I got hurt badly on a construction site. The amount of the L&I lien was insane! It took seven years that was at no fault of my counsel. Brandon Batchelor might be the best attorney and person I've met! Thank you Brandon and Russell and Hill!

I was hit by a truck while commuting on my bicycle and suffered very significant injuries. From the first consultation I felt in good hands and hiring him proved to be an excellent choice. Right from the start Brandon impressed me with his consideration, knowledge, and empathy. He was able to very clearly explain the process and my options for best results. He never pressed to move things faster on the lengthy path to recovery, and went above and beyond throughout the case. He set realistic expectations for the settlement and in the end significantly outdid those. I was thoroughly impressed with his work and while I hope to never need it again I would go back immediately if needed and highly recommend him to anyone else.

I was injured in an accident on city property. My injuries required corrective surgery and extensive rehab. Russell and Hill took my case and Brandon Batchelor worked on my behalf to ensure that my rights were protected. Initially, the City denied any liability and refused a settlement. Brandon fought on my behalf for over three years and finally obtained a settlement that ensured the medical bills were paid and that I was compensated for my injuries. It was a long and arduous process that I hope never to repeat but if any similar situation should ever arise, I would be happy to have Brandon on my side.

Russ, in short, is a wonderful man and lawyer. Not only did he take the time to get to understand me as a person, he did a great job with my legal needs. His approach worked well. The personal attention that Russ gave me was very much appreciated but not expected based on my past experience with other lawyers I have used. Russ helped get me through my divorce and taught me a lot along the way about being a better person. Russ is probably one of the most ethical men I know. I highly recommend him if you are in need of a lawyer. I will give his office my permission to give out my phone number if you require further details about the type of person and lawyer that Russ is.

Amy Brown introduces herself to me last November for the first time via a personal phone call. After nearly 18 months of unsatisfactory communication from any one else at the office of Russell & Hill, I finally felt my case mattered to someone there! Ms. Brown kept me consistently informed about every step in process going forward from then on. She was always professional, polite and knowledgeable when she would converse with me. I felt l was genuinely counseled, with my best interest considered, by Ms. Brown. I will highly recommend Amy Brown as a trusted legal representative. She restored my respect and faith in the law office of Russell and Hill.

I wrote to Lorna at the end of my 2.5-year custody battle - "Words are inadequate to express my gratefulness", and it's true. Lorna has been on my side for that long, not only as my counsel, but to me, also a friend, and a mentor. I remember talking to a dozen attorneys who all turned down my case because of its complexity - a divorce that invovled domestic violence, dependency, immigration, and relocation - yet Lorna was the only attorney that took genuine interest in my case, and she did not even charge me for our first 2-hour consultation. She actually read through over 3000 pages of my dependency case. She always responds promptly, sometimes even after office hours, she is thorough and detailed, insightful and empathic. She remained a delightful spirit despite my ex's constant threats, harassment, and accusation directed at her. Even though I could not continue to afford her representation toward the end of my case, and chose to represent myself in a 3-day trial, she guided me through every step to make sure I was prepared and capable. And I won, even with some extra icing on the cake I did not expect. The judge said he has not seen anyone go pro-se without an attorney and could carry out the whole trial like I did in his 14 years of experience, but I credited Lorna for her guidance. I couldn't have done it without her. She encouraged me and believed in me even when I doubted myself - unlike those lawyers on Avvo who always tell you that you are screwed if you're going to trial alone. Talking to her always made me feel better. She went above and beyond for me from beginning to end like no others, and for that I'm forever grateful for everything she has done for me. Thank you Lorna <3.

We consider his expertise and attention to detail the core definition of dedicated counsel. 15 yrs later we are still getting advice and would always be our #1 recommendation. Thank you Brad Fulton for going above your call of duty in our time of need and being more of a family friend than legal counsel.

I have know C. Anthony for almost 30 years. I was in professional school when he was in Law School. I have always been impressed with Tony's honesty and integrity. He has been my attorney for 25+ years and I have had outstanding service and attention. Tony has the rare gift of humor that dovetails well with a highly professional presentation. I would highly recommend him to anyone who is looking for an honest, caring, spirited, "real" family man. He has unique experience in several aspects of the law and has represented me in the health professions admirably. I view Mr. Davis as one of my closest and respected friends as well as my attorney. 5 stars...a true "10".

Dustin is amazing! I received a letter in the mail that had said I am being re-prosecuted for a DUI that I had already had dismissed 2 years ago. It was a Friday and it said I had to be in court the following Tuesday. I live in TX now and the DUI was in WA so you can see how that was a problem. My previous attorney was no a judge so I didn't know who to contact. I found Dustin online and called his office. Within the hour he got back to me, explained how everything was going to go and made me feel at ease. Unfortunately, I had blew a .26 which is an Aggravated DUI. Originally, Dustin said it was unlikely to get this dropped as my BAC was so high and the goal was to get it down to a regular DUI. The court case was resolved pretty quickly with no action needed from me and Dustin was able to get my DUI charge down to a reckless! I was amazed as I for sure thought there was no chance for this to get reduced that much. I am so happy with my choice to go with Dustin and I would not recommend any other attorney besides him!

