Great elder certified lawyers in Chittenden county and a wonderful, welcoming staff. They give free seminars on educating and preparing your Wills and trusts, etc and explaining law terminology. They also are part of a great professional group of folks, VERG, the VT Elder Resource Group, where they can access any kind of help needed dealing with seniors. A great group of folks!

Glenn has been a godsend for our family, starting with setting up a Living Trust for my father and a Special Needs Trust for my brother. Every time I've had a question, whether it was financial, tax issues, or difficulties in dealing with assets to be placed inside the Special Needs Trust, and dealing with Social Security and Medicare, Glenn was always a phone call away to provide guidance and a sure hand. Many nights that could have been sleepless, weren't because of the help I got from Glenn. I highly recommend him.

Nikki is one of the best if not the best. Told her multiple times she should be earning two salaries, lawyer's and psychologist's. I got such a deal! Having to go through a situation that requires family law is stressful. You want someone who knows their stuff, can couch you through those stressful circumstances, and alleviate the conflict/stress to come to a good solution. That is what she did for me, she is in it for the good of everyone and very loyal. A true advocate setting the bar for all!

Our family had the good fortune to bump into Attorney South when there was a custody issue surrounding our granddaughter. Nikki not only was a fierce advocate for father's rights, she does her homework, provides fact based evidence and keeps all heads calm and focused in what often are very emotional interactions. I can't thank Nikki enough for keep our granddaughter safe and with the parent who had her best interests at heart.

Claudia was very thorough and offered excellent examples of content for this unique trust. She explained how it could be used and not used for his benefit. Her subject knowledge was very important as it helped me anticipate future expectations for my son's quality of life. Her preparation of materials was exemplary, submitted in a very clear and understandable document. I most appreciate that she did not try to use jargon or vagaries regarding the aspects of this trust. She was very understandable speaking in very plain language in her answers to my questions and concerns. I especially appreciate how accessible she is. For this kind of trust, a special needs trust, I highly recommend her.

I utilized Claudia Pringles' services after attending an educational workshop she ran at my local High School. She set up my son's Special Needs Trust and provided legal support through tough times with my son's IEP team. Her advice and encouragement was invaluable. It is easy to be intimidated by people who speak as though they know more than you, but Claudia was very clear on what my son's rights were and gave me the strength to advocate on his behalf successfully. "Don't give away the goat!" Thanks to Claudia I never will.

As a Ph.D. with some formal legal training in autism-related education issues, I never imagined I would require the assistance of an attorney to rectify an essentially problem with my child's program. A component was missing that could be easily added; without this component, the child had demonstrably regressed, and I had the video to prove it. Yet I met resistance several times across 6 months, as the problem intensified. I discovered that merely slapping down my law books with the pertinent passage was getting me nowhere. And while I did my best to be dispassionate and was never impolite, my stomach was in knots and I was finding myself having to work not to lose my temper. I know there's an old saying, "The lawyer who represents himself has a fool for a client." In representing my child, I was much in the same position. I needed someone who, while knowing the law, could remain emotionally detached and professional. A friend had enthusiastically recommended Claudia I. Pringles, Esq. to me. She put me immediately at my ease. She listened respectfully (including during the ranting-and-raving part of my exposition). She interrupted only when, driven by emotion, I was unclear, but otherwise listened patiently. (And this was for our first meeting, for which she did not charge.) Claudia was AMAZING. She accompanied me to a meeting I'd arranged with the essential parties. She was gracious to everyone, and approached the problem not as if we were filming an episode of Law and Order (my style) but as a subtle but skilled negotiator. She acknowledged the school's concerns, and offered as one of several suggestions a means of neutralizing any consequences to them. At the same time, she never backed down as to what my child needed. Her focus was always how, together as a team, we could surmount any hurdle. One meeting - and the problem was solved, with everyone leaving the room feeling good about themselves, my child, my advisor, and me. I know other attorneys in this field who would have been good. But two have a more diffuse focus in this area and others handle other areas of law, as well. I wanted someone who eat, slept, and breathed special education law - and I have yet to hear of anyone I would turn to other than Claudia Pringles.

