Attorney Scully was informative and helpful during my case. I was very frustrated with the work comp process, but Attorney Scully was able to walk me through everything and give me accurate timelines for how long things would take. He gave me step by step information on how things would go and was very professional and polite. I would recommend Attorney Scully to anyone who is having problems with work comp!

Attorney Scully was very knowledgeable and experienced with Work Comp claims. I so appreciated that I could have a phone appointment at my convenience. He listened to all my concerns. I was So relieved to have an attorney fighting for my best interest. There was much I was not aware of. I chose to have an attorney due to the aforementioned issue. I stopped receiving calls from Work Comp as they were putting alot of pressure on me to get back to work. I was told by Mr. Berlin the owner on the initial phone consult that I would be real glad I got an Attorney. I am so happy with my final settlement, all Attorney Scully did for me. One specific example is I have a portable Tens Unit that is So effective in bringing pain levels down and accelerating the healing process. I will continue to heal, now with the settlement no concerns to rush into another job. I can just relax, take care of myself, having no financial concerns. Thank you again Attorney Scully.

Lisa Kalo has restored my faith in attorneys!! We used her to litigate/mediate a workers comp case and she more than exceeded our expectations in terms of competence, professionalism, responsiveness to our concerns and questions, and finally, the mediation with the employer. We agreed to a settlemwent that in no way lined our pockets, nor hers. But she treated us with the respect of a multi-million dollar case. She's down to earth, shots from the hip, has a great sense of humor and an honest and human personality!! If you need a workers comp or wrongful death attorney, call Lisa Kalo. Her staff immediately treat you like family and her office gives a safe and "homey" feel.

I mediate Workers' Compensation cases all over the State of Florida. I am familiar with the best attorneys in this field. Mark Ingram ranks in the very top tier of defense attorneys in this state. He is honest, ethical and very professional in his dealings with people. He is a real advocate for his clients but is both fair and professional in how he presents his case. He is well respected by judges in this State as well as the attorneys who oppose him in his cases. I give him my highest recommendation.

I've used Mark's firm since 1997, to represent many of my clients who were self-insured, large deductible or PEO accounts. Mark holds himself to a very high standard which is reflected in his work. His excellent negotiation and trial skills, coupled with his unwaivering persistence, consistently yield highly successful outcomes. Whether negotiating settlement or going before the judge he always seems to exceed our expectations. Equally as important is the fact that Mark holds himself and his staff to the highest ethical standards while producing the needed result.

I hired Anne for a short sale which she represented my interests succussfully. She was also called again to protect my interests again when one of the parties failed to fulfill their agreement and was posting inaccurate information on my credit report. She boldly went where other attorney's failed and again, corrected the situation in short order. I think she is awesome and highly disappointed that this legal challenge went against her. Her plaintiff in this case probably was overreaching in their so-called rights in the First Amendment.

Nick and the entire Buckman and Buckman team went above and beyond to help me when other firms wouldn’t due to the complexity of my case. It took 2 years to resolve, but they kept me informed and never gave up, resulting in positive results in the end. I’m thankful for the hard work and dedication of this team, and I’d refer my family and friends if they ever needed legal help.

In my experience the best legal council is a balanced one. A firm that will not only represent your side but will also be professional, courteous, understanding of your issue, and educational. One that will offer a range of options or plans of action depending on the circumstances. A personal preference, is Legal council that keeps a sharp stick handy to poke members of the opposing party in the eye when deserved. Buckman and Buckman has my highest recommendation. We are so grateful for Tim Rudge and his paralegal, Mitzi for their work on our case. To start, they rescued our stalled case from our own bad choice of first attny. Tim took over and got our case going in the correct direction right away. He clearly explained every step and option we had in our case and executed our choices promptly with no ego or agenda. Tim and Mitzi were always easy to reach, we never waited more than 24hrs for answers. Mitzi copied us on documents and emails, usually the same business day, and always made sure we understood them and didn't have any questions. For our first legal experience, we couldn't be happier to have found these two to represent us.

