend to fix it even though he said he’d fix it right away… I had to remind him to put my name change in the final divorce decree, as well as to give my ex a time limit for when I could receive the divorce money. It’s a good thing I did too, or I’d have been totally screwed because my ex took MONTHS after his time limit was up… and Keith didn’t want to file for contempt (so I filled out the paperwork myself). The whole time it felt like Keith was advocating more for my ex than me. The only reason I was able to get the money for Keith is because my grandpa gave me some of my inheritance money and he told me to get a good lawyer. I feel like I failed him by wasting money on this lawyer. My parents recommended I report him to the board for neglect on my case and I definitely will.

Poor attorney. Do yourself a favor, hire someone who actually cares. He talks as if he knows the law but doesn't completely or maybe he just didn't like me. Either way. Unprofessional. Do not hire him for a divorce case. He sided with my ex. I should have gotten a better settlement. Mike provide no guidance. My friends provided more information than he did. His memory is failing him. He couldn't remember what was said or done. He talked bad about me to my ex's attorney. Game player for sure. Don't waste your money. If I could give him no stars, I would.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
