I had my initial disability application turned down. I was advised to try Cavanaugh Law Office with my appeal. His team told me what to do and what to expect. I got nothing but the best of service from them at any time and any day. Patrick and his staff always let my voice be known. If I had any questions they were more than willing to answer them.

I CONTACTED MR. HALLER AFTER WORKING WITH TWO PROMINENT ATTORNEYS WHO STARTED BUT THEN DROPPED MY DAUGHTER'S DISABILITY CASE. I WAS LEFT IN A BIND WITH A HEARING BEING SCHEDULED AND NO ATTORNEY TO ASSIST WITH HER CASE. MR. HALLER TOOK MY DAUGHTER'S CASE EVEN THOUGH IT WOULD BE A BIT OF A STRUGGLE DUE TO UNDIAGNOSED CONDITIONS BY THE MEDICAL FIELD. HE WAS DILIGENT IN WORKING ON HER CASE, ALWAYS RESPECTFUL TO US, AND SHOWED CARING THROUGHOUT THE PROCEEDING. HE ALWAYS KEPT ME INFORMED OF WHAT WAS OCCURRING, AND FOLLOWED UP WITH EMAILS, PHONE CALLS, AND WRITTEN CORRESPONDENCE. I HAD REPRESENTATION PREVIOUSLY WHERE I WAS DOING A MAJORITY OF THE LEG WORK AND RESEARCH FOR THE CASE AND I HAD NO UPDATES, OR INFORMATION FROM THE ATTORNEY I HAD HIRED, SO MR. HALLER'S PROFESSIONALISM WAS A WELCOME BLESSING. WE HAD A POSITIVE OUTCOME ON THE CASE, AND MR. HALLER'S COMMITMENT TO HELPING US WAS A HIGH CONTRIBUTING FACTOR. I WOULD CONTACT HIM FIRST IN THE FUTURE FOR ANY OTHER LEGAL NEEDS WE MAY HAVE.

Beginning the battle of custody originally seemed daunting to me, and filled me with insurmountable anxiety. Upon meeting Chellsie, my fears were immediately laid to rest. Her demeanor is completely confident from the way she speaks, to how she follows through on all of her promises. I felt completely taken care of and assured in her council. She enlightened me to information I was not previously aware of, nor think had I been made privy to by a lot of other custody lawyers. I can’t speak enough of how well she did handling my case. Everything I wanted, she got done for me—not to mention in a professional, timely manner. I would recommend her to my closest friends and family, which is saying a lot. I can’t thank this firm and especially Chellsie enough. Her reputation far exceeds her accolades.

Like many people, I was faced with a situation in which I was scared, confused, lacked knowledge on how to handle the situation and was unsure of where to turn. I contacted Chellsie Weber as she works for a highly reputable law firm in Omaha, NE that specializes in handling situations such as mine. Upon meeting Ms. Weber during my initial consultation, she was extremely personable, very knowledgeable in the matter that I was seeking counsel, and beyond patient in answering my plethora of questions. Ms. Weber went above and beyond to ensure that I was prepared when it came time for the hearing and explained the process; moreover, her role in the process and how she was going to represent me in complete detail. Not only was she highly professional, she also has this aura about her that made me feel comfortable from the initial handshake to the finality of the case. If you are trying to decide on an attorney to meet your needs, I highly recommend Chellsie Weber as she exemplifies professionalism and a true sense of humanity to genuinely fight for her client's rights.

Philip Martin Esq. won our SSA case for us because he never stopped analyzing the content of our information vs. the requirements of the law, which ultimately led him to a specific final approach as our hearing drew near. When you first meet with him, don't expect a finalized answer on just what will occur or how, because it will probably change. He has a style of 'strolling' back and forth through a conversation and the evidence. You might wonder about his direction, but trust this professional because his eclectic abilities are going to result in a win, IF you follow his advisements and IF your evidence is true and complete. You might think something should be "this way" and not like it when he tells you the best way to go is "that way"; but he's going to be right. He too wants to win the case....remember a Lawyer doesn't go to court to lose cases. He will streamline things as much as he can to avoid inconsequential things that might cobble up your case. Allow this man to work, don't subject him (or any Lawyer ) with constant hand holding. Get him all your newest info and evidence, and let him in on your thoughts when the opportunity allows for that. He is exceptional & he will get even better as time goes on, so hand it over and let Phil do the worrying. If it's all true and complete, he WILL win your case. His work has changed our family's life & we are glad he handled our case. Thank you Phil.. God Bless and our best wishes.

