I just settled a social security disability claim winning full benefits. Gayle was the only person interested in handling the case. We did everything long distance and did not even have to meet with the Administrative Law Judge. That's how good her pre-appointment submission was. Gayle advised that the process would take 2 years, I had a very good case, and to be patient. She was exactly right. She even sent Christmas cards. Thank you Gayle. God Bless You.

Such a wonderful experience we had with Mr. Lambert, and we thank him so much for all his help. He helped our workers comp case a lot, and honestly without him we couldn't of done it. His Legal Assistant Nikki is just amazing! Whenever I needed anything she was always on top of it. Mr. Lamber was a great attorney, a very smart and educated attorney. I hired Joel to represent me on appeal after being denied a well documented service connected disability claim by the Regional Office. It took some time to gather all that he required to file the appeal, nevertheless, it was time well spent. From there it took several years to get a ruling from the Bureau of Veterans Appeals, owing to the docket backlog. In the end, my appeal was approved. I have no doubts that without Joel's representation my appeal would have been denied.

I hired Joel Ban after being denied for my documented service connected disabilities. Joel fought tirelessly on my claim and i was awarded a hire rating than i had expected. Joel was always patient with my questions and if there was something he was not sure of, he would immediately find the answer and get back to me. Joel was more like a friend helping me in my case than an attorney. I would reccomend him to anyone seeking help.

Dear Matthew Ormsby, I would like to thank you so very much for being with me before and during my disability hearing. As you can imagine, I was very nervous and did not know what to expect. However, your phone call explaining in detail what would take place and what I needed to take with me made me feel very comfortable. I am grateful to you for coming all the way from Salt Lake City Utah to Pueblo Colorado to represent me at my hearing. I am positive without your presence my case would have turned out differently. Walter represented me in a medical malpractice case. My wife and I immediately felt good about him. He was always professional and polite. He was really good about educating us on the situation and explaining things for us in a way that didn't feel condescending at all. We settled the case before we went to trial and felt very good about everything Walter was able to do for us. We felt like he cared, and just overall was a very nice, genuine guy who was there to help us in matters we were not capable of doing ourselves. Walter called when he had questions about details to make sure he had it right, so he could be as prepared as possible. He worked very hard on my case and was very well educated in his field. I always felt 100% confident in him and I feel very thankful to him and the DKOW firm.

My fiancé hired Mary Bevan to help her with a custody matter. After the first hearing we had concerns with Mary's approach and confidence in the court room, after the 2nd hearing we realized she was as good as having no legal counsel. She has no control whatsoever in the court room and she allowed the apposing lawyer to walk all over her. It got to the point where it seemed like Mary didn't believe my fiancé and constantly kept telling her to be honest in order for her to be able to help. My fiancé never lied and was honest from the start. We ended up firing her and hiring a new lawyer. It took the new lawyer 1 hearing to get the case resolved, Mary had 7 months and didn't do anything.

I found Pearson Butler via MetLife legal plan. Connected with Russ to get our family trust in place. Straight forward to complete, no complaints there. Reached back out to Russ about a completely separate matter unrelated to estate planning. His response was "I do not practice law in this area and thus, have not idea." I guess I just had more expectation than a lazy response with typos. Too much to ask if there's someone he can put me in contact with? I will be moving on from Pearson Butler and find another firm to do estate planning in the future.

Been trying to get this settled for 2 and half years. Not impressed with the service or really anything they have done. We have to call them and call again and again. If you want to have any results then don't use this company. It's crazy that we knew more about what payments would be taken in full by the health insurance company than they did. I'm sure there's someone that understands the law better than this company. Keep looking.

My divorce lawyer referred me to John to help me file for chapter 13 bankruptcy with getting most of the debt in the divorce. John is a great guy and is honest for the most part. His office is a different story I feel they unorganized when it comes to keeping track of paperwork & a few grammar lessons with spelling in paperwork being submitted to the court could be handy but nobody's perfect so no big deal. I think John did what he could with my case, but I think he could have advised me better with a few things. I was utter shock when a week before my confirmation the trustees office wanted to double my payment. It seemed John was in favor of me to forward with this & I felt very uncomfortable to do this. My debt was under $30k and with doubling my payment i would have paid about $60k after 5yrs of payments , it didn't make any sense at all. I guess it all depends on your situation and I am sure John could help if can. I just feel he is a people pleaser for the most part.

