Initially, I started handling my worker's compensation case myself. Although I have almost two decades of case management in my professional background, this case was too close and personal and quite frankly, too exhausting to handle on my own. After loads of legal paperwork, as well as, the frustration of not receiving the appropriate rehabilitative care, I gave up trying to handle the case myself. I found Susan in an online Internet search. What made me want to hire her was that she indicated she was ethical, had many years of experience in Worker's Compensation cases and has served as a Pro-tem Judge for Worker's Compensation cases. As soon as Susan took over my case, she proved to be the lighthouse in the storm. Her professionalism, direction and calm demeanor allowed me to trust and let go of handling the case and concentrate on getting better. She also fought for all the benefits I was entitled to receive. My case recently settled, thanks to Susan. Looking back in hind-sight, I realize there were so many legal aspects to handling timelines and tons of paperwork in a Worker's Compensation case, that it really puts an injured worker at a disadvantage, when they are already at a disadvantage after being injured. The help of a caring, professional attorney on my side made a world of difference in my case. I now know why the Worker's Compensation claims adjuster, initially assigned to my case, didn't want me to get an attorney when I mentioned that I was seeking one out. Susan is an exceptional, ethical, consummate professional and her many years of experience proved to be evident in the handling of my case. I am beyond grateful to her for helping me get the care and benefits I needed, and for settling my case beyond my satisfaction, as now I can move on from the injury and positively move forward in my life.

I got injured at work and the insurance denied my case. I heard about Mr. Roland from a co-worker. I decided to give the firm a try and they didn’t disappoint. They immediately got me treatment and took the insurance to court. Soon after, the insurance accepted my claim and even started paying disability. I couldn’t be happier.

George Roland is by far, the absolute best lawyer that I have ever dealt with! I was referred to him by my ex and he highly recommended him to me after I had another attorney, that by the way was the worst lawyer I had to assist me. During my case, my father passed away and he rapidly followed thru to get an advance for me, and I was able to pay for the burial!! I care about him like family!! He has a firm attitude, yet he never behaved superior to me. He works very hard for his clients! He makes me feel as if I'm his only client, and he has many!!! He makes sure that I'm updated on any changes in my case, And he has always been at court with me and gave me an synopsis on what could happen!!! I work for a well known company and he never flinched to go after them to assist me and he has always been present for any deposition! I appreciate him so much! He has even called my mom to check on me after I've had a medical procedure!!! I highly recommend him!!!!

My story started with a personal injury case where I called several different lawyers who wouldn't return my calls. I ended up with a lawyer who I was not fond of who dropped the ball on several occasions. However, one day I came across Mr. Novak's page and I gave him a call. I am so thrilled with how the entire case was handled! Sean picked up the pieces and with the help of his team he got everything handled with no issues whatsoever. Thanks to him I can get started on a path to recovery. Sean is a hero!

Sean Novak and I crossed paths in 2005 after I'd knocked my head on many walls with one roadblock after another and then lo and behold the skies parted and Sunshine arrived through the clouds in Sean Novak which was a blessing to behold which I did not at that time realize how significant in the long run this would be proven to be true at the time it was such a relief considering all that I'd gone through, However as time tells pretty much all what was revealed that this a lifelong significant Blessing of our crossing paths through our case travails along with the travels they have brought consequentially together to bring about resolutions ,Not only is he personable and attentive to your concerns unlike many others he does not just hear you he more importantly listens to your comments with an empathetic understanding take ownership solution minded approach in consideration as he is visualizing how he will approach the case to like an Superstar athlete win Game, As I've learned over the years through the multiple battles that he and i have stood side by side to endure the most positive outcomes I could have ever imagined and through it all as a result of the due diligence and committed mindset that Sean Novak applies to each and everyone of his clients with welcoming arms which each and everyone of those I've recommended over the years can also attest to when you want the best because your case requires the peace of mind from knowing that you've an attorney who cares and will go to bat for you when the road gets rough and not abandon you and or leave you hanging,Sean Novak is your Man. When a Friend or Family member mentions to me they have a personal injury matter I do not even pause with a moment of thought as I say to them with complete and utter confidence that I've done the correct thing by referring them to Sean Novak, I'll provide the individual Sean's contact information and as well get in touch with Sean and offer him their information as well so that there will be two way communication established. Then from this point forward I can rest in peace that Sean Novak, Will apply his extraordinary skill and research combined with communication capabilities to their matter as he's successfully preformed with my cases which I'm thoroughly satisfied with the outcomes of each case that he has been at the helm as I'm confident that he is the Best there is at what he does and when you need the best to Shepard your case Sean Novak would be the Attorney I recommend with the utmost confidence that you hire.

Mr Hinden handled my Workers Comp toxic exposure case, which we both knew was going to be difficult. It had already been essentially abandoned by another attorney, and I was feeling pretty uneasy about my chances of getting a decent settlement. Within three years, Mr. Hinden's thoroughness, dedication and exceptional ability led to a large settlement (by Workers Comp standards) for me. I highly recommend Barry Hinden and his firm in cases of this type. I felt my case was in good hands and I was treated with the utmost respect by all the firm's employees that I encountered.

This is A notice , that if this firm continues to be dishonest , representatives im my case, I will be addressing my concerns with the State Bar. Intimidation has been used to try to discourage me to tolerate lack of representation towards my case. I’ve been questioned regarding statements that the opposing party has made after this firm contacted the opposing party. I’ve been told at least five times that this case was being filed with the court in the jurisdiction of my claim. I have yet to see any proof or case number in relation to this matter. My intelligence has been continuously insulted which has prompted this email. The doctors that work with this firm are also questionable. I’ve seen the Social Media accounts for this firm quoting that clients should be honest with the firm . While the firm follows a”do as I say and not as I do “ behavior. And in my opinion has poor work ethic. I have been respectful in this matter and patient. I don’t feel that I am being properly represented. I was told that A private investigator was hired and that I would be contacted , that it took 2 weeks to obtain insurance information from the Landlord who refused to provide her insurance. It’s been well over that time frame. I was told that the firm was providing payments upfront for filing and obtaining information. Although that maybe true this service is not free of charge. This is where intimidation and manipulation came into place regarding the percentage of my settlement. At this time I do not view this firm as trustworthy. I have kept my public opinion to myself, out of decency and respect. I don’t feel that anyone should be taken advantage of , because of lack of knowledge or different profession. Being rude , because a client is unwilling to accept anything said without proof is unprofessional is wrong ethically and morally. In my opinion it’s a manipulation tactic. I don’t appreciate the treatment I’ve been receiving, or the dishonesty. After I emailed this to the firm , I was accused of being disrespectful, which I now way was disrespectful . I expressed my true feelings regarding my experience and of course they terminated representation after this, to cover up their lies. I stand by what I said !

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
  • Medical records: Provide copies of medical records, including treatment notes, doctor’s reports, and any information related to your injury or condition.
  • Employer correspondence: Bring any letters, emails, or forms related to your claim from your employer or the workers' compensation insurance company.
  • Wage and benefits information: Provide information on your wages, benefits, and any lost income due to the injury.
  • List of questions: Prepare questions about your case, the process, costs, and what to expect moving forward.
  • Timeline of events: Prepare a timeline of the incident, your injury, and any medical treatment or communication with your employer and the insurance company.

Being well-prepared for your consultation will allow the lawyer to assess your case more effectively and provide you with the best possible legal advice.
