Highly recommended. I got there name from a google search when I suddenly needed a lawyer. They had great reviews and responded immediately when I needed time-sensitive counsel with a family matter. Thomas McKinley is an excellent lawyer, very clear in his communications, reassuring and compassionate. Lawyers are always expensive but I found their rates reasonable. He was able to communicate directly with the DA and save me a lot of footwork and time, and was able to get the matter resolved without me having to deal with the court directly and provided great reassurance throughout. Well worth the money and I will call him first if I ever have any other needs

Christine, and her law firm, are great. I reached out to her from a state of confusion, stress, and frustration. I explained my employment law situation and was quickly put at relative ease. She took the time to understand the circumstances and describe how we could proceed, the plus and minus of thestrategy, the risks, and importantly the timeline and things I would likely experience. In short term, I felt confident in her ability to provide assistance and help me. Based on the very personable and responsive communications we had, I decided to hire her to take my case. Long story short, she used her deep expertise and skills to provide a degree of relief, much more than I would have expected on the day I first reached out to her and her firm. I'd recommend her to anybody who needs assistance, multiple times over. Again, thank you very much Christine.

Watching Christine practice law is like watching a fish practice swimming. Christine is pleasant, personable, and awesome to deal with. She is attentive, analytical, and shrewd. I would not want to be the opposing counsel. I tried calling two billboard firms, but no dice. I needed to talk with somebody who could pick up on the nuances of my case. Christine was that person. I left a run-on voicemail at 4pm on a Friday, and received a call back within an hour. We exchanged about 500 emails, and if I had to guess, I sent them at a ratio of 3:1, at all hours of day/night, often ranting and going off on tangents, but still communicating valuable information. Christine always got back to me. I would recommend Christine to anyone.

I bet you never thought "decent human being" and lawyer could reside in the same person, but JPI seems to have found them! I temped for them as a legal assistant in early 1998. I wasn't a regular employee or a client (well, we'll get to that), yet I was always treated like I was one of the gang. I was included in their Friday night outings after work, and spoken to like an equal. Mr. Pass, for being a name partner, is so down-to-earth - I've worked in D.C. law firms with junior associates who treated me with less respect - and I had more seniority than them! Despite working hard, I had a big drop in income from what I had been used to and needed, so JPI helped me file for bankruptcy and even represented me - and they didn't ask for a dime over the filing fees. All Mr. Pass wanted was to see me get to a better place in life. We stayed in touch as I left Pennsylvania to make that happen. Nearly 25 years later, as I write this, I can still call and ask his advice and chat with him, if he's not busy. How many people do you meet in a lifetime who are genuinely good people, who are good at what they do? How many of those people are lawyers? I mean, I can tell stories about lawyers I've worked with and how mercenary they are even in their private lives. The profession seems to attract that type. The law firm of JPI turns the idea of the stereotypical lawyer on its head. They're good people out to do good. It's like they never lost the idealism that drove them to go to law school. This should be the ideal boutique law firm.

I worked with Goldsmith & Ogrodowski, LLC. for a few years. Even after a few years, I had to go check and make sure I had the name of their Law Firm correct. I know them by their first names, Fred, Rich and Heather. My 5 year nightmare started while working on a towboat as a deckhand, I was severely injured. After surgery and about 6 months, I tried going back to work. I didn't like where things were headed. I just wasn't able to do the same work as before. I still had so many issues. At the time, I had never had to call an attorney. I didn't know which way to go. It took a lot of time and thought before I finally made that decision. I now know that it was the right decision. My case was very complicated and took many years. Fred was my attorney, He worked tirelessly on my case. It felt as if I was his only client. It also felt like I was a part of his family. They even treated my fiancée and kids like family. I've had Fred call me at 8-9 p.m. and he was still working on my case. I could call or text any time with questions or concerns and he always responded quickly. It was never an issue. The amount of experience in this firm is amazing. Fred and Rich are the best at what they do. Very knowledgeable. This injury changed my life, forever. Fred understood that. I had hundreds of doctors appointments, a couple thousands pages of medical records. Fred knew every single detail. He was able to accurately answer any question asked over a long period of time and a period of time where things changed. You are not a number here, Fred truly cares. He takes your case and your future afterwards very serious. If you find yourself in a position needing an attorney, call, ask questions, do your due diligence, you won’t be disappointed. You will get what you deserve. The only thing I wish I could change is…..I wish I would have called G&O sooner. Thank you Fred, Rich and Heather. Thanks for everything you guys have done. I’ve just never met anyone that truly cares as much as you guys do. Thank you!!!

On a personal note, Fred made to hour+ trip to pay his respects at my mom's funeral. For this I'm eternally grateful. Highly recommended.

We won that case, due to his diligence and (also his then partner's) willingness to fight for what was right. Years later, he again assisted me with legal advise in a very different venue, his name is definately a strong force to be reckoned as a legal authority. I strongly advise against engaging this attorney or law firm if you seek organized and effective representation. Instead of drafting the demand letter to the insurance company as initially agreed, the attorney requested that I prepare it myself, yet charged me a $500 fee for services that were not rendered as promised.

Mr. Ernsberger is an incredible attorney. When I contacted him, I was without hope and believed there could be no resolution to the situation I'd encountered with my Homeowner's Insurance Carrier. Subsequent to a fire loss in December of 2022, I was without payment and the carrier had canceled my policy based on incorrect information. Within two weeks of contacting Dan, the problems were solved. I've received payment and had my policy reinstated. He made the process simple and easy. In the first case he was able to get me my job back and then in the second case he was able to get me a $740,000 settlement. Not only does he have the legal knowledge but he also knows when to be conciliatory and when to be aggressive. As an attorney myself I know what it takes to be great at this job and Sean is the best Ive ever seen.