I have showed up at Mr. Christiansen’s office, over Halloween last year, I was very overwhelmed having to go through the first time in my life, with my injury and needed help. He has shown so much care, and took his time to explain everything to me, and made sure I understood I was in great hands with him. He has been there for me since day one. I could have not asked to have a better representation then him. I would recommend him and his firm to everyone that is in need of legal services. I feel very blessed he is on my side, and that i have found their firm.

I cannot recall positive experiences with this attorney. I hired Mr. Christiansen after a work related injury to handle my Workers Compensation case. In our first meeting he seemed attentive and interested in the case. After I signed the retention form he suddenly changed. As days went by I started receiving paperwork from the insurance company and others. I had questions. I call Mr. Christiansen many times however he would state that he was busy. I email him. with the same results: no answer. I had to eventually find my answers to legal questions through Google searches. Mr. Christiansen never available. This negligent attitude continued for several month. I eventually received a letter for a deposition and also a mediation appointment in front of a judge. Once again I tried to call him. Not available. I finally email Lancaster & Eure, law office where Mr. Christiansen works, stating that I needed his help, also stating my displeasure of his careless attitude toward my case as an injured worker. After never receiving an answer to my calls for months he finally called me the next day to his office. As he literally slammed legal books on his desk he fired me as a client ten days before a deposition and a coming mediation in front of a judge. He never answered any questions about my case, neither helped me on my case as an injured worker. He left me with many questions having to find another attorney halfway. In my personal experience Mr Anderson doesn’t seem to care about the average guy that is injured on the job, he is unprofessional, vindictive and rude. Avoid a negative experience and work with a different workers compensation attorney in Sarasota Bradenton.

Keith is a fantastic lawyer. Worked on my case for 3yrs and really fought for my case! I had horrible doctors and he kept working to get me a compitant one. He always replied to my emails fast. And as far as being a small firm, that makes them that much more one on one and not shoved somewhere on the back burner. To much corporate america these days if you ask me. When I moved out of state before my case was finished he worked and got me a case manager and hunted down a doctor from my new state that would take my out of state case. Amazingly this doctor was compitant as he wasn't paid off by the ins co and then just dump me. Finally got a settlement and couldn't be happier.

Unfortunately, I made the huge mistake of hiring this layer/ law firm! He got nothing for me after several years of representation, while telling me my case was worth a couple hundred thousand. Not only did this lawyer deceive me, he caused tremendous hardship for me and my life/ future. I consulted other attorneys and they advised me he committed malpractice. He used to be a good attorney years ago. However, he is not anymore and his resources are limited. I would strongly recommend you hire a different attorney or law firm in the area or in a bigger city with better resources and or outcomes of cases. They talk a great talk when you call their office and lead you to believe you are making a great decision when hiring them, but DO NOT FALL PREY to this attorney/ law firm. Just to let you know, I found out later this person is his wife. They have one lawyer, one paralegal and one assistant. Thirty plus years as a layer sounds great on the surface, but when you think about it, that usually means they are old and operate in/ on old school ways (meaning they do not have the desire, ambition, or energy/ not in the prime of their career) plus if they are so great, why are they still working and not retired by now????

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
  • Medical records: Provide copies of medical records, including treatment notes, doctor’s reports, and any information related to your injury or condition.
  • Employer correspondence: Bring any letters, emails, or forms related to your claim from your employer or the workers' compensation insurance company.
  • Wage and benefits information: Provide information on your wages, benefits, and any lost income due to the injury.
  • List of questions: Prepare questions about your case, the process, costs, and what to expect moving forward.
  • Timeline of events: Prepare a timeline of the incident, your injury, and any medical treatment or communication with your employer and the insurance company.

Being well-prepared for your consultation will allow the lawyer to assess your case more effectively and provide you with the best possible legal advice.
