Woody and John Phillips were a fantastic help in resolving a legal issue that came up. Woody's secretary, Jan, was prompt to answer all concerns and my case outcome greatly exceeded my expectations. Overall very pleased with my experience and would recommend Woody & John to anyone who needs expert law services.

My wife, her parents, and I were hit by a drunk driver. The accident resulted in the death of my mother-in-law, the premature birth of my son, and serious injuries to the rest of us. We hired Mr. White to handle our insurance claims. He was professional and compassionate, even showing up to support us at hearings for the criminal case against the other driver. Mr. White negotiated with five different insurance companies to get us the maximum settlement. Our medical bills amounted to over $150,000, but he was able to settle with our insurance for around $12,000. On top of that, he also secured a settlement for our minor child that was over and above the limits of our policy. Throughout our case Woody kept us informed of what was going on and always answered any questions we had. I highly recommend Mr. White.

As a mother who has been in the trenches both professionally and a mother fighting the war on drugs, found herself with a son who for over a decade fighting prison and addiction. As a last ditch effort (after all went wrong) my son again was on the wrong side. I have had society telling me to walk away. As a mother it is not easy. It took me almost a month trying to say, "walk away", throw the keys away, be done!! Then one morning early I got up and said no!! I will find someone for once who will support me!! I did just exactly that!! I was scared to death!!! But this time I knew I could not do it alone!!! I found Woody White. I thought he would be just like all the others in the past! Get it done and over with, put my son in prison, let me take your monies and then be done with you and your addict son! This is a decade of a sick young man who is good when sober. If you are reading this, you know that I speak the truth. This was in fact the total opposite of Mr. White. He knew the pain in my eyes, on my face, as well as his staff. They felt the tears and heartache! They treated me and my son like we were family. Mr. White and his staff never judged my son nor myself. They knew he came from a good home. And if he did not, they did not care! My recommendations to all family members who are need of legal defense for family members who are in trouble with the Judicial System (especially while young or decades of addiction) Please call Mr. White and his staff today. I write this from the heart! Thank you. There is hope............

I would not think twice about hiring Dane for any legal representation. I have used him with several business transactions and plan to for anything in the future. He is extremely attentive. I have used other attorneys in the past and none of them have been quite as responsive as Dane. He is straightforward and to the point and always had my best interest in mind. Dane was able to successfully navigate us through business negotiations that were stressful and seemed impossible. I strongly recommend reaching out to him for any legal needs.

We were happily surprised by the quality and trust we were able to put into our relationship. He was patient with this Mom who knew her child had been treated with injustice and false accusations. He fought for us with every thing possible and pleaded for the best. I could write a page on how we are impressed. It is the fact - this is one trustworthy Lawyer. He is a good man first - but would not want to go up against him in a trial either. The package you want on your side.

This is the first time I've ever had to secure an attorney for legal assistance and I'm so glad Google lead me to Mr. Nutt. I am currently obtaining my graduate degree and had contract trouble with a fairly large and well-known organization. I would be financially ruined if I hadn't found Mr. Nutt. I tried to handle my problem alone, but was getting nowhere. As soon as he stepped in, everything changed. He was incredible from consultation through the entire process. Neither of us anticipated him being able to resolve this issue so promptly or easily, but he is so efficient and knowledgeable. I hope to not need such help again, but if ever in the future I require any legal counseling, I won't think twice about reaching out to Mr. Nutt and his firm.

I was recovering from a number of health issues, including breast and uterine cancer, when my husband and I experienced a leaking window after Hurricane Florence. During that repair, we discovered that our brand new retirement home was rotting from the inside out. Some of the plywood inside our walls was rotting, as were some of the beams that supported the structure of our home. Disheartened, we reached out to Kyle Nutt, who was representing a neighbor who had had similar problems with the same builder. If you have to go through something like this, Kyle Nutt Is your guy. Kyle is a gifted attorney and negotiator. I can’t imagine getting through these last few years without him. From the beginning of what was an exhausting and emotional multi-year process, Kyle has embodied professionalism, calm, reassurance, legal brilliance, energy, and thoroughness. Kyle and his staff made what was surely one of the most difficult times of our lives bearable. To begin, he explained the litigation process in a clear and straightforward way, spelling out our options and making recommendations on how to move forward. This was important, as my husband and I had never been involved in a lawsuit before and were nervous about the process. We spent an entire year working with the forensic structural engineer that Kyle recommended (she was amazing) and our new construction company to find everything we could that was wrong with our home to document and fix it. We were fortunate to be able to begin reconstruction prior to our lawsuit, but the cost was so great that we felt we had no option other than to sue. During that time and over the next year, Kyle helped us collect all relevant documents that we would need to argue our case for reimbursement, including emails, texts, contracts, and so forth. While going through these two years was not fun, Kyle’s sense of humor, ability to explain each step, and efficient process kept us sane. He and his staff lessened the burden as much as they could and guided us through each step. When the time came for depositions, which went on for several months, he knew both of us well enough to give us sound advice and hold our hands through the process. While I am glad that we were able to resolve our case, if that had not happened, we would have had total faith in Kyle to represent us in court and would have been optimistic about achieving a fair final outcome. Hopefully, this is our first and last lawsuit. While we will never recover those two years of our lives and hope that no one else has to find themselves in this type of situation, if you do, there is no one better to work with than Kyle Nutt. Until Kyle, I viewed attorneys as a necessary evil who were mostly for estate planning. But Kyle has turned my whole view of lawyers around. We give him our highest recommendation and compete vote of confidence.