(In total the case was 10 years old) she didn’t have to take it back on after social security made a huge error and as the ALJ said “created a hardship”. Which is very true. My mother has used Scott for a long time and never had much of an issue, HOWEVER...I retained him in January of 2023 for a child protective order I had filed on behalf of my son against my ex, and in court, despite the overwhelming evidence, he more or less just sat there and did nothing which allowed my ex to get it dismissed. Fast forward to now (December 2023) and I have filed to gain full custody of my son, called Scott again more due to history to see if he'd be willing to take the case, said he would but we'd need to get the hearing date changed due to him not being available that day, ok that's fine, we also had a verbal agreement between us directly that he was willing to wait on payment for retainer so we could get the money, but he would start on everything right away, upon attempting 3 DIFFERENT TIMES to come in and sign the retention paperwork, I was turned away by paralegals that "needed to talk to him first" about what? I made the agreement with him, not with a paralegal. Finally was able to come in to sign the papers, but I was told by Josie that he "needed everything up front first" 100% contrary to what we agreed to, and that "HE was the one who said it" yet refused to ask him with me standing there to confirm, as he came out of his office and saw me sitting there, and to this day still have not gotten a return email or phone call to confirm or deny any of this Like others have said, if you want to not be jerked around by this firm, then don't bother even talking to them, and they've missed out on a retainer and a guaranteed case win that would bolster their reputation Oh well 🤷‍♂️

Mr. Cook is very knowledgeable and experienced. Glen has provided guidance to me on two occasions. Glen took my case before an administrative law judge and prevailed on the merits. It was a difficult journey and Glen and/or his staff was there for questions, explain the law, encouragement and of course, sometimes to correct my thinking. "Just the facts," is the motto! It is helpful if you listen carefully and ask questions, keep an open mind. At times things might seem difficult, yet you must learn to adapt. There is no such thing as a "slam dunk." Mr. Cook will give you a candid opinion (might seem blunt); however, this is his style. On meeting, assess whether you think he will be a good match, then evaluate your situation accordingly. Mr. Cook is the best of the best in my opinion; I was more than satisfied with the outcome!

Glen Cook was my first foray into the scary world of Disability. I had spoken with his paralegal? over the phone & thought, she was great, she asked all the right questions and felt my case was a slam dunk. (It was). She set up a consult for the next day. However, Cook was not as impressive. (Just don't tell him that) as he condescending spoke to my wife and I. I happened to repeat what I felt were key points and he asked my wife "does he always do that? We've already covered that" and suggested a mental health evaluation, (for clarifying my position!?) The cost of which would come out of my pocket after the case was closed! What? Did I hear you correctly? I'm about to pay you 6K for a day's work! So I said, "look, I don't know what you're talking about, my case is a physical issue, not a mental one & I'm asking you to be my attorney, not my doctor". (He also misinterpreted a "new law" that would have cost me about $12K) He then sarcastically told my wife that she should show all my medical records to "whoever we found to take the case" she asked, "so you're not going to take it"? He replied "No". I guess you need to kiss his a** to be a client and, that's just not me. We left that office very upset, this was our first shot and I felt afraid I'd screwed things up. (yet I had to listen all about his G.B. Packer partial ownership) Bottom line Mr. Cook is an egomaniac, with a mental disorder of his own. Our next stop got me the proper amount ($12K+ more than if Cook had taken it) and of course, no silly doctors were ever mentioned. I won without going to court. I suppose I should send him a Thank You card. I was never able to assess his legal skills but his bedside manner needs a ton of work. Go elsewhere and save some humiliation and more unnecessary stress. This process has plenty of that without an adversarial relationship with your own advocate. I'm certain all would agree with that. (see all these other reviews, even good ones refer to his "brusque" manner & pay close attention) I should have done it myself, but it appeared just too daunting a task. I'm not going to recommend anyone but if you like being treated like a child sent to their room & grounded, Glen Cook may just be your guy. He doesn't deserve a star, which would be more accurate.

This firm said they would represent me in my SSI/SSDI case. Never having been through this before I really had no idea what my role was and what to do. The firm never made it clear that I was to get all the records and send them on to the firm. I was under the misconception it was their responsibility and since it wasn't discussed or put clearly in writing I didn't catch on to what exactly I was to do. They dropped my case after representing me for about three months, but never specifically told me why they dropped the case. I felt my interests were not protected by them They lacked personalized attention and care to me as a client. It would seem that a firm that specializes in disability cases would note that the clients are not always able to multi task, read between the lines and have the confidence or organizational skills necessary to prepare their own cases without their help and input.

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
