Frugal Legal Services should be the staple for how all parents are represented in custody cases. Ms. Burroughs worked hard and diligently on my case and set realistic expectations. My case had a ton of unrelated issues to custody and Ms. Burroughs was completely understanding and worked through our nearly 9 month case. Ms. Burroughs is a magical and enlightening person who gets results. I went from having no contact with my children to now everything is 50/50 and I get to see my sons every other week and have the assurance that no one should be able to change that. The only shame here is that I can only give Ms. Burroughs and Frugal Legal Services 5 stars because it doesn’t let you show off the absolute brilliance of the firm or Ms. Burroughs. Ms. Burroughs and Frugal Legal Services are the prime and top option of any family matters should anyone require those services. I will recommend them for my entire life because of the amazing work that was done.

Extremely professional, personable and deeply experienced in Estate Planning to include special needs nuances. They handled all of our questions and concerns with ease and speed. Their coordination with financial and estate trust companies was beyond reproach. Everyone we had opportunity to work with in their office were kind, caring, and understood the complexities and stunningly hard decisions a family has to make to have a good Estate Plan. I have recommended them to my co-workers and will continue to do so in the future. Thanks!!!!!

Mr. Boys was recommended to me by a high school friend whose husband is an attorney of long-standing in Norfolk. Mr. Boys had handled their estate needs and they were vastly impressed. I found him professional, kind, communicative, prepared, knowledgeable and on point. As my relative was ill and housebound, Mr. Boys made a house call to assess his needs and later dropped drafts off and returned for a will-signing at the nursing home. I can't say enough about Mr. Boys' lawyering skills, integrity and humanity. A consummate professional in every regard. I HIGHLY recommend him for any and all estate planning concerns. I will rest easier knowing that my loved one's estate was in Mr. Boys' capable hands.

After our retirement move to Norfolk, VA, which coincided with the sudden death of our longtime attorney in NY, we needed our wills, living wills, health care proxies, powers of attorney, and such all redone, carefully but quickly. Brian came highly recommended to us, and after one confidence-inspiring consultation we hired him, breathed a sigh of relief, and counted our blessings to have been directed his way. Brian did an excellent job for us throughout a process that was at every timely step clear, comfortable, organized, and efficient. We will highly recommend him to others.

Powell has been our personal attorney for at least 25 years. I am a financial planner and understand the need to keep legal plans up to date. When I need to reach him, I get a response from him or his legal assistant in a timely fashion. As our children grew and our situation became more complex, he kept our Wills, Trusts, Powers of Attorney and Medical Directives up to date. He has also done work for my adult children at my behest when they lived in North Carolina or Virginia. They have liked him and his work very much. Some of my clients have chosen to use his services and they have learned that Powell works well with their other advisors. He cares deeply about his clients and you cannot buy that attribute.

We hired Mr. Sawyer to assist with an estate gift that was left to our non-profit organization. Our organization is not located in Virginia so we had to seek counsel in another state. The case was one where a family trust was questionably liquidated by the trustees to the exclusion of some of the beneficiaries. Earlier, another attorney had advised us that the harm to trust's excluded beneficiaries was not actionable and would probably result in the beneficiary plaintiffs being disinherited. Legal research by Ms Zizzo, Rack & Olansen's litigation attorney, resulted in a lawsuit that eliminated the risk of disinheritance and the case was settled out of court with the wronged beneficiaries receiving six figure settlements.

I can’t say enough good things about having David as your attorney. From the very first phone call, in which I spoke to David directly, my first take away from our interaction was how personable was, and the amount of information he gave me just in our initial conversation. Even with that, I opted to look around to find a couple other opinions and honestly, to compare rates. This was the first time I have ever needed a lawyer, so this was all new to me. I quickly found out that David was by far the most open, honest, and genuinely concerned to find the best possible outcome for me. After not talking to David for almost a month prior to me court date due to some family issues, we touched base again, and he was on top of everything. He had a plan, and he knew what he wanted to see happen in court. Well today was the court date, and I am very happy to announce that Mr. Cardon saw that plan all the way through to the end. He was able to get my charges dismissed for the exact reasons he had stated to me. This guy is an ACE! In the court room and in person. I can’t recommend him highly enough!

I gave them 1 star because I called to get my remaining balance to pay off. Their accounting person was awful and rude. She did not know what the fees are being charged for nor the remaining balance that I would had to speak to the lawyer handling the case to get the final balance. That was fine but why be nasty and rude if clients are asking. They really need to train their front office or accounting staff better customer service or how to properly talk to clients better. My husband called a second time and asked to speak to a specific paralegal or lawyer involved in the case to get the final balance and they mistakenly transferred him to this accounting person they had again. She was soo rude and spoke to us both slowly like you are talking to a 1st grader like we did not speak any English. I do not know if it’s because of our last name but we both were born in the states so there was no need to belittle people that are trying to pay off their remaining balance. Makes me think she speaks to all foreigners this way and everybody should be spoken with respect regardless what race, former or current client. We will not be using them ever again for any services knowing they have rude and nasty accounting or front office staff that are not properly trained. I will also be telling others I know about this awful experience.

My Father and I had a wonderful experience with J.S. Burton updating our wills and trusts after my Mother had passed away. We've done this 4 different times so far with 4 different attorneys (different states), and Mr. Burton was by far the most thorough and asked the most thoughtful questions that helped us make the best adjustments. I recently received a notice from a collections agency, which was contracted by a local municipality. They claim I owe back taxes on a car I purchased about six years ago. I called David after talking to several local area attorneys who were unable or unwilling to help. David was empathetic the entire phone call and went well beyond anything I was expecting. He, without being prompted, found the statutes - the source of the unpaid taxes - and explained them in a straightforward way. Additionally, he counseled me on some strategies to either pay a reduced amount or avoid the expense altogether. While I'm still negotiating with the collections agency and the city that hired them, I know I will reach a more satisfactory solution after my conversation with David.

Mr. Bastiaans is skilled at complicating, prolonging and bloating tasks to benefit the billable hours charged. Communication was consistently inconsistent and often statements made were not executed. An example, billing for services rendered would be issued monthly, but at the end of month one, it was changed to quarterly, which was again changed to end of the month following the previous quarter. Four months of billing charges accrued before a client is made aware of cost seems unreasonable. Not someone I would recommend or trust to manage my family’s estate.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