I have spent a number of sessions with Mr Bartsch over the past three years and have come away feeling fully satisfied with the service. I think the aspect I like the most about Adam is that he is not in a big hurry to charge for every minute of his time. He waits until tangible results are produced and then bills you for specific services rendered. The results are of high quality and the charges are fair. You can't say that about all lawyers. Additionally, Adam is just interesting to talk to. He knows his area of expertise extremely well and he is a good listener.

Andy Delaney is the best attorney on planet earth. He is Tom Brady meets William Wallace meets Gandalf. My wife and I were in an all-of-a-sudden horrible and complex situation through no fault of our own (which I won’t be getting into here). We exhausted several family and friend recommendations for legal counsel in this area but it seemed that no one could/would help with our case. Then, after seeing the high Google review ratings, we decided to take a chance on MDR who were at least willing to meet with me. About five minutes into the meeting, realizing the complexity of the situation, the guy I was meeting with says, “I think I need to get my boss.” Enter Andy… Within one hour I walked out with a cohesive plan of action, and (despite MONTHS of research on my own) a hundred times more understanding of the legal circumstances we were in. Andy ended up taking over our case and delivered like you read about. I can’t say enough good things about Andy. The dude saved our bacon when we needed it most. There are already plenty of reviews talking about how intelligent, professional, funny, and caring he is (all of which I absolutely agree with); so I'll just say that if you're seeking legal counsel and you find anyone on earth that's better than Andy... I owe you $50. He is the best there is, end of story. Andy is the GOAT.

Walks the walk! Andrew Delaney is unique in that he truly believes in the principles he advocates for. Most of the world, especially at the professional/fancy-degree level, is motivated primarily by money, but Andy was persistently focused on doing the right thing. Not pretending to do the right thing, and not doing the right thing to the extent required by his job, but actually doing the right thing for its own sake. Andy has a brilliant mind, equally able to make witty jokes and cite obscure procedural rules from memory, and an unheard-of work ethic, willing to focus on a case above his own needs at 9pm or on a Saturday, and still be good-humored about it. He worked tirelessly for us, preparing his strategy perfectly, piecing together everything, thread by thread, until he had a beautiful tapestry that showed the truth of the matter in a direct way. Andy also does one other thing that is unheard of for attorneys in his (exceptional) skill bracket as well: he is willing to communicate. The entire time, he gave feedback and explanations and was never too important to take a call and genuinely care. Most attorneys of his station will let you talk to the assistant and *maybe* get called back, but the only time his assistant replied for us was when he was out sick and, even there, she was well-informed and gave us some useful information. Never once did we feel like anything less than real people who mattered, represented by an attorney who actually cared about our outcome. Finally, thanks to his preparation, we wound up getting well over double the amount we even thought was possible to get. With anyone else, generally not willing to listen to the clients or take the time to go over everything, we're convinced that outcome would have been impossible. If you want an attorney who has real principles, truly cares, and gets results, Andy is the person to talk to. Thank you again!

Dear Brooks and the Gravel & Shea Team, I am writing to express my deepest gratitude for the exceptional legal representation provided by Brooks during our recent lawsuit. Brooks's expertise, dedication, and compassionate approach were evident in every aspect of his work. He took the time to thoroughly explain the legal process, answered all our questions with patience and clarity, and always kept us informed about the progress of the case. His professionalism and commitment to our case were truly outstanding. What impressed us the most was Brooks's ability to make my daughter feel comfortable and confident throughout the entire process. His empathetic and understanding nature provided her with a sense of security and reassurance that was invaluable to us as a family. We are extremely happy with the outcome of the case and cannot thank Brooks enough for his hard work and dedication. His efforts have had a profound impact on our lives, and we are forever grateful. He was so kind and made sure that I understood my rights and told me exactly what I needed to do and without having to retain him, as it seemed as there was reason to retain him beyond our conversation. I feel so much better and will absolutely work with him if the need ever arises. Seriously the nicest person I've spoken to!

Lisman lies and understands that the legal system is not an ethical system but one of asset exchange and assignment among preferred participants....one that can absorb an enormous amount of deceit. He's commoditized his Harvard credential and his political affiliations to make Vermont's legal system unbearable. It's little more than brutal careerists with the occasional subnormal and comedic relief (Skoglund). Congratulations on financial success at the expense of what makes life worth living.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
