Kevin McCann is not only a fabulous lawyer but an absolutely amazing person in general. He has never let my family down and has continued the hard fight to prove my father’s innocence for the past 3 1/2 years. This man has a strong backbone and a desire to fight for what is right. It took almost 17 years of begging someone to help us to finally be led to the legend that is Kevin McCann. For the rest of my life I will tell everyone I know about this man, how courageous and dedicated he is to helping others. Kevin is the person you want on your side when your life is on the line or you just need someone to stand beside you. Thank you Kevin for everything you’ve done for my father, me and everyone else you have fought for! We are blessed to know you!

Kevin was very helpful from the initial consult to finalizing the case. He explained and represented with professionalism that I thought was lost in the lawyer arena. Our HOA dispute was completed with the best results we could have hoped for. Will use him again for my personal issues - hopefully I never will need him again!

I would highly recommend Mr. McCann for representation in both local and Federal courts. His prior law enforcement experience combined with his extensive understanding of Federal agency interactions provides the kind of depth necessary for sound legal representation in several areas of law. Mr. McCann handled representation for my family in local courts, represented me personally in employment related issues, and even prepared my will. I have referred multiple clients to him for criminal representation. His personalized attention to his clients is a welcome change from the mid to larger sized firms.

Divorce, now that is a proposition that nobody looks forward to, I know I did not. When the other person in the marriage has given up on you and refuses to work on the marriage anymore you kind of run out of options though and as hard and daunting as that seems, divorce is sometimes the only option left. This was my case after almost 20 years, a paid off home, no debt and four beautiful children. Honestly, as a Christian man divorce was certainly not something I ever wanted or thought I would do in my lifetime. So, I hung in there (probably a little too long) hoping things would or could get better but I was only living in a fog and one day finally realized things were never going to change. Yes, I prayed for her and for God to help our marriage, but the answer was no. Simply put It takes two. Both people in the relationship must be willing to work on it or it just will not work, and she wasn’t interested in fact she had already lined my replacement. I had heard the ads on the radio for years about a divorce lawyer specifically for Dad’s but after paying a 150.00 consultation fee and meeting with one of their attorneys in Orlando I was not really impressed. It just did not feel like they would represent me well after our meeting. I remember leaving there quite unsure and discouraged about moving forward. To be honest, I do not like attorneys in general because of past experiences. I contemplated and really wished I could of just do it all myself but that was just not realistic with the complex nature and lack of wisdom on my part. That is when a friend recommended me to Kelly Duncan’s office in Cocoa Village. I called and was able to get in and speak with her the following day. I explained my situation as there were many complications. The most important part that I conveyed to Kelly that day was my desire to have an ongoing, continuing relationship with my children like I always have. She reassured me about everything and was very knowledgeable. After speaking with Kelly, I knew immediately that she was the right choice. She offered me a payment option or a flat fee for the whole thing which was nice. She totally took charge and guided me through every step. She helped me like I was a close friend from beginning to end. Everyone on her team was also very kind, respectful and supportive towards me throughout the whole process. I am very happy with the outcome and my divorce which is thankfully behind me now. I have referred a good friend to her and he is also very impressed with her knowledge and skill navigating through everything. If you are looking for a great Attorney that will fight for you and your rights as a Father Kelly Duncan will not disappoint you. She really knows her stuff; she cares a lot and does not like to lose. Remember I mentioned earlier how I did not really like attorneys that much? Well, that has changed a little, because of Kelly, she was not just my attorney, and I was not just another client she genuinely cared for me, and my family and I am happy to now call her, friend.

She is a great lawyer. She took great care of my parents affairs. Never took advantage. She is a very professional and caring attorney. She even took time out of her busy schedule to attend their funeral. She ensured I had a good and fair estate attorney to handle my parent's affairs. I would highly recommend her without a second thought.

Kelly was absolutely amazing with my case. She was so detailed and gave me great advice that helped us win my case. Her knowledge of family law was amazing and I will refer her to anyone I can. Her and her office staff great, you can truly tell they all care deeply for their clients. As for the bad review that’s in here. He contract clearly states the money that’s due up front is not refundable. Even if your mind is changed to not go forward. A lot of time and work goes in to the first two weeks for her that you may not know or see. They all do a lot behind the scenes we don’t necessary see and I know they did that with my case and it all paid off.

Sarah Lewis Litigation Paralegal, this one cant read or write. In a gripping legal drama, Sarah Lewis found herself at the center of a contentious litigation that not only tested the boundaries of legal ethics but also showcased the murky waters of courtroom rivalry. As the case unfolded, it became increasingly apparent that Lewis resorted to a series of deceptive tactics to sway both her opponents and the presiding judge. Allegations surfaced that she fabricated appointments and misrepresented key evidence, painting her adversaries in an unfavorable light while simultaneously positioning herself as the victim of a convoluted legal conspiracy. The courtroom, charged with tension, reflected the intricate dance of influence and persuasion as the cunning strategies appeared to gain traction, causing discomfort among the opponents who struggled to maintain their composure. With an undeniable charisma, she managed to impress upon the judge her narrative of victimhood, leveraging courtroom decorum to evoke sympathy and allegiance. Each day, as her meticulous lies unraveled, the case became a profound examination of moral dilemmas and the lengths an individual might go to secure victory, leaving a palpable tension that echoed beyond the court’s walls and into the realm of public perception.