Paul was the only lawyer who was willing to take my case for something I could actually afford, and put in more work than I could possibly have asked of any lawyer at any price. He is honest, humble, funny, as well as well-versed and tireless in his pursuit of justice. No one wants to need these services, but if you find yourself in need of these services you want a human who knows the law from both a prosecution and defense perspective, is well versed in the law and systemic issue, and genuinely cares about his clients. That’s Paul.

DO NOT HIRE! They accepted my case, did absolutely nothing with it, and then Like 10 months later without warning or updates they emailed me and said they decided to drop my case and to figure something out quickly because time was running out for me to do anything about it. Thanks for wasting my time window and screwing me out of an opportunity to make my case.

Walking into Rodi’s office for the first time, I was nervous. I was staring down what was certain to be a long, nasty, complex divorce and I needed to make sure I had the best representation possible. But, I also had to know I could trust and relate to whoever might provide that. Rodi commanded the room with her presence, nevertheless, she immediately put me at ease. Within no time at all I could tell she understood where I was coming from, what my children and I were going through, and how my ex figured into these things. She got up to speed on my particularly complicated/unique situation extremely quickly, and I knew at once I had an ally. And a determined, smart, experienced, relentless, caring one at that. I knew she had my back from day one. And she never once faltered. Through the countless, pointless and malicious deviations, distractions, and motions my ex threw up to complicate things; the endless diatribe of slander and lies, the messy and ugly, Rodi was my rock. She – and her equally amazing and dedicated paralegal – gave me confidence, kept me informed, and put everything into perspective. She has a vast history with and inside knowledge of the courts and judges and she possesses a fierce, but steady, demeanor. She doesn’t let emotion get in the way as she works tirelessly to create a fair, appropriate, and welcome outcome. When my ex failed to even try to make mediation a success, we faced at court time—something both she and I had hoped to avoid. Mediation is always Rodi’s preferred outcome; that said, the court is truly where she shines. My own court experience turned into a three-day circus of sorts, thanks to my ex’s antics, vitriol, and curious representation. Rodi was at the top of her game fielding all the balls he kept trying to throw at us; she had hold of every thread and met each of his efforts with her legal expertise to ensure they fell short. Above all else, though, Rodi held my children at the heart of the everything and truly served as their advocate. There is no doubt that my kids were her highest, sacred priority. In the end, the outcome was best it could possibly be, given my situation. There is also no doubt that if it weren’t for Rodi O’Loane I don’t think I would have made it through all of this. She made me stronger and kept my family safe and protected. I would recommend her to anybody.

Dropped a huge retainer and we have not had a single filing completed in time for my family’s case with Leslie Gilberston specifically. Communication is massively lacking. I’m charged for every time I email or call for an update that I don’t get. Be wary when they say they have the capacity for your case and expect to be your own advocate with the courts if you choose this firm, especially if it is family law.

What a Wrongful Death Lawyer Can Do for You

A wrongful death lawyer specializes in representing families who have lost a loved one due to the negligent, reckless, or intentional actions of another person or entity. These lawyers help families seek compensation for the emotional and financial losses associated with the untimely death of a loved one, including medical bills, funeral expenses, lost income, loss of companionship, and pain and suffering. Wrongful death claims can arise from various situations, including car accidents, medical malpractice, workplace accidents, and criminal actions.

If you have lost a family member due to someone else’s wrongful actions, a wrongful death lawyer can help you navigate the legal process and pursue justice on behalf of your loved one.

When Should I Hire a Wrongful Death Lawyer?

You should consider hiring a wrongful death lawyer if a loved one has died as a result of someone else’s negligence, recklessness, or intentional harm. Some common reasons to hire a wrongful death lawyer include:

  • Car accidents: If a loved one was killed in a car, truck, or motorcycle accident caused by another driver’s negligence (e.g., reckless driving, DUI, or distracted driving), a lawyer can help you file a wrongful death claim.
  • Medical malpractice: If a loved one died due to medical negligence, such as a misdiagnosis, surgical error, or medication mistake, a wrongful death lawyer can help you pursue compensation from the healthcare provider.
  • Workplace accidents: If your loved one died in a workplace accident or due to unsafe working conditions, you may be entitled to compensation from the employer or third parties responsible for the unsafe conditions.
  • Defective products: If a defective product caused your loved one’s death, a lawyer can help you file a wrongful death claim against the manufacturer or distributor of the product.
  • Criminal actions: If your loved one was the victim of a criminal act, such as homicide or assault, a wrongful death lawyer can help you pursue a civil claim for damages, even if a criminal case is also ongoing.
  • Nursing home negligence: If an elderly loved one died due to neglect or abuse in a nursing home, a lawyer can help you hold the facility accountable for their wrongful actions.

Hiring a wrongful death lawyer soon after the incident ensures that important evidence is preserved and that you can meet any legal deadlines for filing a claim.

