Scott Lewis is compassionate, empathetic, yet aggressive for his clients! Furthermore, he is on top of the current laws/cases as they pertain to your particular case. I went to Scott after I suffered a severe traumatic brain injury (including a skull fracture, 3 week coma, and a 4 week stay in what was supposed to be a rehab but was a physiatric hospital that was attempting to get their accreditation for TBi REHAB) from a motorcycle wreck out of town. When I was told I couldn’t return to my career, I was devastated! But I know I misspeak a lot, get grouchy with the public, and feel so isolated and alone. Scott was always there for me! Cried with me- fought tooth a nail for me!! He still calls to see how I am. I forgot to mention this started in July 2015. Not only was I denied twice, we had a full hearing finally in 2017 or 2018 ( I can’t remember). After waiting almost 7 or 9 months for the decision, I was turned down AGAIN! Scott still didn’t quit. He appealed the Judges decision and won!!! We had a new hearing in June of 2019. 30 days later we WON!! Not only won- but retroactive to the date of injury!! I don’t know what I would have done without Scott during this process.... I was so depressed and I literally feel like he gave me a second chance at life after a wreck tried to take my life. Thank you, Scott (and his associates are so patient and helpful!!)!! I can never say thank you enough!’ Anyone who has been wrongfully denied Disability and doesn’t go consult with Scott Lewis is missing out on an amazing non-quitting advocate!!!

James expedited the process faster than we could ever imagine and we don’t have a single complaint regarding his work. He provided updates even when there was no update to be given. James was on top of things throughout the entire process and he was able to get the expungement completed only within a few months. I knew nothing about the long term disability process before I hired Mr. DuBach. My long term insurance cut me off and it was a terrible experience for me and my family. The insurance company harassed me and I just didn't know where to turn. After months of not knowing what to do, I found Mr. DuBach in the phone book. When we first met, he was honest about my chances- he felt it was a bad policy, but said he would do the best he could. Him and his wife, Lesley (paralegal), were so kind and kept me informed during the entire process. I hired him March 2013 and my case was just settled a few days ago. Thank God for Mr. DuBach's help- I wouldn't have my money without him. I'd recommend him and the entire law office to anyone in need of advice or legal help. Thank you again!

He was a FANTASTIC advocate. I won my case at the hearing level and I owe that to the Hankey Law Office and Mr. DuBach. The staff kept me informed during the appeals process. They helped with the paperwork, ordered my records and prepared me for the hearing. I was very nervous to go in front of the judge, but Mr. DuBach answered all my questions and made me feel very comfortable. I can't thank him enough for all he's done for me.

Several years fighting a complicated disability claim, one that six previous lawyers refused without even reviewing the case. With two weeks before a hearing before an administrative law judge, I came across Mr Browder's profile online. For some reason, I reached out and spoke with an intake person, attempting to explain the case. A couple of hours later, I receive a call from 317 area code. After repeated rejections, I very nearly didn't answer but felt guided to do so in this case Two weeks ago, I was running around with a good bit of knowledge and zero idea how to put the pieces into coherent form. This morning, this attorney drove from Indianapolis to Columbus OH for a case he had crammed to prepare for, with no guarantee of anything, save lost time and gasoline Fifteen minutes in the hearing room and this attorney turned a very complex case into an approval. I cannot say enough about this man who has ensured my children will have a secure future after my passing How do you thank a man who stepped in when every other passed on the opportunity, one of which had an office right next to the hearing location? There is no way I can do so other than this. Any attorney who takes a case no one else wants and turns it into a six figure award in back pay alone is surely the person anyone should want in their corner. I cannot put into words, the respect I have for Mr Browder nor can I ever properly repay the debt I owe him If you have a social security claim, Thomas Browder should be your only choice. If he can fix the mess I had, in less than two weeks, he should be able to take care of anything you might need

I have personally known John for 30 years. We were very close friends growing up in Indiana and shared many of the same passions. Two of which were basketball and water skiing, where we were High School teammates and summer companions. John comes from a great Family, with values and ethics. His Dad afforded me my first "real" paying job cooking chicken! I say this because John, and his Family, are always willing to help, period. As a result, he has built a tremendous Law Practice with some of the most talented lawyers in the State of Indiana. I say this too, personally speaking, because John and one of his highly talented lawyers have represented not one, but two, of my own Family members with disability concerns. As a Vice President of Investments, I naturally refer my valued clients or their loved ones to John without blinking an eye. If I Trust him with both my clients and my Family, there really isn't a better thing I can say about his Law Practice, or for the matter, him as a person. -Jason K. W. I was lied to constantly. I never once was able to speak with Mr. Lewis. I paid half which I was told I needed to paid in October 25, 2023 and the other half was to be paid when the expungement was completed. I made several calls to Mr.Lewis office always speaking to a Mark?? I was lied to constantly. First lie was the prosecutor was being replaced in Hamilton County so that was causing a hold up. I waited another month I called and lied to saying that my paperwork had been lost in the process. End of April I requested copies of court documents sent on my behalf. I received the PDF. Forms of documents to both counties I needed expungement from. Neither had been submitted to the court. And not signed by David Lewis. I have times and dates of every call and the PDF forms sent to me on May 1st. Never once during this time was I asked for balance to complete process. Not until July when I called Mark out as being a liar and this he admitted to everything. I asked for a refund he said it would be a couple days for the check to process. I called back to see if he could just refund my boyfriend’s CC. That’s when Mark informed me that he couldn’t give a refund I would have to pay the balance to get Mr. Lewis to move forward with this process. Of course I have been dealing with this for almost a year now. When I was first told it would take 3-4 months to complete. I didn’t want to give more money considering how much I had been lied to and never once had a chance to speak with Mr. Lewis. No matter how many times I ask. The office completely stopped answering my phone calls. Until one day Julie Brown answered I explained my dilemma. She is another attorney in this office. She said she would take notes and leave on Mr. Lewis desk but she doubts if I will get a return call. Mind you my cases were both minor both misdemeanors. I should have never been put through this stress. I would never have a kind word to say about what I was put through and never about Mr Lewis. He is a fraud to me. Robin McCaslin

Melissa was excellent in my disability hearing, especially considering the judge I had a extremely low approval rate. She stood her ground to fight for my case. Yes I had only met with her once before the hearing but it was only necessary to meet once before to review my case. She is very knowledgeable in her field and definitely knows what she is doing in the courtroom, whether it be face to face, or a video hearing like mine was. I never once doubted her or the Hankey Law firm when it came to my case. I believe it is not just her or the firms job when it comes to what to say and not say during a hearing to win a case, especially because she is not the only who gets asked questions. Keep yourself prepared for the hearing, and if there is any questions before your hearing she is very open to them. I HIGHLY recommend her and/or Hankey Law office as a disability attorney.

I maybe 3-4 times in 3 years and it's not on my end it's on Keller and Keller end. The case manager that was assigned only works 3 days a week and gets back to you weeks and months later with no answers just leaving me with no solution. Very frustrating finally had a pre hearing appointment and they cancelled it the day before with him less than a 24-hour notice how professional. I would steer clear from this law firm as much as possible when there are dedicated Social Security lawyers out there and with me seeing the Social Security doctor almost three years ago with confirmed diagnosis is there should not be any hang up. It's pretty sad when I have a transparent relationship with Social Security office and they even say that my case should have been pushed through by now and that if I haven't even seen my lawyer in person since I hired them then it's time to walk away. It's a money Mill stay clear away they do not have you in your best interest you're nothing but a income tag to them you're not a person that matters.

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
