While on vacation in Boston, I was falsely accused of a serious crime, arrested, and faced with felony charges. After spending the night in jail, I was assigned a public defender who was entirely unfamiliar with my case. Unfortunately, not only was this public defender incompetent, but he also lacked the appropriate credentials to handle a case of such seriousness. I was facing a minimum of five years in prison, and my bail was set at $60,000. The public defender made no effort to fight for me. He didn't attempt to have my bail reduced or identify any weaknesses in the case against me. Instead, he simply agreed with the prosecutor and judge, and I was sent back to jail. After three nights in jail, my family informed me that they had hired a criminal defense attorney named Paul Moraski, who would be visiting me in a couple of days. True to their word, Paul arrived at the jail two days later. I was escorted by a correctional officer to meet him. From the moment we met, I knew Paul was the right lawyer for me. He had an incredible personality, was highly educated and knowledgeable, and held himself to a very high standard. For the first time, I felt hopeful again. The first thing Paul said to me was, "We’re going to beat this case." He then assured me, "I am going to get your bail reduced from $60,000 to $30,000 so you can go home." Paul not only understood my case thoroughly but also knew the courtroom inside and out, thanks to his 14+ years of experience. Two days later, I had another court appearance, and Paul was outstanding. He successfully persuaded the judge to lower my bail from $60,000 to $30,000, allowing my family to secure my release. The night I was bailed out, Paul immediately called to congratulate me on going home. He reassured me once again, saying, "There are numerous holes in your case, and you have nothing to worry about." Despite Paul's reassurances, I remained anxious about my case after returning home and would call him weekly. Each time, Paul answered the phone, and if he was in court, he would return my call immediately afterward. Paul is an exceptional attorney, though not inexpensive. However, he provided me with a very reasonable rate given the severity of my case. He also offered me a monthly payment plan, which greatly eased the financial burden. When it comes to fighting for your freedom, no price is too high. Paul Moraski was worth every dollar. Six months later, just as Paul had predicted from the start, my case was completely dismissed. If you find yourself facing legal issues in the Boston area, I highly recommend contacting and hiring Paul Moraski. He is not only an outstanding defense attorney but also a remarkable person. I feel like I not only hired a lawyer but also gained a friend. Thank you for everything, Paul. Ray Ray

Attorney Medore is a phenomenal at what he does. I would recommend him/his services to anyone. I hired him to assist me with my SSDI claim. He was instrumental to the successful outcome of my claim. I simply could not have done it without his expertise. He skillfully guided me through the entire claims process, navigated through the subsequent appeal process and ultimately the successful outcome of my hearing in front of the judge. I attribute this success entirely to my Attorney Rick Medore. I was so impressed with his professionalism and depth of knowledge on the subject. I will be forever grateful for the legal services he provided me. Worth every penny.

Grateful to have found and worked with Attorney Madore. I needed someone patient to help with my SSDI case who was not frustrated by my difficulties with anxiety and cognitive overwhelm due to PTSD and chronic illness. I am glad he was on the other end of the phone for all the information needed. I really did need that help and am grateful to now on the SSDI that I currently need with the least stress possible considering the challenges of the process. I do recommend Richard maybe especially for folks with complicated illness such as Lyme and PTSD.

I was referred to Jason through another attorney and let me tell you, I could not be more pleased. He did an amazing job helping me get guardianship for my 55yr old brother. I had been trying for a few yrs to get this task accomplished. Jason is very professional and compassionate, he truly understands how family's feel going through this rather tedious ordeal. Jason knows exactly what the courts need for all date sensitive documentation. He was always willing to help with calling the Dr. or going to pick up documents for me if need be. My brother and I are very pleased that its completed and safely filed away. I would highly recommend Jason to friends and family! Thank you again Jason!!

I don’t know what we would have done without Jason. My husband and I hired Jason to help us obtain guardianship for our disabled daughter who turned 18 years old this past December. From our initial meeting to help us understand what the guardianship process entailed, to our last meeting in court, Jason was an amazing resource and always so patient and understanding…no matter how many questions I had. My husband and I thought the final court appearance would be a simple formality, but unfortunately, we had a rather cold judge who made it a very unpleasant experience. Thanks to Jason’s calm, knowledgeable and professional demeanor with this judge, we were granted guardianship. We would highly recommend Jason as an attorney who is extremely smart, kind, and professional!

I am the representative payee for my adult disabled son. After five years of my son being disabled and collecting disability, his Doctor and I received a form to fill out for a medical review to see if he was "still disabled." I filled this out perfectly describing my son's day to day life and impairments. Although I am a medical professional, obviously I did not do this as well as I perceived as just before Christmas 2014, we received a notice stating my son was no longer disabled and his disability payments would stop in two months. Social Security was not at all helpful and gave me the run around re: the appeal process. Sometimes Social Security employees were not nice or helpful. I knew we needed help. I researched disability attorneys and found Jason. All I can say is "Thank God." He met with both of us and asked questions about my son's disability and symptoms. My son and I provided all the answers to the review to him however Jason worded it in the manner that SSDI requires, unlike what I had done in the previous summer. He was kind, patient, and understanding. There were a few times when my emotions got the better of me, "How can they do this to us?" These were the times when Jason stood behind us and helped us stand on our own two feet. He directed us in following the instructions on the appeal as they are not easy to understand, Jason understood exactly what they were and explained them in a manner that was both understandable and helpful, never degrading. On May 6th of this year, I received the notice from disability stating that after reviewing all the information, they found my son to continue to be disabled, therefore there was no need for a hearing. Of course I would prefer my son to not be disabled. However it is what it is and I do not even want to think of how awful this denial could have been without Jason. I wish I had known him and used him to initially get disability for my son back in 2009 as that process was not pleasant and took three denials/appeals. I definitely could not have done this without his help! My husband and I are now going to be using Jason for estate planning and our wills.

Attorney Light represented me on two occassions. I found him to be informative, knowledgeable and professional. Although I felt somewhat intimidated on our first meeting, the more I got to know him, the more I realized that he was looking out for my best interest. One of my cases involved my teenage son and Mr, Light would make it a point to ask aout him. Mr. Light is the utmost professional but he is also a family man and he cared about my family and did everything in his power to assist me. I was pleased with the outcome of both cases and would highly recommend him. He was very genuine and always had my best interest at heart. I continue to keep in touch with him.

He made what had been a difficult time in our lives easier. He is hard working professional who makes himself and his team fully available to clients throughout the process at any time. The Burns & Jain team are a dedicated group of individuals who offer thorough explanation at each step of the legal process and through their kindness help you to feel comfortable and able to see the process through. My daughter and I were in a horrible head-on car accident, Neil and his team were able to help both of us navigate the legal channels and get insurance coverage maximized for us both. What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