What Does a Wrongful Death Lawyer Do?

A wrongful death lawyer provides a wide range of services to help families navigate the legal complexities of a wrongful death claim and seek compensation for their losses. Their responsibilities often include:

  • Investigating the death: Conducting a thorough investigation of the circumstances leading to your loved one’s death, gathering evidence such as medical records, accident reports, and witness statements.
  • Establishing liability: Identifying who is legally responsible for your loved one’s death, whether it’s an individual, company, or government entity, and building a case showing how their negligence or wrongful actions caused the death.
  • Calculating damages: Helping you determine the full extent of your financial and emotional losses, including funeral expenses, medical bills, lost income, loss of companionship, and pain and suffering.
  • Filing a wrongful death claim: Preparing and filing the necessary legal documents to initiate a wrongful death lawsuit within the statute of limitations in your state.
  • Negotiating settlements: Working with the responsible party’s insurance company or legal team to negotiate a fair settlement for your losses.
  • Representing you in court: If a settlement cannot be reached, representing you in court by presenting evidence and making legal arguments to support your case.
  • Handling legal deadlines: Ensuring that all legal filings are completed within the deadlines set by your state’s statute of limitations for wrongful death cases.

How Are Wrongful Death Lawyers Paid?

Wrongful death lawyers typically work on a contingency fee basis, meaning they only get paid if they win or settle the case. Here’s how it generally works:

  • Contingency fee: The lawyer’s fee is usually a percentage of the total settlement or damages awarded, typically ranging from 25% to 40%. You won’t have to pay any upfront fees, and the lawyer only gets paid if they successfully recover compensation for you.
  • No fee if no recovery: If the lawyer does not win or settle your case, you generally won’t owe them any legal fees.
  • Case expenses: In addition to the contingency fee, you may also be responsible for reimbursing the lawyer for case-related expenses, such as court costs, expert witness fees, and investigation costs. These expenses are typically deducted from the settlement or award.

It’s essential to discuss the fee structure with your lawyer during the initial consultation to ensure you understand how much you will owe if your case is successful.

How Much Does a Wrongful Death Lawyer Cost?

The cost of hiring a wrongful death lawyer is usually based on a contingency fee structure, meaning you only pay if the lawyer recovers compensation for you. General cost estimates include:

  • Contingency fee percentage: Most wrongful death lawyers charge between 25% and 40% of the total settlement or court award. For example, if you receive a $500,000 settlement and the lawyer’s fee is 33%, the lawyer would receive $165,000, and you would keep the remaining $335,000.
  • Case expenses: In addition to the lawyer’s fee, expenses such as court costs, expert witness fees, and investigation costs may be deducted from the settlement or award. These expenses can range from $5,000 to $50,000 or more, depending on the complexity of the case.

Make sure to ask your lawyer for a clear explanation of their fees and case-related expenses before proceeding with your wrongful death claim.

Top Questions to Ask a Wrongful Death Lawyer

Before hiring a wrongful death lawyer, it’s important to ask the right questions to ensure they have the experience and resources to handle your case. Key questions to ask include:

  1. What experience do you have with wrongful death cases?
Ensure the lawyer has successfully handled cases similar to yours, whether it’s medical malpractice, car accidents, or workplace deaths.
  2. How do you charge for your services?
Clarify the lawyer’s contingency fee percentage and any additional costs, such as case expenses, that you may be responsible for.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and any potential challenges that could affect the outcome.
  4. How long will the process take?
Wrongful death cases can take time to resolve, so ask how long the lawyer expects the process to last, from filing the claim to reaching a settlement or going to trial.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be managing your case and representing you in court.
  6. What types of damages can I recover?
Ask the lawyer to explain the types of compensation you may be entitled to, such as medical bills, funeral expenses, loss of income, and emotional suffering.

How to Check the Credibility of a Wrongful Death Lawyer

To ensure you are hiring a reputable wrongful death lawyer, take the following steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for wrongful death experience: Review the lawyer’s website or professional profile to ensure they specialize in wrongful death cases and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on wrongful death cases.
  • Check for certifications or memberships: Membership in organizations like the American Association for Justice (AAJ) or local bar associations can indicate the lawyer’s dedication to wrongful death and personal injury law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a wrongful death lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Death certificate: Bring a copy of your loved one’s death certificate, as this is a key document in wrongful death cases.
  • Medical records: If applicable, bring your loved one’s medical records, autopsy reports, or any documentation of their medical care leading up to their death.
  • Accident or incident reports: If the wrongful death resulted from an accident, bring any police reports, accident reports, or workplace incident reports.
  • Financial records: Provide documentation of your loved one’s income, benefits, and financial contributions to the family to help calculate economic damages.
  • Correspondence: Bring any communication you’ve had with the responsible party, their insurance company, or legal representatives.
  • List of questions: Prepare a list of questions for the lawyer about the legal process, potential outcomes, and fees.
  • Timeline of events: Be ready to provide a clear timeline of the events leading up to and following your loved one’s death.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice.
