I had reached out to Jean to discuss/review a separation agreement that I received from my employer. She was very accessible - I was able to speak with her directly on my first outreach (vs. many other firms who required a detailed questionnaire or discussion with a paralegal). Based upon that first conversation, it was clear that she had good intentions (it wasn't all about how much she would make from the settlement) - her desire was to help me achieve an appropriate outcome. She came across as experienced, measured and fair. I ultimately had her step in to help with the negotiation and was happy with the overall result. Jean was recommended to me by another employment lawyer that is highly regarded - very glad I had the opportunity to work with her.

When a person is wrongly terminated it takes away more than your job. You loose the essence of who you are, your confidence, your trust in people, how you interact with the outside world. You feel ashamed. But, Jean was able to change all that for me and my termination turned out to be a blessing. Jean gave me hope from the very first conversation. She and Katherine won my case and the money was great but what they really did was continually make me know that the termination wasn’t my fault. They believed in me. I lived across the country from Jean but it felt as though she was right next door. She was in contact when necessary and was always available when I needed to ask something. She allowed me to make decisions on my case and always gave me options and suggestions. Her guidance and in sight was right on target, I trusted her and she was very successful for me. I am forever grateful.

Attorney Melanie D. Popper asked me to leave a review regarding her representation in my case from a few years ago. It was a long fight, but we did prevail after several depositions and hearings on my sexual harassment case. Ms. Popper made me feel protected and like I had a boxer in my corner and I highly recommend her firm for representation in California.

Thank you so much for your service! Your support made me feel powerful in this situation. Attorney Melanie D. Popper represented me in a sexual harassment lawsuit a few years ago involving my supervisor and she asked me to write this recommendation for their office. I so appreciated her attentiveness and professionalism. Women in the workforce dealing with this type of behavior and treatment need zealous attorneys who are willing to stand up for us. It was a long journey, but with great results in the end. Thank you!

John Winer is an excellent attorney. He is hard working, dedicated to his clients and sensitive to the situations his clients are in. Mr. Winer draws from his past trial experience to build cases that obtain favorable results. He won't back down when it comes to fighting hard to get the settlement amount he expects. He has a name out there and I know why! I would refer any family members or friends to John Winer.

My case is not yet completed, and I wanted to write this before then...because for me, it is about more than a dollar amount. Working with John Winer has helped me realize what it is that happened to me; that brought me into his office. He has reminded me time and again that the injuries and batteries I endured were not my fault. I went to him at such a low and wounded point, and he met me there. Inch by painful inch he has brought me to a place of realization - that my attacker preyed on me, used me, and had the training and know-how to manipulate me. It was not my fault. Walking into John's office, I had lost the ability to trust anyone, least of all myself. A person I'd placed so much faith in, had completely destroyed me physically and verbally. John seemed to understand where I was, how I'd gotten there, and most importantly, how to put me back together and give me some power in making decisions about my case, and understanding how this horrible thing could have happened without my permission. There is much pain in growth sometimes. Its nice to have a person beside you who seems to really understand the feelings that go with these experiences. I have felt as safe as I am able with Mr. Winer handling my case. I'm very grateful to have found my way into his office, and to have had the honor of working with him.

"I retained John Winer of Winer, McKenna and Burritt LLP to help me with a dispute against the major corporation I was working for at the time. From the minute I met with John and decided to sign on with the firm I felt nothing but comfortable as the staff and attorneys handling my case kept in constant communication with me, always putting my mind at ease. I never felt neglected and know my case was given the attention it deserved. Devoting countless hours researching and working up my case to its maximum potential, John hired investigators and experts to support my claim- something not every firm does. The law offices of Winer, McKenna and Burritt, LLP were relentless up against the most experienced opposing council and persevered to the very end. John obtained a confidential settlement amount that I was more than pleased with. I would highly recommend him and the law offices of Winer, McKenna and Burritt for anyone with an employment claim within California. "

