This firm, hands down, is the best personal injury firm in this state! I was treated like a family member during my case and I got excellent results from all their hard work to get my case settled. I could not be more pleased. If you need help, don't hesitate to give these folk's a call! Thank you very much!

Being in an accident can be a scary and vulnerable place to find yourself in. From my very first encounter to the closing of my case, I felt that Hicks & Funfsinn had my best interest in the forefront of each step of the way. I am extremely grateful that I reached out about my case, and was able to work with Langdon and the team. With their guidance, expertise, and help, it made a scary situation navigable and took the brunt of the pressure off of my shoulders. If you are considering a lawyer for an injury or accident, hands down, I recommend Hicks & Funfsinn. You will not regret it.

Joel is absolutely amazing. I got rear ended last year, and it wasn’t until after I was hurt and realized that it wasn’t going away that I decided to take action. I had called Issac’s and Issac’s first and hated the way that I was treated like I was just a number instead of a human being. Joel immediately made me feel welcome, and relaxed. He definitely took the stress and pressure off that arises out of these situations. I had never experienced anything like this kind of accident, being hurt from an accident, or any of other stuff that comes with it (ie: chiropractors, specialists, physical therapy, etc.) from the beginning me made sure I had complete understanding and support from medical to legal. His main focus was ensuring I got better, instead of just focusing on money. That was not the experience I had with any other lawyer or firm at the beginning of this whole experience. Joel was easy to maintain open communication with, and took the time to make me feel seen, heard, and understood from day one straight through to case closed. I highly recommend Joel Franklin to be your representing attorney should you be the unfortunate victim to an auto accident. Joel is beyond fair, and genuinely cares about every client he takes on. Should I ever have to go through anything like this again, Joel Franklin will be the first and only man I will call; no second thoughts about it.

I was first referred to Joel by my sister who had gotten in a bad accident a year before mine. I called him, set a meeting, and met at his old louisville office. (Its a stunning building.) He's a laid back guy, has a good sense of humor, and is very professional. He's not a slip-and-fall-my-neck-suddently-hurts lawyer. He's legitimate, not a lazy or self serving lawyer. He works to get you healed first, and paid second. If another car ever wipes me off the road again, I'll be calling Joel.

I cannot express how grateful I am for the knowledge, patience, professionalism, and execution of Greg Simms. After being miss represent by a different attorney, Mr. Simms was very upfront, honest and realistic about my legal situation. I was not just another court appearance for him, he took the time to get to know me, my family & explain things very thoroughly and in a way we could understand. We saw immediate results and I am beyond blessed he got the outcome for me in my legal situation that in my opinion no other attorney could have. 10 out of 5 stars if possible. Greg Simms is the real deal. Thank you Greg for everything you did for me and my family.

Greg Simms is not only my law partner but also the most creative attorney in Kentucky. Speeding tickets (filed motion to hold speed limit signs unconstitutional), went all the way to the Supreme Court of Kentucky. Air B&B take criminal charges against you for "damage" (takes case to Jury trial, wins then sues air B&B) getting them to pay the wrongfully charged. DUI, (Greg is certified to teach police to do field sobriety tests). Watching him pick those tests apart in court is worth the price of admission. Greg doesn't charge extra for a Jury trial, that is included should you choose a trial; 100% of the time no ifs, ands, or buts. If my liberty was at stake, I would hire Greg Simms: no ifs, ands, or buts.

Robyn and I graduated high school together, many years ago, which is how I know her. Robyn has always been polite and well-spoken. Recently I found myself in a situation with a former employer that was a surprise to me. During this time in my life, my livelihood was turned upside down. Even though I knew Robyn prior to my case, I was not aware that Robyn was an employment attorney, until she reached out to me regarding another case that my name was brought up in, that she was working on. On that same phone call I questioned Robyn about the type of law that she practiced. Robyn informed me that she was an employment attorney who dealt with employees that were wrongfully terminated, discrimination, retaliation, etc.. This information is what I needed to hear at that time. I asked Robyn if she had time to speak with me briefly and to look over some paperwork that I had received a few weeks ago regarding my wrongful termination with my former employer. Robyn agreed. Robyn took notes as she listened to my concerns and advised me that she would look over everything including my paperwork and would return my call to discuss the matter further. While I waited to hear back from Robyn I started to Google her to find out information regarding her and her prior cases. I was in awe with the information that I found out but not really surprised due to the person I knew in high school. After researching Robyn for several hours I knew that she was the attorney that I wanted to handle my case if she deemed that I had one. Robyn returned my call a few days later and agreed to handle my case. From that point on Robyn has been very thorough with me, upfront about all of my options, and has worked tireless hours on my case as well as keeping me informed. Not only has Robyn been professional about handling my case, she has also been there to assist me through some dark times. I feel as if Robyn can sense when something is wrong and will call to check in on me. This has not been an easy journey but I could not have picked a better attorney to represent me during one of the worst times in my life. Robyn has also had my best interest at hand through all of this while standing firm with the other side. Robyn is the epitome of excellence when dealing with her clients. I highly recommend Robyn Smith. Robyn is the best out there!

