3 years ago I took a fall at work due to the negligence of a coworker for which he admitted to. My neck, shoulder and lower back were sore from the fall. My supervisor was there at the time and he wrote up the WC report, I didn't seek medical attention at that time, thought it was just bumps and bruises and I would be ok However, the next day it was more than that so I sought medical evaluation. From that day and the next 3 months I dealt with red flags, hurdles, a few adjusters and a Nurse Case Manager. With my care being delayed, the first adjuster informed me of how 80% of workman's comp claims are fraudulent. Didn't feel it had anything to do with me. My second adjuster was assigned to me and went on vacation. My third adjuster ordered physical therapy for my lower back nothing for my shoulder or neck. I went to therapy and it helped with my lower back but didn't do anything for the neck and shoulder. I asked my adjuster why WC was dragging their feet and she told me they had to make sure I actually hurt myself at work. I assured her I did and had witnesses. An MRI was scheduled for my shoulder also an appointment with an orthopedic surgeon. At my doctor's appointment he was reviewing the MRI and asked me why they didn't order an MRI for the surgical spine? I didn't have an answer, so he scheduled one. I returned for my second appointment with the surgeon and my nurse case manager was there she told me she was hired by WC to represent me and make sure that I was getting the proper care and went in with me to review the MRI with the doctor. The doctor had his idea of how we should proceed with my treatment and care, the NCM had a different opinion. When the doctor asked me what I thought I agreed with him, he's the doctor. No decision was made at that time for treatment, we needed WC approval. When the NCM and I were outside, she told me she didn't feel comfortable with that doctor. Said, she knew another doctor that she believed could provide better care, I didn't feel the same way. When I got home I googled the role of a nurse case manager and found out her role is to represent WC. While reading over the NCM role, I pressed on the site for the Law office of Franks Koenig and Neuwelt, a message appeared and said I would receive a call within 15 minutes and I did. While speaking with the representative I gave her the background info and she told me there were two ways we could go about representation. She said, that I could have the firm represent me or they can monitor the case in the background. I opted for representation because of too many flags and didn't trust WC. David Schweiger was assigned to represent me and I couldn't have asked for a better attorney. David and his team of paralegals, Sasha the most recent have had my back 100% through my ordeal. Even with legal representation WC continually try to minimize my injuries and make it difficult for treatment. With the help of David I had surgery for three-tier cervical decompression and fusion. Without him I feel it never would have happened. We recently reached a settlement for money in my pocket as well as a fund for future care. I am deeply appreciative for the dedication of David, Sasha and the Law office of Franks, Koenig and Neuwelt and strongly recommend their services for anyone with a workman's comp claim. After all. Workman's comp is all they do!
