Living in Vegas 2024, I was there for work. It was an experience. In August, I had fallen at a property that had no markings of “ Beware of broken curb”. I did fall and fractured my ankles, out of work and no one there to help me. I knew this was not a fault of mine. I just searched on my search engine and took my gut feeling. The Fletcher Firm was listed and I called spoke to Maysoun. She was so calming, understood my situation. I didn’t know what to do. She was concerned on my health and I decided to accept Maysoun as my attorney. Through the whole ordeal, she was always there for me with answers. I felt comfortable, no pressure and reassurance. ER, Dr Visits, X-rays, caregivers. The end results I returned to Hawaii and she was there till the end. We got a settlement, I stop feeling stressed out. She took care of everything. I give this Firm 10 stars ⭐️. When in doubt of any injury, call THE FLETCHER FIRM!!!

I received a cease and desist letter from Jesse Sbaih and Associates claiming I defamed his client. I concluded from the letter that either Sbaih has no idea what defamation is, or he hoped I would fold my constitutional right to free speech to legal bullying. I found the letter to be legally insufficient and this law firm to be an amateur operation. The ridiculous letter saying I would be sued for over $500,000 if I did not remove an online statement misquoted me, making it nonsensical. I cannot fathom how my comment would rise to defamation had Sbaih bothered to copy and paste it accurately. The scheme backfired spectacularly for Sbaih and his client. After receiving the threatening letter, I immediately published it on social media, where it gained over 20,000 views and was widely mocked. Several observers noted that Sbaih failed so badly here that he did not even appear to know the difference between libel and slander. It started an educational online free speech discussion. A few minutes of research would have revealed that I am a free speech advocate and defamation law expert. I testified to the Nevada Assembly Judiciary Committee on the topic. I participated in the 2015 anti-SLAPP (Strategic Lawsuit Against Public Participation) law amendment discussion when Nevada needed to change clear and convincing to the prima facie evidentiary standard due to a ruling by the Washington Supreme Court on a similar law in that state. Speaking of anti-SLAPP laws, this case would be disastrous for Sbaih and his client if it moved forward. I feel it would be one of the most frivolous defamation lawsuits in Nevada history and would be punished accordingly under the state's anti-SLAPP law. All Nevadans are immune from frivolous speech-related lawsuits under NRS 41.650. When a court finds a speech-related lawsuit meritless, it is immediately struck. Under this ruling, the plaintiff must pay all the defendant’s legal fees. A judge may impose additional damages of up to $10,000 under NRS 41.670. A separate action may be brought by the defendant of the SLAPP suit for compensatory damages, punitive damages, attorney’s fees, and the costs of bringing the separate action. I feel an ethical lawyer would have refused to sign their name to a letter like this and instead would have encouraged the client to have a civil discussion with the other side to resolve it. I think unethical lawyers see this type of frivolous letter writing as an opportunity for a billable hour at the expense of the First Amendment. Keep all this in mind if you are thinking about retaining Sbaih. If he blew this situation so badly, what will he do with yours?

I called a well known attorney after seeing his commercials for years back in 2011. I knew I had a case I just needed someone to listen to me and hear my story. That attorney was only interested in taking cases that were a guaranteed win, and as many as possible. He referred me to Phil. I had never heard of Phil or his firm so I was skeptical but had no other option. I left Phil a message and he responded via text to set up a time to talk. Finally someone was willing to hear my story. I was expecting a girl from his office to call in the way that the previous firm had done. Phil called me directly and did not rush me at all. I was a little put off because his personality was different than the charismatic attorneys I had seen on tv, but no one else had given me more than 5 minutes and here he was asking questions and showing empathy and interest for an hour. He believed me. Also he was my only option. He took my case. What I saw over the year that Phil represented me was a man who was not afraid of or intimidated by anyone. He believed me. He fought for me. It didn’t matter who opposing counsel was or how big the case was going to get. He fought for me and we won. I was awarded a large settlement after three other attorneys told me I had no case. Phil isn’t going to win best personality or be on a commercial or the cover of those magazines that attorneys pay to be featured in…but I have never seen someone so passionate, determined and unafraid. I hope I have no need, but if I do need an attorney again, I wouldn’t consider anyone BUT Phil.

Philip Trenchak and his Office Staff have helped me immensely with my Separation Agreement from my previous employer. I was new to the area and had no one to speak to when middle management decided to make personnel changes while the CEO was on sabbatical. Basically, my workload was increased and the respect given to me and my support staff decreased. I tried to defend myself by speaking to Corporate directly and give my A/P staff a raise but I was repeatedly ignored. They would not speak to me directly and told me to hire a lawyer. I used AVVO to find Philip's Stellar Law Office. They were very attentive, gave me specific options with fees on how to move forward, and were very patient with me and diligent with my case. Since my employer would not speak to me, Philip and Cristina were in constant communications with them and kept me updated with any new developments. After 3 months, Philip's office secured my Severance Payment and I can now move on to working for a more ethical not-for-profit company. I highly recommend Philip Trenchak to fight for your employment rights!