We have worked with Charles for over 20 years and he has consistently guided us through challenging transitions. Most memorable was his steady guidance during an emotional contract negotiation. While we were inflamed enough to go to court, Charles had the integrity to talk us through a settlement that, while shorting his fee potential, left our firm on much stronger footing. For that, I recommend none other.

Cory was retained by my company at the time as a result of a buyers agent not properly informing his client of the condition of the property she was purchasing. Mr. Linesberry represented my dad in a 3 day long divorce trial recently. This is my first time ever writing a review about anyone or anything but I just have to. "Duke" Linesberry is by far the best attorney I have ever met. He did a spectacular job during the trial . He not only works as hard as he can he genuinely cares. We were all upset at this very stressful time but seeing how he fought for my dad and most importantly was by his side being so supportive that it actually put my dad at ease as well as all of us. I live in NY and am getting divorced I even joked I would pay any amount of money to steal him for 3 days to represent me in NY . Absolutely do not use this law firm. I paid 5k up front for an uncontested divorce and custody for one child. The lawyer took my money and left the firm and didn't handle eather. I now have a bill for 9k the firm says that I never paid them anything, but the contract they wrote clearly says I had to pay up front before services were rendered. I have the original receipt and contract, that are signed and dated. The firm will not do anything about it. Completely robbed me and screwed me. Highly recommend NOT to use this law firm.

We moved to Wilmington as a retirement destination. Like most we decided to build a new home in a very nice community. Building can have its interesting moments as some have learned. Not having any ties in the area, we picked Shipman & Wright to help us with a never-ending problem. This firm is extremely efficient as we first spoke with Phillip, who paired us with our attorney Jillian. As a previous builder and real estate broker it only took a few moments to know we have the right attorney. Jillian knows not only the law but every aspect of the construction industry. I have never had an attorney so on top of things, she listens and retains then goes to work with amazing communication skills which are always timely. This woman never stops and is always right there. Another good reason to move to Wilmington. Highly recommend.

Had to find new law firm because this one lied to us and here is the last email I sent to their office after finally getting my documents back along with half retainer due to the non refundable clause in the contact. Even though they breached the contract with dishonesty and poor standard of care. Placing my grievance with the state for our wasted time and funds. email from me to office manager: Is it a breach of contract to lie to your client or just a breach of ethics? We have honored our side of the contract with the expectation to get honest representation and a standard of care. Now we have a huge waste of time and money because of the professional performance of your firm. I will attach the email communication that proves that we have been told two different statements. First being an email labeled (receipts), In which I provided Mrs. Frey with the receipts she requested. In her response, "I have reviewed the discovery served upon you and have made my objections; I'll scan over to you once I return to the office. Along with it, I'll send you a tip sheet to make the process less daunting".. Document was never sent. A week later, I asked through email for an update on our CS case since I have heard nothing since the last email stating that she would scan and send documents. Her reply was "how's it going with the discovery?". Which is ridiculous to ask seeing as she had the discovery and never sent it back with the corrected questionnaire. I responded, informing her that she has the discovery and was reviewing it last week. Her response was " just double checked, looks pretty straight forward!"..... This is completely opposite of what was said the week before. Both cannot be true and can only conclude that one statement is a lie. This is a complete abandonment of trust along with the lackadaisical update on our case, especially when I am asking on a Friday evening whether we are showing up for court Monday morning because I have gotten no word from my paid attorney. I believe this is gross negligence of standard of care from your firm. I will leave a detailed review of my experience with your firm and place my grievance with the state. This is a very important matter to my family and I. I hope that other cases you have, that you treat them with more respect and care than we have received.

My Step daughter petitioned for guardianship for my spouse in a thinly veiled money and property grab against her father and me. She won against me even though I am the legal spouse. She kidnapped him into her care and won't let me near him even blocking my phone calls to him. Aaron did a very poor job with this case and I lost. He did little to no preparation and did not properly present my case . He did not obtain key elements i.e. medical records which would have proven our case. He also failed to pick apart the Medical documentation that the petitioner used to gain guardianship. She actually conducted the medical herself and had a doctor who was her former employer sign off on the incompetency. The medical that was presented was done virtually and she clearly lied on the form. The Petitioner even went so far as to admit in court that she was searching for her fathers property and admitted the doctor who did diagnoses was not my husbands regular doctor. The petitioner also failed to notify all next of kin. Aaron seems to be a nice fellow but if you need a litigator keep looking.

Had a consult, he decided it wouldn’t be worth the time to take my case even though I was out of work for 2 months, not to mention other payments that were missed. I guess $10k isn’t worth it

Had a consultation with Mr. Blanchard about an employment contract. He had reviewed all the information I provided him only an hour before the meeting. Did not seemed rushed, listens well and presented the issues as he saw them. I was impressed he asked me up front what I wanted from the deal I was considering. I cannot comment on his ability to litigate, which is where most of his practice time is spent. However I would choose to work with him if I had a case to try.

Maynard sat on my case for nearly 2 years, did not pick up structural reports that sat on the engineer's desk for 16 months, never challenged the opposite to even visit the property claim in question, began working on the case with extensive overtime costs 2 weeks before trial, only wanted to settle, cost me for his arrogance and incompetence. I had to pay stenographers for overtime, consultants for hastily prepared incomplete work. I true ambulance chaser! He's an insurance attorney NOT a litigator. His desk has to have 4 feet of papers scattered everywhere. no organization, no help

Had a patient who almost died from drinking alcoholic beverages and Steve wanted the patient to hire him to sue me. She had her chance and decided to go after the bigger pockets and tried to sue the rehab facility for not providing drinks within normal date of service.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
