Mr. Carlton stated that he previously represented HOAs and now represents homeowners against HOAs. I was referred to Mr. Carlton from a partner in another firm who said he’d fight for me. That partner, and two other partners in different firms all stated I had a good case. Not only did Mr. Carlton not fight for me, he went back to the HOA. Highlights:
I emailed Mr. Carlton a witness list for him to get started on preferably before writing the complaint, and have affidavits prepared for filing with the complaint. Mr. Carlton did not speak to any witnesses.
I gave Mr. Carlton several documents I had received from the HOA. Either he never reviewed them or lacks the attention to remember anything he reviewed.
I had to spend 6 hours revising the beginning of the complaint – all he had to do was write the causes of action/Counts and he couldn’t even do that. And nearly a year later, Mr. Carlton asked ME to review and revise/mark up the complaint for him as an amended Complaint.
Two Counts of my complaint were completely false. I never told Mr. Carlton what he wrote and there were no documents stating that. He added those on his own accord.
Mr. Carlton never wrote a cause of action/Count regarding harassment or my being stalked.
No Request for an Order requiring the HOA Board to honor their decision in the relief section. Instead, it was part of “Such other and further relief as deemed just and proper.” Hidden away, he never thought of this again.

Despite wanting three defendants, he stressed the HOA only should be sued. He ended up being wrong.'
Deposition of HOA Board President. I prepared seven pages of questions, which were a lot of yes/no regarding Board Members, two other parties. I also authorized Mr. Carlton to make it a day and half or two-day deposition. He spent 1.90 hours and only handful of questions. Because Mr. Carlton did not talk to my witnesses and refreshed his memory with documents-exhibits of the complaint he had in his possession, he failed to challenge the HOA President’s answers.
In reading the transcript, and emails from Mr. Carlton, it appears as if the HOA Board was Mr. Carlton’s client, not me. He seemed to fawn over the HOA President as such a truthful witness. I was shocked.
It was Mr. Carlton who asked the HOA President about HIS two incorrect causes of action, which then opened the door to opposing counsel accusing me of lying in my papers at my own deposition.
Mr. Carlton never prepared me for my own deposition. We could have gone over the HOA President’s deposition transcript and submitted further exhibits and testimony to counter the HOA President’s untruths.
At the end of my deposition, Mr. Carlton did not ask me one question to dispute the HOA President’s testimony or clarify answers for the record at my own deposition. It was like he wasn’t even present.
He thought my deposition was “fine.” I said it was a disaster and said opposing counsel would probably file a dismissal. He disagreed. I was right on both.
By the end, he completely and utterly lost site of the reason for my wanting to sue the HOA Board. Mr. Carlton caved to the HOA’s attorney and especially the HOA President. I knew then Mr. Carlton really never had a grasp of what my case was about.
I am not saying I would have prevailed at trial, but I feel my chances would have been better if Mr. Carlton had focused on and talked to my witnesses, focused more on the actions of the HOA Board and two parties in the causes of action and as stated in my deposition questions, and if he had prepared me for my own deposition. A good settlement might have been reached. In the end, I spent around $8,000 and got nothing. He didn’t even try, nor even think to negotiate on my behalf.

I began working with Victoria Collier and Shannon Pawley over a year ago. My father had passed away and I needed assistance with the probate process. Their law firm has been wonderful!
