REVIEW UPDATE 11/18/24: After posting my earlier review below, Justin Gilbert literally contacted me within less than 30 minutes to follow up. I was very surprised to hear from him and impressed that he cared enough to immediately contact me. He apologized for the horrible experience(s) I encountered and offered his help regarding my initial request for a trust. I accepted his apology and hesitantly decided to hire him to handle our trust and wills. I must admit, I am happy I did. We had a phone consultation the next day, drafts were sent about ten days later and today we met in person to finalize everything. All committed timelines were met as planned. The entire experience today with Justin was very good - he was thorough, patient and detail oriented. He did not rush the process and effortlessly made last minute adjustments as we fine tuned details. Justin is worthy of a 5 STAR rating but combined with my prior experiences, I changed my initial review to an overall 4 Star. As a side note, Justin did explain the issues with their answering service and is making a change going forward. I can now confidently recommend using this firm and specifically after working with Justin, I believe you would be very satisfied like we are. I am not one to normally write a review but found my experiences with this firm to be horrible. Hopefully I can spare someone else the aggravation and frustration I have experienced, as well as the wasted time based on their inability to return calls. INITIAL REVIEW: Looking for a law firm, I read positive reviews about this firm and reached out to have a consultation regarding a trust. Scheduled the phone consultation and then they changed the appointment two times before I was actually able to speak with Madelyn, an attorney at the firm. And the day of the scheduled call set for 12:30, no call, I waited 10 minutes and called the firm only to be told she would call me at 1:00. Not the scheduled time of the consultation, and no apology offered when she did actually call. Should have been my first clue about this firm, We had an informative conversation but towards the end of the call, her phone disconnected. She did not call back to follow up to determine if we were finished or if I had additional questions. I called this week on Monday morning - asked for Madelyn and was told to leave name and number: she would get the message. No call back - waited 48 hours and called again Wednesday morning. Same process with another receptionist - left name and number - no call back for another 32 hours. I missed the call back but received a pleasant message from someone else (Jenna possibly, name did not come across clearly on the voice message) where she asked to call her back. So two hours after receiving the message, I called back, the receptionist was unable to get me the person that I spoke with and said leave my name and number again. Completely frustrated, I explained my multiple calls to the firm, response was he would take my name and number and pass on the message. Sadly, I have wasted 4 days this week trying to speak with an attorney at this firm to prepare a trust. I can only assume that their business is so good that they do not have time for a new client. And if I were a client, would I have to go through the same horrible process to speak to my attorney?

Crystal and Annie are the dynamic duo you want on your side! They are experts in their field and were a comforting support during my divorce. Crystal guided me through the MDA & PPP process, and Annie was a friendly face through the entire 8 month ride. They almost make me want to get divorced again just to work with them once more (JK LOL)!! But if you are a mom, or someone about to begin a season of divorce, Crystal and Annie are who you want as your representation! Professional, kind, tough, and the smartest in the room.

I would highly recommend MC Davis to anyone in the process of a family law matter, specifically divorce. MC had a personal touch and never failed to ask me how I was doing personally. This meant so much to me during what was probably the most stressful and intense experience of my life. MC was willing to take on my complicated case halfway through after my first lawyer dropped out. MC gave me a clear view of my options and got results. She was able to take a perfect stand to get the other party to the negotiating table and keep us out of court. MC gets results!

From our first meeting, MC was great to work with through my divorce. She listened to my concerns and helped me through what is honestly a crappy process even in the best situation, and helped bring the divorce settlement to a sensible resolution. I would absolutely recommend her to a friend.

Kay represented me during a very long divorce process as well as in multiple post-divorce hearings that arose. She is extremely competent, and took time to explain how things worked and prepared me for what to expect throughout the entire process. I could always count on her to respond quickly when I had urgent questions or needed direction and had 100% confidence in her counsel. She was forthcoming in what to expect and I was very pleased with the outcomes in multiple cases. The thing that really stood out to me in the five years we worked together was how much she genuinely cared about my case and my children and how she worked very hard to represent our best interest at every turn. I highly recommend her and can't imagine going through those 5 years without her being my voice and representing me.

Ms. Church has handled several matters for me, my family and some of my friends. I've seen her in court in a child custody case (she won), in a child support case (she won), and in a collections case (she won). She is always professional and clearly explains your options and her plan of attack. I've seen her during negotiations where she was firm, aggressive, and took the lead. I've used other attorneys, but Ms. Church is heads and shoulders above any other. I've referred her to friends who have also had great experiences with her. She is THE BEST!