Navigating the complex world of law, as exemplified by firms like Rigdon Alexander & Rigdon LLP, can sometimes raise ethical questions, particularly concerning the behavior of attorneys and their motivations in representation. While most legal professionals strive to uphold integrity, advocates for justice, and ethical standards, the competitive nature of the legal field can lead some to engage in less-than-honest practices to secure a financial advantage. This behavior often stems from the pressure to win cases and the incentive structures within the legal system, where success can translate into substantial monetary rewards. Unfortunately, this pursuit of profit can result in tactics that may damage individuals' lives, particularly those on the receiving end of aggressive legal maneuvers, deceptive tactics, or manipulation of truth. Such actions highlight a critical need for accountability and reform within the legal profession to protect the rights and dignity of all individuals involved, ensuring that justice prevails over profit. This dichotomy between ethical lawyering and the darker side of legal strategy is a complex conversation that continues to evolve as society demands greater transparency and accountability from legal practitioners. Sarah Lewis and Kurt Alexander, both attorneys at the firm in question, have garnered controversy for their unconventional practices that some critics argue rely more on psychological maneuvering than on legal fundamentals. Known for their ability to weave confusion into the fabric of their arguments, they employ techniques that blur the lines between clarity and ambiguity, often leading judges and juries into a maelstrom of doubt regarding the facts presented. By masterfully crafting their prose, they manipulate the language of the law to create narratives that can overshadow the evidence, raising ethical questions about the methods employed in the pursuit of winning cases. This approach has proven effective in complex litigation, where the intricacies of the law can sometimes obscure the truth, but it has also sparked debates within the legal community about the responsibilities of attorneys to uphold the spirit of justice. As they navigate the murky waters of legal ambiguity, Lewis and Alexander exemplify how skillful rhetoric can be wielded like a double-edged sword, capable of both achieving success and risking the integrity of the legal profession especially when you have judges that does not pay attention. The sense of betrayal is profound when the very institutions meant to uphold justice appear compromised. In this scenario, seeking out allies who can stand witness to your experiences becomes crucial. I stand ready to testify on your behalf, bringing attention to any irregularities, malpractices, or injustices you have endured. This isn't merely about recounting events; it's about amplifying your voice and shedding light on the systemic issues that may lurk behind closed court doors. Together, we can challenge the narrative, exposing the intricacies of a system that may prioritize personal agendas over the principles of fairness and integrity. My testimony aims to not only support you but also to advocate for a legal framework that respects the rights of all individuals, ensuring that the scales of justice are balanced once more.

What a Personal Injury Lawyer Can Do for You

A personal injury lawyer specializes in helping individuals who have been physically or emotionally injured due to the negligence or wrongful actions of another party. Whether you've been hurt in a car accident, suffered a slip and fall, or experienced medical malpractice, a personal injury attorney works to ensure you receive fair compensation for your injuries. They can help you recover damages for medical bills, lost wages, pain and suffering, and other related expenses.

Personal injury lawyers act as your advocate, navigating the legal system on your behalf and dealing with insurance companies to ensure you get the compensation you deserve. They understand how to handle complex legal matters and help you avoid common pitfalls.

When Should I Hire a Personal Injury Lawyer?

Hiring a personal injury lawyer can be beneficial in many situations where you've been harmed due to another's negligence. Some key scenarios include:

  • Severe injuries: If you've suffered significant or permanent injuries that result in substantial medical bills, a lawyer can help ensure you are fairly compensated.
  • Long-term or permanent disability: Injuries that affect your ability to work or require ongoing medical treatment are complex, and a lawyer can help estimate long-term damages.
  • Disputed liability: If the responsible party or their insurance company denies liability for your injury, a lawyer can gather evidence and advocate on your behalf.
  • Insurance company lowball offers: Insurers often try to settle personal injury claims for as little as possible. A lawyer can negotiate to get you a fair settlement.
  • Medical malpractice claims: Injuries caused by a doctor, nurse, or healthcare provider due to negligence require a personal injury lawyer experienced in medical malpractice law.
  • Exposure to hazardous substances: If you've been injured due to exposure to toxins, chemicals, or dangerous substances, a lawyer can help pursue legal action.

Hiring a lawyer early in the process is crucial, especially if you're unsure of the full extent of your injuries or damages.

What Does a Personal Injury Lawyer Do?

