I consulted with Jeremy with the intention of hiring him for a ERISA appeal on my husband’s behalf because I was anticipating a termination of his LTD benefits. Fortunately, it turned out to be not necessary but I will be contacting Jeremy if needed in the future. During our discussions, I was very comfortable with his advise and he helped me to map out a strategy for our appeal very quickly. Highly recommend!

Jeremy Bordelon is in the upper echelon of attorneys handling ERISA and SSDI disability benefit claims. I have consulted him for his advice and expertise on several of these matters. Jeremy has always been timely, professional, and thorough. He is remarkably strategic in his client representation. I know other attorneys in this area who also think and speak highly of Jeremy. If you are in Oregon or Tennessee and need a fantastic attorney, give Jeremy a call!

Without his help my case for SSD would have ended up with a denial. He was well prepared and never overlooked the details. The details important to winning my case. Also having help with turning in documents wasn’t so bad either. I would recommend him to anyone struggling with this process.

I was referred to Mr. Cuppett (Dan) by a friend. From our first phone conversation Dan has been very positive and courteous, accessible by phone and in person, Since Covid 19 we have had to communicate by phone, which has worked out perfectly. Dan has taken me through each step of my case and answered all of my never ending questions with great expertise and patience. His vast knowledge of the legal system and guidance has helped me to continue when I was ready to give up. Thanks to Dan’s help, my case had a positive outcome. I highly recommend Daniel Cuppett for legal services. He’s the best!

I've dealt with a lot of attorneys and Bennett is one of the few that was able to review my case with an open mind. He was able to give me realistic expectations and was empathetic to the "employee" in a worker's comp claim. Unfortunately it appears that I missed the filing deadline to move forward with my claim. However, I wish the hearings office would have let me know that before they even scheduled the hearing. Even after all that, Bennett was kind in breaking the bad news to me and I would call him back in a nanosecond if I ever find myself in another work comp situation and refer anyone who would listen to him and his firm! Thank you Bennett!

When you retain an Attorney, especially a Worker Compensation Attorney, you want an Attorney who is knows the Law, defends your rights, and is there when you need to speak to them. I just described Mr. Dalton, who is your Attorney for the legal issues, who is a Counselor during your legal fight for the due benefits, and a friend when needed during the legal process. All of the attributes described above define Mr. Bennett Dalton, as he will be yout Attorney, your Counselor, and your Friend during your legal fight, which are attributes needed to win the legal fight for your Rights and Benefits under Worker Compensation Laws! I contacted Mr. Dalaton on a matter related to Police Officers and Firefighters who suffer a Line of Duty Injury and he was available 24/7 and was very helpful in providing information and guidance with our legal matters but unfortunately our issues were not in his legal practice but did provide directional information that helped us to follow the correct legal parh. Just a final note, Bennett is an Attorney who has Integrity, which is a trait not seen in every licensed some attorneys! If and when you contact Mr. Dalton you will be retaining an Attorney that will represent you and achieve the Benefits you worked for as an Oregon Injured Employee! Respectfully, JJ

Work related "stress" claims are difficult to prove in Oregon. After many rejections from other attorneys I was fortunate enough to try Art Stevens. Art was not afraid to take my case! After my Workers' Compensation claim was denied Art expertly guided me through the appeal process. His knowledge, experience and expertise with Oregon Workers' Comp law was invaluable in helping me attain a settlement. I felt listened to and cared about. He went to great lengths to explain the legal processes thoroughly and ensured I took every step necessary to gather the evidence needed for a successful mediation, or, hearing, if it came down to that. The situation with my former employer was quite complex and involved a separate civil employment discrimination complaint. Art helped keep me focused on the most important aspects of both cases and worked in tandem with my attorney for the civil case. He guided the cases into a successful global mediation. This saved me the added stress of hearings and potentially years of court action. If you need an experienced attorney who believes in you and your case Art Stevens is the one to call!

From the very first phone call, Robyn has been “on it” like nothing I’ve experienced before. She was on top of every deadline and every item that came up through the disability application and appeal process. Even before she was my attorney for my disability case, she had so much knowledge and guidance she offered without regard to being my attorney. I felt as though I had a partner in this complicated and lengthy process. She held my hand through the whole thing and was always up front about what the process entailed. I can’t recommend her enough!! You will be grateful to have her working with you!

I contacted Robyn, and another attorney, following an illness that led me to start investigating Social Security Disability. When I met with Robyn, I knew instantly that she was the attorney for me, and cancelled my appointment with the other attorney. Robyn was thorough, and guided me through every step of the process. She managed my expectations realistically, letting me know that most applications are denied at the initial review level, but she did in fact obtain my disability benefits at this first level. I was impressed with her knowledge and level of professionalism. My application was filed in December, and in May direct deposits began flowing into my checking account. If one of my loved ones needed to file a disability claim, I would recommend Robyn in a heartbeat.

My family encouraged me to file for Social Security Disability, I kept putting it off because I didn't feel good and felt overwhelmed when I would log on to the SSDI site to start a claim. I stopped by Roger Ousey's office after a doctor appointment one day. Cheryl Ousey met with me right away, then looked up my information and pointed out I only had about a month to get it started before I missed a time frame to file! So I went home and filled out by hand many pages to file, and turned those over with an immense pile of doctor reports, test results, etc. - and they inputted all of those for me. Roger Ousey kept me informed along the way - and he or his staff were always there to answer any questions for me - no matter how trivial. Their work ethic is above and beyond - especially taking on a case without knowing for certain I would receive benefits - and they would then get paid. When my court date finally came up - Mr. Ousey was with me - as he had been all through the long process of waiting to get to court. And I was so pleased that I received my benefits!

