If you are thinking about applying for SSDI benefits on your own, let me offer some advice. My point of view is specifically for Florida as the process varies by state. When I had to leave my job because of medical conditions, I decided to apply for SSDI benefits. This is something you can do onyour own, but applicant should beware. After speaking to friends who went through this process in other states, they unanimously told me to hire a disability lawyer to represent me. I followed their advice and have never regretted it. The benefit ended up being invaluable. So looking on the internet, there are plenty of SSDI lawyers out there who can't wait to help you. I did initial consults with a 3-4 firms, but the Law Offices of Nancy Cavey stood out. When reading Nancy's profile, she tells the story of how she had to navigate the SSDI process with her family, and as a lawyer took on the charter to help others through what is a complicated, unorganized, extremely slow and some would argue arbitrary and unfair process. This commitment was enough for me to consider them for the running. During my initial consult I spoke with Assistant Attorney Krysti Monaco. It was clear from the conversation how verse she was with ERISA (LTD) and SSDI processes. She spent a lot of time with me and answered all of my questions (and I do ask a lot of questions). What I liked most about this firm was I was speaking with an actual lawyer who gave the personal feeling that I was just not another number. The other firms did not have this hands-on attention. Nancy Cavey Law was the real deal. So I am in my 60's and according to Google, getting SSDI benefits is supposed to be easier. HA! It took me almost 3 years to get my benefits, and that's with extensive medical records and multiple doctor recommendations. It was an awful and stressful period. The most difficult thing was waiting and being denied at multiple steps. I was constantly bugging Cavey Law for updates (I give them kudos for putting up with me) but they were in a rock and a hard place. The efficiency of SSA/DDS is out of their control. There was nothing they could do but wait, keep me assured and be prepared for each step. That is their real value here. I kept being denied benefits with what seemed to be a lack any real due diligence on SSA/DDS part. Cavey Law was right there to respond to each hurdle. Without delay! The 3 years that it took me, was due directly a result of the understaffed and inefficient SSA system. If it were not for Cavey Law it could have gone even longer or possibly never happen at all. What you should also know. I had 3 years of back benefits on the table. Had I tried this on my own and failed, I would have had to re-apply for benefits and that back pay could have gone away. In other words, benefits would be calculated from the new application date. This is another reason why you need a lawyer for this. There are so many prat-falls in this process it can be a costly mistake without one. The fees involved far weigh out the risks (IMO). So good luck to anyone applying for SSDI benefits. If you want to maximize your ability to be approved, Nancy Cavey Law is the right business to have on your side. Especially in Florida

I will start off with my personal experience of saying that I did not realize that long term disability companies were only in the business of rejecting claims with the hope that you ultimately give up. To take the time to fight them you need a team of legal professionals that have a wealth of experience in dealing with their tactics and can help connect the dots. My husband and I will forever be thankful for the team at The Law Offices of Nancy L. Cavey! Nancy, Krysti and their team fought and won my husbands long term disability case for him and it has put our lives back together. It was a daunting task facing the complex world of long term disability but Nancy Cavey law firm expertly guided us every step of the way! Krysti, specifically, was so attentive to our questions and concerns and we appreciate her so much! We know without their help we would have never seen a dime. This office will be a tireless, hardworking and honest advocate for you and is the only law office we recommend. Thank you from the bottom of our hearts for everything you have done for us Nancy Cavey Law.

I could not be happier with the result Mr. Palso brought to my case. I had to fire one of the big law firms and Dennis took over and guided me every step of the way. Don't buy into the marketing hype. Mr. Palso and his paralegal team will fight for your interests and will fiercely negotiate your case as needed.

When I needed a lawyer I turned to Google for help. A long list appeared, I first called some well-known names but felt like a number rather than a person. I focused in on reviews of others and found Dennis Palso and I'm so grateful because it turned out to be the best decision ever! During my free consultation I realized he was an expert in the field of workers' compensation so I hired him that day. He's passionate about his work but also about the people he is representing. He explains every step of the process and you get paperwork so you can review it at anytime. You can call or email anytime, Michelle or Dennis will respond right away to answer all your questions. You will never sign paperwork from the other side until Dennis makes sure all your benefits and interests are taken care of, he doesn't stop fighting for you until it's over! Thank you Dennis and your Team!

There were so many law firms to chose from but something told me to go with my gut and I am so grateful I did. Gibbons & Gibbons are hands down THE BEST in town! Katie and her team are by far compassionate, caring, understanding and more. From the first day of having to deal with situations I had no knowledge of, to the end of feeling like family, Katie made me feel like there was nothing to worry about and there wasn’t! I am so appreciative to have had Gibbons & Gibbons in my corner because man, they pack a punch and are a force to be reckoned with!

I had been suffering in pain for over two years and also denied social security disability twice before hiring Mr. Freeman. He was knowledgeable, upfront, honest and to the point as to how things would go moving forward with him. Just when I thought I'd never get my disability approved, Mr. Feeman made sure I got it. He is awesome at what he does. If your looking for representation look no further.

