Richard Morgan and team provided timely and professional service. Richard listened and asked lots of questions to ensure we received advice and made decisions that fit our needs. He took time to explain how things worked. In our case, we selected Revocable Living Trusts for our estate plans. Richard and team delivered high quality documents on the initial drafting. The document reviews and execution were efficient, and the executed documents were delivered to us timely in electronic files and professionally organized and bound hardcopy. I highly recommend Morgan & DiSalvo

I wanted to take a moment to describe what a fantastic job Loraine DiSalvo and her team did while helping us to work through our sister’s estate after she passed away unexpectedly. As you can imagine this was a stressful and sad time for our family and Loraine’s balance of compassion and pragmatism helped us immensely. Loraine responded promptly to requests for information with practical recommendations and options for how to move forward with decisions. In addition, Loraine’s partner provided valuable advice regarding how to wrap up outstanding issues with the estate such as a vehicle that my sister had leased. It is worth mentioning that between state and federal government filings this process has taken several years to bring to a close and Loraine has been there consistently throughout. It is hard to imagine a more supportive, helpful, and knowledgeable advocate than Loraine DiSalvo and I highly recommend her for your legal needs.

Attended the SFST student course facilitated by Anthony Palacios and his team-- It is ESSENTIAL that you take this course if you are an attorney specializing in DUI litigation. I can confidently walk into any courtroom and approach any DUI-related police investigation and feel that I am providing the most competent and effective advocacy and representation for my client armed with the knowledge I picked up from this course. Thank you to Anthony and team for a fantastic weekend. Would definitely recommend, 5/5 stars

My wife and I needed to revise our estate planning documents, because since our last documents were executed we had moved to Georgia, our adult daughter had become disabled, and the tax laws had changed. Allison was very knowledgeable and thoroughly explained the documents we would need. She also asked our preferences and offered suggestions on how to include them in our estate plan. When the drafts were provided to us, Allison took the time to explain each of the documents and answer our questions when the legal phrasing was somewhat unclear to us. She guided us through the Power of Attorney and Medical Directive drafts and explained the possible outcomes of the choices available to us. She also provided a cover letter which not only included a summary of our bequest preferences but also how best to achieve those preferences. Included with the cover letter were instructions on how to title ownership in our accounts and assets in Georgia so our preferences were more readily accomplished upon our demise and what title changes would be necessary when the first of us dies. Lastly, she suggested non-legal documents we may want to prepare to assist our executors, trustees, and beneficiaries in carrying out and explaining our final wishes. Allison is a very pleasant person with whom to work, and we highly recommend her.

Allison helped me with my estate planning after my recent divorce. She was able to explain things in an easily understandable way and was very patient with my questions throughout the process. Allison is very attentive to her clients and responds very quickly to any communication attempts. I felt like she gave me the same attention she would be giving to much more complex and involved cases. I value greatly working with someone who listens closely and respectively to whatever I have to say and Allison is excellent at that. She is a true professional in every way.

Lauren Bryant is a wonderful attorney and Ashley Clark, her paralegal also a wonderful person. Both took the time to help my husband and I file for guardianship and conservator for our special needs son, as well as update our Last Will and Testament to include a Special Needs Trust for our estate plan. Lauren was recommended to me by my boss and I would highly recommend Lauren Bryant and her staff to help you with filing for Guardianship, Conservator, Estate Planning, and Last Wils. Amy was terrific in guiding us through the complex planning and creation of our estate planning documents. We made the decisions, but she helped us think through and understand the sometimes complex implications of each option. Amy also helped us communicate our wishes clearly, to avoid mistakes. We now have a health care proxy, durable power of attorney and wills. We were provided copies and flash drive to store our documents. Amy was extremely knowledgeable, caring and had our best interest through the process.

Most of my assets have legal beneficiaries associated with them so I had been putting off having my Will done for some time now. I was introduced to the Estate Law Center through one of Holly Geerdes' informative articles in our local paper, followed by an introductory in person presentation on Wills and Trusts. That session prompted me to hire the firm to help me. Knowledgeable, patient, friendly and professional would be some of the key words I'd use to describe my experience. Thoroughly worth talking to of you're looking for someone to help you with Estate planning and protecting you and your family interests.

It seemed like all the estate law commercials were trying to beat out personal injury law; they were everywhere. We decided to see what the free seminar was all about. The first one "Estate Law" w HOLLY GEERDES. We were so impressed, made the appt on the spot. Before we could get there we had a major home emg and took somewhere around 4 or so weeks to complete. We were still somewhat puzzled about the Trust language and decided to go to the seminar again but thought we'd check a couple of the other firms, just for comparison. Went back to Holly at Estate Law and she answered everything simply and got us on the right track (Revocable vs Irrevocable Trust) and we were good to go. Then we met Lindsey, she was a paper work wizard. Got all the forms and kept them in the right order every time we unsorted them for questions. Sign here, initial here, & here & here etc. A bang-up 'go to professional'. Love her to bits. Just a note on cost; a probate attorney & court costs for your heirs will likely be 35-40k and take months. Your trust to avoid probate would likely be 10 times LESS and your heirs need only the death certificate and they're good to go, no attorneys needed period. Don't waste your time with what you see on TV commercials; go to Holly's free seminar & get going.

I cannot give enough accolades to Attorney Ryan Mullins and all of the team that I worked with at Vayman & Teitelbaum. I do not live in Georgia, Montana to be exact, and had to immediately find an attorney in Georgia to handle a custody matter. Finding a new attorney on a very short time frame was very nerve racking for me. After reading reviews on line - I consulted with numerous attorneys - and ultimately went with Ryan Mullins. She was so wonderful to work with. Listened openly and attentively to my concerns and thoughts, provided me with great professional suggestions and opinions, and overall just made what could have been a very unpleasant custody situation "easy" for me. Furthermore, her and her team were efficient in handling matters and responding. There is no way I could begin to express how much I recommend Ryan Mullins and her team. I wish I could give 100 stars!

Ms. Blackstone handled a real estate closing for my parents a few years ago. The seller's real estate agent chose her. My Mother has just passed away and my father and I have been trying to contact Ms. Blackstone with questions regarding the deed that was recorded, type of ownership, etc. and will most likely need an estate attorney in helping with the issues we are encountering. Unfortunately, after several messages, we still have not been successful in getting a return call, (and have been trying for 2 weeks). There are 2 phone numbers for Ms. Blackstone listed online, one as an office number, the other, a cell phone. When I first tried the office number, I expected a staff member to answer, be able to answer questions and schedule an appointment, but I have only heard a recorded message from Ms. Blackstone with no mention that I have even reached an office?? Ms. Blackstone, it is very disappointing that you are apparently too busy to return a phone call. My family would have preferred to pay you to help with the estate issues, but you are no longer even a consideration.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
