Forget your preconceived notions about attorneys! I must admit going in, I thought they might be more concerned about getting a case and getting their fee than they were in making me whole again. This was the warning from so many others that had traveled this road before me. Wrong… I was a victim of an under insured motorist- damage to my car and injury to my back. From the first time I met Mark, he was understanding, empathetic, and thorough in explaining the process that we would need to go through to get compensation for the mounting expenses. He was straightforward and although I was reluctant to get surgery at first, trying all the other methods to get pain relief, Mark stayed with me asking if there was anything that he could do to help as a friend. Mark and Domenic were able to get me just compensation for the accident all without having to go to court! Having someone, who understands the process, knows what can be achieved and is willing to go to bat for you, not just settle, best describes Mark and Domenic. Although I hope to never need their services again, I would not hesitate asking them to represent me or my family and friends.

My case was unusual and difficult to prove. Mark Smith handled it perfectly and was successful in getting me a settlement He gave it his full attention even though there wasn't a big payout involved. He takes the time necessary to handle both big and small cases. I would recommend him highly and give him 5 stars.

Having a divorced and a bankruptcy in my past, I have had experience dealing with attorney's. I can honestly say that this has been my first positive experience regarding a legal process. Rather than feeling like I was chasing an attorney around, Mark gave my case the attention that it deserved. He not only guided me through the whole process, but he explained everything in detail and with the patience that I needed to understand a very confusing legal process. I would highly recommend Mark to all my family and friends and anyone who is in need of a great attorney who will take your case with the seriousness and sensitivity that an attorney should show their client.

Mark Smith and his team helped my brother and his family through some tough legal problems during a very hard personal bad time for our family. He was professional and empathetic to my family. We never felt like we were dealing with lawyers but rather extended family members and I will for ever be grateful to him and his team for that. Dealing with the legal system can be more often than not overwhelming and scary and Mr. Smith always made us feel heard, respected and grateful to be represented by such a caring and professional individual. Needless to say as someone who has experienced all of the above first hand I highly recommend Mr. Mark Smith and his firm.

If I ever did one thing right--it was hiring Mark P. Smith as my lawyer for my personal injury case. I was from out of state and tried to settle with the insurance company for almost 2 years. Mark was willing to take my case and represent me. He gave my case the greatest of attention and was always one phone call away from any question or concern I had. He took the time to understand my case and made sure I understood the options available. He kept me aware of any and all actions taken and provided me with expert legal advice. He is an extremely capable certified trial lawyer and a very pleasant man with the highest of integrity. He worked diligently to recover appropriate compensation for the injuries that I sustained from the negligence of another driver. I would recommend Mark P. Smith to anyone who needs a honest, hardworking attorney. I am thankful I called him and that he took my case. You won't be sorry about your decision to call Mark for your legal concerns.

I can't believe it's almost been 9 months since my divorce. I was in a surprising and stressful situation. Dustin met with me right away. He was very understanding and patient with me. He thoroughly understood my situation. He explained to me that what I was being asked to do by my spouse was not possible according to the law. I was totally satisfied with his knowledge and professionalism. I would highly recommend Dustin to anyone needing a lawyer in Family Practice.

I hired Dustin for my recent divorce. He listened carefully to my questions and concerns, and gave me direction and good counsel on every point. Dustin truly cared about my situation, which lessened the anxiety that I had about my personal circumstances during the divorce. He communicated with me very well along the way, and made sure I understood each step in the process. The divorce is now finalized and I am very pleased with Dustin's work to make that happen. I am grateful to him for his help and genuine concern, and would recommend him to my friends and family. I appreciate the office staff as well, particularly Lauren, who was always gracious and helpful on the phone.

Mr. Youngner’s services are exceedingly professional, expert and effective. My case involved delicate interaction with local and higher Headquarters military authorities and necessitated an insightful and experienced understanding of U.S.Code and Military Law and the nuanced application of each. In all, Mr. Youngner's level of expertise and communication skills were direct, insightful and complete, enabling optimum case resolution. I simply cannot compliment Mr. Youngner enough for all his truly exceptional work, completed on my behalf, including responding to an urgent legal matter during his personal time off. His ongoing case management was always complete; and at the same time, his client interaction was always courteous and personable. His knowledge of the subject matter and grasp of my case’s impacts also enabled max effectiveness in dealing with all related authorities. The support staff at Tully Rinckey is as well warm, competent and professional (especially his assistant Ms Sherry Holland). Tully Rinckey PLLC is a superb law firm and Mr. Youngner is in particular, an outstanding civilian, military attorney.

I had been seeking justice for many years on my own, but it was to no avail due to the tangled administrative and military laws and lack of support. I finally found Larry at what felt like the last hour, because I couldn't fight anymore. Larry heard me, and not only believed in my case, but he believed in me and the cause. It was an intense case and after all these years of hardship and trauma I was finally made whole and it is absolutely attributed to the in-depth expertise, unique approach, and genuineness of Larry. He spoke the truth in the most honorable and strategic manner and the military finally heard me, because Larry stood up for what was just. I couldn't believe it, but I received a positive outcome in less than 4 weeks after the military board heard my case through Larry. For any individual seeking justice, through not just a lawyer, but through someone who is actually compassionate, straightforward, positive, and fully vested in you, then look no further. Larry is a rare lawyer, because he is first a human and he invests everything he has and more to support you first, and the rest will follow.

In my opinion, Mr. Youngner is a very sharp attorney and advocate. He communicates clearly (and is available). After reviewing my case, Mr. Youngner found more than two additional points of noncompliance by the offending department in my appeal for correction. Mr. Youngner and his team kept me informed of the status of my case at regular intervals. He sets reasonable expectations and meets them. Dealing with a large and impersonal bureaucracy, a person needs an advocate as effective as Mr. Youngner. I highly recommend Mr. Youngner.

Can a Lawyer Represent Me in Courts Outside of Cape Coral, Florida?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
