It's my pleasure to submit a positive review for attorney Dan Murphy. Dan brings integrity to his profession, something I suspect he demonstrates in his personal life as well. During my 13 month divorce, he continually coached me on the value of restraint, always concerned with how any action might be perceived should we head to trial. His patience, coupled with his relentless attention to detail, resulted in a positive outcome when my divorce turned from amicable to litigious. Dan successfully reduced my now ex-wife's settlement demand by 85%. Her lawyer tried an aggressive approach that Dan's experience and coolheadedness was able to navigate and resolve using the facts of our case. While I am grateful to settling only weeks before our trial, part of me wishes I could have seen Dan litigate -- his tenacity and willingness to fight on my behalf was a preview I got to glimpse during deposition. Thank you, Dan.

My husband and I had had individual estate planning documents (Wills, Powers of Attorney, Advanced Medical Directives) drawn up during a period when we lived out-of-state. When returning to CT, it was high on our priority list to identify an attorney with the right expertise to assess the adequacy of what was in place and develop whatever changes/additions necessary to conform with CT statues and be as prepared as possible for Probate. For us, not only were we seeking an individual with extensive experience, but we also felt the need for a personal connection; an attorney who could inform, explain and make recommendations in "laymen's terms" and give us the confidence that everything that we needed for our particular circumstances would be prepared promptly and for a reasonable fee. Staff personality was also important. Not to be cliche, but Gerald Shea and his team "checked all the boxes." Two weeks from the time of our initial (free) consultation, we had fully executed, complete documents in our hands. During this process, we learned that our prior Wills were deficient, lacking the details that would have distributed our estate to the appropriate heirs according to our wishes as a blended family. What peace of mind this has brought! We also know that Gerry is there for us for any future questions we may have and/or if there are legal changes that require updating.

Stacey made the divorce process simple and uncomplicated. She was extremely efficient, responsive and knowledgeable on all aspect of the legalities. She is aware that this is so much more than putting together a divorce agreement and I felt 100% supported by her on so many levels. I highly recommend Stacey and cannot imagine having gone through this without her.

I highly recommend Joyce Riccio! She has extensive knowledge of divorce law, and fought for my kids and assets. She was always prepared, had a powerful presence in the courtroom, yet was compassionate and supportive when privately discussing my case. Attorney Riccio had comprehensive explanations of the law and proceedings, was accessible, and professional.

If you’re entering into a real estate transaction in Connecticut, hire Jamie Gerard, partner at Nevas, Capasse & Gerard LLC, as your attorney (or run the risk of her being snapped up by the other side). Even the simplest transaction can become difficult or complicated (or both, as ours did) and if that happens, you will want the best legal advice and representation available. Jamie was able to navigate us through the contract and closing process of selling our home that was made problematic by demanding buyers and their unpleasant representatives. Her quick responsiveness, sound judgement, calm demeanor, and keen legal acumen resulted in the satisfactory closing of a transaction that at times seemed nearly impossible. We are very grateful to her, and we can’t recommend her highly enough.

My husband and I recently engaged Anne Crane for Trust and Estate planning. We had been going on and on with our general attorney for over a year about this process but were, it seemed, just going around in circles. Anne was able to put our interests and concerns in perspective, walked us through 'Estate Planning 101', and translated all the legal, tax, and asset protection issues into plain language for us so we could understand what we were doing. We are very impressed with her wealth of knowledge, incredibly analytical skills and her practical approach with near 30 years of experience. She is very creative and thoughtful in working to achieve our objectives within the constraints of the law in a very tax (estate, income, and gift) efficient way. She was always very reachable, personable, calm, and patient in taking us through every step. At the end of the day, her fee is reasonable and more than paid for itself in tax savings by looking forward and being proactive in the planning stage. We both feel very comfortable and secure with the plan Anne put forth and consider ourselves very fortunate to know such a skilled and personable attorney. Anne is truly exceptional, clearly one of the best of best in Connecticut and New York State, on estate planning, with a unique and special expertise in dealing with clients/families as real people.

I worked with Ann twice to draft my personal Revokable trust and family trust. She was patient, very detailed oriented and was eager to help me to examine and explore different possibilities for my trusts. She also worked with me in regard to fees and didn't surprise me with charges on the final bill. It was so refreshing.

We engaged Anne Crane when it came time to update our will/estate planning. She came highly recommended by other trusted professionals, but the decision was solidified by a gut instinct that she was the right attorney for us. She possesses the intelligence and integrity to address all of our legal needs, yet is able to clearly and succinctly convey pertinent information to us in language we can easily understand! We look forward to many years as clients!

Jerry and Tim Shea provided me with excellent guidance through a very lengthy Probate case. Both are very professional and personable with great consistency with communications, no question too small to respond to. I felt that they were always looking to provide the best an attorney has to offer: quality, professionalism, kindness and compassion. I highly recommend the law firm of Shea and Shea for excellent legal representation that you will be glad you chose.

Attorney Shea is probably very good. HOWEVER, I found him through a legal aid type of website & she seemed to decide there was no money for him in my situation & basically hung up in my face. I told him from the start that I was not looking to make money; rather just needed to know my rights. If he isn’t looking to help/advise people, he should remove his name and/or firm from those sites. I’m sure there are many more attorneys who are kind, patient, and have10 minutes for a few questions pro-bono. If you have a lot of money and want to sue someon, Mr.Shea may be your guy. If not, look further

The best of the best, lawyers with integrity. A rare find, especially in Fairfield county. I’ve been a client for 20+ years and couldn’t recommend a better team. Kevin, Neil, Stephen and Karin are all superstars! I’d be remiss, not to include all of their admins, support staff and everyone that furthers their efforts. I can’t say enough about this firm.

My divorce was difficult and emotional. We have children and my former wife was very difficult to deal with. Eric and his team helped me to make sure i made sound decisions for my children and me and my former spouse. I never felt they were trying to just get fees out of me. I felt they were there to help me and even to give me tough advice if i needed it. Even 7 years after the final legal settlement, Eric continues to counsel me when i need him. I have recommended Eric and his team to personal friends also having to go through a divorce and would not hesitate to do it again.

I have known Tom for a few years. When I decided to put together a Trust I looked him up and saw that his focus is Estates and Trusts...I called him and he spent over 30 mins. asking me questions and advising me. i did my own research online and decided he was the one that could help me. He was courteous, kind, understanding, and most of all thorough and well versed. He built my Trust and Living Will etc., I highly recommend Tom Drew.

My experience with Attorney Drew was extremely positive. I found Mr. Drew to be very responsive, professional, and reasonable in terms of expenses. My mother's estate turned out to be much more complicated than we expected, and the CT Department of Social Services was unusually thorough and sometimes difficult to deal with, but with Mr. Drew's assistance, we reached a very positive outcome. His assistance was invaluable and he did a great job in advocating the interests of my mom.

I’m an unsatisfied client of Tom Drew who I hired for Estate Planning. He didn’t invest the time or have patience to properly educate us about his estate plans and was intolerant to accommodate and address our concerns. His estate plan could have been better formatted with articles headings, an index, more definitions and key words notations to easily reference subjects and to facilitate comprehension. We couldn't go forward with the estate plans he submitted. The relationship was terminated and not in a pleasant manner. We lost our $2,215 advance.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