I consulted with a few different attorneys in Franklin & Crystal was the only one that made me feel as if she really was listening to what I was saying. The others, for the most part, made me feel as if we were being timed & I had to race through my situation. I hired Crystal after about a month when I was ready to file for divorce. She walked me through all of the scenarios & her paralegal gave me a bunch of information to help me when I needed to refer to if I needed it, which I found so helpful. I’m still going through the divorce process but they’ve made me feel like I’m not alone. Crystal is a straight shooter which I like. She doesn’t charge for every little thing and she genuinely wants the best for me & my two kids. I can feel that with every conversation I have with her. I can’t imagine going through this process with any other attorney.

Cannot give enough credit or positive feedback for Mrs. Etue and her staff, especially Erin. They are what a lawyer should be when it comes to truly knowing and advocating for their client. They took the time to truly get to know me, my situation which two previous attorneys had blundered horribly, and then on principle, dug in and scratched and used their extensive understanding of the law to clear the minefield my ex had laid out. They saw the truth, dug hard to get the facts and evidence to support it and overcome opposing sides efforts to conceal and hide crucial materials. I had almost been broken by the process and stress, but they gave me a glimmer of hope, then fed it and worked so hard to stand up to the opposing side, and now, we clearly are in an incredible position to get the results we sought and then some because they fought the right fight and took a stand against an opposing side based on values and principles. You cannot go wrong hiring Mrs. Etue, just be honest, forthcoming NO MATTER WHAT, because they are the poster child for integrity and can handle anything put forth as long as they aren't blindsided. You'll actually enjoy speaking to your attorney and NEVER feel like they just adding dollar signs to your bill. VERY BEST HANDS DOWN!!!!

Daniel is very good with helping his clients understand their options and the best way to proceed. He answers every question they have and makes sure they are comfortable with the decisions they make. Having never gone through the process before, I never understood how important and how many details are involved. With his experience and understanding of how much we want to protect our family, he made going through the process a very pleasant experience.

All in all he's reasonably priced & straight forward. No sugar coating and he doesn't beat around the bush. Communication was a little hectic but it's very understandable considering how busy a lawyer is and the system at the jail was all out of wack. When you call him about questions and concerns he doesn't rush you! That's a huge plus for me being as I've had quite a few attorneys for different reasons and they've all seemed too busy to hold more than a 5min phone call.

This lawyer will act so caring and then she will pounce! She did (her paralegal) paperwork, I did the footwork. I carried, so my case would go quicker, paperwork to Chattanooga, paid a notary and brought paperwork back to Parker. She charged me. Then on the court date, she was 45 minutes late to meetme, we went to the court house, she charged me for meeting her when we only said hello and left for the court house. At the beginning of the whole case she said she would only charge me a certain amount, which I immediately paid in full. She said if there was nothing substantial happens, she would not charge anymore. Well she decided she needed more. I would try to talk with her or her assistant and they were not available. Then after almost 7 years she takes me to court because I wouldn't pay her for all of the work I did. I had a wedding I had to attend in FL on the court date, she would not talk to me nor would her lawyer. Of course I lost when I could not show up. Not sure how she sleeps at night, but people like this do not care. Stay away!!!!

What an amazing experience! Megan was absolutely wonderful!!! Can not express enough how thankful I am for her. I've had dealings with Megan for over two years now and I can tell you now, some of these negative reviews are either, flat out lies, or Google claims old reviews from years ago when she had partners as "recently ". There are no men operating out of this office as some of these reviews claim. It's just Megan, her paralegal, and a large friendly dog. Megan is a rare gem in the legal community. A God fearing, horse riding, pistol packing, dog loving, southern belle, who will look you in the eye and speak the honest truth. And she will do it for less of the cost than any other attorney in Williamson County.

Jack was hired to be an unbiased manager of my parents' estate. We had properties that required selling. We not only paid the realtor and inspector fees, but Jack charged us for work that only they were supposed to do. He racked up an unbelievable amount of hours. He even hired his son to work on the properties. He does not have a paralegal, so you will be charged $360 an hour for work that a secretary would normally do for $12 an hour. Every time he had a 5 minute phone call with any of us (beneficiaries), he charged close to 15 minutes. I was forced to get an attorney because my sister was trying to steal portions of the estate from me. My attorney had to find an outsider who we allowed the other beneficiaries help pick. Jack was the one we picked. He realized how crooked my sis was. Yet when she took me to court to make me pay my atty fees, he showed up and fought on her side against me knowing full well that she forced me to fight her by being crooked. He even so from the books where she'd stolen tons of money from the estate and didn't make her repay it. The only good thing about Jack is his ability to get very high dollar for the properties. That's the only reason I gave him a star at all. I wouldn't hire him again for anything. After this is over, I hope to never ever be in another situation where I have to gave another attorney.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