Prior to my being able to retire, I was "let go" from my position. As a professor, I had never received a bad review in my seventeen years of employment, and my students were very positive about my teaching. I had published books, represented my institution here and abroad and organized major colloquiums. My identity was wrapped up in being a professor, so I was at a complete loss about what to do when I lost my job. I will always be grateful for the help and understanding I received from William Corman. When he entered the picture, his sterling reputation was recognized by my former employers. His efforts on my behalf were taken very seriously. Any attempt I would have made regarding a settlement would have been dismissed. I ended up with a sum of money that would see me through a couple of years if I needed it. Time to pause and reflect on the future without the stress of financial hardship was essential -- required in order to think clearly and logically about how to go forward instead of falling into a lengthy depression. I thank William Corman for his help in making it possible to find my way to work that I enjoy. I am paid considerably more than a professor in my current job. I have recommended William Corman to others, and will return to him myself if I need an attorney. I should mention that my settlement was reached without having to go to court. That was a blessing. And, to add to the positive: William Corman is a personable, kind human being. His presence and attention to our conversations made a painful time for me much less difficult.

I found myself in a serious employment situation, and was referred to Bill Corman by my sister who had researched local best practice attorneys for me. Bill was incredibly responsive, knowledgeable and articulate about the legal aspects of my case. He is direct and honest, and clearly has a wealth of experience and expertise in labor law. He kept me informed through the process, stayed on point despite my tendency to meander off on my emotions, and was very respectful of my finances in regards to his fees. He was always professional, respectful, and non- judgmental as he gathered information about the case. Bill was able to quickly achieve a positive outcome, and I would not hesitate to recommend him to anyone with a labor/employment issue. He is results oriented and it is apparent that he genuinely cares about the best interests of his clients. If you must seek legal counsel, Bill can definitely get results and minimize the painfulness of the process.

I had taken on a large company where I had worked for personal wrong-doing. I received a lot of rejections from other attorneys; however, I knew that I had a strong case, and knew I just needed to find the RIGHT attorney that saw what I saw in my case. Then, I met Mr. Corman. He invited me into his office, and listen intently to what I had to say, asked questions, reviewed some documentation that I had. By the end of the meeting he told me that he would take on my case. He also gave me a clear and accurate assessment of how much the fees would be ( he stayed true to this to the end of the case). There were subsequent meetings after that, and he never gave up on me or the case - always keeping me apprised on the progression of my case. To make a long story short - We won the case!!! Without Mr. Corman's dedication, and belief in me and my case - I could not have won. Thanks again, Mr Corman.

Ed Casey was referred to us when we desperately needed the help of an experienced personal injury lawyer. He's been a lifesaver for us more than once.  First, he helped my husband when he suffered a severe head injury after a heavy metal ladder fell on him at work.  Ed ensured that my husband got full compensation for his injuries, including payment for his medical expenses, wage loss, and the severe pain and suffering he endured. Ed Casey fought the insurance company hard and obtained a great settlement.  Ed helped us again (and a few of my husband's co-workers) when he was able to negotiate a substantial settlement against my husband’s employer for a racially hostile and unfair workplace. I can't thank Ed enough for his expert counsel and his friendship. I highly recommend Mr. Casey to anyone looking for help with a personal injury matter. Ed is kind, responsive and, best of all, gets results! LaDerica G.

I met Ed Casey during the darkest time of my life. A neighbor libeled me on Facebook. Being that this was my first time I ever needed a personal injury attorney, Ed guided me through the ugliness. He helped me understand the civil litigation process and took the time to explain what I could expect during the lawsuit. Ed had a clear and accurate vision on how the case would unfold. He was on point every step of the way. He always kept me informed and was a great communicator. He represented me with honesty and professionalism throughout the entire litigation. Ed also showed a great deal of empathy and compassion for what my family and I had been subjected to. He understood the pain and emotional distress that had been inflicted upon me and how this person’s false statements had caused me significant damages and had injured my reputation. Ed brought light into that dark time in my life. He believed in me and fought for me and for that I will forever be grateful! I would recommend Ed Casey in a heartbeat.