I cannot say enough good about Robyn as an attorney and person. I had a situation arise that needed legal assistance and eventually representation and I am beyond blessed that I was led to her. From the first time I reached out to her I knew she was the person that could help me navigate a very difficult period in my professional and personal life. I found her at a time when most others were failing to even acknowledge me as a person and it was affecting me in ever way imaginable. She was patient, open minded, open hearted and genuine in a way that shows without words that you've got a fighter on your side that won't back down. She took the time to get to know me, my situation, and is doing all she can to advocate for me and be my voice. She has helped me to be in the best possible place mentally and emotionally while guiding me through my suit. She can be tough when she has to be but she handles those times with such professionalism and decorum it's enviable. Robyn is incredibly hard working, dedicated to honesty, and doesn't roll over when other attorneys might. She takes her cases and her clients seriously and really works to right the wrongs. She knows my case and I backwards and forwards and has quite an admirable respect for the law, due process, and fair working environments for all workers. If you have been wronged and need legal advice or counsel I can't recommend her highly enough. With her experience and knowledge of federal and state laws I guarantee you can't go wrong.

Brandon helped me through a very difficult time in my life. I was just fired from job, my bills were piling up, and fiancée had left me. When I chose to sue my employer for wrongful termination, Brandon devoted hours of time discussing my case with me. He evaluated all of my possible claims, and was very honest about the likelihood success. Brandon fought hard when the my former employer sought to discredit me, and fought even harder to show my supervisor's illegal motives. When time came to settle the case I felt well informed and vindicated.

I hired Jacqueline Mayer, or should I say I hired the law firm that Jacqueline Mayer worked at after being accused of a misdemeanor crime. I did not hire Jacqueline or the firm that she was working at because of AVVO. I hired the law firm due to their reputation and feedback given by other clients through Google. Shortly thereafter Jacqueline Mayer decided to leave the law firm and to start her own practice. After Consulting with the law firm and getting to know Jacqueline Mayer initially I was given the choice to either stay with the law firm or to continue to have Jacqueline Mayer represent me outside of their Law Firm. I chose to stay with Jacqueline Mayer only because I had been initially working with her and established a preliminary relationship with her. I only later realized that this was the biggest mistake I could have made. Jacqueline is young and quite inexperienced. I later found out that before briefly working at the aforementioned Law Firm Jacqueline Mayer had worked with the District Attorney's office for several years here in Lexington Kentucky and had a personal understanding of the judge that had been assigned my court case. I, as most people might, thought that her working knowledge of the judge was very encouraging. Here in Lexington, as in most communities, having an attorney that has a understanding of their working environment as well as a working relationship with the prosecuting attorney seems like a great strategic choice. As you may or may not know the police only need reasonable suspicion of a crime having been committed which is much different than the standard required in court which is based on facts Beyond A Reasonable Doubt. Reasonable Suspicion is basically and alleged victims statement. Whereas in court you have to present evidence that a crime has been committed and there is evidence Beyond Reasonable Doubt that you would be guilty of a crime. The prosecutor's office nor the detectives involved had any evidence other than an accusation that a crime had been committed. However Jacqueline's inexperience as a defense attorney and close working relationship with the prosecutor's office turned out to be a little less than a complete nightmare for me. In the few months the Jacqueline Mayor representing me she did not file not even one motion. There was no motion for an evidentiary hearing there was no motion to examine a witness and their most certainly was no motion to dismiss because the prosecutor's office and the detectives had absolutely zero evidence other than an accusation. Let's remember that one's friend Court the standard for prosecution or for a trial conviction is evidence Beyond Reasonable Doubt. Jacqueline Mayor, after our first pre-trial hearing seemed absolutely lost. Pretrial hearing after pretrial hearing was called by the judge and Jacqueline Mayor did absolutely nothing other than show up in court. After the 5th or 6th pretrial hearing I began getting the impression that Jacqueline Mayer had never defended a case by herself in her entire life. After the 5th or 6th pre-trial hearing I demanded evidence of exactly what she had done to represent me other than to show up in court. At this time I begin initial conversations with a different attorney. As a result of me having demanded evidence of what she had done to deserve such a healthy fee she produced absolutely nothing and the court records can easily represent exactly what I'm saying to be the truth. Very shortly after being provided zero evidence that Jacqueline Mayer had done anything with my case other than to show up in court I began securing representation from another attorney. My patience with Jacqueline Mayer had come to an end. At this point Jacqueline and I had a conversation. And by conversation I mean that I basically verbally drug her from one end of Main Street to the other. Long story short my new attorney had my case dismissed within two hearings and made sure my record was completely expunged!