A personal injury lawyer provides a wide range of services to guide you through the legal process and maximize your compensation. They can:

  • Evaluate your case: A lawyer will assess the strength of your claim and determine whether you have a viable case.
  • Investigate the incident: Gathering evidence such as police reports, witness statements, medical records, and expert opinions is key to building a strong case.
  • Negotiate with insurance companies: Lawyers handle communications with insurance companies to ensure you receive a fair settlement and aren't taken advantage of.
  • File a lawsuit if necessary: If a fair settlement can't be reached, the lawyer can file a personal injury lawsuit on your behalf and represent you in court.
  • Help calculate damages: This includes medical expenses, lost wages, future medical needs, pain and suffering, and emotional distress.
  • Prepare and file legal documents: Lawyers handle all the paperwork and deadlines associated with your case, including filing motions and discovery requests.
  • Represent you at trial: If your case goes to trial, the lawyer will argue your case before a judge and jury to obtain the compensation you deserve.

How Are Personal Injury Lawyers Paid?

Most personal injury lawyers work on a contingency fee basis. This means they only get paid if they win your case, either through settlement or a court judgment. Here’s how it works:

  • Contingency fee percentage: The lawyer will take a percentage of the settlement or award, typically between 25% and 40%, depending on the complexity of the case and the stage at which it's resolved.
  • Costs and expenses: In addition to the contingency fee, the lawyer may deduct other costs associated with the case, such as filing fees, expert witness fees, and court costs. These expenses are often advanced by the lawyer and repaid out of the settlement.
  • No upfront payment: Since the lawyer’s fee is contingent on winning, you usually don’t pay anything upfront.

Always discuss the lawyer’s fee structure during your consultation to avoid surprises.

How Much Does a Personal Injury Lawyer Cost?

The cost of hiring a personal injury lawyer depends on the specifics of your case and the lawyer’s fee structure. However, since most personal injury lawyers work on a contingency fee basis, the amount you pay will depend on the outcome of your case. Here are some general guidelines:

  • Contingency fees: Typically range from 25% to 40% of the settlement or award. The percentage may increase if the case goes to trial or requires an appeal.
  • Other costs: In addition to the lawyer's fee, you may be responsible for case-related expenses such as expert witness fees, medical record retrieval fees, and court costs. These are often deducted from your settlement, so you won't have to pay out of pocket.

While the cost may seem high, hiring an experienced lawyer can significantly increase the amount you recover, making it a worthwhile investment.

Top Questions to Ask a Personal Injury Lawyer

Before hiring a personal injury lawyer, it's essential to ask questions to ensure you’re choosing the right representation. Here are some important questions to ask:

  1. What is your experience with personal injury cases like mine?
Make sure the lawyer has handled cases involving similar injuries or accidents.
  2. What is your fee structure?
Clarify whether the lawyer charges a contingency fee and what percentage they will take from any settlement or award.
  3. How long will my case take?
While it's hard to predict, a lawyer can give you an estimate based on similar cases they’ve handled.
  4. How often do you take cases to trial?
Some lawyers prefer to settle quickly, while others are more comfortable going to court if necessary.
  5. Will you personally handle my case?
In larger firms, junior lawyers or paralegals may handle some aspects of your case, so it's important to know who will be managing your claim.
  6. Do you have references from past clients?
Speaking with past clients can provide valuable insight into the lawyer’s effectiveness and professionalism.

How to Check the Credibility of a Personal Injury Lawyer

To ensure you’re hiring a credible personal injury lawyer, take the following steps:

  • Check bar association records: Verify that the lawyer is licensed and in good standing with your state’s bar association. Look for any history of disciplinary actions.
  • Read client reviews and testimonials: Online platforms like Avvo, Martindale-Hubbell, and Google reviews can provide insight into the lawyer's reputation and client satisfaction.
  • Look at their track record: Review their experience with personal injury cases, particularly how many cases they’ve successfully resolved or taken to trial.
  • Ask for references: Credible lawyers should be willing to provide references from past clients who can vouch for their work.
  • Check professional memberships: Lawyers who are members of respected organizations, like the American Association for Justice (AAJ), often have a solid reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with a personal injury lawyer, prepare the following:

  • Detailed account of the accident: Write down everything you remember about the incident, including dates, times, and locations. Include any witnesses or police reports if available.
  • Medical records and bills: Bring any documentation of your injuries, treatments, and associated medical costs.
  • Insurance information: Provide your insurance details and any communication you’ve had with the other party’s insurance company.
  • Employment and income records: If your injury has impacted your ability to work, bring proof of lost wages or reduced earning capacity.
  • Photos or videos: If you have photos of the accident scene, your injuries, or property damage, bring them to your consultation.
  • Questions for the lawyer: Prepare a list of questions to ask, including how the lawyer will handle your case and what you can expect in terms of timeline and outcome.

By preparing thoroughly for your first consultation, you’ll help the lawyer understand your case more quickly and get a better sense of your legal options.