Mr Petersen represented me after I caught a drug charge etc. I had no clue where to start and things at the courthouse along with procedures and court dates was all too much and a huge extra stress on top of everything else that comes when you a facing troubles such as these. From the moment I spoke with his paralegal to setup a meeting to get the ball rolling, I was actually put at ease, more than I expected to. Everyone was exceptionally kind, they handled everything! When I say everything, I mean it was automatic with wonderful communication, and explanations and honesty. Mr. Petersen is a straight shooter, he knows the court systems like the back of his hand, he's respected around the courthouse and he absolutely delivers when it comes to having your back and getting the best outcome for you, hands down! With the upmost respect for Mr. Peterson I will always thank him and his office for their help, they did wonderful by me but I hope to never need to see them again .. lol, if Something ever happens however, I know who I'm calling. Petersen Law is the best decision you can make if your ina sticky situation that requires the best help. Thanks again!

I was told in the first written communication from my case manager that she would be in contact with me approximately every 40 days. I did not receive a call or letter until I contacted her well after the 40 days. The first day I came to the Cuddigan office to learn about the services available for help with a disability claim, I was told that Cuddigan law does not know about a Medicare program. I was so confused that they would not know about Medicare. I assumed that I would need to work directly with medicare to get it set up. I was on the phone with my case manager on 11/20/23 regarding a callback that I didn’t receive from the SSI office. I told my case manager that I knew she could not help me with Medicare. She stated that she does know some things about Medicare and she could help. How could I not be confused and frustrated with this situation? I held up my end of the contract but I feel let down by the service I received.

I became disabled last year and thought handling the process on my own would be simple enough. Wrong. I interviewed a couple different firms and was nervous when I heard Cuddigan didn’t take every case because they were my first choice. Then I figured they probably only take clients they know they can help! So right. They always respond to phone calls and emails. They are so friendly and reassuring. They are the absolute gold standard in every way. I couldn’t have done it without their support and now I can rest easy that I’m only a few months with no denials or additional paperwork my SSDI was approved and now I can focus on my health and stop worrying about how I’m gonna make it through! So very grateful! Thank you.

After years of being at a 60% VA rating, with the possibility of having it decreased, and being denied any type of increase with another non lawyer agency, I was referred to Cuddigan law firm by another vet who got to 100%. Within 6 months, I got 3 increases, finally getting to 100% P&T. There’s no risk to the veteran. No increase on previously denied claims? ? No fee. They handle all of the hard stuff. You just have to make your appointments. They keep you informed with calls and emails. Michael was available and informative. Sean, the lawyer, personally calls and speaks with you WITHOUT charging you. If you’re on the fence or it’s time to make that move for that 100% rating, give them a call. They make it easy and they understand veterans and how the VA works. U appreciate their care, patience, and non-judgemental approach. Don’t wait! I should have called sooner.

Although the case was in question is not quite at lawyer phase, as I was calling as aide to a third party, they gave sound (not legal) advice on where to find necessary information and resources. They didn't have to do this as their time is extremely valuable and we were not clients. And as I stated the advise was not legal, just a kind person listening and sharing life knowledge. These will be the only lawyers to call once the situation progreesses through the necessary steps as they see people as more than just a payday!

I had troubles finding a disability lawyer to take my case not because of my conditions, but because of my age. She prepared me by letting me know that it will take some time because of my age but my conditions qualified me and was very confident that I would win my case. She was prepared every corner in my fight and worked around that I lived in a rural area not easily accessible of making trips to her office for hearings, paperwork and any other issues that may have arised. I really am grateful for all her support and hard work. I recommend her highly for fighting for disability.

I legit have court in the morning and I am not prepared. I asked my attorney (MARK BESTUL) to get a continuance and that I couldnt miss work for 90days and he emphatically said no! He said the judge wouldn't approve it as the initial order would be "halfway into the order." Ummm, what the hell does that even mean IF they can be granted from 1 year to 5? Nevermind my abuser (yes, it's DV) was granted a continuance to 1) LEAVE THE COUNTRY. Then, they 2) gave me the wrong address to the courthouse. Then, 3) it was reset for lack of time last week. I asked Mark this last week as getting all the necessary documents, etc would take some time AND I did not want to lose my job. I called and asked what I could do to escalate it for his boss to speak with him and was told I could file a grievance. Yes, a grievance that WOULD take weeks/months to resolve. I have court in the morning, less-than 1 weeks after the last court appearance that was reset by the judge. This is ridiculous. This is why people handle things their own way as doing it the "right/preferred" way gets you wholly ignored and minimized. I will end up dead and it'll be my fault that I didn't do what exactly? Report, file, comply??? He is a joke and this agency is a bigger joke. 😔

This is supposed to be an organization that helps those who cannot help themselves in a tricky, confusing legal system. They know their clients are likely to not have computers (why are their documents barely fillable on a phone??), and they know their clients likely do not have bank accounts (why TF do they ask for a debit card???), and they know their clients have likely been screwed over by the legal system time and again (why do they make it difficult to complete a process like getting a d*mn ID????). If I could leave zero stars I would. Do your job, Legal Aid of Nebraska. Do your job.

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