I never doubted his knowledge or competency during the process. He was always available for any of my questions or concerns. I am very pleased with the outcome of my case and very highly recommend Mr. Abney.

Immediately upon meeting with Stewart, I was sure that I had made the right decision. He was confident, knowledgeable, and quick to respond. At a time when I was overwhelmed and completely unsure, it was comforting to know that Stewart was taking care of everything. He kept me up to date on my case at all times and was always available to answer any questions that I had. It was very apparent that he did his research in my case. He paid great attention to detail and made it very clear that he would work to ensure that my voice was heard- and he did. While the circumstances were unfortunate, I am happy to have worked with such a genuine person who also happens to be an excellent attorney.

After growing up having an isolated childhood with negligent parents, I always wondered what playing peekaboo would be like. Thankfully, the McCarty legal team gave me an approximation of that feeling with their communication, leaving every 3-month-late reply to my emails saying they were “working on the case” and would “get back to me” filling me with genuine surprise and excitement, much like the plot twist in a good book. Over those two years I worked with Jennifer I wondered “will Jennifer get the milk? Or will it expire before my statute of limitations?” And that thought superseded the angst and pain that was originally brought about by my unlawful termination case. Thanks McCarty legal! I only had to email the office receptionist a copy of my contract to prove I was a client once and, when I requested Jennifer call me back, they asked for my name. I responded “Ben Esgar” and they said, “ok but which one is your last name?” Very thorough work! In all seriousness, this one star review is to symbolize the reader of this review, not the firm; for you, dear reader, are the one star of your case and you deserve better than McCarty Legal. I would rather have my life depend on a trial with Judge Judy presiding and my jury be comprised of the hyenas from Disney’s “Lion King” than work with Jennifer again.

If I could give 0 stars, I would. I contacted the office on February 12th of 2023. I submitted my paperwork within 24 hours after receiving a document to fill out. I called back two weeks later , and I was told they were working on it. Today, I contacted them. It still hasn't been looked at (even though it's been TWO MONTHS) and and I was told I should just "look elsewhere for an attorney." If I had received a denial in a timely matter, I could have already done that. This was a total opposite of what I read on Google, and I am very disappointed with this firm.

What a Sexual Harassment Lawyer Can Do for You

A sexual harassment lawyer specializes in representing individuals who have experienced unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature that affects their employment or creates a hostile work environment. These lawyers help victims understand their rights under federal and state laws, such as Title VII of the Civil Rights Act, and guide them through the process of filing complaints, negotiating settlements, or pursuing litigation. They also assist employers in implementing anti-harassment policies, conducting investigations, and defending against claims.

Whether you're an employee facing harassment or an employer seeking to address or prevent harassment claims, a sexual harassment lawyer can provide the legal expertise needed to navigate these sensitive issues.

When Should I Hire a Sexual Harassment Lawyer?

You should consider hiring a sexual harassment lawyer in the following situations:

  • For Employees:
    • Experiencing workplace harassment: If you are subjected to unwelcome sexual advances, comments, or behavior that creates a hostile or offensive work environment, a lawyer can help you understand your rights and the steps to take.
    • Retaliation for reporting harassment: If you've reported harassment to your employer and are facing retaliation such as demotion, termination, or other adverse actions, a lawyer can help protect your rights.
    • Failure of employer to address complaints: If your employer does not take appropriate action after you've reported harassment, a lawyer can advise on how to escalate the matter legally.
    • Constructive dismissal: If the harassment is so severe that you feel forced to resign, a lawyer can help you pursue a claim for constructive dismissal.
    • Negotiating settlements: If you're considering a settlement with your employer, a lawyer can negotiate on your behalf to ensure you receive fair compensation.
  • For Employers:
    • Receiving a harassment complaint: If an employee has filed a harassment complaint, a lawyer can guide you through the legal obligations for investigating and addressing the complaint.
    • Implementing anti-harassment policies: A lawyer can help you develop and implement policies and training programs to prevent harassment and protect your organization legally.
    • Defending against claims: If your organization is facing a harassment lawsuit, a lawyer can represent you in court or during settlement negotiations.

Hiring a lawyer early can help ensure that your rights are protected and that you take the appropriate legal steps.

What Does a Sexual Harassment Lawyer Do?

