I could not have asked for a better attorney. He was always available to answer any and all of my questions timely. Every step along the way, I was kept informed of the progress, promises were maintained, copies of communication were conveyed...I could not have asked for more! I sincerely appreciate all of the help and professionalism shown by Mr. Baratta.

Hiring Andy is the best decision one can make when hiring an attorney. In truth, Andy's skills extend beyond the law. He is as much an advisor as he is an attorney, and I value his input on just about every matter with which I'm confronted. In short, I can't make any more ringing an endorsement for ANY advisor.

It was a difficult time for my husband and I. We weren't looking for an attorney but following a tragic car accident that left me with a serious traumatic brain injury, Andy was our man. We had known him personally for a few years and trusted him as a friend and felt it would be good to have someone like him on our side. Little did we know, Andy proved to be a great asset during a challenging time. He took care of everything so we could focus on my recovery. Andy checked in frequently and provided a supportive ear to my husband. He worked efficiently and quickly responded to any of our questions, no matter how small. Andy demonstrated a great knowledge for any legal matter and knew what needed to be done in our case. Because of Andy's hard work, I am still able to work on my recovery despite the effects of my injury. We continue to consult Andy for any legal matters that arise. Andy is the only attorney I want on my side!

I hired Gregg after I saw him in litigation on another case. Expensive but clearly an attorney who is not going to let go until the best result for the client is achieved. Highly recommend Gregg.

It has taken me a few years to write this review. One of the previous reviewers said that Gregg Cotler is the attorney of last resort-well maybe that is true but if you can help it, why wait. I hope people read this review and realize how critical it is to engage the right attorney. Gregg Cotler deserves the highest attorney rating and anyone who is going through even half of what my family experienced, should, without question, retain Mr. Cotler. One or two word platitudes regarding Mr. Cotler simply won't suffice. Mr. Cotler represented my company and my family at a time when everything seemed lost and we were literally running out of any hope. For many years, we ran a small family company. We paid our employees quite well, we treated them as family members, and never in our wildest dreams would we ever have suspected that one of those employees would be responsible for stealing more than a half a million dollars from us and was ultimately responsible for destroying our entire business. We were alerted to the theft by our credit card company but it was Mr. Cotler who figured out what really was going on inside our company. Once he deciphered and disentangled the criminal scheme, he walked our family through the criminal investigation, taking us to the best group of detectives in our county. Then he counseled us through the criminal trial, penalty stage and restitution agreement. He met with the defense counsel, the detectives, and with the judge and, he developed an amazing criminal and civil litigation strategy. On the civil side, he negotiated a settlement with our insurance company and filed suit against the employee for damages. His litigation skills were so sharp that he basically forced the defendant to choose settlement which included the sale of her personal home. His overall strategy and plan for helping my family was nothing short of miraculous. Where most attorneys would have only been peripherally involved in the criminal case, Mr. Cotler orchestrated the best possible resolution for our family. It is my understanding that in most cases involving embezzlement by an employee, that employee either receives a jail sentence and then probation or just probation. Although restitution may be ordered in many cases, the enforcement of those payments is almost non-existent. In our case, the former employee actually received 21 years house arrest which was primarily based upon the monthly calculation to repay our family. It was such an original and novel plan that it instantly received national attention and we were contacted by both the television and newspaper press. I have read some of the reviews previously written about Mr. Cotler and I hope that I can add some helpful and significant information. If you are looking for an attorney who can review and write contracts or negotiate business deals, you certainly can hire Mr. Cotler. However, you probably could find a fair number of attorneys in your community who could handle general business matters for less money. Mr. Cotler is fair minded when it comes to hourly billing but he is not the least expensive attorney around. No, the most important thing that I could say about Mr. Cotler is the fact that he is one of a kind and if you are looking for an attorney to help solve complex and serious problems, he gets my highest recommendation. He has that very rare quality of being a great listener combined with the highest level critical thinker and possesses a unique analytical mind, the empathy of a saint and has a seemingly endless energy reserve. He is an incredible litigator and he can out-work a team of big firm lawyers. If you can afford his services by all means hire him before the other side does.

Gregg has represented me for about three years in a matter that has required extensive and detailed knowledge in a variety of business areas. He has competently provided the appropriate case law and citations to document the powerful arguments he has offered on my behalf. He has used logic and understanding in presenting his arguments. Most important, he has provided me with support and security by assuring me that he would not abandon me during this difficult and time consuming ordeal.

I have only positive things to say about Andy. He made an uncomfortable situation bearable for me from beginning to end. He always addressed my questions and concerns in a timely manner, he was patient with me and helped me to understand when I was confused, AND he also kept me informed as developments occurred. He made me feel important and that I mattered. Of course I hope that I never have another situation needing a lawyer but, if I do, I would certainly reach out to Andy to ask if he would represent me again. Definitely would recommend him!

I have known Andy (Andrew) for over 30 yrs, when he first represented me in my 1st personal injury claim. I was then 18yrs of age. Andy was always available to answer phone calls, even when those calls were going to be contentious ( usually resulting in my anxiousness or uncertainty of the outcome of the case)/ Andy was always honest and forthright with his findings/information. I have often told him that he has broken the sterotype of a "lawyer" because he is a man/professional of Integrity, character and principle. Whomever is reading this review I can assure you that Andy will do two things for you: 1. Andy will be up front and realistic about your potential wage loss/recovery. 2.He will keep you informed every step of the way.

Mr. DiPiero was very kind, patient and understanding when it came to listening and advising me on my case. His appearance and the manner in which he dealt with my case was always very professional. He always made me feel like I mattered and that I could ask him anything without feeling stupid. I would strongly recommend him to anyone involved in a car accident or who suffered personal injury. He is one of the best!

My husband and I had an immigration case that needed to be taken care of. From the moment we came in everyone was courteous and helpful. They kept us informed every time we had paperwork sent to us by USCIS. They were with us every step of the way and along side when we had our interview. The same day of our interview we were approved and got my green card within 5 business days. I would highly recommend James Donovan ESQ. Thank you James, Raniah, Samantha and Sauri. We will be forever grateful for being there with us.

Paid retainer by taking out a bank loan, as we did not have that much money in savings. She wrote a single one page letter on our behalf, which we had to edit for her. We decided not to take the civil matter any further and requested a copy of the billable hours on August 23, 2019 and a refund for our remaining balance. It is now September 26, 2019 and we have not gotten a response to the 4 emails and phone message we have sent her.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
