I was in need of a lawyer for a property case I went online to find a lawyer and chad’s website stood out the most being more professional than others and more explanatory so I gave Chad a call I was able to connect right away with him. What I liked about this lawyer is he was on top of everything he moves quickly finding out all the details to your case and then filing any documents to get the ball rolling he is prepared for any curveballs thinking ahead of the game. I was able to get through to this lawyer anytime I had a question or concerns I was able to connect to him quickly by phone, text message or email and get a fast response. I highly recommend using this lawyer I will deathly use Chad in the future if needed. Thank you again for getting me to where I needed to be.

Ted has been our family attorney for years. When I was diagnosed with leukemia, Ted helped us draft a will that allowed me to go forward with treatment, knowing my family would be taken care of in case I succumbed. Thankfully, I am now cancer free. Ted also helped us with a legal matter regarding our son and our school district. He was professional, knowledgeable, and an excellent advocate for us. I have known Ted before I knew him as a lawyer - I taught his daughter in Middle School, and through that, I got to know this outstanding, compassionate man. I am honored to know him, and glad that he has been there when my family needed him.

Ted took my divorce modification case after being turned away from a major law office in the area. That attorney had me convinced I had no grounds for modification. With Ted, I received an extremely fair buy out of the shared home that I was ordered to pay on for the next 3 years. He also saved me nearly $30,000 in future child support payments on top of the buy out. I am grateful to have found him! I would definitely recommend Ted to anyone looking for the best lawyer in Collin, Denton county!

I came to Debby with a mound of mistakes through my divorce. She had to undo so many of my mishaps and explained everything in plain English. She let me know all my options, both good and bad, and all she asked of me was to be prepared. The preparation before trial made me feel confident (although horribly nervous and scared) and I was able to answer the cross examanitation without any surprises at all. The trust was earned right away and everything from that point forward was only about winning the case!! The level of trust I have in recommending Debby Mackoy is 100%. I owe so much to her and her entire law firm. They have helped me in so many ways and I cant begin to express my gratitude!!

I first consulted with Mr. Hogue in approximately 1995. He carefully articulated the distinctions between a support trust, and a discretionary trust as the terms are used in estate planning. We discussed, and he shared with me his publication entitled, “Biblical Principles of Estate Planning”. I’ve practiced law myself for nearly 48 years, and in that time, I have never met a more capable and careful estate planning attorney then Mr. Rex Hogue.

I hired Mr. Widner as my attorney recently when I was fighting for custody of my son during a messy divorce. Mr. Widner was affordable and consulted with me countless times throughout the process. His senior paralegal, Mrs. Adams, was phenomenal. She was very responsive and reassuring because she could relate to my situation. I panicked a few times when I didn't get a response as quickly as I wanted but they never took a day off from handling my case. All in all I was granted my divorce and obtained custody of my son. I couldn't be more pleased. Thanks team.

Ms. Qualls at first provided adequate services in consulting about divorce. However, the amount I paid by the end did not equal the value of services rendered. Her assistant was rude and overcharged the minutes I was on the phone with her. She didn’t fight as hard as she should’ve for me during mediation. She had me agree to some things that I later found out was not a normal agreement to make. When she didn’t file some paperwork, my ex and his lawyer came after me. She wouldn’t correct her mistake without paying for services again, which I couldn’t afford.

I've used this law firm twice for issues concerning my ex being in contempt of a court order over child support issues and non payments. The first time was with Deborah Mackoy and I was granted all back child support, unpaid medical expenses, court costs and attorney fees. Deborah was very efficient, professional and was pleased from start to finish with my results. Four years have passed since I first hired this law firm. I started having issues again with my ex not abiding by our court order. I didn't hesitate to contact this law firm and was assigned attorney Christine Qualls. Christine was professional and performed exceptional in court. Once again we were granted all child support, uninsured medical expenses, court costs and attorney fee's. I wouldn't hesitate to hire Christine Qualls again for any issues that arise .

