Totally lives up the the title "counselor". Can't make enough positive comments for Mr. Owens. Helped us to dig through the maze of legal complexities and think about our position from a law standpoint along with strong dose of much needed reality. Kept his promises and never misguided us, never over booked hours/time. We consider him a professional in all regards.

I felt like I got so much more value from Patrik than the amount I paid! Who walks away from an attorney-client relationship thinking that?!! Well, I did! Throughout the process Patrik was always very quick to respond to my emails and his hard work and diligence led to a favorable outcome in my case. Thank you Patrik!

The Zwerdling law firm is nothing less than the best. They took me on as a client in 2018 after I was rear ended and stuck with my case until they got exactly what I deserved for the injuries I sustained. I can’t say enough wonderful things about each and every person that works there. They are professional, excellent at communicating and very supportive. Thanks to you all for what you have done for me I’m so grateful I reached out for your help instead of taking some small settlement from the insurance company.

She skipped out on court dates to take a vacation in Cuba leading to orders to be implemented while she was gone snorkeling. Sanctions were ordered by the judge against her for the stunt. Orders in the case had been made months prior in which she didn't follow through on implementation of the orders. She then left her practice to join another practice leaving the case high and dry. Very unprofessional.

I initially hired Neal in 2017 for a power-of-attorney issue/question. Although I had no idea of the gravity of the situation that was unfolding before me, Neal was right on point! He knew exactly what was happening and what needed to be done to correct it. He got it done quickly, professionally, and thoroughly. I then needed his services again (2019-2022) as I became the trustee of a rather messy family trust. He guided me through the process, always one step ahead of potential problem makers. Then, when a petition was filed with the court by a disgruntled family member, he remedied it quickly with a calmness and surety that showed me (and the complainer) just how much he knows his stuff! He is a gem to work with.

I was referred to Philip Watson by an attorney, and now I can also recommend him without any reservation. Mr. Watson successfully settled a personal injury claim for me this year. His professional experience and knowledge were integral to a positive outcome. Further, his balanced demeanor offset the emotional experience I faced. I also appreciated that he communicated the exact action taken, and his office staff was efficient. I will definitely be seeking Philip Watson's counsel as needed in the future.

Phil and his brother Steve have been our attorneys for 27 years. Phil has been instrumental in writing and reviewing contracts for our various family businesses.....always with an eye for detail yet keeping things as simple as possible. He and his brother have helped us through our own estate planning process. When my father-in-law died, they guided us through the administration and final distribution of his rather complicated estate. They are very knowledgeable attorneys who are detailed orientated, always there to answer questions and their fees are more reasonable than most. Would highly recommend both Phil and Steve.

Stephen Watson provided legal services to settle our family estate. Services included review of and overseeing the division and settling of the family trusts. Mr. Watson was thorough, clear, and concise in our conferences during this process. He reviewed all documents and explained all options in clear language that was easy to understand. Mr. Watson monitored the settling of the estate from start to finish and checked each step along the way so that pitfalls were avoided and tax implications were understood before decisions were made. The settling of the estate was completed with no problems and I could not have been happier and more satisfied with the legal services and solid advice that Mr. Watson provided.

We needed the advice of an legal expert for a claim against a Government agency. We spoke to Mr Watson and he provided us on how to proceed without needing his immediate services. When said Government denied any responsibility, We hired him immediately. From the start he was very forthwith about the extreme difficulties in litigating against them. He was open about the expenses and probable extended time to pursue this matter. It was seven years later that we prevailed and were awarded our settlement. We will always be grateful to both Stephen and his brother, Philip. They were tireless and always committed to helping our family. Without their extensive knowledge and expertise, I am certain we would not have had the same results. Mr Watson is best described by his statement to me at the outset of this. " Just always tell the truth and never waiver from it, and you will do fine" Highly recommend the firm

Paul Brisso has been Council for the Humboldt Bay Harbor, Recreation and Conservation Distict (District) for over six years. Over that time, I have interacted with Paul 2-3 times per week on all facets of local government law covering personnel, property, liens, leases, agreements, contracts and insurance issues. In all of these interactions, I have found Paul to be very professional, knowledgable, and go the extra mile to help solve the sometimes complex legal issues that face a special district. Paul also teaches local government compliance classes. I have taken his class on California's Brown Act open meeting law and found Paul to be very good at presenting complex legal information in a very understandable and useful way to a non-legal audience. In my opinion, Paul has done an outstatanding job of representing the District and I would not hesitate to recommend him for any legal activity for which he feels qualified.

Charged with a criminal case, you will be lucky to have Mr. Michael P. Acosta as your attorney. I found him to be extremely generous with his time. In the middle of a very large case, Mr. Acosta took the time to take on mine and gave it the quality attention it needed. His knowledge of the law is undoubtedly sound but it his years of experience and familiarity of the strategies and tactics of the DA’s office I found most reassuring. I cannot praise his work enough and if ever I should experience trouble with the law again I am calling on Mike. I just hope he answers.

Some time back I had a consultation scheduled with her and I paid $500 for the fee, before my appointment a woman called me and said my appointment was canceled and she would not see me, keep in mind this is after they had checked to see if there was any conflict, determined there was not and booked and charged for a consultation...the lady was rude, ended up hanging up on me after I protested AND they ripped me off for my $500, said they would mail a check to me to refund it, and they NEVER did. This lady is below the belt unscrupulous, don't believe she's one of the best in Humboldt county, my advice is to keep looking for a better lawyer with some business morals, this lady is not to be trusted

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