The experience received by attorney Trevor Hatfield was phenomenal, to say the least. Although borrowing the motto from another familiar business due to it's ideal application, I must say, I immediately knew we were in good hands! We approached the elevator and took it to Hatfield and associates offices. Suddenly, surrounded by glistening white walls beautifully garnished with interior floral decorum, I felt encompassed within a style of professionalism and class. The leather seats were comfortable and of quality. Even the cylindrical glass tabletop shone so immaculately, you'd have felt comfortable eating food served directly upon it! The ladies at the front desk were pleasant. We did not wait long before Mr. Hatfield invited us beyond the door into a private conference room. Trevor Hatfield was clearly a gentleman of stature and wisdom, an asset to his trade. His skilled approach to the issue at hand was reassuring, and suddenly we took comfort for the first time, knowing that things will work out exactly as they should! Mr. Hatfield was thorough, went over every detail of the case, explained our options, and confirmed we understood what was needed to move forward successfully. There is no doubt his representation is top notch. Hatfield is an attorney who won't nickel and dime you; he genuinely cares about doing the job well and taking proper care of his clients. Trevor Hatfield has been a recipient of the city's recognition, and was awarded as such. He was readily referred by other colleagues within the same field and he takes the time to adhere to each case in order of finding an appropriate solution. He is worth the expense of a high priced lawyer, while willing to help those who are justified in their predicament. I wanted an attorney of moral integrity who was truly discerning. Hatfield's shrewd observational ability and keen eye for detail quickly identified convolution dwelling behind the veil built by a condescending company. Hatfield uncovers corruption beyond efforts to keep it hidden. He is one of the good guys, ready to support cases, big or small. Within our current world's state of affairs, he found the silver lining within a formerly bleak situation. We were victims of a targeted circumstance, and now may finally obtain recourse! There is hope because of individuals such as Hatfield; he stands for justice and truth, and in that, no failure could exist. I commend your firm and highly recommend your services to anyone who needs solid representation pertaining to any area within the vast field of employment law.

We hired Ms. Holman to represent our son with an employment-related case. She was pleasant at first, almost too pleasant. She called my husband back a few times to follow up and see if we were interested in meeting with her to discuss things further. This should have been the first red flag. Any attorney with time to follow up with prospective clients must not have a full caseload, and there is a reason for that. We read the reviews here on Yelp and thought we'd give her a chance anyway...big mistake. Once she was paid in full for her services we never heard another thing from Ms. Holman. She also allowed our son's case to expire with the EEOC 90-day cutoff, which ruined his chances for recourse through the legal system against his previous employer. In addition, she never assisted our son with receiving the unemployment funds she claimed she could get for him. She is filled with promises and pumps herself up to be this amazing attorney, but she fails to meet the high level of expertise/standards she claims she has. We filed a grievance against her with the State Bar of Nevada, to which they sent her a letter requesting her response. In addition, we sent her a demand letter (via certified mail and email) for payment in full. As of today, she has returned all of our original funds. I would never recommend her to anyone for representation. Unless you like headaches and irritation, it is our opinion that it would be highly beneficial to avoid any of the so-called services she offers.

I would give 0 stars if I could. The woman is a straight up thief. I paid 250 for a consultation. She said she could assist me with a letter to start on my behalf but required a 1,000 retainer. I paid the fee and she literally disappeared. First she would answer my emails with excuses. Then she stopped answering me all together. Absolutely atrocious. Do not use this woman for any service. I have reported her to the bar association and will be taking her to court for my money back. Worst attorney I’ve ever come across and not professional at all.

What a Wrongful Termination Lawyer Can Do for You

A wrongful termination lawyer specializes in representing employees who have been illegally fired or laid off from their jobs. Wrongful termination occurs when an employer violates federal or state laws, employment agreements, or public policy when dismissing an employee. These lawyers help clients understand their rights, evaluate the legality of their termination, and pursue legal action to recover damages such as lost wages, benefits, and emotional distress.

If you believe you have been wrongfully terminated, a lawyer can guide you through the complex legal process, negotiate with your former employer, and advocate on your behalf to achieve a fair resolution.

When Should I Hire a Wrongful Termination Lawyer?

You should consider hiring a wrongful termination lawyer if you have been fired under circumstances that may violate the law. Common reasons include:

  • Discrimination: If you were terminated based on your race, color, religion, sex, national origin, age (40 or older), disability, or genetic information, this may constitute illegal discrimination under federal laws like Title VII of the Civil Rights Act or the Americans with Disabilities Act (ADA).
  • Retaliation: If you were fired for reporting illegal activities, discrimination, harassment, or for participating in an investigation or lawsuit against your employer, this may be illegal retaliation.
  • Violation of Employment Contract: If you have an employment contract that outlines specific terms for termination and your employer breaches these terms, you may have a claim for wrongful termination.
  • Public Policy Violations: If you were terminated for reasons that violate public policy, such as refusing to engage in illegal activities, taking time off for jury duty, or exercising your legal rights (e.g., taking family medical leave), a lawyer can help.
  • Whistleblower Protection: If you were fired after reporting your employer's illegal activities to a government agency (whistleblowing), you may be protected under specific laws.