I got to know Ed many years ago in a case when I was representing the defendant and Ed was representing the Plaintiff. Ed aggressively and intelligently represented his client, and was always very professional. This speaks so well of Ed and, in the end, his professionalism and knowledge of the law gets the best results for his clients. I have referred clients and close friends to him for legal representation, when I could not because of a conflict. I would unhesitatingly hire Ed to represent me if I needed a lawyer. He is smart, hard working and someone who I would trust.

Sometimes when seeking a skilled lawyer to resolve such matters, you must forgo having a compassionate and enjoyable experience. Not in the case with Larry. I had the pleasure of working with AJ during a very challenging time in my life. After my first lawyer, who worked remotely and was unfamiliar with Alameda County, I was relieved to find someone like AJ who truly knows the local legal landscape. AJ's experience and knowledge were evident from the start, and he and his paralegal Teddy always responded to my questions in a timely manner. His billing was transparent and accurate, which added peace of mind throughout the process. What a Sexual Harassment Lawyer Can Do for You

A sexual harassment lawyer specializes in representing individuals who have experienced unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature that affects their employment or creates a hostile work environment. These lawyers help victims understand their rights under federal and state laws, such as Title VII of the Civil Rights Act, and guide them through the process of filing complaints, negotiating settlements, or pursuing litigation. They also assist employers in implementing anti-harassment policies, conducting investigations, and defending against claims.

Whether you're an employee facing harassment or an employer seeking to address or prevent harassment claims, a sexual harassment lawyer can provide the legal expertise needed to navigate these sensitive issues.

When Should I Hire a Sexual Harassment Lawyer?

You should consider hiring a sexual harassment lawyer in the following situations:

  • For Employees:
    • Experiencing workplace harassment: If you are subjected to unwelcome sexual advances, comments, or behavior that creates a hostile or offensive work environment, a lawyer can help you understand your rights and the steps to take.
    • Retaliation for reporting harassment: If you've reported harassment to your employer and are facing retaliation such as demotion, termination, or other adverse actions, a lawyer can help protect your rights.
    • Failure of employer to address complaints: If your employer does not take appropriate action after you've reported harassment, a lawyer can advise on how to escalate the matter legally.
    • Constructive dismissal: If the harassment is so severe that you feel forced to resign, a lawyer can help you pursue a claim for constructive dismissal.
    • Negotiating settlements: If you're considering a settlement with your employer, a lawyer can negotiate on your behalf to ensure you receive fair compensation.
  • For Employers:
    • Receiving a harassment complaint: If an employee has filed a harassment complaint, a lawyer can guide you through the legal obligations for investigating and addressing the complaint.
    • Implementing anti-harassment policies: A lawyer can help you develop and implement policies and training programs to prevent harassment and protect your organization legally.
    • Defending against claims: If your organization is facing a harassment lawsuit, a lawyer can represent you in court or during settlement negotiations.

Hiring a lawyer early can help ensure that your rights are protected and that you take the appropriate legal steps.

What Does a Sexual Harassment Lawyer Do?

A sexual harassment lawyer provides various legal services depending on whether they represent the employee or the employer. Their responsibilities often include:

  • For Employees:
    • Legal consultation: Provide advice on your rights and the merits of your case, helping you understand the legal definitions of harassment and applicable laws.
    • Filing complaints: Assist in filing a complaint with the Equal Employment Opportunity Commission (EEOC) or state agencies, ensuring that all procedural requirements are met.
    • Negotiating settlements: Engage in negotiations with the employer to secure compensation for damages such as lost wages, emotional distress, or punitive damages.
    • Litigation: Represent you in court if a lawsuit is filed, presenting evidence, questioning witnesses, and making legal arguments to support your case.
    • Protection against retaliation: Advise on how to handle retaliation from your employer and take legal action if necessary.
  • For Employers:
    • Policy development: Help create comprehensive anti-harassment policies and training programs to prevent harassment in the workplace.
    • Internal investigations: Guide the investigation process when a complaint is made, ensuring it is thorough, impartial, and compliant with legal standards.
    • Legal defense: Represent the company in responding to EEOC complaints or lawsuits, aiming to resolve the matter efficiently and protect the organization's interests.
    • Compliance advice: Keep the company informed about changes in employment laws related to harassment and recommend best practices to maintain compliance.

