Mark Rafidi charged my opinion about lawyers. There still are good honest lawyers. He did a great job with my case & went over & above what I expected from a law firm. Stephanie does a great job & is always available with information & answers. I HIGHLY recommend this law firm & especially Mark Rafidi.

Very professional, very communicative. I had so many people reach out after my accident and I wasn’t sure what to do. The chiropractor I went to recommend Attorney Mark to me. Honestly I’m so glad I didn’t just go with the first person who contacted me. I would come back, and I will recommend them to anyone I know who gets into an accident.

I dont normally leave google reviews, but felt my experience was needed to be shared. In November of "23" I spoke with Frank Cassese when he worked for another firm. After filling out the consultation form online, he called me the very next day. I had high hopes for him following our discussion on my son and his medical malpractice case. We had discussed sending files and documents to be reviewed. This took us 6-8 weeks to get all the most updated files on our son to Frank. January "24" comes around and I follow up to make sure documents and CDs were recieved, to find out he no longer works there and has moved to this current firm. I called for months trying to find out what happened to the documents with no response, nobody knew anything I was talking about. Fast forward to summer of "24" I finally get ahold of Geena, Franks paralegal. Stated they would set up a zoom meeting for August 26th,2024, and frank would review the files, that I had sent. August rolls around and the zoom meeting lasted about 5-10 min, in my opinion quick for a child that is severely disabled. Frank told me if i didn't hear anything back in 2 weeks from that meeting to call. I sent a follow up email on Sept 11th, 24, the response I got back was from Geena stating If you need anything please feel free to email me if you cannot get a hold of Frank. I called her to let her know I did not have franks email, and left a message for her because she was in a meeting. October 23rd came around and I never got a return call, message nothing, so I decided to send my last email stating why I was contacting them, from our August Zoom call, and if I could just get a response on my sons case. Here we are November 2nd, I have heard nothing, this has been almost a year of absolute mess. Any individual dealing with a special needs child that is reaching out for help and advice, It would be nice if individuals could be transparent if they can help or can’t help. If you read under medical malpractice on their website and the example they give, that is what happened to us, and what we go through on a day to day basis. I feel like I have given patience and have been very understanding, with no communication given.

I could not recommend James Melli, Daniel Leslie and the rest of the wonderful staff at Betras Kopp & Markota more. The team was compassionate, professional and confident. Their care and grit was the comfort I didn’t realize I was missing during this unfortunate process. This law firm handled my case with grace and class, saving me thousands in legal bills and sparing unnecessary points on my drivers license. I cannot thank this team enough for what they provided me and my family over the months and weeks of the ongoing case. I would highly recommend this law firm.

If you like to be lied to and treated like garbage then this is a good place to throw money to; terrible personal injury FIRM! Four long miserable years of their negligence! Attorney Betras “promised” on more than one occasion to personally handle my claim. Attorney Betras did not handle my claim, as he stated to me. He never called me back with corrected or updated info… always “let me check and get back with you”; but NEVER did. Attorney Betras did not come to mediation. Attorney Murkota arrived late to mediation. Attorney Murkota tried to threaten me that he could legally keep 40% of my net; pressuring at the time of mediation. Attorney Murkota was not part of this firm when I signed with them June 2018. No one contacted me prior to mediation to go over the procedure or what to expect. I was lied to the entire 4 year period and suffered economical hardship during the entire time. Lack of representation and professionalism! If your case is not worth millions, then you get treated accordingly!

David was my criminal lawyer for 4+ years. Initially, he was able to negotiate a plea agreement for me, but his negotiating style was to simply give into the US Attorney in most cases. I basically had no choice to accept, and David used scare tactics to get me to agree. When in court, David fumbled over his papers and questions to witnesses. The DA was more prepared than my own lawyer. Then David basically abandoned me when I was on probation, and it took weeks at times to get him to return my phone calls. I kept David as my lawyer, as there was little to do in my case -- when he did have to submit motions, it was a difficult experience. He wouldn't listen on the phone. He put a junior lawyer who hadn't passed the Bar yet on the case, who I learned he paid $11/hour (and charged me $75/hour for his services). Frankly, this junior lawyer was better than David who would make many mistakes on the motions -- some of which I'd catch, and others were submitted to the courts with mistakes on dates and details. I found myself complaining about David to this junior lawyer, who agreed with my concerns, and told me that David also yelled at him all the time. One time, David met me for a meeting at a restaurant, and literally played trivia games on his phone (asking me to help with the questions). Then he announced that he had to leave after we'd spoken about my case for less than 15 minutes. Basically, David always has to be right about everything. He will argue with you, scream at you, be condescending, be passive-aggressive, etc. For all the years as my lawyer, David never once gave me a detailed hourly statement, which I requested many times. He would just negotiate for every dollar and not do the work until he was paid in advance, and when you need things to be done on a criminal case, you're in no position to negotiate. While I was in jail, I had to give David power of attorney and use my credit card. He paid himself, and then didn't pay the credit card bill costing me over $1,500 in interest and penalties, which I did't discover until I got out of jail. Several times I asked David to help intervene with my probation officer -- his tactic was to tell me to do everything they said, or "they will put you back in jail!". I was very scared, and didn't know what to do. In the end, David abandoned me when I had a probation violation. He refused to take my calls from jail, or calls from my friends/family until I paid him another $25,000 on top of the $200,000+ I'd already paid him. David wouldn't even recommend another lawyer. It became all about the money, and he dropped me as a client in my time of great need. I had no choice but to hire another lawyer at considerable cost just to get up to speed on my case. David refused to help this new lawyer, and literally wouldn't give him any of my case materials from the years he'd been my lawyer, which made it very difficult for the new lawyer to represent me.