If you're dealing with a disability issue and need a lawyer to help you get your Social Security benefits, your best bet is to contact Mr. Freeman and retain him as your lawyer, he's absolutely the best. My husband passed away last July and in addition to the immense sadness I was going through, I was also at a loss of what I would be able to do, and if I could receive windows disability social security. I'm disabled and have never dealt with applying for SSD because I had heard so many bad stories about people losing their cases after years of trying, but with my husband gone I had no means to support myself financially and decided that I'd better get a lawyer and just hope for the best. I decided to retain Mr. Freeman and am forever grateful that I did, because rather than just hoping for the best, I got the best!! In addition to being a wonderful lawyer, Mr. Freeman is also a wonderful person. He took my case and was available for me anytime I had a question or was confused about the paperwork that Social Security needed me to fill out. I recall that at one point, after I had already sent Social Security copies of my marriage certificate, they sent me a letter of denial for my widows disability case, saying that my husband and I were never married. I called Mr Freeman in tears, not only had I just lost my husband of 23 years, but now they're saying that we weren't married!! Mr. Freeman calmed me down and said he'd take care of it, which he did. I have never in my life had to deal with a lawyer, and never needed one as much as I did during this terrible time in my life, like I stated before, he's the best!! I'm so thankful that Mr. Freeman was my lawyer, fighting for me to receive the benefits I was entitled to, and ultimately winning my case for me. The paperwork and proof about my disability, that he submitted to the Judge showed how thorough Mr. Freeman is at his job. The day before my hearing, the Judge called Mr. Freeman and said there would be no need for the hearing, that all of the paperwork and evidence for my disability case was perfect and I was granted a full favorable decision regarding my widows disability case. Due to the Covid situation, I never had the chance to see Mr Freeman in person, but if given the chance, I would of wanted to give him a giant hug of gratitude. Thank you Mr. Freeman, Mrs. Freeman and your team of experts, I don't know what I would do without having you on my side. May God bless all of you.

I decided to hire Byron after my second appeal was denied. He understood my case was unique and told me he thought I had a legitimate claim. With early stages of prostate and chronic lymphocytic leukemia, along with other disabling illnesses, Byron recognized the deterioration in my quality of life. With his insider knowledge of the system and experience, he helped me convince a disability judge of this and receive my back pay and set up my monthly disability payments. So after a year of covid-19, homelessness and little healthcare, I now have thousands of dollars in my bank account and a Humana medicaid plan. Thanks Byron! You might have saved my life.

After 18 years combined federal service between active-duty military and federal civil service, my health military service-connected health conditions quickly began deteriorating, making it quite difficult for me to remain productive and reliable in my current job. But at only 46 years of age, I knew early FERS retirement wasn’t an option for me yet with my current employer. After contacting attorney Barszcz; however, I quickly learned that I had hope … that disability FERS retirement would be an option for me based on my conditions and my time in service. Attorney Barszcz was very attentive, professional, and patient with me during my initial consultation and has been in in every subsequent phone conversation from there on forward. Attorney Barszcz was quickly able to assess my circumstances at the beginning seeing a potential positive outcome to my situation and was able to thoroughly advise me on how to proceed with the application. And boy, was he right! After moving forward with my application, having him represent me throughout my entire OPM FERS disability retirement process, I was able to get an approval with the initial submission just 6 months later! Attorney Barszcz was always able to give me an answer to all of my questions and always responded in a timely manner. Thank you, attorney Barszcz. I wouldn’t have been able to do this without your help!

Hi Mr. Barszcz: I am extremely grateful to you regarding your honest response, professional integrity and high ethical standards unlike many other attorneys who asked for fees ranging up to $5000. One of them took $2000 from me and billed me for approximately $1500 within three days and then wrote to me in his email that he has been frustrated with OPM as usual dealing with their bureaucracy while trying to contact OPM to inquire about the status of my case, and strongly recommended me to contact my congressional representative asking them to intercede with OPM to expedite processing my case, as they are frequently very helpful in getting OPM’s attention. I am already under such financial and mental distress that I can’t describe. I have contacted local congressman and senator and also two accountants are helping me to put together a response. The accountants found big flaws in two letters that I received from OPM. I probably never sent you the second letter dated 10/25/13, where now OPM claimed that pay for my position in 2011 was $162,343 and not $120,343, and the 80% income limitation was $129,874 and not $96,274 as previously stated in their first letter dated 7/3/13. But they are now telling me that the income that I made was not $96,949 but $163,809, so I am still over and have terminated my disability as of last year June 2012. The Social Security on the other hand has already issued me a letter dated 10/23/13 with my new earned income as $89,187, and my accountants can’t figure out how OPM got to the figure $163,809. So I am now going through the Congressman/Senator. I hope this is resolved soon. I am sorry to have taken your time again, but I couldn’t resist to appreciate your honesty and high moral standards. My father was an attorney back in my home country, Pakistan and he held such high standards as you did and you just reminded me of him. I truly became tearful thinking of him when I was reading your email. He had passed away in 1979. I salute you for who you are ….. I wish I could post this on either your website or some blog place so people can see what an incredible human being you are !!! Thank you very much for your advice.

This program , the Law Firm, the Attorney’s, and everything they do for our community and the people of our community is absolutely amazing! My attorney Mr Brooks Fusselman and his associates helped me through a major crisis I was facing with an elderly landlord who didn’t even live in this country. This landlord tried to put me and my very young child on the street. The “Property Manager” is her alcoholic tenant who dwells downstairs from the house I leased for 12 months. He doesn’t like the noise of a child running down the hallway, or his bath time, etc.. therefore I was considered a “noise problem”. Once Mr Brooks and the very generous people of Community Law Program took my case and started looking into the eviction process…they immediately took legal action to protect me and my child, giving me extra time to prepare for our sudden move and a new place to call home.. I could not have done this if it wasn’t for the kind hearted people at Community Law Program. Thanks again to all of you.

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