How Are Sexual Harassment Lawyers Paid?

Sexual harassment lawyers typically charge for their services in various ways, depending on the nature of the case and representation:

  • For Employees:
    • Contingency fee: Many lawyers represent employees on a contingency fee basis, meaning they only get paid if they win or settle the case. The fee is usually a percentage of the recovered amount, typically ranging from 25% to 40%.
    • Hourly rate: Some lawyers may charge an hourly rate, especially if the case is unlikely to result in monetary compensation but still requires legal assistance.
  • For Employers:
    • Hourly rate: Lawyers representing employers usually charge by the hour, with rates ranging from $200 to $600 or more, depending on their experience and the case complexity.
    • Retainer: Employers may pay a retainer fee for ongoing legal services, especially if they require regular legal counsel on employment matters.

It's important to discuss fees during the initial consultation to understand the cost structure and any additional expenses.

How Much Does a Sexual Harassment Lawyer Cost?

The cost of hiring a sexual harassment lawyer varies based on several factors:

  • For Employees:
    • Contingency fees: If working on a contingency basis, you typically won't pay any upfront fees. If you win or settle, the lawyer's fee will be a percentage of the compensation. For example, if you settle for $50,000 with a 30% contingency fee, the lawyer would receive $15,000.
    • Hourly rates: If charged hourly, fees can range from $200 to $600 per hour. Total costs depend on the number of hours worked.
  • For Employers:
    • Hourly rates: Legal fees can range from $200 to $600 per hour. A straightforward case might cost between $5,000 and $20,000, while more complex litigation could exceed $50,000.
    • Retainer fees: Ongoing legal services may require a retainer ranging from $5,000 to $25,000 or more, depending on the anticipated legal work.

Always request a detailed fee agreement to understand all potential costs.

Top Questions to Ask a Sexual Harassment Lawyer

Before hiring a sexual harassment lawyer, consider asking the following questions:

  1. What experience do you have with sexual harassment cases?
Ensure the lawyer has a strong background in handling cases similar to yours.
  2. How do you charge for your services?
Understand the fee structure, including contingency fees, hourly rates, and any additional costs.
  3. What are the strengths and weaknesses of my case?
Get an honest assessment to set realistic expectations.
  4. What is the likely timeline for my case?
Ask how long the process might take, from filing a complaint to resolution.
  5. Will my case go to trial?
Discuss the likelihood of settling versus going to court.
  6. How involved will I need to be?
Understand what will be required of you throughout the process.
  7. What outcomes can I expect?
Discuss potential remedies, such as compensation, policy changes, or reinstatement.

How to Check the Credibility of a Sexual Harassment Lawyer

To ensure you're hiring a reputable lawyer:

  • Verify their license: Check with your state bar association to confirm they are licensed and in good standing.
  • Review their experience: Look for lawyers who specialize in employment law, particularly sexual harassment cases.
  • Read client reviews: Check online reviews and testimonials on platforms like Avvo or Martindale-Hubbell.
  • Ask for references: A credible lawyer should provide references from past clients.
  • Professional memberships: Membership in organizations like the National Employment Lawyers Association (NELA) can indicate a focus on employment law.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting:

  • Detailed account: Prepare a written timeline of incidents, including dates, locations, and individuals involved.
  • Documentation: Bring any relevant documents, such as emails, text messages, voicemails, photographs, or witness statements.
  • Employment records: Provide your employment contract, employee handbook, performance reviews, and any prior complaints filed.
  • Questions: Write down any questions you have about your case, the legal process, or the lawyer's experience.
  • List of witnesses: Note any colleagues or individuals who may have witnessed the harassment or can support your claims.

Being well-prepared will help the lawyer assess your case effectively and provide accurate legal advice.
