I cannot speak highly enough about the work that JD Segers and Allen Sydnor did on my behalf. I am so fortunate to have been represented by them. They were tireless in their work to defend my case, leaving no stone unturned. Most importantly they were concerned about me as a person and navigated me through a difficult and uncertain time with great care, skill, and diligence, ultimately with a vindicating outcome. Thank you!!!

The team put together by John Isaac Southerland and Paul Malek handled my appeal after a very questionable ruling in my divorce. Exploring every available resource, their team provided a myriad of evidence adding to what my divorce court attorney had established, enabling them to mount a successful appeal. The resounding decision by the Alabama Appeals Court will reverberate throughout the state protecting countless veterans. They all have proven diligence, honor and integrity will prevail over money, power and lies.

Mr. Brom was incredibly knowledgeable and responsive throughout my entire case, always explaining complex legal issues in a clear way. I felt confident and well-represented throughout the entire process and would highly recommend him and his firm to anyone needing legal assistance. I would not hesitate to call Bachus, Brom & Taylor again for legal services.

Tara exceeded my expectations in winning my wife’s case. She did not charge us for every phone call or email. She worked with us to keep the cost down. Tara was aggressive and fought hard in the courtroom. At times she left opposing counsel speechless and even caused the judge to laugh when objecting to opposing counsel’s ridiculous attempts to slander my wife. Tara got us everything we asked of her. Thank you Tara.

Mr. Fernambucq and Mr. Dunn, My name is Tabitha Edwards and I am coming with concerns of events that have recently happened with my previous Lawyer Caleb Faulkner who works at your firm concerning a case that I am in. I was originally referred to Mr. Dunn by Jim Holliman, who has been a dear patient and friend since 2012. When I called to schedule with you, Mr. Dunn, Caleb happened to be available that day and my case was emergent so that is why I hired him. When I first hired Caleb Faulkner at the beginning of August I handed over all evidence that I had meticulously collected. Included in this evidence was a physical recorder that contained 5 separate files of recordings of sensitive matter directly involving my case. These recordings could have potentially been additional shields for me in court. Prior to my hearing, my previous lawyer Caleb Faulkner asked me to meet him at your office at Boyd, Fernambucq & Dunn, P.C. while there, Caleb stated "Let me go get you're recorder, my assistant has had it listening to it and taking notes for me". Caleb then handed me the recorder that was enclosed in a zip lock bag. Caleb then stated "I want you to take this with you to court, I don't want it in my possession because I don't want to mess it up". Immediately in front of Caleb I took out the recorder and turned it on to find all 5 files on my recorder had been deleted. I immediately informed Caleb that the recorder was blank and all files were missing. Caleb put his hands in the air and stated " I have not touched that recorder once since it was delivered it was not me, my assistant is the only one who has had it because she was listening to it for me and taking notes". This was equally concerning because in the earlier hours before I arrived Caleb stated that I have more evidence concerning my case instead of the recordings - this leads me to believe I was being lied to because how would Caleb know if he has not taken the time to listen to them? Later in the week when I went to receive my mail, the assistant Kaylee Franks was at the office. I informed her about my recordings and how each file was separately deleted. I explained that there is not a delete button on this recorder and each file has to be deleted one by one. Kaylee stated that she only listened to my recordings on August 12th and she can 100 percent attest that she did not delete any files and after listening she turned the recorder off and has not used or listened to it since August 12th. Kaylee seemed flushed and in obvious distress. I told her not to worry, I am only asking because I am concerned that my evidence had been destroyed and I did not understand how it had happened and I wanted to let her know what Caleb had told me that she was the only person that has had it in her possession. I have since retained a new attorney. I informed my new attorney what happened. She informed me that I need to report this immediately to the Alabama Bar and things seem questionable and if not careless with my evidence and property at the least. When I emailed Caleb informing him that I no longer require his services and would like my retainer fee back, he stated that he has used up my trust and there is no money back he can give. I am not currently worried about receiving my retainer fee back as I am concerned about why these things have happened to me. My property and evidence was destroyed and I am asking respectfully for someone to look into this incident and please help. Rather this happened on accident, it happened. I do not want this to happen to anyone else. I have tried to email you both separately, but I was nervous to be frank that it might get erased if I went through your website. This review is not reflective upon you or Mr. Fernambucq, but at this point I am fighting for the possible outcome of my life and I am trying to keep myself safe. Sincerely, Tabitha Edwards

My Boyd is without doubt the worst trial attorney I have ever met. He defines the term " let's settle this case". He does not follow requests that his client wants, but just wants to get off after he has charged you enough to fill his pockets. The other two attorneys are very professional. Don't ever trust Boyds' word, he will not keep it! He absolutely blew a case with me (thus the negativity), which has literally put me on the road to homelessness. I could not make this up. Dr. J. Griffiths

Loring S. Jones III is the rudest and most unprofessional attorney I have ever met. He was at Shelby County Courthouse today ,12/13/16, as I witnessed this man screaming and cussing in the courtroom halls, as well as in the back area with all of the attorneys. He was clearly and knowingly speaking to two individuals that were both represented by other attorneys. Very very unprofessional. I have seen and been around all types of people and attorneys and NEVER have I seen a man, an attorney at that, act so out of control. This man was so rude and being so unprofessional and very disrespectful yelling and cursing with Children around. He literally threw a temper tantrum and a child would. I would never recommend him to anyone. Please be aware. I am still in awe, as was everyone else, including the other attorneys.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