A sexual harassment lawyer provides various legal services depending on whether they represent the employee or the employer. Their responsibilities often include:

  • For Employees:
    • Legal consultation: Provide advice on your rights and the merits of your case, helping you understand the legal definitions of harassment and applicable laws.
    • Filing complaints: Assist in filing a complaint with the Equal Employment Opportunity Commission (EEOC) or state agencies, ensuring that all procedural requirements are met.
    • Negotiating settlements: Engage in negotiations with the employer to secure compensation for damages such as lost wages, emotional distress, or punitive damages.
    • Litigation: Represent you in court if a lawsuit is filed, presenting evidence, questioning witnesses, and making legal arguments to support your case.
    • Protection against retaliation: Advise on how to handle retaliation from your employer and take legal action if necessary.
  • For Employers:
    • Policy development: Help create comprehensive anti-harassment policies and training programs to prevent harassment in the workplace.
    • Internal investigations: Guide the investigation process when a complaint is made, ensuring it is thorough, impartial, and compliant with legal standards.
    • Legal defense: Represent the company in responding to EEOC complaints or lawsuits, aiming to resolve the matter efficiently and protect the organization's interests.
    • Compliance advice: Keep the company informed about changes in employment laws related to harassment and recommend best practices to maintain compliance.

How Are Sexual Harassment Lawyers Paid?

Sexual harassment lawyers typically charge for their services in various ways, depending on the nature of the case and representation:

  • For Employees:
    • Contingency fee: Many lawyers represent employees on a contingency fee basis, meaning they only get paid if they win or settle the case. The fee is usually a percentage of the recovered amount, typically ranging from 25% to 40%.
    • Hourly rate: Some lawyers may charge an hourly rate, especially if the case is unlikely to result in monetary compensation but still requires legal assistance.
  • For Employers:
    • Hourly rate: Lawyers representing employers usually charge by the hour, with rates ranging from $200 to $600 or more, depending on their experience and the case complexity.
    • Retainer: Employers may pay a retainer fee for ongoing legal services, especially if they require regular legal counsel on employment matters.

It's important to discuss fees during the initial consultation to understand the cost structure and any additional expenses.

How Much Does a Sexual Harassment Lawyer Cost?

The cost of hiring a sexual harassment lawyer varies based on several factors:

  • For Employees:
    • Contingency fees: If working on a contingency basis, you typically won't pay any upfront fees. If you win or settle, the lawyer's fee will be a percentage of the compensation. For example, if you settle for $50,000 with a 30% contingency fee, the lawyer would receive $15,000.
    • Hourly rates: If charged hourly, fees can range from $200 to $600 per hour. Total costs depend on the number of hours worked.
  • For Employers:
    • Hourly rates: Legal fees can range from $200 to $600 per hour. A straightforward case might cost between $5,000 and $20,000, while more complex litigation could exceed $50,000.
    • Retainer fees: Ongoing legal services may require a retainer ranging from $5,000 to $25,000 or more, depending on the anticipated legal work.

Always request a detailed fee agreement to understand all potential costs.

Top Questions to Ask a Sexual Harassment Lawyer

Before hiring a sexual harassment lawyer, consider asking the following questions:

  1. What experience do you have with sexual harassment cases?
Ensure the lawyer has a strong background in handling cases similar to yours.
  2. How do you charge for your services?
Understand the fee structure, including contingency fees, hourly rates, and any additional costs.
  3. What are the strengths and weaknesses of my case?
Get an honest assessment to set realistic expectations.
  4. What is the likely timeline for my case?
Ask how long the process might take, from filing a complaint to resolution.
  5. Will my case go to trial?
Discuss the likelihood of settling versus going to court.
  6. How involved will I need to be?
Understand what will be required of you throughout the process.
  7. What outcomes can I expect?
Discuss potential remedies, such as compensation, policy changes, or reinstatement.

How to Check the Credibility of a Sexual Harassment Lawyer

To ensure you're hiring a reputable lawyer:

  • Verify their license: Check with your state bar association to confirm they are licensed and in good standing.
  • Review their experience: Look for lawyers who specialize in employment law, particularly sexual harassment cases.
  • Read client reviews: Check online reviews and testimonials on platforms like Avvo or Martindale-Hubbell.
  • Ask for references: A credible lawyer should provide references from past clients.
  • Professional memberships: Membership in organizations like the National Employment Lawyers Association (NELA) can indicate a focus on employment law.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting:

  • Detailed account: Prepare a written timeline of incidents, including dates, locations, and individuals involved.
  • Documentation: Bring any relevant documents, such as emails, text messages, voicemails, photographs, or witness statements.
  • Employment records: Provide your employment contract, employee handbook, performance reviews, and any prior complaints filed.
  • Questions: Write down any questions you have about your case, the legal process, or the lawyer's experience.
  • List of witnesses: Note any colleagues or individuals who may have witnessed the harassment or can support your claims.

Being well-prepared will help the lawyer assess your case effectively and provide accurate legal advice.