Hiring a lawyer promptly is crucial, as there are strict deadlines (statutes of limitations) for filing wrongful termination claims.

What Does a Wrongful Termination Lawyer Do?

A wrongful termination lawyer provides various services to help you pursue a claim against your former employer:

  • Case Evaluation: Assess the facts of your termination to determine if your employer violated any laws or breached your employment contract.
  • Legal Advice: Explain your rights under federal and state laws and advise on the best course of action.
  • Filing Claims: Assist in filing a complaint with appropriate government agencies, such as the Equal Employment Opportunity Commission (EEOC) or state labor departments, if required before suing.
  • Negotiation: Engage in settlement discussions with your former employer to seek compensation without going to court.
  • Litigation: Represent you in court if a lawsuit is necessary, presenting evidence, questioning witnesses, and making legal arguments to support your case.
  • Documentation and Evidence Gathering: Help collect and organize necessary documents, such as employment contracts, company policies, performance reviews, emails, and witness statements.
  • Protecting Against Retaliation: Advise you on how to handle any retaliation or further adverse actions from your former employer.

How Are Wrongful Termination Lawyers Paid?

Wrongful termination lawyers typically charge for their services in one of the following ways:

  • Contingency Fee: Many work on a contingency basis, meaning they only get paid if you win or settle your case. Their fee is a percentage of the compensation you receive, usually ranging from 25% to 40%.
  • Hourly Rate: Some lawyers charge an hourly rate, which can range from $200 to $600 or more, depending on experience and location.
  • Retainer Fee: A retainer is an upfront payment against which the lawyer bills their hourly rate. Once the retainer is exhausted, you may need to replenish it.
  • Flat Fee: For specific services, such as reviewing a severance agreement, a lawyer might charge a flat fee.

It's important to discuss payment arrangements during your initial consultation to understand how fees and expenses will be handled.

How Much Does a Wrongful Termination Lawyer Cost?

The cost varies based on the complexity of your case, the lawyer's experience, and the fee arrangement:

  • Contingency Fees: If you win or settle, the lawyer's fee will be a percentage of the award. For example, if you settle for $100,000 and the contingency fee is 30%, the lawyer receives $30,000.
  • Hourly Rates: Total costs depend on the number of hours worked. A straightforward case might require 20 hours ($4,000 to $12,000), while complex cases can exceed 100 hours.
  • Additional Expenses: Be aware of other costs such as court filing fees, costs for depositions, expert witness fees, and administrative expenses, which may be billed separately.

Always request a written fee agreement detailing all potential costs.

Top Questions to Ask a Wrongful Termination Lawyer

  1. What is your experience with wrongful termination cases similar to mine?
Ensure the lawyer has relevant experience and a successful track record.
  2. How do you charge for your services?
Understand the fee structure and any additional costs.
  3. What is the likely outcome of my case?
Get an honest assessment of your chances of success and potential compensation.
  4. What is the estimated timeline for resolving my case?
Know how long the process may take, from filing to settlement or trial.
  5. What steps will you take to build my case?
Understand the strategy and what will be required from you.
  6. Will my case go to trial, or can it be settled out of court?
Discuss the possibilities and implications of each option.
  7. How will you keep me informed about my case?
Ensure there will be regular updates and open communication.

How to Check the Credibility of a Wrongful Termination Lawyer

  • Verify Their License: Check your state's bar association website to confirm the lawyer is licensed and in good standing.
  • Review Their Experience: Look for lawyers who specialize in employment law and have specific experience with wrongful termination cases.
  • Read Client Reviews: Websites like Avvo, Martindale-Hubbell, or Google Reviews can provide insights into the lawyer's reputation.
  • Ask for References: Reputable lawyers should be willing to provide references from past clients.
  • Professional Memberships: Membership in organizations like the National Employment Lawyers Association (NELA) indicates a focus on employment law.
  • Disciplinary Record: Ensure the lawyer has no history of disciplinary actions or complaints.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting:

  • Employment Documents: Bring your employment contract, employee handbook, offer letters, termination letter, and any severance agreements.
  • Performance Records: Include performance reviews, commendations, or any disciplinary actions.
  • Correspondence: Provide emails, texts, or memos related to your termination or any incidents leading up to it.
  • Witness Information: List names and contact information of colleagues who can support your claims.
  • Timeline of Events: Prepare a detailed account of events, including dates and descriptions of incidents.
  • Previous Complaints: If you filed complaints with HR or external agencies, bring copies.
  • Questions: Write down any questions you have about your case or the legal process.

Being well-prepared helps the lawyer assess your situation effectively and advise you on the best course of action.