What a Wrongful Termination Lawyer Can Do for You

A wrongful termination lawyer specializes in representing employees who have been illegally fired or laid off from their jobs. Wrongful termination occurs when an employer violates federal or state laws, employment agreements, or public policy when dismissing an employee. These lawyers help clients understand their rights, evaluate the legality of their termination, and pursue legal action to recover damages such as lost wages, benefits, and emotional distress.

If you believe you have been wrongfully terminated, a lawyer can guide you through the complex legal process, negotiate with your former employer, and advocate on your behalf to achieve a fair resolution.

When Should I Hire a Wrongful Termination Lawyer?

You should consider hiring a wrongful termination lawyer if you have been fired under circumstances that may violate the law. Common reasons include:

  • Discrimination: If you were terminated based on your race, color, religion, sex, national origin, age (40 or older), disability, or genetic information, this may constitute illegal discrimination under federal laws like Title VII of the Civil Rights Act or the Americans with Disabilities Act (ADA).
  • Retaliation: If you were fired for reporting illegal activities, discrimination, harassment, or for participating in an investigation or lawsuit against your employer, this may be illegal retaliation.
  • Violation of Employment Contract: If you have an employment contract that outlines specific terms for termination and your employer breaches these terms, you may have a claim for wrongful termination.
  • Public Policy Violations: If you were terminated for reasons that violate public policy, such as refusing to engage in illegal activities, taking time off for jury duty, or exercising your legal rights (e.g., taking family medical leave), a lawyer can help.
  • Whistleblower Protection: If you were fired after reporting your employer's illegal activities to a government agency (whistleblowing), you may be protected under specific laws.

Hiring a lawyer promptly is crucial, as there are strict deadlines (statutes of limitations) for filing wrongful termination claims.

What Does a Wrongful Termination Lawyer Do?

A wrongful termination lawyer provides various services to help you pursue a claim against your former employer:

  • Case Evaluation: Assess the facts of your termination to determine if your employer violated any laws or breached your employment contract.
  • Legal Advice: Explain your rights under federal and state laws and advise on the best course of action.
  • Filing Claims: Assist in filing a complaint with appropriate government agencies, such as the Equal Employment Opportunity Commission (EEOC) or state labor departments, if required before suing.
  • Negotiation: Engage in settlement discussions with your former employer to seek compensation without going to court.
  • Litigation: Represent you in court if a lawsuit is necessary, presenting evidence, questioning witnesses, and making legal arguments to support your case.
  • Documentation and Evidence Gathering: Help collect and organize necessary documents, such as employment contracts, company policies, performance reviews, emails, and witness statements.
  • Protecting Against Retaliation: Advise you on how to handle any retaliation or further adverse actions from your former employer.

How Are Wrongful Termination Lawyers Paid?

Wrongful termination lawyers typically charge for their services in one of the following ways:

  • Contingency Fee: Many work on a contingency basis, meaning they only get paid if you win or settle your case. Their fee is a percentage of the compensation you receive, usually ranging from 25% to 40%.
  • Hourly Rate: Some lawyers charge an hourly rate, which can range from $200 to $600 or more, depending on experience and location.
  • Retainer Fee: A retainer is an upfront payment against which the lawyer bills their hourly rate. Once the retainer is exhausted, you may need to replenish it.
  • Flat Fee: For specific services, such as reviewing a severance agreement, a lawyer might charge a flat fee.

It's important to discuss payment arrangements during your initial consultation to understand how fees and expenses will be handled.

How Much Does a Wrongful Termination Lawyer Cost?

The cost varies based on the complexity of your case, the lawyer's experience, and the fee arrangement:

  • Contingency Fees: If you win or settle, the lawyer's fee will be a percentage of the award. For example, if you settle for $100,000 and the contingency fee is 30%, the lawyer receives $30,000.
  • Hourly Rates: Total costs depend on the number of hours worked. A straightforward case might require 20 hours ($4,000 to $12,000), while complex cases can exceed 100 hours.
  • Additional Expenses: Be aware of other costs such as court filing fees, costs for depositions, expert witness fees, and administrative expenses, which may be billed separately.

Always request a written fee agreement detailing all potential costs.

Top Questions to Ask a Wrongful Termination Lawyer

  1. What is your experience with wrongful termination cases similar to mine?
Ensure the lawyer has relevant experience and a successful track record.
  2. How do you charge for your services?
Understand the fee structure and any additional costs.
  3. What is the likely outcome of my case?

How to Check the Credibility of a Wrongful Termination Lawyer

  • Verify Their License: Check your state's bar association website to confirm the lawyer is licensed and in good standing.
  • Review Their Experience: Look for lawyers who specialize in employment law and have specific experience with wrongful termination cases.
  • Read Client Reviews: Websites like Avvo, Martindale-Hubbell, or Google Reviews can provide insights into the lawyer's reputation.
  • Ask for References: Reputable lawyers should be willing to provide references from past clients.
  • Professional Memberships: Membership in organizations like the National Employment Lawyers Association (NELA) indicates a focus on employment law.
  • Disciplinary Record: Ensure the lawyer has no history of disciplinary actions or complaints.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting:

  • Employment Documents: Bring your employment contract, employee handbook, offer letters, termination letter, and any severance agreements.
  • Performance Records: Include performance reviews, commendations, or any disciplinary actions.
  • Correspondence: Provide emails, texts, or memos related to your termination or any incidents leading up to it.
  • Witness Information: List names and contact information of colleagues who can support your claims.
  • Timeline of Events: Prepare a detailed account of events, including dates and descriptions of incidents.
  • Previous Complaints: If you filed complaints with HR or external agencies, bring copies.
  • Questions: Write down any questions you have about your case or the legal process.

Being well-prepared helps the lawyer assess your situation effectively and advise you on the best course of action.