Nothing special here. Case was related to custody. Mccoy Hernandez and Qualls was the office. Overall, I felt that representation was inadequate for the price. I was thankful that her office was able to work with me financially. Like all law offices, I felt that I was SIGNIFICANTLY overcharged, but that is par for the course. I paid some $5,000.00 to be told by the court that I would have to go through a significantly more expensive step up program, which I couldn't afford. Law needs to be regulated by the federal government. There is an FDA, a DEA, an FAA etc. Why isn't there a FLCA (Federal Legal Counsel Administration). Would be nice if there was a body one could complain to which had some authority over practice. Overall I think the office was better than some others, but nowhere near as great as some others. This is a Collin County ring game.

Where do I begin? Elizabeth Nielsen started off appearing to be a competent attorney. In the time that she was my attorney, she had three different paralegals and moved her office to three different locations. She was all I could afford at the time. Do not waste your money or your time! She is unorganized and unprofessional. She was late to almost every court date and one time the entire court including myself, waited 15 minutes for her to arrive. I ended up getting totally screwed by my ex-husband and his pitbull attorney and Elizabeth. Worst life experience ever! Run away from this attorney!

She is very unprofessional. She was not prepared and unorganized. She did not present any of the information that we provided her. Before court, she built our confidence, but did not perform in court. I'm not sure if she was scared of the OAG or just lazy. At least we would have been heard if we would have represented ourselves. Please don't trust her with your money or your family.

I first spoke to Barata Hollis regarding my divorce about 6 months ago. I must admit I was a bit of a mess. She was so very kind and understanding well above her legal requirements. Regarding her work ethic, it was above all my expectations. She was responsive and compassionate, and she was knowledgable, but understanding of my lack of focus at that time. She was informative without appearing bothered. She was outstanding. I went to other attorneys, who put a lot of emphasis on money, and did not seem to be concerned about my state of mind. In comparison to the others, she was very kind. I guess the best endorsement a mother could give would be to say that I recommended her to my children.

Never trust an attorney who keeps putting you off when you want a meeting. I got taken to the cleaners in a divorce, largely because this attorney did not even bother to check the false financial information given by my ex-spouse; and because she refused to give me any coaching or advice before I testified (despite my asking multiple times). she apologized for how things turned out, but then stopped returning my calls.

I was referred to Barata by a friend, and I occupied her full attention for over an hour. She was attentive, polite, and very knowledgeable about the legal questions I had. At the end of the time, I offered payment for her consultation. She told me that the initial consultation was free. I expected a hard sell for my business after my consultation, but I never got one. I chose to come back to her to handle my case, and it was handled professionally and quickly. She operated with my best interest at heart. I would recommend Ridgely & Hollis in Dallas, and would recommend Barata 1000%.

I was assigned this woman as an court appointed lawyer. I had to tell her what to do at every turn. She kept extending my case because it benefited Her!!! She doesn’t care about you! Do not use her (Evette) for legal issues especially divorce. She is more focused on establishing good connections/networking within the legal community than defending you as a client. If she has to meet with the opposing lawyer, “BE PRESENT”. She will laugh/joke (about you) with the opposing lawyer if you are not present. Find a lawyer that will represent you.

Ryan Russo was assigned as my attorney for a DWI case in Collin County when he worked for Dunham and Jones and it was a very poor outcome! This was my 1st time in my life being in trouble with the law, but he seem to not take the case serious making snarky comments about the whole situation. He illustrated not to be prepared for a motion before the judge getting destroyed by a new asst DA in training, it was so bad the judge stopped him questioning the police and told the type of questions he shouldve been asking. I ended up having to go to jail, paying fines, being on probation for a 12 months with community service for a first offense DWI that didnt include an accident. In the plead deal the judge found an error in the paperwork that showed me going to jail for months and made the DA change it. In some of the classes i was required to attend, I talk to other offenders that said they were on their second DWI some with accidents and their attonery got them only probation. For $4000+ one would expect better representation for such a serious case as well as competences along with more compassion from their attorney for this life altering experience, Ryan was absolutely none of that; he was horrible and would steer clear of his represenation for lawyer in any situation!

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