What a Medical Malpractice Lawyer Can Do for You

A medical malpractice lawyer specializes in helping individuals who have been harmed due to the negligence or misconduct of healthcare professionals, such as doctors, nurses, or hospitals. These lawyers assist in cases where a healthcare provider deviates from the accepted standard of care, resulting in injury or death. Medical malpractice cases can involve misdiagnosis, surgical errors, medication mistakes, birth injuries, and other forms of medical negligence.

If you or a loved one has suffered harm due to improper medical treatment, a medical malpractice lawyer can help you understand your legal options, file a lawsuit, and pursue compensation for medical expenses, pain and suffering, lost wages, and other damages.

When Should I Hire a Medical Malpractice Lawyer?

Hiring a medical malpractice lawyer is essential if you’ve been seriously injured due to the negligence of a healthcare provider or institution. Situations where you should seek legal representation include:

  • Misdiagnosis or delayed diagnosis: If a doctor fails to diagnose or delays diagnosing a medical condition, leading to harm or progression of the illness.
  • Surgical errors: Harm resulting from surgical mistakes such as operating on the wrong site, leaving instruments inside the body, or performing unnecessary procedures.
  • Medication errors: Injuries caused by prescribing the wrong medication or dosage, or mistakes made by pharmacists in dispensing drugs.
  • Birth injuries: Injuries to a newborn due to medical negligence during labor and delivery, such as failing to perform a timely C-section or improper use of delivery instruments.
  • Anesthesia errors: Complications arising from improperly administered anesthesia, which can lead to serious injury or death.
  • Inadequate follow-up or aftercare: Suffering due to lack of proper monitoring or care after a medical procedure, leading to complications.
  • Hospital or nursing home negligence: Harm caused by the negligence of hospital staff, nurses, or administrators who failed to provide adequate care.

Medical malpractice cases are complex, and hiring a lawyer early can help ensure your rights are protected and your case is handled effectively.

What Does a Medical Malpractice Lawyer Do?

A medical malpractice lawyer provides various legal services to help injured patients hold negligent healthcare providers accountable. Their responsibilities include:

  • Evaluating your case: Reviewing medical records and consulting with experts to determine if you have a viable claim based on the standard of care and harm suffered.
  • Filing a lawsuit: Initiating legal action by filing a complaint against the responsible parties in the appropriate court.
  • Gathering evidence: Collecting medical records, expert testimonies, and other relevant evidence to build a strong case.
  • Negotiating with insurance companies: Working to secure a fair settlement that compensates you for your injuries without the need for a trial.
  • Litigating in court: Representing you during trial proceedings if a settlement cannot be reached, presenting evidence and arguing your case.
  • Calculating damages: Assessing the full extent of your losses, including medical expenses, lost income, pain and suffering, and future care needs.
  • Handling expert testimony: Coordinating with medical experts who can testify on how the standard of care was breached and how it led to your injuries.

How Are Medical Malpractice Lawyers Paid?

Most medical malpractice lawyers work on a contingency fee basis, which means they only get paid if they recover compensation for you. Key aspects of this payment structure include:

  • Contingency fee percentage: The lawyer's fee is typically between 25% and 40% of the settlement or award.
  • No upfront costs: You do not pay any legal fees unless the lawyer successfully recovers compensation on your behalf.
  • Case expenses: Costs for expert witnesses, medical record retrieval, and court fees may be deducted from your settlement or award in addition to the lawyer's fee.

Always discuss the fee arrangement during your initial consultation to understand your financial obligations.

How Much Does a Medical Malpractice Lawyer Cost?

The cost of hiring a medical malpractice lawyer is usually based on a contingency fee model. General estimates include:

  • Contingency fee: Lawyers typically charge between 25% and 40% of the total recovery amount.
  • Case expenses: Additional costs such as expert witness fees and court expenses can range from $5,000 to $50,000 or more, depending on the case complexity.

Ensure you receive a clear explanation of all potential fees and expenses before proceeding with your case.

Top Questions to Ask a Medical Malpractice Lawyer

Before hiring a medical malpractice lawyer, consider asking the following questions:

  1. What experience do you have with medical malpractice cases like mine?
Confirm the lawyer has a successful track record with similar cases.
  2. How do you charge for your services?
Understand the contingency fee percentage and any additional costs you may incur.
  3. What is the likelihood of success in my case?
Seek an honest assessment of your case's strengths and potential challenges.
  4. How long will the process take?
Get an estimate of the timeline for settling or taking the case to trial.
  5. Will you handle my case personally?
Ensure you know who will be managing your case and their level of involvement.
  6. Have you worked with expert witnesses?
Verify the lawyer's experience in collaborating with medical experts essential for your case.

How to Check the Credibility of a Medical Malpractice Lawyer

To ensure you're hiring a reputable lawyer, take the following steps:

  • Verify their bar status: Check with your state bar association for their license and any disciplinary actions.
  • Review their experience: Look for specialization in medical malpractice and a history of successful cases.
  • Read client reviews: Consult platforms like Avvo or Martindale-Hubbell for testimonials and ratings.
  • Ask for references: Request contact information of previous clients willing to discuss their experience.
  • Check professional affiliations: Membership in organizations like the American Association for Justice (AAJ) indicates a commitment to the field.

What Should I Prepare for My First Consultation?

To maximize the effectiveness of your initial meeting, bring the following:

  • Medical records: All documents related to your treatment and injury.
  • Evidence of harm: Photos, medical bills, and records of lost wages.
  • Communication records: Any correspondence with healthcare providers or institutions.
  • List of healthcare providers: Names and contact information of all involved medical personnel.
  • Questions for the lawyer: A prepared list to address all your concerns.
  • Timeline of events: A detailed chronology of your medical care and the issues encountered.

Being well-prepared helps the lawyer assess your case accurately and advise you on the best course of action.
