Sarah did a wonderful job of making a really ruff time in my life bearable. She was always there to answer my questions and keep me updated on progress of divorce. Sarah did a wonderful job of watching out for side of things and made sure I thought with my head and not my heart . So in ten years I wouldn’t be saying what was I thinking when I did that. I would recommend Sarah to any man going thru a divorce.

I met Dale when he and his colleague Joe Della-Rodolfa had represented me in some federal & state matters. He is one of the best - point blank... I have been to many offices and been in several claims/cases - his team was by far the BEST out of every other encounter.. He is honest, he will listen to you, he will fight for you, and he will have no reservations whatsoever in speaking his mind to stand up for what's right. He is a very honorable person and he has no issues with being firm and aggressive in his stance while fighting for you! A++ and a 20 out of 10 in my view.. I`ll follow him and Joe for life - they will be the main two I call for any future matters if within their practice areas for sure!

About 15 years ago my attorney for many years dropped his private practice to work for a Federal Judge. I wandered in the wilderness for most of time since and about two weeks ago I had something come up where I really needed good, competent legal assistance. I scanned Google for a familiar name and saw Bernstein, Stair & McAdams whom I recognized and gave them a call. I was put through to Mike Moyers. I am not an attorney but I have a better than average understanding of business law and have a lot of practical business experience and knew within a few minutes I had found the right guy. It was clear that Mike understood the problem and knew what he was doing. He handled my situation deftly and was always out in front of what was going on. Problem solved. I found my new guy. Thank you Mike. Well done sir.

I have known Mike Moyers since he was a Chancellor on the bench for 20 years. I appeared in his Court for many years. He was compassionate about his work as a Judge. Recently, he decided to retire as Chancellor and move to practicing law again. He wants to help people and use his expertise to help those people struggling and need help. He is an asset to our legal community. He is genuinely a kind person and very intelligent. In my life there are few people that I consider to be "real" and he is one of the few. He calls it how he sees it with honesty and integrity. His representation brings his clients the "edge" of being a Judge for years and now a litigator. I personally rely on reviews when I am searching for professionals, travel, etc. I focus on reviews that are sincere and appear to be "real." I assure you that Mike Moyers will provide you with top notch legal representation. It appears that I now have a major competitor in my profession. I welcome him back. He is a good one! Definitely 5 stars.

Great lawyer. Very friendly, and most importantly very honest - in my case he was very upfront at all points about what he thought our odds were, and gave excellent advice that made it clear that he had my best interests in mind, and wasn't trying to get extra billable hours. If I ever need to hire a business lawyer in Tennessee again, he would 100% be my first call.

I am a father of three. I was never married to their mother, and she was not allowing me to see them. I wanted to just get visitation rights to see my children again. I had been paying for child support, and knew that I had rights as their father. However, I was unclear as to what they were. A friend had referred Patti Jane Lay to me. I will say that I almost hired another attorney because she is difficult to get a hold of. Luckily, God put in my heart to just be patient, and she returned my call the next day. Patti Jane was amazing in just explaining to me the different options I could take. After a troubling phone call from my son, I decided that I needed to go after emergency custody. We had to travel across the state just to even take it to court. She made me feel confident every step of the way. Patti Jane seemed to anticipate everything that would take place, therefore she prepared me for everything. I didn't just get rights to my children, I now have full custody of my children, and I am so grateful for her. I found it comforting that her husband is a retired attorney, that came to the courthouse as well, and her son is an attorney as well! What's even better was when I got my bill, and I really feel like I got the deal of a lifetime! She was so helpful and an absolute Godsend. The best part about her is that, she actually cares as to what is best for the children. I highly recommend her if anyone is curious about child custody.

I had an issue regarding a car accident that I couldn't get resolved with my insurance company. I turned the problem over to Mr. John Butler of Butler, Vines and Babbs Law. Mr. Brown agreed to represent me for two separate traffic offenses and gave me a slightly reduced rate ($500 for both). However, he instructed me to go ahead and pay the original higher rate ($300) for the first ticket he had already billed me for and then he sent a second bill for $200, which I also paid in good faith. The result of Mr. Brown's representation for the speeding ticket was disappointing. He was only able to get the speed reduced slightly and the court costs reduced accordingly, but I still wound up with three points against my license and over a hundred dollars in court costs on top of what I paid him! It has been a number of years since I needed a traffic attorney, but back when I drove cross country and picked up an occasional speeding ticket, they were always able to get the ticket dismissed. Mr. Brown's excuse was that the court in Alcoa was very hard line on speeding tickets. But when he voiced his apprehension about being able to effectively represent me for the second ticket where the other driver actually struck me, I began to wonder whether this guy knows what he's doing. I've had a few traffic attorneys represent me over the years and this is the first time I ran into one who considered himself ineffective. When I expressed my concern, he abruptly withdrew from my case, but said he will only refund $200 instead of the $250 we had agreed to when he agreed to represent me for the second traffic offense. Not only do I feel duped by an attorney who is clearly ineffective, I feel ripped off by an obvious con artist.

I presented my case to Alexander which was a small claims case. He took it very serious and immediately began contacting necessary parties upon receiving all my information. Alexander kept in close contact with updates on the case as they happened. Alexander always returned my calls in a timely manner. Alexander asked me to collect specific paperwork regarding my case and then did all the communication with the other parties which made it very easy on me. I would highly recommend anyone to seek Alexander's expertise.