Jeremy comes highly recommended. I researched multiple attorneys in Clark county and decided on Elizabeth Christy Law Firm because of the great reviews, and I'm glad I did. Jeremy was very quick, thorough, supportive, knowledgeable and responsive during this whole process. The process to which I'm referring is establishing a parenting plan and court ordered child support. The process took about 3 weeks, consultation to signed orders. I hired Juliana to help me with my SAIF claim. I injured by back, and SAIF accepted a strain. I had a lot more problems than that, and she got my other conditions accepted. She and her staff worked tirelessly on my case, answered my questions, and explained how the system works to me. Thanks to their work, I got a good permanent disability award and I am being retrained. At the end, I could not believe they had done all that work and because of the law, not get paid. In spite of that, Juliana and her whole staff were kind and gracious and treated me with respect at all times. If I ever need a lawyer again, she's the first call I'm going to make.

My father had a horrible accident that almost ended his life. I was stuck in a world that was unknown to me. How do I deal with insurance companies? Hospitals? Interpreting Medical Charts? I googled a few attorneys and the one that stood out to me was Mr. Coon. Mr. Coon has led an admirable career and has helped people like you and me his whole life. I contacted Mr. Coon's office and spoke to a nice lady who scheduled a meeting. After meeting with Mr. Coon he decided to take my father's case. It ended up being one of the best decisions I have ever made. What is remarkable about the Thomas Coon Newton & Frost team is that they each specialize in their own field. Mr. Coon leveraged the expertise of Mrs. Newton (Who is a remarkably kind, and a killer negotiator.) She made the world of difference within my father's case. Mr. Coon and Mrs. Newton were the light at the end of the tunnel for my family. This law firm puts their heart and soul regarding the individuals they represent. Mr. Coon and Mrs. Newton got justice for my family and my mother, father and I will forever be grateful for them. Thank you Mr. Coon and Mrs. Newton for representing our family. We traveled from Utah for a two week bicycling vacation in Oregon. Our first ride, first hour we were hit by an RV mirror it shattered my left humerus and caused my wife to crash too with numerous injuries. Upon returning home a friend knew this firm and reputation for handling bike v auto accidents. We researched this law firm and on our first phone call late on a Friday afternoon, Jim Coon took the time to explain Oregon bike (friendly) law; some legislated by their firm, and how his firm could help us through the insurance claim - alleviating our concerns for the claim so we could focus on healing (year long process). The claim involved two insurance companies and a mountain of medical which his staff assisted in managing throughout the nearly two year process. They were able to bring about the settlement we were expecting and manage our fiduciary responsibilities in the closure of the case. Sadly we never personally met our team because they deserve a HUGE hug from these Utahan’s. Lyle & Gladys

Bruce recently represented me in an Adjudication SSDI trial. It was my second to last chance to receive approval to receive my SSDI benefits. He has knowledge and 20+ years experience with all the SSDI judges in Portland. He was able to tell me about the judge we were about to meet, what his personality was like, and most importantly, the Judges likes and dislikes in his courtroom from the folks he is facing, like me. I had a strong case, but had been denied my SSDI benefits 3 times in 22 months,, (standard protocal here, folks), and had to appear for a final decision. One hour before the trial, Bruce was magnificant at making sure I handeled the trial "correctly". He told me exactly how it would go, (he was right on the money), He told me exactly what questions he was going to ask me when it was his time to depose me, after the judge was done with his questioning of me. He also knew within minutes of talking to me that I was a nervous wreck and quite "pissed off", as he put it. He managed to pull me off the ceiling and prepare me for was what to come in just a short 45 minutes from that moment. I did what Bruce asked of me. He told me afterward, that I was a completly different person in the courtroom and that I did so well, he genuinly believed that we would win my case. He knew our Judge, which helped immensly. Seems all the judges there do, and all we ran into were so happy to see him. I received my outcome within 4 days! Not the 60'ish days that is quoted by the Social Security Administration. I even had my retro-paycheck with the following week! Our judge knew I he was foing to approve me about 1/2 way throught the houe we spent in there. We could both see it on his face and by his questions and comments to me. Bruce told me my trial went amazingly well, which I responded...."Thanks to your perfect coaching of how my behavior needed to be in the courtroom" . Again, my case was strong, a huge file with lot's of MRI's and tests and 2 years of Doctor visit reports. Bruce was there all the way through, doing the intracacies of filing an SSDI case. But, when it comes ro SSDI cases, there is no need to "need" your lawyer during the red tapee bullshit that goes on throughout the wait, he tells you what to do and gathers all your records for you, and gets them to the proper place in a most timely fashion. Bruce mattered when he sat next to me before and in that courtroom, which is where WE won my case. Don't try and find anyone else. This dude has it all, from following the rules like no layman can to get everything you will need to everywhere it has to go, to appearing at court time as a professional with a "smack" of inside track knowledge. That is who you want representing you. A real human being, not a sruffed-shirt who won't look you in the eye. Someone who has been around the block LOCALLY for so many years. The relationships he has forged with all the right people have given him insight that he can share with you to insure you get a fair shake. If this gentleman can't do it, then, no one can.

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
