I was arrested in Lee County and facing life in prison for a crime I did not commit! My life was instantly shattered and in a few short hours everything that I have ever worked for was taken from me! I hired a large law firm in Ft. Myers to represent me only to have them write me off as a plea bargain. After several months of terrible representation, I then sought new counsel. Living across the country, I zoomed multiple firms in the southwest Florida area. All of which but one gave me the same run around story. Attorney Foley is the only consultation that did not tell me what I wanted to hear, but instead told me what I needed to hear, “The Truth”! He provided me with the blunt facts and possible outcomes of my horrific case. Attorney Foley’s transparency was unmatched and I instantly retained him to represent me in the fight of my life to prove my innocence. On day one, both attorney’s Foley and Wilson went right to work on my case! Over the next 18 months, they investigated and learned every single nuance of my case through depositions and thorough research of all provided discovery. During the two year period, I was offered serval plea bargains as a way to resolve the case. Bob and Desiree shared their true and professional insights and feelings when I was faced navigating those difficult choices. Ultimately, I was forced to “roll the dice” and went to trial in order to prove my innocence. Last month we went to trial for the fight of my life. Over the course of the three days, Bob and Desiree swiftly and persistently destroyed the state’s evidence against me. They quickly exposed and impeached several of the prosecutions key witnesses and displayed all the inconsistencies and the terrible investigation that took place. After living in literal hell for 733 days and 12 minutes of deliberating, the jury set me free and claimed my innocence!!! I chose to put my life into Bob’s and Desiree’s hands. Today, as a result, I am a free man!!! I promise all of you, there is NO OTHER law firm in the state of Florida that possess their background, knowledge, talent and methodical ways of executing plans. They are my “Dream Team”. They have a spot forever in mine and family’s hearts and forever grateful for them. I love you guys!!!

I was accused of felony misconduct on two occasions and summoned to court for a hearing. Had to buy suitable clothing as, being 74 and long retired, I did not own even a jacket and tie, much less socks. Attorney Desiree Wilson was waiting at the door when I walked into the courthouse at 8:30 AM. She stayed right by my side, and told me exactly what would happen, until we were called before the judge at 9:45. Leaving me at the back, she then went forward and negotiated a deal that gave me all I wanted and gave the other side nothing they truly wanted. It was over by 10:15 and I had never said a thing. When we parted ways outside the courthouse, my last words to her were, "Raise your rates." Experience isn't everything. Sometimes poise counts even more. Attorney Desiree Wilson has plenty of both. She defended me aggressively and with ruthless efficiency. She knew just what would occur--not only in court but at every stage--and she expertly shaped the narrative. I was not merely pleased with the outcome, I was awed by the performance. I believe that Attorney Wilson also handles appeals; however, if you bring her in at the start, when first accused, I am pretty sure you won't need to file one.

Alvaro was able to resolve contentious inheritance issues that other attorneys couldn't. He remained patient and professional amidst the bickering and produced an outcome accepted by all. Alvaro is personable and intelligent and his fees are very reasonable relative to other attorneys we used.

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.

Can a Lawyer Represent Me in Courts Outside of Cape Coral, Florida?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