What a Mediation Lawyer Can Do for You

A mediation lawyer specializes in resolving disputes outside of the courtroom through a process called mediation. Mediation involves a neutral third-party mediator who helps the disputing parties reach a mutually acceptable agreement. Mediation lawyers can represent clients in various matters, including divorce, business disputes, employment conflicts, contract issues, personal injury claims, and more.

Unlike litigation, mediation is a less adversarial and more cost-effective way to settle disputes, often leading to faster resolutions and preserving relationships between the parties involved.

When Should I Hire a Mediation Lawyer?

Consider hiring a mediation lawyer when you’re involved in a dispute and want to avoid the time, expense, and stress of going to court. Common reasons to hire a mediation lawyer include:

  • Divorce or child custody disputes: A mediation lawyer can help you reach a fair settlement on issues like property division, alimony, and parenting arrangements without going to court.
  • Business or contract disputes: For disagreements such as contract disputes, partnership conflicts, or intellectual property issues, a mediation lawyer can assist in resolving the matter through negotiation.
  • Employment disputes: Issues like wrongful termination, discrimination, or wage disputes can be addressed through mediation to find common ground and avoid lawsuits.
  • Personal injury cases: Mediation can help both parties agree on compensation in cases like car accidents or slip-and-fall claims without a prolonged court battle.
  • Property disputes: Disputes over property ownership, landlord-tenant issues, or boundary disagreements can be settled more amicably through mediation.
  • Family or inheritance disputes: Mediation can help resolve conflicts over wills or trusts without further dividing the family.

What Does a Mediation Lawyer Do?

A mediation lawyer provides a range of services to help clients resolve disputes through negotiation and mutual agreement. Their responsibilities often include:

  • Representing your interests: Acting as your advocate during mediation to ensure your rights are protected and you understand your legal options.
  • Preparing for mediation: Reviewing the facts of the case, gathering necessary documents, and advising you on potential resolutions.
  • Facilitating communication: Helping to facilitate open and constructive dialogue between parties to clarify points of contention.
  • Negotiating settlements: Assisting in negotiating fair and balanced settlement terms that are in your best interest.
  • Drafting mediation agreements: Preparing the official mediation agreement that outlines the terms of the settlement, which is often legally binding.
  • Avoiding litigation: Aiming to reach a settlement that eliminates the need for a court trial, saving time and resources for both parties.
  • Handling complex legal issues: Explaining the legal implications of various settlement terms in cases with complicated legal matters.

How Are Mediation Lawyers Paid?

Mediation lawyers typically charge for their services based on the complexity of the case and the time involved. Common payment methods include:

  • Hourly rate: Charging an hourly fee ranging from $150 to $500 or more, depending on experience and case complexity.
  • Flat fee: For simpler mediations, some lawyers may offer a flat fee covering all legal work involved in the process.
  • Retainer: In ongoing or complex cases, a retainer may be required as an upfront payment billed against as work progresses.

Discuss fees and payment structures with your lawyer during the initial consultation to understand the cost of mediation services.

How Much Does a Mediation Lawyer Cost?

The cost of hiring a mediation lawyer depends on several factors, including the case's complexity, the lawyer’s experience, and the time required to resolve the dispute. General cost estimates include:

  • Hourly rates: Typically between $150 and $500 per hour.
  • Flat fees: For simple mediations, fees may range from $1,000 to $5,000.
  • Total mediation costs: Can vary widely, from $2,000 to $10,000 for straightforward cases, up to $10,000 to $50,000 or more for complex disputes.

Always request a detailed cost estimate during your consultation to understand total expenses.

Top Questions to Ask a Mediation Lawyer

Before hiring a mediation lawyer, consider asking the following questions:

  1. What experience do you have with mediation cases like mine?
Ensure the lawyer has relevant experience in handling similar disputes.
  2. How do you charge for your services?
Clarify the fee structure and request an estimate based on your specific case.
  3. What is the likelihood of resolving my case through mediation?
Seek an honest assessment of whether mediation is suitable for your situation.
  4. How long will the mediation process take?
Inquire about the expected timeline and number of sessions required.
  5. Will you personally handle my case?
Confirm who will manage your mediation and represent your interests.
  6. Can we pursue alternative dispute resolution (ADR) if necessary?
Ask about other forms of ADR, such as arbitration, if mediation doesn't resolve the conflict.

How to Check the Credibility of a Mediation Lawyer

To ensure you're hiring a reputable mediation lawyer, take the following steps:

  • Verify their bar status: Confirm with your state bar association that the lawyer is licensed and has no disciplinary history.
  • Look for mediation experience: Review their website or professional profile for specialization in mediation and successful case histories.
  • Read client reviews and testimonials: Check platforms like Avvo, Martindale-Hubbell, or Google for client feedback.
  • Ask for references: Request references from past clients familiar with their mediation skills.
  • Check for certifications: Look for certifications from organizations like the American Arbitration Association (AAA) or the Association for Conflict Resolution (ACR).

What Should I Prepare for My First Consultation?

To maximize the effectiveness of your initial meeting, bring the following:

  • Relevant documents: Any materials related to the dispute, such as contracts, emails, financial records, or court filings.
  • List of key issues: A detailed list of the main points of contention that need resolution.
  • Timeline of events: A chronological account of events leading up to the dispute, including prior resolution attempts.
  • Goals for the mediation: Be prepared to discuss your desired outcomes and areas where you're willing to compromise.
  • Questions for the lawyer: Any queries about the mediation process, fees, or their approach to dispute resolution.

Being well-prepared will help the lawyer assess your case effectively and provide the best possible advice for resolving your dispute through mediation.
