His staff is equally great! They are prompt with any requests, they are so kind and helpful and we never felt like we were bothering them when we had questions or any needs related to our case. The Plaintiffs Law Firm proved to be an excellent firm. They were very professional; calls were returned in a reasonable amount of time; everyone used the same terminology and gave the same answers; and during the length of my case, there was no turnover in the office (which says a lot). Mr. Frazier would respond via phone, fax, email, or text; thus, the firm is up to standards with technology. Mr. Frazier's availability is rated as excellent. My concerns were always considered "important". The pleasant attitude and willingness to follow through ensured that everything was being handled and Mr. Frazier's knowledge of the law lessened any apprehension about my case. He was always upfront and the attention given to my case proved he cared. Mr. Frazier is also a family man and that was impressive.

Sean Aiello worked with our attorney Brad Carter in representing my son. Sean has a very pleasant way about him and it is easy to feel comfortable in his presence. Their diligence and dedication to represent my son is what we received from their team. We never saw the hours spent preparing for court appearances nor the times spent speaking with the plaintiff’s attorneys; yet, we know all this was instrumental in negotiating the favorable outcome in the Civil Lawsuit against my son. It took two years for the case to be settled in our favor. Sean’s assistance in this case for my son was due to his and Brad’s expertise in law, research, skilled collaboration and attention to detail were sure components to him being able to deliver the best solution possible for my son. He was not the lead attorney but whenever we met with them, it was obvious he was an intricate part of the process in turning this in my son’s favor. They were prompt in relaying information regarding any new developments and any court related issues. The day we met to retain Brad Carter and Sean was a very dark day for us. It was like walking in the dark; groping for a glimmer of light and direction out of this deep hole my son had fallen in. In his sympathetic way, we got that glimmer of light we had hoped for; though he laid out the worst case scenario, we felt confident that we had been led to the right place. We were not made any promises, but that they team would represent my son with the goal of getting the best result. When people come to an attorney seeking counsel, the response of that attorney should be as reassuring as possible that he/she is on their team. We were not given false hope. Yet, we felt some relieve knowing that Sean Aiello and Brad Carter would be doing everything they could to represent my son well. I close adding, they not only represented my son in such an excellent way that leaves us feeling forever grateful , but they also represented their profession and their law firm to a high level of honor. I admire and think highly of these two men knowing that though they may have had some personal reservations regarding some of the details in the case, it never hindered their acts of professionalism. I pray that, I nor any of my family will ever have a need to be represented in a court of law again; but should I ever know of someone who does, I think I could honestly refer them to Sean Aiello.

Tom Boylan did an amazing job dealing with Evernest our rental agency for a home in Franklin. They simply bullied renters into having no reasonable recourse but to either accept their approach or seek an Attorney. We did the latter. We ended up paying Tom around $2K for what was services over a few months dealing with them. In total, we'd have lost about $8K had we not had him on our side. It was well worth it, and also really wonderful to not allow this rental agency to simply do whatever they want without regard to meeting their obligations. Tom was accessible, responsive, and spot on with his advice. Will use him again in the event we are unfortunate enough to need an Attorney in the future!

I have been representing borrowers on HUD-insured loans and similar financing transactions for about 20 years, and it's tough sledding for borrower's counsel. So it's truly a blessing whenever Peaseley and Derryberry is on the lender's side. More than any other lender's counsel I have ever dealt with, they actually HELP borrower's counsel navigate the arcane rules and requirements of HUD closings. Both Kelly Derryberry and Tami have levels of knowledge, skill, experience and organization that are remarkable. They're consummate professionals, but they're not trying - like some firms seem to - to prove they know more than borrower's counsel does about HUD financing transactions (even though they always do). What sets Kelly and Tami apart is their willingness to use those attributes to GET THE DEAL DONE; working with you whenever possible, not against you. I have sent post-closing notes to lenders, thanking them for using Peaseley and Derryberry. I commend any HUD lender that decides to engage P&D as its counsel.

I've had dealings with Megan for over two years now and I can tell you now, some of these negative reviews are either, flat out lies, or Google claims old reviews from years ago when she had partners as "recently ". There are no men operating out of this office as some of these reviews claim. It's just Megan, her paralegal, and a large friendly dog. Megan is a rare gem in the legal community. Jack was hired to be an unbiased manager of my parents' estate. We had properties that required selling. We not only paid the realtor and inspector fees, but Jack charged us for work that only they were supposed to do. He racked up an unbelievable amount of hours. He even hired his son to work on the properties. He does not have a paralegal, so you will be charged $360 an hour for work that a secretary would normally do for $12 an hour. Every time he had a 5 minute phone call with any of us (beneficiaries), he charged close to 15 minutes. I was forced to get an attorney because my sister was trying to steal portions of the estate from me. My attorney had to find an outsider who we allowed the other beneficiaries help pick. Jack was the one we picked. He realized how crooked my sis was. Yet when she took me to court to make me pay my atty fees, he showed up and fought on her side against me knowing full well that she forced me to fight her by being crooked. He even so from the books where she'd stolen tons of money from the estate and didn't make her repay it. The only good thing about Jack is his ability to get very high dollar for the properties. That's the only reason I gave him a star at all. I wouldn't hire him again for anything. After this is over, I hope to never ever be in another situation where I have to gave another attorney.

This attorney has only one thing in mind when it comes to her clients....her pocketbook. We asked her to deal with two different matters. In each case, she agreed to take our case and told us that we did have causes of action. In both cases, after months of doing nothing but sending letters and emails, she reversed her position 180 degrees and told us that we did NOT have a case. But this was not until we had paid her firm approximately $12,000. Do yourself a favor....escape the heartache and find another attorney. If that is what she calls herself.

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
